Moved: McColgan Seconded: Dovey Passed: Unanimously 3. PUBLIC COMMENT None 4. BUSINESS ITEMS A. 2007 Asphalt Overlay Proiect List John Mulkey provided the background information on this item. Council Member McColgan commented that the city, and thereby the citizens of the city, receive numerous benefits because of this program. He suggested that the staff prepare a report for the city's web site, or a video for the city's TV channel why the city has an overIayprogram and the benefits(such as money saved) ofthe program. Mr. Roe replied that staff would be able to produce such a report or video and he suggested the report explain the consequences of not having an overlay program. The staff could have this prepared by late 2006 or early 2007. Chairman Dovey suggested the report include a list of what streets have been done over the last 14 years of the program and what is planned for in the next few years. Mr. Roe replied that the staff does have a list of the last 11 years and what is planned for the next two, possibly three years. Council Member Burbidge spoke in support of this report and requested a ballpark figure for the overlay ofa residential street. Mr. Mulkey will provide her with this information. South 336th Street at 1 sl Way South Intersection Improvements Proiect - Proiect Acceptance and Retainage Release John Mulkey provided the background information on this item. He noted that this project was completed under budget. Flood Damage Prevention Ordinance Paul Bucich provided the background information on this item. This ordinance will replace the 1996 resolution (06-229). The Department of Ecology informed the city in the spring of 2006 that adoption of a resolution does not meet the minimum standards for participation in the National Flood Insurance Program (NFIP). The NFlP also deals with landslides, which is the major concern of these properties. Council Member Kochmar asked if the city notifies residents if they are in a landslide hazard area. Mr. Bucich replied that the city does not, but does have the information and could inform citizens. Council Member Kochmar suggested staff prepare an informational article for the city newsletter about landslide hazard and let citizens know they can contact the city to find out if their property is in a landslide hazard area. She also suggested the article contain information that flood insurance must be purchased separately from home insurance. Mr. Bucich replied the staff will do as requested. RTID-ST2 Cary Roe and Doug Levy provided the background information on this item. Mr. Roe commented that staff is seeking direction regarding whether to prepare a letter to Sound Transit and the Regional Transportation Investment District (RTID) from the City Council what projects and sales tax funding level the city would support. The possible funding levels are: · A 0.3% sales tax, which would extend light rail south to the Kent-Des Moines Road and thus, fall short of the City Council goal of serving Federal Way. · A 0.4% sales tax, which would extend light rail south to the Federal Way Transit Center and thus, will meet the minimum goal of serving Federal Way. · A 0.5% sales tax, which would extend light rail south to the Port of Tacoma and thus, most closely attain the goal of connecting Federal Way to Seattle and Tacoma. Mr. Levy commented that this is a critical time and the city needs to let its preference known. Council Member Kochmar commented that the Federal Way Mayor's letter states that the city wants the light rail to be along 1-5. She has heard that the Federal Way Chamber wants the light rail to run along 1-5 and Pacific Highway South (99). Is this correct? Mr. Roe and Mr. Levy commented that it is correct and they would clarify what the city and chamber want in the proposed letter. Council Member McColgan asked why the light rail stops at the Port of Tacoma if there is no transit center there. Mr. Perez replied that there is not enough money to go further and this light rail is incompatible with Tacoma's light rail. Council Member McColgan asked if the currently funded amount of$50 million for the triangle project was enough, or will it now cost more. Mr. Roe stated that with the increasing costs, the current cost range for the triangle project is $194 to $324 million. He said the proposed letter would ask for $120 million for the triangle project and would comment that this project would relive congestion of the 51b most congested interchange in the state. Council Member McColgan asked if there will be a list of projects. Mr. Levy stated that Sound Transit and RTID have a time line of December 2006 for a list. The Committee supports the 0.5% sales tax and requested $120 million for the triangle project. The new fees, if approved, will be effective January 1,2007, are $3,018 per single-family unit and $856 per multi-family dwelling unit. This is a $375 or 11 % decrease from the $3,393 single-family rate, and $39 or 4% decrease from the $&95 multi-family rate. A number of variables go into the school impact fee calculation. Among