The property in question is located at 2025 South 3415` Place and is zoned Business Park (BP). The Federal Way City Code (FWCC) Section 22 -1, determines that a Change of Use has occurred when the general character of the operation has been modified. This determination shall include review of, but not be limited to: 1) Hours of operation; 2) Required parking; 3) Traffic generation; 4) General appearance; 5) Type, extent, or amount of indoor or outdoor storage; and 6) Constituents of surface water discharge or runoff. The proposed dog grooming, boarding, and limited retail sales business is permitted in the BP zone as a Limited Retail Use pursuant to FWCC Section 22 -866. The Northwest Treatment center is a legally nonconforming use, established at the property prior to the City's incorporation in February 20, 1990. Given the information available to the City concerning the clinic use, and the information provided to the City concerning the proposed business, it does not appear that any of the thresholds for a "change of use" have been exceeded by the proposed business. Hours of operation, required parking, and traffic generation for the proposed use are similar to other limited retail uses and the operating procedures for the clinic use. You have not proposed any exterior alterations or outdoor activities or storage, and the Public Works Department has determined that constituents of surface water discharge or runoff would not be modified from what is currently generated on the site. As such, in order to operate a dog day care, grooming, and limited retail business at the site, you would be required to obtain a Federal Way Business Registration, but no Land Use approval would be required. Please be advised that if, in the future, you were interested in establishing an outdoor dog run or construction of a new kennel structure, land use approval would be required.
