Description: The City of Federal Way is undertaking a periodic review of its Shoreline Master Program (SMP), as required by the
Washington State Shoreline Management Act (SMA) (RCW 90.58), which requires local jurisdictions to review such regulations
every eight years. The city adopted its current SMP in 2011. Federal Way's SMP guides construction and development along the
shorelines of Puget Sound, Steel Lake, North Lake, and the northwestern portion of Lake Killarney. The city has predesignated
shorelines along Star Lake, Five Mile Lake, Lake Geneva, Lake Dolloff, and the remaining portion of Lake Killarney.
The focus of this periodic review is on consistency with changes to state law made since its adoption in 2011. The review also
will address consistency with the city's comprehensive plan and development regulations. The goal is to adopt the updated SMP
by June 30, 2019. The city's periodic review proposes to:
• Revise or add several definitions.
• Incorporate an updated Environmentally Critical Areas Ordinance, repealing the reference to FWRC 15.10 and
referencing FWRC 19.145.
• Update language consistent with recent changes in state laws and rules.
• Add a section on shoreline setback vegetation conservation standards.
• Ensure consistency with other city plans and regulations.

The city's Responsible Official has determined that the proposal does not have a probable significant adverse impact on the
environment, and an Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was
made after review of a completed environmental checklist and other information on file with the city.
A completed environmental checklist and supporting documents are posted to the city's SMP update website at
hi!Rs-://www.c.ilyoffederalway.com/node/3819 and are available for review at the City of Federal Way Community
Development Department (Federal Way City Hall, 33325 8f Avenue South, Federal Way, WA 98003, 253-835-7000), from
8 a.m. to 5 p.m., Monday through Friday.
This DNS is issued under WAC 197-11-340(2). The lead agency will not act on this proposal for 30 days from the date of
issuance. Comments must be submitted by 5:00 p.m. on May 13, 2019. Unless modified by the city, this determination will
become final following the comment deadline. Any person aggrieved by the city's determination may file an appeal with the
city within 21 days of the above comment deadline. You may appeal this determination to the Federal Way City Clerk
(address above), no later than 5:00 p.m. on June 3, 2019, by a written letter stating the reason for the appeal of the
determination. You should be prepared to make specific factual objections.

SEPA ENVIRONMENTAL CHECKLIST
Purpose of Checklist
Governmental agencies use this checklist to help determine whether the environmental impacts of your
proposal are significant. This information is also helpful to determine if available avoidance, minimization
or compensatory mitigation measures will address the probable significant impacts or if an environmental
impact statement will be prepared to further analyze the proposal.
Instructions for Applicants
This environmental checklist asks you to describe some basic information about your proposal. Please
answer each question accurately and carefully, to the best of your knowledge. You may need to consult with
an agency specialist or private consultant for some questions. You may use "not applicable " or "does not
apply" only when you can explain why it does not apply and not when the answer is unknown. You may also
attach or incorporate by reference additional studies reports. Complete and accurate answers to these
questions often avoid delays with the SEPA process as well as later in the decision -making process.
The checklist questions apply to all parts ofyour proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.
Instructions for Lead Agencies
Please adjust the format of this template as needed. Additional information may be necessary to evaluate the
existing environment, all interrelated aspects of the proposal and an analysis of adverse impacts. The
checklist is considered the first but not necessarily the only source of information needed to make an
adequate threshold determination. Once a threshold determination is made, the lead agency is responsible

The City of Federal Way and the Washington State Department of Ecology must approve the changes to the
SMP prior to adoption of this proposal.
11. Give brief, complete description of your proposal, including the proposed uses and the size of the
project and site. There are several questions later in this checklist that ask you to describe certain
aspects of your proposal. You do not need to repeat those answers on this page. (Lead agencies may
modify this form to include additional specific information on project description.)
This is a non -project action and contains proposed policies and regulations that are applied citywide within
the identified shoreline jurisdiction of the City of Federal Way. The project area is the shoreline jurisdiction
within city limits and in the city's Potential Annexation Area (Exhibits A, B, and Q.
Regulatory changes include:
• Updating the SMP to ensure consistency with changes in policy and regulation affecting shoreline
management made by the state legislature since 2011 when the SMP was last updated. These changes
are outlined in the Washington State Department of Ecology SMP Periodic Update checklist.
• Updating the SMP to ensure consistency with regulations adopted by the City of Federal Way that
affect environmentally sensitive areas and flood hazard areas.
• Adding vegetation conservation standards within the SMP to provide clarity for applicants.
• Changing bulkhead standards to be the minimum necessary to afford relief from the existing
requirement to be a maximum height of one foot above the elevation of mean higher high water on
tidal waters.
This includes the waters and all land within 200 feet landward of the ordinary high-water mark (OHWM) of
the Puget Sound, Steel Lake, North Lake, and the northwest portion of Lake Killarney within city limits, as
well as Star Lake, Lake Dolloff, Lake Geneva, Five Mile Lake, and the remaining portion of Lake Killarney
within the city's Potential Annexation Area and associated wetlands of all of the waterbody's listed above.

