BUSINESS ITEMS
AMENDMENT TO ORDINANCE NO. 91-84
Staff reported that the Parks and Recreation Conunissionhave thoroughly reviewed the Kikaha 0 Ke Kai Canoe Club's request
to hold trials and competitions at Steel Lake, which included public meetings and a canoe demonstration at the lake. At their
August 5 meeting, the commission moved to recommend to Council that Ordinance No. 91-82 be amended to approve the
Canoe Club's use of Steel Lake for trials and competitions. Staff have worked with the Legal Department to draft an
amendment to the ordinance and a policy to review requests for use of park facilities for trials/competitions on a case-by-case
basis. Ordinance 91-82, Section I, No. 29 Trîfils and Competitions is proposed to read as follows: "It is unlawful to engage
in, conduct or hold any trials or competitions for speed endurance, or hill climbing involving any vehicle, boat, aircraft or
animal in any park except pursuant to a permit issued by the Director. LINDA KOCHMAR MOVED, JEANNE BURBIDGE
SECONDED A MOTION TO RECOMMEND TO CITY COUNCIL APPROVAL OF THE AMENDMENT TO
ORDINANCE NO. 91-82, SECTION 1, NO. 29 TRIALS AND COMPETITIONS AS PRESENTED, AND
RECOMMEND TO CITY COUNCIL APPROVAL THAT THE SPECIAL EVENTS USE PERMIT AS AMENDED
BY THE PARKS AND RECREATION COMMISSION BE USED TO REVIEW REQUESTS FOR TRIALS AND
COMPETITIONS AS DESCRIBED IN ORDINANCE NO. 91-82. MOTION PASSED.
SKATE PARK
Staff reported that the pre-application process through the Community Development Department is complete. One of the
outcomes from the review based on the project value of $250,000 may be the code requirements to improve the entire Steel
Lake Park site to current development standards for streets, storm water and parking. Given this information, staff contracted
for appraisal of Steel Lake Park to establish the entire park improvement value including the beach house. Staff began to
review other park sites as possible alternatives in the event the appraisal caused the design to be reconfigured. Alternative sites
included the area north of the restroom concession building at Celebration Park and the entrance to the BP A Trail Phase I at
the intersection of324'" and 11 "'. Mr. Wilbrecht reported that the appraisal of Steel Lake Park has been received. The appraised
value is $1,720,000, which IT!eans that the City could build an element to the park valued up to $430,000 without triggering
the improvements required by City code. Steel Lake Park is the preferred site for Skate Park. Approximate cost to build a skate
park is $250,000. JACK DOVEY MOVED, JEANNE BURBIDGE SECONDED A MOTION TO SPEND UP TO
$250,000 TO BUILD SKATE PARK AND INSTRUCT STAFF TO MOVE FORWARD WITH THE PROJECT.

TWIN LAKES HOMEOWNERS POLICE CONTRACT
Ms. Kochmar voiced some concerns regarding the Twin Lakes Homeowners security contract with the Public Safety
Department that was presented at the September 13 meeting. Ms. Richardson stated that the Law Department is working on
a legal opinion, which the Council will receive on Friday, October 1. Mr. Dovey noted that the Councif:i::an discuss this item
at their October 5 meeting and either come to a decision or send it back to the committee for further review.

February 1998, the City of Federal Way Public Works Department contracted with the engineering
firm ofParametrix, Inc., to develop the trail alignment and construction documents for the BP A Trail
Corridor Phase III.
Open House/Public Comments:
On May 27, 1998, and June 16, 1998, the City hosted two public meeting regarding the design
proposals for the BP A Trail Phase ill. The city's consultant presented three trail alignments and
answered questions from th~ community. The community survey accepted trail alignment 'A'
On September 14, 1998, the City Gouncil's Park, Recreation, Human Services and Public Safety
Committee approved the trail alignment 'A' and recommended staff to proceed with the trail
alignment 'A' design development phase. This was also approved by City Council on October 6,
1998.
October 4, 1999, Parametrix Engin~ering completed 95% of the design development for the BPA
Phase III Trail Corridor. The engineer's cost estimate for construction is $728,064. The Public
Works Department has recently received a Federal Enhancement Grant "TEA-21" for $629,775;
the estimated City match for construction is $150,000.
Staff will be present at the October 11 meeting to present the final design and answer questions.
Right-of-way acquisition will begin in November 1999 and construction is anticipated to begin to
begin in July 1999.
Staff Recommendation:
Staff recommends the following:
1. Accept the 1999 Federal Enhancement Grant "TEA-21" for $629,775.
2. Approve the BP A Phase HI Trail final design of 95% and proceed with construction
documents and public bid.
Recommend tbat Council consider funding the match requirement in the mid-biennium
budget adjustment.

Judicial Infonnation System (HS) Interlocal Agreement

The Judicial Information System (nS) is a statewide computer system that tracks cases in municipal
and other courts. The system is managed by the state's Office of the Administrator for the Courts
(OAC), which nonnally purchases, maintains, and replaces all hardware and software necessary for
the system.
Because the State Legislature did not anticipate the formation ofthe Federal Way Municipal Court,
OAC does not have the necessary funding in its budget to bring Federal Way on line. Therefore, staff
have worked out an agreement with OAC whereby the City will contribute the funds necessary to
purchase the equipment, and OAC will purchase the equipment, maintain it, and add it to its normal
replacement schedule. This approach has been used in other start-up municipal courts.
The estimated $27,600 expenditure is anticipated in the Municipal Court's start-up budget.
Committee Recommendation:
Authorize the City Manager to execute the attached interIocal agreement with the State for the
purchase of equipment necessary td operate the TIS system.