them are the District's facility needs, construction costs required for schools, and the student generating factor (average students per household in elementary, middle, and high schools respectively) in new single and multi-family developments. The calculated amounts are then reduced by any state matching funds and voter approved property taxes for construction. Finally, a 50% factor is applied to eliminate imperfections in the fee calculation model. I In response to the requirements of the State of Washington Growth Management Act (SHB 2929 (1990) and ESHB 1025 (1991)), and under the School Impact Fee Ordinances of King County Code 2lA, City of Federal Way Ordinance No. 95-249 effective December 21, 1995 as amended, City of Kent Ordinance No. 3260 effective March 1996, and the City of Auburn Ordinance No. 5078 effective 1998, Federal Way Public Schools has updated its 2006 Capital Facilities Plan as of May 2006. II \ \ 1 j Ii 1.1 This Plan is scheduled for adoption by King County, the City of Kent, City of Federal Way and the City of Auburn and is incorporated in the Comprehensive Plans of each jurisdiction by reference. This plan is also included in the Facilities Plan element of the Comprehensive Plans of each jurisdiction. To date, the City of Des Moines has not adopted a school impact fee ordinance. ( , I ! I \ ! I The Growth Management Act requires the County to designate Urban Growth areas within which urban growth can be encouraged. The Growth Management Planning Council adopted and recommended to the King County Coun.cil four Urban. Growth Area Line Maps with designations for urban centers. A designation was made within the Federal Way planning area, which encompasses Federal Way Public Schools boundaries. King County will encourage and actively support the development of Urban Centers to meet the region's need for housing, jobs, services, culture and recreation. This Plan's estimated population growth is prepared with this underlying assumption. LI rr p d u This Capital Facilities Plan will be used as documentation for any jurisdiction, which requires its use to meet the needs of the Growth Management Act. This plan is not intended to be the sole planning tool for all of the District needs. The District may prepare interim plans consistent with Board policies. As the projects from the 1999 bond were finalized, the District presented a 20-year plan for the renovation and construction of Federal Way Schools and support buildings. Phase 1, a'$245 million bond was presented to the voters in February 2006. This received a 54% yes vote, unfortunately not enough to pass. The School Board is studying options for placing the bond proposal on the September or November of 2006 ballots. If approved, the bond would replace four elementary schools, Lakeland, Panther Lake, Sunnycrest and Valhalla and one middle school Lakota. Federal Way High School would be replaced and capacity increased by approximately 800 students. Federal Way High School was built in 1938. It has been added onto at least 10 times and currently has an almQst maze-like layout. The cost to rebuild is $81 million. The reconstruction would increase the capacity of the high school by 800 students, or by about 33%. Part of this cost is included in the Capital Facilities Plan impact fee calculation. The non-instructional projects included in the 20- year plan will consolidate support services operations at a single location. The current T~ansportation and Maintenance facility cannot continue to meet the District needs in the future. Nutrition services and other administrative functions will also relocate to this centralized location. Because of continued construction inflation, estimated construction costs will be re- calculated prior to the next bond election. II f! l. I II d ! ! J I r u iii FEDERAL WAY PUBLIC SCHOOLS 2007 CAPITAL FACILITIES PLAN f... I, I l j The proposed bond package includes shared instructional and community facilities. The current stadium would be moved to align with the City of Federal Way Celebration Park sports fields and future Community Center. A performance auditorium is planned for a comer of the Federal Way High School campus. This is a facility that would serve the District schools as well as the community. An environmental instrUction and retreat center is proposed for property adjoining Sequoyah Middle School. fI In September 2006, the District will open a pilot program at TIIahee middle school to allow 5th grade students to attend. This first program will have fifty 5th grade students receiving instruction on the Illahee Middle School campus. As smaller class sizes roll forward into the secondary levels, we anticipate a slight decline at middle school between 2007 and 2010. Sequoyah Middle School opened in September 2005. With the opening of Sequoyah Middle School the average enrollment at all middle schools is between .650 and 800 students. Ii L i 1J [I Another iriitiative that impacts capacity at the secondary schools is the Puget Soul)d Early College. Highline Community College is offering