Chair Dovey calledthemeetingtoorderat5:30 pm.
2.APPROVALOFMEETINGMINUTES
The summary ofthe December15,2003,meetingwas approvedaspresented.
3.PUBLICCOMMENT
DiniDuclos, Chair of the Chamber Board, spoke to rescind the Chamber’s previous support of the Sound
TransitCenter.ThegroupcalledCitizensforaVibrantCityCenter(CVCC)havemetwithvariousgroups
andreviewedpublicdocuments.Muchtimehasbeenspentonissuesofeconomicdevelopmentasrelated
tothetransitcenter.Generaleconomicdevelopmentpresentandfutureisseenaspositive.However,
currentbusinessisviewedasbeing a victimandnot the winnerifthetransitcenterislocatedat23rd Avenue
SouthandSouth316th Street. The Chamber’s Government Affairs Committee, currently reviewing the
transit center project, will make a final recommendation this Thursday [January 15] on the Chamber’s
positionontheproposedtransitcenter.
DaveMcKenzie spokeinoppositiontotheproposedtransitcenterat23rd AvenueSouthandSouth316th
Street.Hesaidthatitmakesnosensetoaddadditionalcongestiontothealreadymostcongestedareaof
Federal Way.
ShelleyThompson,theExecutiveDirectorofWoodmark,opposedtheTransitCenteronthebasis that it
will create toomuchtraffic.
MylaMontgomery statedthatuntilaprojectistotallycompleted,changecanbemade.Shesupporteda
transitcenteratthecurrent320th StreetParkandRide.ToimprovetheexistingParkandRidewouldoffer
onlyatemporarydisruption whileconstructionoftheTransitCenterat23rd AvenueSouthandSouth316th
Streetwouldofferapermanentdisruption.
4.BUSINESSITEMS
A.OversizeCommercialVehiclesCodeAmendment –Theexistingcoderelatingtooversizevehiclesis
difficulttoenforce.Thiscodeamendmentmakesitclearwhatanoversizevehicleisdefinedtobeand
whereitisallowedtobeparked.Staffwill revisitthestorageofRVsandboatsinthespringwhenthere
canbegreaterpublicparticipation.
LawsonBronson commentedthathethinkstheCityhasgonetoofarandspenttoomuchtimeonan
issuethathasgeneratedminimalcomplaints.Hebelievesthescrutinyofoversizevehiclesbelongsto
neighborhoodcovenants.

JeanAtwell favored theoversizevehiclecode.Thetowtruckparkedinherneighborhoodreducesthe
valueofthehomeslocatedthere.
MarieSciaqua statedthatfewcomplaintsarenotan accurateindicationthattheoldcodeworkedwell.
She doesn’t want commercial vehicles parked on the street.
WallyAikala supportedrestrictionsofoversizevehicles.Hisneighborhasthreesemi-tractortrucks.
Thecovenantsinhisneighborhoodprohibitingtrucksarenotbeingenforced.
Staffpointed outthat proposed changeswouldnot affecttheparkingofboatsandRVsin
neighborhoods.However,byselectingtorecommendOption#2totheCouncilforapproval,staffwould
begiventheoptiontoadd languagethataddresses screening ofconstruction vehicles usedforprivate
purposes.
Onasplitvote,theCommitteem/s/ctherecommendationto theCityCouncil thatthey approve Option
#2.
14th AvenueSouthat South312th StreetTrafficSignalProjectAwardofBid –Fivebidswerereceived,
thelowestresponsive,responsiblebidderbeingSignalElectricwithatotalbidof$136,197.30,whichwas
$56.20 below the engineer’s estimate. Theprojectremains$19,924.77overbudget.However,thereare
fundsavailableinthecompleted8th AvenueSouthandSouth312th StreetSignalProjectasdetailedina
November17,2003,LUTCmemo.TheCommitteerecommendedplacingtheawardofthe14th Avenue
SouthandSouth312th StreetTrafficSignalandIntersectionImprovementProjecttoSignalElectriconthe
January20,2004,CityCouncilagenda.Alsorecommendedforapprovalwasa10%contingencyof
$13,619.73foratotal cost of$149,817.03.The Committeem/s/crecommendationtotheCityCouncilto
authorize the CityManagertoexecutethecontract.