THIS AGREEMENT is made and entJred into by and between the Office of the Administrator for the
Courts, hereinafter referred to as "OAC", and City of Federal Way, Washington, hereinafter referred to as
the "CI1Y", for and on behalf of the Fedrral Way Municipal Court, hereinafter referred to as the "COURT',
pursuant to the authority granted by Ch,pter 39.34 RCW, Interlocal Cooperation Act.
1.
PURPOSE: The OAC, the courts of the state of Washington, and the Washington counties and cities
share a vital interest in the Judicial Information System (JIS). This Agreement will assist the COURT
and CITY in obtaining equipment r)ecessary to access the JlS which will increase the effectiveness
of the JIS. .

The OAG will purchase 10 personal computers. 2 report printers with print servers, and 2
receipt printers with print servers. Equipment will meet OAG's specifications.
The CITY will reimburse I OAC for the actual purchase costs, including tax and
shippinglhandling charges, or the JIS equipment.
The COURT will use the equipment primarily for JIS purposes.

3. . TERM OF AGREEMENT: This Agreement shall be in effect through June 30, 2000 unless sooner
terminated pursuant to Section 7 of this Agreement.

4. MANNER OF FINANCING: OAC shall purchase the equipment and shall invoice the CITY for the
actual cost of the e~uipment. Based upon past experience, OAG estimates the actual cost, which
includes tax and shippinglhandling¡charges. to be $27,600. Payment to OAG shall be made within
30 days after the receipt of an invoice.

5.
ADMINISTRATION: The following individuals are designated as representatives of the respective
parties. The representatives shall be responsible for administration of this Agreement and for
coordinating and monitoring performance under this Agreement In the event such representatives
are changed, the party making the change shall notify the other party. --
5.1 The CITY's representative shall be Derek N)atheson.
5.2 The COURTS representative shall be Sandra Warter.
5.3 The OAC's representative shall be Patty Frost

TREATMENT OF ASSETS AND PROPERTY: OAC shall be the owner of any and all fixed assets
or personal property jointly or cooperatively, acquired, held, used, or disposed of pursuant to this
Agreement. .
7.
TERMINATION: Either party may terminate this Agreement upon thirty (30) days written notice to the
other party. In the event of termination of this Agreement, the CITY shall be liable only for payment
for equipment ordered by OAG prior to the effective date oftermination.
8.
CHANGES, MODIFICATIONS. AMENDMENTS AND WAIVERS: This Agreement may be
changed, modified, amended or waived only by written agreement executed by the parties hereto.
Waiver of any breach of any term or condition of this Agreement shall not be considered a waiver of
any prior or subsequent breach.

SEVERABILITY: If any prqvision of this Agreement, or any provision of any document incorporated
by reference shall be held invalid, such invalidity shall not affect the other provisions of this
Agreement which can be given effect without the invalid provision and to this end the provisions of
this Agreement are declared to be severable. '.
10. ENTIRE AGREEMENT: This Agreement contains all the terms and conditions agreed upon by the
parties. All items incorporated herein by reference are attached, with the exception of the OAC
equipment specifications. No other understandings, oral orothelWise, regarding the subject matter
of this Agreement shall be deemed to exist or to bind any of the parties hereto.
11. EXECUTION: We, the undersigned, agree to the terms of the foregoing Agreement.

Dear Ms. Jenkins:
Thank you for your September 7, 1999, letter inquiring whether the City Council
received your previous letter (July 6, 1999) regarding Fishers Pond Park
gardens, In your July letter, you asked whether efforts to weed and water the
gardens that surround the old "Fishers" home at the park are in vain. You also
asked whether the City feels that this park would benefit the community.
The City's vision for a comprehensive park system is for a balance of both
passive and active parks. The Fishers Pond Park was purchased by the City of
Federal Way in 1994 with Conservation Futures funding. These funds are to be
used to acquire natural areas for open space parks. As you stated very well in
your letter, the experience a person engages in activities like gardening or
walking along the water edge are truly positive experiences that contribute to our
well being. The benefits from our city's green spaces, whether they be athletic
fields or open space parks lilke Fishers Pond and the West Hylebos, are
important elements to preserving the quality of life for Federal Way citizens for
today and years to come.
Your willingness and that of others who volunteer their time to preserve the
. many unique and colorful rhododendron beds that were planted by the Fishers is
greatly appreciated. Our City has 818 acres of parkland; this total includes 360
acres of. open space. Over 1000 citizens volunteer to improve the quality of our
parks each year. The ongoing volunteer involvement significantly effects the
city's cost efficiency of maintaining our parks.
The Fishers Pond Park is included in the Parks Capital Facilities plan. The plan
for this park is to preserve the natural plant species (including the gardens) and
develop trails to provide walking and viewing of the lake experiences. In
addition the plan supports upgrading the existing house for an interpr~tive
facility. As you .kflOW the Federal Way Historical Society. has taken steps to

improve the building for this very purpose. Annually the City Council revi~ws all
Capital Facility plans including parks for funding. The Parks' Capital Facility Plan
current recommends capital improvements in 2001/2002.
Through community partnerships, I am confident that Fishers Pond Park will
continue to evolve as a cherished openspace that offers a valued respite and
quality to our lives. Thank you for your interest and commitment to car-e-for this
valuable resource to our co~munity.