this program to 11th and 12th grade students at the Federal Way campus. The program allows promising 11th and 12th grade students the opportunity to complete their high school diploma and the Associate of Arts college degree in their final two years of high school [1 r! [.1 U U U The District is also considering offering one to four schools with a Kindergarten through 8th grade instructional configuration. These schools could be offered at existing sites, with appropriate facility changes. Other options for opening these schools are new construction or purchase and remodel of existing buildings. The district has a cooperative agreement with Head Start for facility use to serve income eligible Pre-Kindergarten students. A new Headstartfacility on the Harry Truman High School campus opened in January 2005. This facility centralizes Headstart services in the Federal Way community. Headstart was housed at three of the elementary schools in the Federal Way District. Currently the only decentralized program is in a portable facility at Sherwood Forest Elementary. tJ The District is facing unique challenges with declining enrollment at some levels and anticipated reductions in State funding for education. Elementary populations have declined the past two years and projections show moderate growth at this level. Because of declining enrollment and continuing budget challenges, the concept of closing an elementary school in the near future has resurfaced. A committee will be meeting during the 2006/07 school year to study elementary populations and boundaries. A recommendation from this committee could include consolidating elementary populations in to fewer facilities. Many filters considering educational requirements and fiscal responsibility will be used to develop a recommendation to the Board. f \ \. $ L\ I ':.. Ii Federal Way Public Schools (the District) has twenty-three elementary schools (grades K-5), seven middle school schools (grades 6-8), five senior high schools (grades 09-12) and one school serving students in grades 6 -10 for the 2005/06 school year. The Internet Academy serves grades K-12. In January 2005 the Board of Education adopted new secondary boundaries beginning with 2005/06 school year. The following maps show the service area boundaries for each school, by school type. (Harry S. Truman High School, Merit School, Internet Academy and Federal Way Public Academy serve students from throughout the District). The identified boundaries are reviewed annually. Any change in grade configuration or adoption of programs that affect school populations may necessitate a change in school service areas. rt U rt t i n [1 {..l , J The Growth Management Act requires that a jurisdiction evaluate if the public facility infrastructure is in place to handle new housing developments. In the case of most public facilities, new development has its major impact on the facilities immediately adjacent to that development. School Districts are different. If the District does not have permanent facilities available, interim measures must be taken until new facilities can be built or until boundaries can be adjusted to match the population changes to the surrounding facilities. n [1 [} [.1 U n 1'1' ..1 '.J... b Adjusting boundaries requires careful consideration by the District and is not taken liglltly. It is recognized that there isa potential impact on students who are required to change schools. Boundary adjustments impact the whole district, not just one school. It is important to realize that a single housing development does not require the construction of a complete school facility. This Capital Facilities Plan establishes the District's "standard of service" in order to ascertain the District's current and future capacity. The Superintendent of Public Instruction establishes square footage guidelines for capacity, but these guidelines do not take into consideration the education program needs. The District has identified a Building Program Capacity for each of the schools in the District. This Full Time Equivalent (FfE) capacity is based on: fJ [} 11 LI U fJ fl. fJ [J n . The number of classrooms available in each school Any special requirements at each school . In general, the District's current target class size provides that the average class size for a standard classoom for grades K through 2 should be 20' students. For grades 3-5 the target is 25 students. In sixth and seventh grade the students are scheduled with block instruction and see only two teachers for core curriculum. Teachers at this level see 60 students per day. At eighth grade, the teachers will see 90 students per day. For grades 9-12 the target class size is 26 students. In the 2005/06 school year, all of the 23 elementary schools offer at least one all day Kindergarten. This program does have capacity impacts, as the classroom is only available for one session of Kindergarten for the full day. It is not an efficient use of District resources to build a school with a capacity for 500 students due to lack of space for 25 students