ORDINANCE NO. 90-51
AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, AMENDING CERTAIN PORTIONS OF
ORDINANCE NO. 90-43 TO ADOPT NEW DEFINITIONS
RELATING TO BUILDING ELEVATION; AMENDING THE
FEDERAL WAY ZONING CODE TO REFLECT SUCH
CHANGES; AND ESTABLISHING AN EFFECTIVE DATE.
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 3.10.040, Average Buildinq
Elevation, contained in Chapter 3 of Exhibit A, as adopted by
Section 2 of Ordinance No. 90-43, is hereby amended by
establishing a new definition for "average building elevation" as
follows:
3.10.040 Average Building Elevation - A
reference datum on the surface topography of a
subject property from which building height is
measured. The reference datum shall be a point
no higher than five feet above the lowest
elevation taken at any exterior wall of the
structure either prior to any development
activity or at finished grade, whichever is
lower, provided the reference datum is equal to
or lower than the highest elevation at any
exterior wall of the structure prior to
development activity.
Section 2. A new section 3.10.351 entitled Height of
Structure, is hereby added to Chapter 3 of Exhibit A, adopted by
Section 2 of Ordinance No. 90-43, to read as follows:
3.10.351 Height of Structure - The vertical
� distance above the average building elevation
measured to the highest point of the coping of
a flat roof or to the deck line of a mansard
roof, or to the average height of the highest

gable of a pitched or hipped roof.
Section 3. Plate 4, Calculating Average Building
Elevation, contained in Chapter 185 of Exhibit A adopted by
Section 2 of Ordinance No. 90-43 is hereby repealed and deleted
from said Chapter 185.
Section . This ordinance shall be effective five (5)
days after passage and publication of an approved summary
consisting of the title to this ordinance.