C.Right-of-WayUseAgreementforImprovementsby SoundTransitto South316th Street –Aspart
oftheTransitCenter/ParkingGarageProjectonSouth316th Streetand23rd AvenueSouth,SoundTransitis
proposing toinstallstreetfurnitureincludingstampedconcretesidewalks,trellisfootings,landscaping,
bannersandbenchesrequiredbyCitycodedesignguidelines.TheRightofWayUseAgreementforsuch
improvementswasrecommendedbytheCommitteeforapprovaltotheCityCouncilatitsJanuary20,2004,
meeting.
D.AgreementbetweenCentralPugetSoundRegionalTransitAuthorityandCityofFederalWayfor
FutureDevelopmentofTransitOrientedDevelopmentattheFederalWayTransitCenter –Itwas
pointedoutinthebeginningofthisdiscussionthatthisagreementwasentirelydifferentandseparatefrom
the decisionmade bytheCity Council at itsNovember18,2003,meetingapprovingtheSoundTransit
TransitCenter.
Transit OrientedDevelopment (TOD)is definedasanybusinesslocatedonaTransitCentersite,suchas a
drycleaners,eateries,coffeeshops,shoerepair,daycaresandanyotherbusinesseswhichmaybe
allowedintheCityCenterCorezoningarea.Thepurposeofcomingtoanagreementofhow spacewasto
beusedontheTransitCenterproperty wastoidentifyresponsibilitiesofthepartiesand toidentifythe
associatedtimeframes.
DaveLarson,speakingasaprivatecitizen,disputedtheproposedagreementsayingthatthere hesawtoo
many contradictions withpastagreementswithSoundTransit,andnofirmdollaramountslistedas
purchasepricesintheTOD Agreement.Hedistributedadocumentthathehadprepared.
DaveKaplan commentedthattheTransitCentercouldnotfeasiblybelocated at the current Park ‘n Ride
onSouth324th Streetbecausethefly-overHOVofframpswouldbesohightheywouldinterferewith
existing,andunmoveable,powerlines.
JerryFitts,localrealtorandhomeowneratChelseaCourtcitednoise,exhaustemissions,safetyand
diminishedpropertyvaluesasthereasonsforhisoppositiontothecurrentplanstolocatetheTransitCenter
atSouth316th Streetand23rd Avenue South. He pointed out that the Park ‘n Ride at 21st AvenueSW
appearedtobeunderutilized.

LawsonBronson,PlanningCommissionalternate,statedthatitwashisbelieftherewasneverapublic
hearingtoidentifytheproposedTransitCenterasaparkinggarage.HesaidtheTransitCentershouldbe
puton hold anditslocationreconsidered.
MarieAgear wascrippledinacar-pedestrianaccidentin1996.Shesaidshebelievesthattheentire
TransitCenterprojectisamistakeandwould notsupportfuturetaxestofundit.
Aletterwrittenandsubmittedby SherylNevers wasreadbytheClerkof theCommitteestating her
oppositiontoboththelocationoftheproposed TransitCenterandtheadditionalagreementassigning
responsibilitiesandtimelinesinaTODagreement.
DanEder ofSoundTransitstatedthathisdirectionatthistimewastomoveforwardinspiteofI-776
passage.
TheCommitteehadsomanyquestionsthatbydirectionoftheChair,thequestionswerelistedandstaff
wasdirectedtoreturntoafuturemeetingwiththeanswers.Thequestionsincluded:
Whatwasthe purchaseprice oftheeasternportionoftheproperty?
Howwouldtheparkingwork?Wouldcondominium tenantsbe allowed toparkinthestructure?
Whatarethedimensionsofthewestandeastsides oftheTransitCenterproperty?
