SUBJECT: MOU between auburn and Federal Way Regarding R-O-W Disposition along PAA
Boundaries
Auburn has signed two original MOD documents regarding disposition ofR-O-Ws between our PAA and
theirs. As you may recall we had discovered the P AA agreement between the two cities does not provide
this level of detail. Derek, Kathy, Cary, Ken and me negotiated a mutually acceptable agreement with
Auburn stafflate last year. The attached MOD documents formalize this agreement.
I've reviewed the attached documents and am satisfied they are accurate and implement the agreement we
reached. Please sign both original copies and return to me. A copy will be forwarded to the BRB in
support of our annexation application. Let me know if you have any questions. X2643.

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITIES OF
FEDERAL WAY AND AUBURN REGARDING DISPOSITION OF RIGHT OF
WAY ALONG POTENTIAL ANNEXATION AREA BOUNDARIES
WHEREAS, in June of 1995 Federal Way and Auburn entered into an interlocal
agreement designating Potential Annexation Area (P AA) boundaries in the
unincorporated area between the two cities; and
WHEREAS, the interlocal agreement designated the boundary along a number of
right-of-ways, but did not indicate the disposition of such right-of-ways to one city or the
other. These right-of-ways include portions of 55th Ave. S'" S. 288th St., 51st Ave. S., S.
321 st St. and Peasley Canyon Rd.; and
WHEREAS, both cities wish to clarify the boundary in order to facilitate
annexation and understanding of service area responsibilities; and
WHEREAS, the two cities have reached mutual agreement regarding disposition
of these right-of-ways and wish to document such agreement in this Memorandum of
Understanding (MOU);
NOW THEREFORE, the cities of Federal Way and Auburn agree:
A. That the following segments of right-of-way shall be included in Federal Way's
P AA for ownership and maintenance upon annexation:
1. 55th Avenue S from S. 272nd to an intersection with the north line ofthe south
half of the southwest quarter of the southwest quarter Section 35, Township
22 North, Range 4 East; and
2. 51 st Ave. S. from a point 250 feet south ofthe south margin of S. 304th St. to
its intersection with S. 321 st St; and
3. S. 321st St. from its intersection with 51st Ave. S. to its intersection with S.
Peasley Canyon Road; and
4. S. Peasley Canyon Road from its intersection with S. 321 st St. to the east line
of Section 15, Township 21 North, Range 4 East; and
5. S 336th Street west of the west right-of-way line of 56th Avenue S;
6. 56th Avenue S south of a point 60 feet west of the NW comer of Lot 1, Block
39 of the plat of Jovita Heights Addition as recorded in Volume 20 of Plats,
page 12, records of King County
The clarified P AA boundary generally described above is depicted on the
boundary maps attached as Exhibit A through A4.
B. That the' following segments of right-of-way shall be included in Auburn for
ownership and maintenance upon annexation:
1. 55th Ave. S. from the north line of the south half of the southwest q~arter of
the southwest quarter Section 35, Township 22 North, Range 4 East to its
intersection with the south right-of-way line of S. 288th St.; and
2. S. 288th St. from its intersection with 55th Ave. S. to its intersection with the
