2009-12-18 HEX Rules of ProcedureHearing Examiner Procedures Revised 1211812009 The City Clerk is the liaison between City Staff and the Hearing Examiners office. Process IV Review — Land Use Appeals Chapter 22 Article 7 Community Development will work with the City Clerks office to schedule hearing date with HEX. Community Development is responsible for preparing and distributing the notice of application. Day of Hearing: Assist HEX staff with audio equipment and provide sign up sheet. After Hearing: CDS staff will email the City Clerk with the following information: • Length of Hearing • Outcome of Hearing (continued to specific date, record left open, decision due date) • Any other pertinent information Decision is due to the Clerks office 10 business days from the date of the hearing. The HEX will email an electronic copy, and mails a hard copy. The Clerks office will forward the electronic decision to: Planner, Senior Planner, CDS Director Appeal of Hearing Examiners Decision: Applicant has 14 calendar days to appeal the HEX decision. Appeals of HEX Land Use decision go before the City Council \\cfwfilel\department\CK\City Clerk Files\Hearing Examiner\Rules of Procedure\2009 Hearing Examiner Procedures.doc FWRC 1.15.060 Appeal of Violation to HEX (Clerks office responsible for everything. ) A request to appeal must be submitted to the Clerks office within 14 calendar days of receiving the violation, along with appeal fee mandated in City's fee schedule. The City Clerk will schedule a hearing date with the Hearing Examiners office within 10 calendar days of receiving appeal request. The hearing date must be within 30 calendar days of Clerk receiving appeal request. The Clerk will prepare a Notice of Hearing that includes information identified in sec. 1-19.d.2.a. (See attached). Notice must be mailed to appellant, and property owners within 300 feet of the property in violation, and posted at property in violation (CD staff will post notice for Clerk), The notice shall be mailed and posted at least 10 calendar days before the hearing_ Day of Hearing Assist HEX staff with audio equipment and provide sign up sheet.