HowisTODdoneinothercities?Isotherretailsuffering?
Islightrailcomingtothislocation?
Why/howwasthislocationchosenforthetransitcenter?
Whyistheirrigationproposedtobetemporaryinsteadofpermanent?
WhatgoesintoTOD?
Followingalengthydiscussion,theCommitteevotedtomovetheTODAgreementissue withouta
recommendation to the City Council’s next meeting on January 20, 2004, for further discussion.
E.AwardofBidfor51st AvenueSWStormDrainImprovements –Elevenbidswerereceivedforthe
51st AvenueSWStorm Drain MainlineReplacementProject(CrestviewShoreclub).Thelowestresponsive,
responsiblebidder wasR.L.AliaCompanywithatotalbidof$48,546.56.Witha10%contingencyof
$4,854.66,thetotalprojectcost of$77,901.22whichalsoincludespreviouslycompleteddesignworkandin-
houseconstructionmanagement.Aportionofthetotalbudgetconsistsofcarry-overfundsfrom2003.The
CommitteerecommendedCityCouncilapproval atitsJanuary20,2004,meeting.
F.LakotaWetlandsRegionalStormwaterFacility85%DesignApproval –Thisprojectconsistsof
increasingthestormwaterstorageoftheLakotaWetlandbyconstructingacontinuousbermadjacenttothe
pondandinstallinganewoutletcontrolstructure.AKingCountyConservationFuturesGrantof$194,000
wassecuredforpurchasingthetwoprivatelyownedparcelsthatwillbeaffectedbytheproject.Thegrant
requiresaone-to-onematchfromCityfunds.Projectdesignisapproximately85%complete.The
Committeem/s/crecommendationof approvaltotheCityCouncilatitsJanuary20,2004,meeting.
G.EastBranchLakotaCreekRestorationProject30%DesignApproval –Thisprojectrestores2,625
linealfeetoftheEastBranchLakotaCreekfromthemouthofthecreekupstreamtoSR509at LakotaPark,
theupstreamlimit.Alsoincludedintheprojectisa500-footunnamedtributaryreferredtoastheNorth
Tributary.Severalfishpassageimpedimentswillbeeliminated,unnecessarystructuresremoved,selected
streambanksstabilized,andfishhabitatstructuresadded.Stormwaterflowswillbetightlinedtoreduce
channelerosionandreducesedimentinputtotheEastBranch.The projectdesignisapproximately30%
complete.Totalbudget,including10%contingencyis$864,470.TheCommitteem/s/crecommendationof
approvaltotheCityCouncilatitsJanuary20,2004,meeting.
H.MemorandumofAgreementforMarineShorelineInventory –ThemissionoftheWRIA9forumisto
developasalmonhabitatplanthatwillguidelocaljurisdictions inprotectingandrestoringsalmonhabitat
withinthewatershed,whichincludesthenorthernpartoftheCityofFederalWay.Somepartsofthehabitat
planrequireadditionalscientificandtechnicalstudybeforepolicyrecommendationscanbedeveloped.The
WatershedForumisworkingtofilldatagapstoensurethemostaccurateinformationisusedinassembling
thesalmonhabitatplan.ThisworkwillalsoassisttheCitytoupdateitsShorelineMasterProgramby2009,
asrequiredbylaw.ThemarineshorelineinventoryisbeingcoordinatedbytheCityofSeattleandtheKing
ConservationDistricthasgrantedfundstotheCityofSeattletoconductmappingwithinKingCounty.Since

FederalWayisnotamemberof theConservationDistrict,theCityisbeingaskedtocontributedirectlyto
thecostsoftheshorelineinventory.Theestimatedcostoftheshorelineinventoryfortheentireshoreline
withintheCityofFederalWayis$4,144.ThewatershedForumwillcontribute$64,356foratotalof
$68,500.TheCity wouldalsopay$500totheCityofSeattleforprojectmanagementcosts.Anadditional
$2,000hasbeenincludedasareservefundintheeventadditionalcostsareincurred.TheCommittee