12. Location of the proposal. Give sufficient information for a person to understand the precise
location of your proposed project, including a street address, if any, and section, township, and
range, if known. If a proposal would occur over a range of area, provide the range or
boundaries of the site(s). Provide a legal description, site plan, vicinity map, and topographic
map, if reasonably available. While you should submit any plans required by the agency, you
are not required to duplicate maps or detailed plans submitted with any permit applications
related to this checklist.

B. ENVIRONMENTAL ELEMENTS
1. Earth

b. What is the steepest slope on the site (approximate percent slope)?
There is a variety of terrain located within the SMP jurisdiction, but the steepest slope is estimated in excess
of 40 percent along portions of the Puget Sound shoreline.
c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you
know the classification of agricultural soils, specify them and note any agricultural land of long-term
commercial significance and whether the proposal results in removing any of these soils.
Soils within the SMP jurisdiction vary, but mostly include sand and gravel, clay, and peat and muck in
associated wetlands.
d. Are there surface indications or history of unstable soils in the immediate vicinity? If so, describe.
Based on the city's Critical Areas Map, there are landslide and erosion hazard areas within the shoreline
jurisdiction (Exhibit E).
e. Describe the purpose, type, total area, and approximate quantities and total affected area of any
filling, excavation, and grading proposed. Indicate source of fill.

required by the SEPA Rules, and will be evaluated in accordance with all plans, policies, rules, and
regulations adopted as a basis for the exercise of substantive authority under SEPA to approve, condition, or
deny proposed actions. In addition, when future projects are submitted, any erosion -related impacts created
during clearing and construction activities will be mitigated in compliance with the 2009 King County
Surface Water Manual (KCSWM), as amended by the city. This requires any erosion -related impacts created
during clearing and construction activities to be addressed according to a Temporary Erosion Sedimentation
Control Plan (TESL), which is a standard part of engineering review and approval.

Proposed changes to the SMP will not increase discharges, emissions, or release of toxic or hazardous
substances, or the production of noise. The changes improve the degree of consistency and coordination
of the current policies and regulations with state SMP policies and rules, as well as local regulations, such
as the adoption of revisions to Federal Way's Environmentally Sensitive Areas and Flood Damage
Prevention. It is expected that these changes will improve the administration of policies and regulations
within the Shoreline, and by doing so, enhance environmental protection from potentially harmful
discharges, emissions, and releases.

The existing SMP includes restrictions on uses, activities, and development within SMP jurisdiction that
prevent the discharge of water or release of toxic or hazardous substances into the water. The standard
requires no net loss of environmental functions within the shoreline.
2. How would the proposal be likely to affect plants, animals, fish, or marine life?
Proposed changes will not negatively affect plants, animals, fish, or marine life. By increasing the degree of
consistency of the SMP and improving its usability, it should improve the administration of policies and
regulations within SMP jurisdiction, and by doing so it may improve conditions for plants, animals, and fish.
Proposed measures to protect or conserve plants, animals, fish, or marine life are:
The existing SMP establishes a standard of no net loss of environmental functions within the shoreline. This
is intended to preserve and protect existing habitat for existing plants, animals, and fish through the policies
and regulations in the SMP. Provisions of the SMP also encourage the restoration and enhancement of
ecological functions that should positively affect habitat for native plants, animals, and fish.
3. How would the proposal be likely to deplete energy or natural resources?
This proposal has no effect on energy depletion. Proposed changes will not deplete natural resources. By
increasing the degree of consistency of the SMP and improving its usability, it should improve the
administration of policies and regulations within SMP jurisdiction, and by doing so it may restore natural
resources within the shoreline area.
Proposed measures to protect or conserve energy and natural resources are:
The proposed regulations are measures aimed at protecting natural resources along city shorelines as shown in
Exhibits A-D. The proposal will have no effect on energy conservation, but is strongly linked to protecting
remaining intact natural resources along the shoreline not already impacted by development.
