Ord 97-287 ORDINANCE NO. 97-287 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING ITS SOLID WASTE AND RECYCLING UTILITY SCHEDULE OF RATES AND RETAINAGES FOR YARD WASTE RECYCLING SERVICE BY PROVIDING FOR A 16.9% INCREASE IN YARD WASTE RECYCLING RATES AND BY TeE ADDITION OF AN AUTOMATIC PASS THROUGH OF FUTURE YARD WASTE RECYCLING FEE INCREASES ASSESSED BY YARD WASTE RECYCLING FACILITIES FOR USE OF SUCH FACILITIES (AMENDS ORDINANCES 93-167 AND 94-218). WHEREAS, the City has previously entered into a franchise agreement with Federal Way Disposal; and WHEREAS, Federal Way Disposal collects yard waste from the residents and businesses in Federal Way and recycles it at a yard waste recycling facility; and WHEREAS, on August 2, 1994, the City Council of the City of Federal Way adopted Ordinance 94-218 which established a Schedule of Rates and Retainages for Service provided as part of the City's solid waste and recycling utility, including yard waste collection; and WHEREAS, Federal Way Disposal's yard waste recycling vendor has enacted several rate increases since 1994 which Federal Way Disposal has absorbed; and WHEREAS, on January 23, 1997, the city Council Finance and Economic Development Committee decided that the city should increase its rates for yard waste collection to more accurately reflect rates currently being charged and that the City pass through the costs of future yard waste recycling Ord. 197-287 , p. 1 (Ç;(Ö)~11, facility tipping fee increases enacted by the most economical yard waste disposal vendor; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: section 1. Findings. The City Council finds that an increase by 16.9% in the yard waste collection fees currently charged will accurately reflect the rates being charged by Federal Way Disposal's vendor for yard waste recycling facility use. The City Council further finds the need to add an automatic pass through of future yard waste recycling fee increases assessed by Federal Way Disposal's vendor, which vendor will be the most economical yard waste recycling facility. section 2. Amendment. The rates for services set forth in Exhibit A to Ordinance 94-218 titled "Rates and Retainages for Service" is amended to provide for a 16.9% increase in yard waste fees and a pass through of future rate increases for yard waste collection in Section B entitled .yard waste collections' thereof, which amended Exhibit A is attached hereto and incorporated by this reference. section 3. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. section 4. severability. The provisions of this ordinance are declared separate and severable, invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance or the invalidity of the application Ord. # 97-287 , p. 2 thereof to any person or circumstances shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances. Section 5. Effective Date. This ordinance shall take effect and be in force thirty (30) days from the time of its final passage, as provided by law. Rates for Commercial and Multi-Family Solid Waste and Recycling 1. Multi-family Solid Waste and Recycling Collection (Can Service) a. Solid Waste Only Existing complexes with curbside can service will be charged for each 32 gallon can collected. Each unit shall receiye curbside service. The entire complex must subscribe at a rate of $ 8.12 per can per month. Of the rates collected, $ 7.76 is retained by the Franchisee and $ 0.36 is retained by the City. Page Three b. Solid Waste and Recyclables Existing complexes with curbside can service will be charged for solid waste and recycling pickup at each unit.