when enrollment fluctuates throughout the year and from year to year. n I ..1. l. LI Portables are used as temporary facilities or interim measures to house students until permanent facilities can be built or boundary adjustments can be made. When permanent facilities become available, the portable(s) is either used for other purposes such as storage or child care programs, or moved to another school for an interim classroom. Some portables may not be fit to move due to age or physical condition. In these cases, the District may choose to buy new portables and surplus these unfit portables. Enrollment projections influence many of the financial estimates that go into budget preparation. The majority of staffing requirements are derived directly from the forecasted number of students. Allocations for instructional supplies and materials are also made on the basis of projected enrollment. Other expenditures and certain revenue projections are directly related to enrollment projections. Enrollment projections are completed annually in the Business Services Department. Projecti~ns must be detailed at various levels, district total, school-building totals, grade level and program level to include vocational and special education students. The basis of projections has been cohort survival analysis. Cohort survival is the analysis of a group that has a common statistical value (grade level) as it progresses through time. In a stable population the cohort would be 1.00 for all grades. This analysis uses historical information to develop averages and project the averages forward. This method does not trace individual students; it is concerned with aggregate numbers in each grade level. The district has used this method with varying years of history and weighted factors to study several projections. Because transfers in and out of the school system are common, student migration is factored into the analysis as it increases or decreases survival rates. Entry grades (kindergarten) are a unique problem in cohort analysis. The district collects information on birth rates within the district's census tracts, and treats these statistics as a cohort for kindergarten enrollment in the appropriate years. The Federal Way School District is using various statistical methods for projecting student enrollments. The resultant forecasted enrollments are evaluated below. The first method is a statistical cohort analysis that produces ten distinct forecasts. These are forecast of enrollment for one year. The projections vary depending on the number of years of historical information and how they are weighted. u u A second method is a projection using an enrollment projection software package that allows the user to project independently at school or grade level and to aggregate these projections for the district level. The Enrollment Master™ software provides statistical methods including trend line, standard grade progression (cohort) and combinations of these methods. This software produces a five-year projection of school enrollment. fJ 1.;.' . s" f .1 In November of 2001, the District contracted a demographer to develop projections for the Federal Way School District. The report was complete in January 2002. This forecast was provided as a range of three projections. The long-range forecast provided with this. report used a model with cohort survival rates and growth rates based on projected changes in the 5-19 age group for King County. Most of the methods used for long range enrollment reporting assume that enrollment is a constant percent of something else (e.g. population) or that enrollment will mirror some projected trend for the school-age population over time. The. report included 5 different calculations to provide a range of possible projections for the District to the year 2015. This model produces a projection that is between 24,000 and 26,000 when applied to the low, medium and high range modes. This provides a reasonable range for long-range planning and is consistent with estimates from various models. The District will contract with an independent demographer to update these projections after the October 1 2006 enrollment counts. 11 r ! ., I \ I n i t \ I f} n n [1 Long-range projections that establish the need for facilities are a modification of the cohort survival method. The cohort method of analysis becomes less reliable the farther out the projections are made. The Federal Way School District long-range projections are studied annually. The study includes information from the jurisdictional demographers as they project future housing and population in the region. The long-range projections used by Federal Way Public Schools reflect a similar age trend in student populations as the projections published by the Office of Financial Management for the State of Washington. Near term projections assume some growth from new housing, which is offset by current local economic conditions. The District tracks new development from four permitting jurisdictions. Long range planning assumes a student