AN ORDIN�II�TCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, DECLARING THE INTENT OF THE CITY TO
JOIN AND BE ANNEXED BY KING COUNTY FIRE
PROTECTION DISTRICT NO. 39, REQUESTING THE
CONCURRENCE OF THE DISTRICT BOARD OF FIRE
COMMISSIONERS, AND REQUESTING THE COUNTY COUNCIL
TO CALL A SPECIAL ELECTION IN THE CITY AND THE
DISTRICT FOR FEBRUARY 6, 1990 FOR THE PURPOSE OF
SUBMITTING THE ANNEXATION TO THE VOTERS.

WHEREAS, RCW 35.02.130 authorizes the City Council of
the City of Federal Way to submit ballot proposition� to the
voters of the City in order to authorize annexation of the City
by a fire protection district effective immediately upon the date
of incorporation, and
WHEREAS, pursuant to RCW 52.04.061, the process of
annexation must be initiated by an ordinance of the City stating
the City's intent to join the District and finding that the
public interest will be served thereby, now, therefore,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Declaration of Intent and Findinq. The
City of Federal Way hereby declares its intent to join and be
annexed by King County Fire Protection District No. 39 effective
immediately upon the date of incorporation of the City. Having
weighed the options for providing fire protection service to the
citizens and property within the City, the City Council finds
that the public interest will be best be served by annexation to
the said District.

Section 2 Transmittal to District - Request for
Concurrence. Pursuant to RCW 52.04.061, the City Manager is
hereby directed to forward a certified copy of this Ordinance to
the Board of Fire Commissioners of King County Fire Protection
District No. 39. The City Council requests that the Board of
Fire Commissioners concur in the proposed annexation of the City
by the District.
Section 3. Transmittal to Coun*y Council - Rec�uest for
S�ecial Election. Pursuant to RCW 52.04.061 and .071, if the
Board of Fire Commissioners concurs in the annexation, the City
Manager is hereby directed to notify, and to send a certified
copy of this Ordinance and a copy of the District's concurrence,
to the King County Council. The King County Council is hereby
requested to call a special election to be held in the City of
Federal Way and in King County Fire Protection District No. 39 on
February 6, 1990, which is the next date provided in RCW
29.13.010 and is not less than forty-five (45) days from the date
of this declaration and finding. The King County Council is also
requested to give notice of the election as provided for in RCW
29.27.080. The purpose of the election shall be to submit to the
qualified voters within the City of Federal Way and King County
Fire Protection District No. 39 a ballot proposition in
substantially the following form:

Section 4. Annexation. If a majority of persons
voting on the annexation proposition within the City and a
majority of the persons voting on the proposition within the
District shall vote in favor of annexation, then the City of
Federal Way shall be annexed to and constitute a part of King
County Fire Protection District No. 39 effective immediately upon
the date of incorporation of the City.
Section 5. Effective Date. Pursuant to the authori-
zation for submission of ballot propositions set forth in RCW
35.02.130, this ordinance shall become effective five (5) days
after its passage and publication of the attached summary
consisting of its title, which is hereby approved.
