NOTICE OF ENVIRONMENTAL MITIGATED
DETERMINATION OF NONSIGNIFICANCE (MDNS)
West Hylebos Creek Gravel Removal

The City of Federal Way has determined that the following project does not have a probable significant
adverse impact on the environment, provided the mitigation measures identified in the MDNS are met,
and an Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision
was made after review of a completed environmental checklist and other information on file with the city.

Proposed Action:
Proposed removal of approximately 100 cubic yards of streambed gravel from under and near a bridge on
S 373rd St. in Federal Way that spans West Hylebos Creek. The proposed work would be along an appx.
200 ft. stretch of the streambed. The project is proposed as a result of a bridge inspection report received
in December 2022 from Washington State Department of Transportation. The report requests the City of
Federal Way dredge the West Hylebos Creek underneath the South 373rd Street bridge so that the bridge
can be inspected. Since the last gravel removal operation, a significant amount of gravel has been re-
deposited leaving the clearance underneath the bridge less than 12 inches.
To complete the work, West Hylebos Creek will be diverted via bypass pump as to minimize turbid
water. All construction equipment will work from paved area of S 373rd St and no adjacent
areas/landscape will be disturbed by dredging activity. All dredging will be completed within the same
footprint as past years.

MITIGATION MEASURES (SUMMARY):
1) Comply with all recommendations from the Washington State Department of Fish and Wildlife
(WDFW) included with the required Hydraulic Project Approval (HPA) for this proposed dredging
work.

will not act on this proposal for 14 days from the date of issuance. Comments must be submitted by 5:00

Unless modified by the city, this determination will become final following the above comment deadline.
Any person aggrieved of the city’s final determination may file an appeal. Anyone may appeal this
determination to the Federal Way City Clerk (33325 8th Avenue South, Federal Way, WA 98003), no
later than 5:00 p.m. on August 18, 2023, by a written letter stating the reason for the appeal of the
determination along with the required appeal fee. You should be prepared to make specific factual
objections. All appeals shall contain a specific statement of reasons why the decision of the responsible
official is alleged to be in error.
