ORDINANCE NO.
90-45
AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, ADOPTING CERTAIN RULES AND
REGULATIONS OF KING COUNTY TO PERMIT THE
PROCESSING OF APPLICATIONS AND/OR PERMITS
DETERMINED BY THE CITY TO BE VESTED IN
ACCORDANCE WITH APPLICABLE STATE STATUTES AND
JUDICIAL DECISIONS TO THE RULES AND REGULATIONS
ADOPTED HEREBY AND DECLARING A PUBLIC
EMERGENCY.
WHEREAS, In order to provide for the processing of in
excess
of
2,100 permits
and applications which were pending,
approved and/or issued as of the date of incorporation of the
city, and
WHEREAS,
under
applicable
State
laws
and
judicial
decisions,
certain
of
the
above-identified
applications
are
vested
requiring
the
city
to
have
said
permits
and/or
applications reviewed for conformance with certain zoning and/or
land use rules and regulations in effect at the time that such
vesting occurred, and
WHEREAS, in order to minimize the confusion that might
otherwise arise between the administration of County Codes and
newly adopted regulations of the city, to provide for efficient
processing of those permits and/or applications determined by the
City to be vested, and in order to provide for the public peace
and minimize substantial delays that might otherwise occur, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,

DO ORDAIN AS FOLLOWS:
section 1.
For purposes of enabling King county to
process only those permits and land use applications pursuant to
that certain Interlocal Agreement Between the city of Federal Way
and King county dated as of February 28,
1990, the City hereby
adopts
by
reference
only
those
zoning,
land
use
and/or
development regulations to which the applications and/or permits
are determined by the city to be vested,
and are necessary to
complete the processing of" the applications and/or permits.
The
ordinances
and
regulations
of
King
county
adopted
by
this
ordinance for the limited purposes enumerated in this ordinance
and in the Interlocal Agreement, shall have no applicability to
any permits determined by the city not to be vested nor to any
permits accepted by the city of Federal Way after the date of
incorporation.
Nothing contained in this ordinance shall
be
construed
as
extending
or
establishing
vesting
in
any
application
or
permit
covered
by
the
Interlocal
Agreement.
Nothing contained in this ordinance or the Interlocal Agreement
shall be construed as preventing a permit and/or application from
lapsing under applicable rules and regulations.
section
2.
The
City
council
hereby
declares
that
there is a public emergency necessitating that this ordinance go
into effect immediately upon its passage in order to preserve the
public health, safety and public peace.
