INTERLOCAL AGREEMENT REGARDING POTENTIAL ANNEXATION AREAS

THIS AGREEMENT is made and entered into this 3l day of
1994, by and between the CITY OF PACIFIC, WASHINGTON ("Pacific"), and the CITY OF
FEDERAL WAY, WASHINGTON ("Federal Way"), both municipal corporations of the State
of Washington.

RECITALS
A. RCW 36.70A.110(2)requires Pacific and Federal Way to propose the location of
Iitheir respective urban growth areas.

*O B. The Countywide Planning Policies adopted by King County Ordinance No. 10450
establish rules for a city's adoption of a Potential Annexation Area ("PAA") within its urban
growth area.
C. Countywide Planning Policy LU-19 provides that PAA's shall be specific to each
city, shall not overlap, and shall be designated by each city in consultation with residential
groups in the affected areas and in collaboration with King County and adjacent cities and
counties.
D. Pacific and Federal Way have consulted with such groups and collaborated with
King County and adjacent cities and counties.

E. It is in the public interest that Pacific and Federal Way cooperate in designating
logical and achievable PAA boundaries.
AGREEMENT
Pacific and Federal Way agree as follows:
1. Designation of PAA's. Pacific and Federal Way agree that their respective PAA's
in the unincorporated territory between the cities shall be as set forth in Exhibit A (legal
description) and Exhibit B (map), both of which are attached hereto and incorporated herein.
2. County Designation. Pacific and Federal Way shall jointly request King County
Nto adopt the PAA's set forth in Exhibits A and B, and shall develop and carry out a coordinated

The following is a description of the proposed potential annexation area boundaries lying
between the cities of Federal Way and Pacific:
Beginning at a point of intersection of the easterly right of way
• line of 57th Avenue South and the southerly right of way line of
South 360th Street; Then running west along the southerly right
of way line of South 360th Street to the intersection of the
southerly right of way line of South 360th Street and the easterly
right of way line of Military Road South; Then south along the
easterly right of way line of Military Road South to the
intersection of the easterly right of way line of Military Road
South and South 376th Street extended.

Urban Growth Area Boundary
Dear Mr. McFall:
The purpose of this letter is to request clarification from you regarding a recent news article titled
"Federal Way stakes land claim" (please see attached copy). If the article is true, it would seem to be
very contrary to the statements contained in your letter to Pacific, dated April 5, 1993, and the numerous
more recent conversations and verbal agreements between your planning department and us regarding our
mutual UGA boundary.
Federal Way has agreed, both in writing and verbally to honor Pacific's initial UGA boundary and in fact
recent conversations between Mr. Springer and myself have even been slightly expanding that boundary
at Federal Way's request. If the article is true, it would appear that Federal Way is not only not
honoring both written and verbal agreements, but that you are taking official actions contrary to those
agreements without even contacting us. I sincerely hope that this is an incorrect observation on our
behalf.
I would like to request at this time copies of any petitions you may have received, and any actions the
City may have taken which might effect Pacific's proposed UGA boundary in King County and our
previous agreements.
I also request that we find better lines of communication between us to prevent any future
misunderstandings between the Cities.

Dear Philip:
Attached herewith are two copies of a very brief agreement between
Pacific and Federal Way agreeing upon PAA areas as we have
discussed.
The agreement was prepared by City Attorney, Rod Kaseguma. He can
be reached at 455-1234.
The legal description and map came from Federal Way. We have
reviewed them and find them satisfactory.
I believe that Pacific is prepared to take the necessary steps to
sign the agreement.
Please review the documents and let me know if there are any
changes required before Federal Way will sign the agreement.