yield from proposed new housing consistent with historical growth patterns. The Federal Way School District is a partner in this planning with the various jurisdictions comprising the school district geography. The calculated cost per acre in the impact fee calculation is a weighted calculation using the $80,000 per acre baseline cost and the assessed valuation at the time of purchase for the Federal Way Public Academy. Federal Way Public Academy is a 3-acre site. The grade span for this facility is grades 6-10. Middle school accounts for 60% of the cost; senior high is 40%. HISTORY AND BACKGROUND The Lakota Crest Subdivision is a proposed subdivision of 43 single-family lots on a 10.8-acre site (Exhibit B - Final Plat Map). The Lakota Crest Preliminary Plat, File No. 98-103452-00-SU (Exhibit C - Preliminary Plat Map) was granted approval by the Federal Way City Council on September 21, 2004, per Resolution 04426 (Exhibit D - Preliminary Plat Resolution). Zoning for the site is RS 7.2 with a minimum lot size of 7,200 square feet. The [mal plat map and lot closure calculations were checked to ensure all lots meet the minimum size requirement. The developer applied for final plat approval on June 15,2006. Improvements installed under Engineering Application Number 04-105112-00-EN are now substantially complete or bonded. The final plat application was determined complete.on October 5,2006. Pursuantto RCW 58.17.110 and FWCC Section 20-136, the City Council is charged with determining whether the following requirements have been met: 1. The proposed final plat conforms to all terms of the preliminary plat approval; 2. If the subdivision meets the requirements of all applicable state laws and local ordinances that were in effect at the time of preliminary plat approval; 3. If all taxes and assessments owing on the property have been paid; and 4. If all required improvements have been made or sufficient security has been accepted by the City. City of Federal Way staff has reviewed the Lakota Crest final plat application for compliance with preliminary plat conditions and all applicable codes and policies. All applicable codes, policies, and plat conditions have been met. A proposed resolution of the City of Federal Way, Washington, to approve the Lakota Crest final plat is enclosed (Exhibit E - Draft Resolution of Final Plat Approval). IV. COMPLIANCE WITH PRELIMINARY PLAT CONDITIONS The following lists conditions of preliminary plat approval in the same order referenced in Federal Way City Council Resolution 04426. Required improvements have been completed as allowed by FWCC Section 20-135. I. Final plat approval shall require full compliance with drainage provisions set forth in the FWCC. Final review of the storm drainage engineering plans will occur in conjunction with full . . . engmeenng reVIew. Staff Response: This condition has been met. Storm drainage engineering plans (EN file) were reviewed and approved by the Public Works Department. 2. As required by the Public Works Department, the applicant shall designate and provide an onsite Erosion Sediment Control Supervisor, who possesses a Construction Site Erosion and Sediment Control Certification. This ESC Supervisor will be available for the duration of the project. The qualifications and responsibilities of the ESe Supervisor are outlined in the KCSWDM. The City may further limit clearing and grading activities on the site based on recommendations from the ESC Supervisor and requirements of the KCSWDM. Staff Response: This condition has been met. The site has been inspected by the Public Works Department. 3. Condition #3 of the Hearing Examiner's report, regarding clearing limits, was stricken by the City Council, and not included in the resolution as a condition. 4. Prior to approval of construction plans, the applicant shall provide written approval from Federal Way Public Schools for installation ofa gate, or other approved device, or approval of alternative access to allow school children to access Lakegrove Elementary School from the site. The pedestrian improvements shall also be approved by the City prior to construction plan approval, and completed prior to final plat approval. Staff Response: The applicant submitted written approval from Federal Way Public Schools for the gate. The pedestrian improvements have been made, except for the installation of the gate, which is anticipated to be completed one week prior to .the City Council meeting, i.e. October 31, 2006. The City will not record the plat until the gate is installed. 5. Prior to final plat the applicant shall design and construct a bus stop shelter footing and bus stop landing in accordance with King County Metro standards. Prior to construction, the applicant shall provide approval of the landing design and location from Metro. Staff Response: King County Metro approved the design and it was installed along SW 312th Street. It was inspected and approved by a Public Works inspector. 6. As required by the Public Works Department, grading around the ponds shall be done in such a way as to reduce or eliminate the need for walls, rockeries, and slopes greater than 3: 1. Staff Response: This condition has been met. The grading around the ponds was inspected by a Public Works inspector and approved. v. SEPA A Mitigated Determination of Non significance (MDNS) was issued on May 5, 2004, in accordance with the State Environmental Policy Act (SEP A). A Revised MDNS was issued July 26, 2004. In the Staff Report Lakota Crest Final Plat File #06-1030 12-SU/ Doc. ID. 38128 Page 3 Revised MDNS, the SEPA official (the Director of CDS) reduced the mitigation fee for Transportation Improvement Plan (TIP) projects from $124,065.11 to $49.588.29. The following conditions of approval were identified in the Revised MDNS: 1. In order to mitigate potential erosion impacts to Mirror Lake downstream of this project, clearing, grading, and street/utility work for the plat improvements will not be permitted from October 31 to March 30, unless approved in writing by the Public Works Director. 2. In order to mitigate potential flooding impacts, the proposed culvert modification and lowering at Fishers Bog must be completed prior to initiating clearing and grading on the Lakota Crest site as required by the Public Works Director. 3. In order to mitigate for potential adverse transportation impacts resulting from the construction of the project, the TIP projects under the Project ill colunm in Table I [as shown in the Revised MDNS) must be constructed by the applicant prior to final plat approval. In lieu of constructing these TIP projects, prior to final plat approval, the applicant may voluntarily offer to pay a pro- rata share contribution of$121,065.11 $49588.29 towards the TIP projects based on the calculation in Table 1 [as shown in the Revised MDNS). Staff Response: The SEP A conditions have been met. The applicant has constructed the plat improvements. The culvert modification and lowering at Fishers Bog was completed. The applicant submitted $49,588.29 toward the TIP projects, based on the calculation in Table 1 of the Revised MDNS. VI. DECISIONAL CRITERIA Pursuant to FWCC Section 20-136, if the City Council finds that the following criteria have been met, the City Council may approve the final plat for recording: 1. The final plat is in substantial conformance to the preliminary plat. Staff Response: This criterion has been met, as the final plat is representative of the preliminary plat and the conditions of preliminary plat have been met or financially guaranteed. 2. The final plat is in conformity with applicable zoning ordinances or other land use controls. Staff Response: This criterion has been met. The plat meets the zoning standards for the RS 7.2 zoning district, providing single-family dwelling unit lots of at least 7,200 square feet. As provided for in FWCC Section 20-135(b), performance and maintenance bonds are in place for the entire plat including frontage improvements, streets, and all infrastructure. 3. That all conditions of the Hearing Examiner and/or City Council have been satisfied. Staff Response: This criterion has been met as noted in the staff comments above. All plat conditions have been met and/or are financially guaranteed to be completed within two years of final plat approval. All life safety improvements have been completed. 4. That the public use and interest shall be served by the establishment of the subdivision and dedication by determining if appropriate provisions are made for, but not limited to, the public health, safety, general welfare, open space, drainage ways, streets and roads, alleys, other Staff Report Lakota Crest Final Plat File #06-1030 12-SU/ Doc. 1.0. 38128 Page 4 public ways, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, and schools and school grounds, and shall consider all other relevant facts, including sidewalks and other planning features that assure safe walking conditions for students who walk to and from school. Staff Response: This criterion has been met. The final plat is consistent with applicable zoning and subdivision regulations. Public health, safety, and welfare have been provided for. The applicant is providing a fee-in-lieu of open space, in accordance with FWCC 20-155. The applicant has submitted a spreadsheet which calculates the fee-in-lieu of open space (Exhibit G) The applicant has been given a two percent credit for the landscape tracts. 5. That all required improvements have been made and maintenance bonds or other security for such improvements has been submitted and accepted. Staff Response: This criterion has been met. All road, pedestrian pathway, and storm drainage improvements have been constructed and/or financially guaranteed. In addition, all water and sewer lines have been installed and approved by Lakehaven Utility District as identified in Lakehaven's "Letter of Substantial Completion," dated October 2,2006 (Exhibit H). 6. That all taxes and assessments owing on the property being subdivided have been paid. Staff Response: Prior to being recorded, the plat is reviewed by the King County Department of Assessments to ensure that all taxes and assessments have been paid. VII. CONCLUSION Staff recommends approval of the Lakota Crest final plat. Based on site visits, review of the final plat maps, construction drawings, and the project file, staffhas determined that the application for the final plat meets all platting requirements ofRCW 58.17.110 and Section 20-136 of the Federal Way City Code. Plat infrastructure improvements have been substantially completed and/or financially secured to guarantee that the plat conditions and code requirements will be completed within two years of final plat approval as allowed by FWCC Section 20-135. The project has been developed in conformance with the preliminary plat approval, Resolution 04-426. This memorandum provides additional information regarding SEPA mitigation measure number three and proposed clearing and grading limits for the preliminary plat. First, the City has corrected an error identified by the applicant in condition number three of the City's May 5. 2004, Mitigated Determination of Non significance (MONS). Specifically, the City's May 5, 2004, environmental determination incorrectly calculated the pro-rata traffic impact mitigation fee for Transportation Improvement Plan (TIP) project number 23 to be $78,206.63. The correcttraffic impact mitigation fee for TIP project number 23 is $3,729.81. To rectify this error, the City modified the MONS pursuant to WAC 197-11-340(2)(f). The modified MONS was sent to agencies with jurisdiction. There is no comment or appeal period associated with this modification procedure. A copy of the modified MONS is enclosed. By revising MDNS condition number three to correctly calculate the pro-rata traffic impact mitigation fee related to TIP project number 23, the total Lakota Crest preliminary plat pro-rata traffic impact mitigation fee has beenreduced from $124,065. J I to $49,588.29. By revising the traffic impact mitigation fee for TIP project number 23 from $78,206.63 to $3,729.81, the SEPA appeal issue identified by the appellant has been substantially reduced or eliminated. However, the City's analysis and position on this appeal issue remains unchanged. Second, City staff and the applicant were unsuccessful in reaching agreement on the clearing and grading limits. The City's analysis and position on site clearing and grading remains unchanged. Now THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY HEREBY RESOLVES AS FOLLOWS: Section 1. Findings and Conclusions. 1. The Lakota Crest final plat, City of Federal Way File No. 06-103102-00-SU, is in substantial conformance to the preliminary plat and is in conformance with applicable zoning ordinances or other land use controls in effect at the time the preliminary plat application was deemed complete. 2. Based on, inter alia, the analysis and conclusions in the Final Plat Staff Report, dated October 10,2006, which are adopted herein by reference, and on the City Council's review of the application for final plat, the proposed subdivision makes appropriate provision for public health, safety, and general welfare, and for such open spaces, drainage ways, streets or roads, alleys, other public ways, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, and schools and school grounds as are required by City Code, or which are necessary and appropriate, and provides for sidewalks and other planning features to assure safe walking conditions for students who walk to and from school. 3. The public use and interest will be served by the final plat approval granted herein. 4. All conditions listed in Federal Way Resolution No. 01-348, dated September 21, 2004, have been satisfied, and/or satisfaction of the conditions have been sufficiently guaranteed by the applicant as allowed by Federal Way City Code Section 20-135. 5. All required improvements for final plat approval have been made and/or sufficient bond, cash deposit, or assignment of funds have been accepted as guarantee for completion and maintenance of all required plat improvements as identified in the Final Plat Staff Report. Lakota Crest Draft Resolution Page 20f4 6. All taxes and assessments owing on the property being subdivided have been paid or will be paid, prior to recording the final plat. Section 2. Application Approval. Based upon the Findings and Conclusions contained in Section I above, the Lakota Crest final plat, City of Federal Way File No. 06-103102-00-SU, is approved. Section 3. Recording. The approved and signed final plat, together with all legal instruments pertaining thereto, as required pursuant to all applicable codes, shall be recorded by the applicant in the King County Department of Records and Elections. The applicant shall pay all recording fees. Section 4. Severability. If any section, sentence, clause, or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this resolution. Section 5. Ratification. Any act consistent with the authority, and prior to the effective date, of the resolution is hereby ratified and affirmed. Section 6. Effective Date.
