Street Systems Project Manager John Mulkey presented information on this item. There was
no public comment. Chair Celski noted that Bidder No. 1 (and all bids) was over the
engineer's estimate and wondered if re -bidding the project would yield lower bids. Mr.
Mulkey responded that the Engineer's estimate is known at the time the project goes out to bid.
Staff will spend time studying all bid items and evaluating why the initial bids on these items
were so high. Staff may restructure bid items to lower the overall cost of the project. Re-
bidding is open to all, in addition to those who bid the first time around.

Senior Transportation Planning Engineer Sarady Long presented information on this item.
There was no public comment. Committee member Burbidge noticed that no matching City
funds are required for this project. Mr. Long confirmed that there was no additional cost to the
City. Committee Burbidge is pleased that the proposed projects will improve safety and will
also help traffic flow.

D. Neighborhood Traffic Safety (NTS) Program Policy Amendment
City Traffic Engineer Rick Perez presented information on this item. There was no public
comment. Committee Noble-Gulliford asked for clarification on a speed table. Mr. Perez
explained the difference between a speed hump and a speed table. A good example of a speed
table is the one located on S 333`d Street on the north side of City Hall. Committee Member
Noble-Gulliford asked if a speed table is a possible solution for traffic calming on S 300 St
from SR -9 to 28`h Ave S and voiced concern for pedestrian safety at that location. Mr. Perez
noted that this particular location was not yet at this stage of the application process and would
still have to go through the entire process.

F. Amendments to the Federal Way Revised Code (FWRC), Title 13, Adoption of 2012
Construction Codes
City Building Official Martha Gillis presented information on this item and gave background
information leading up to the requirement by the State for the City to adopt the amendments to
the WA State Construction Code. Ms. Gillis also gave a brief summary of the code
amendments being amended and spoke briefly about the exceptions, ie. mandatory sprinkling
of all new residential structures. Staff is not including mandatory sprinkling provisions to be
adopted at this time as the state has moved these provisions to an appendix and is allowing each
jurisdiction the ability to choose whether or not these provisions will be mandatory. Ms. Gillis
also gave some background on some housekeeping amendments.
Committee member Noble-Gulliford asked about the code provisions for roofs to meet certain
wind thresholds. Ms. Gillis noted that the structural provisions of the code have been amended,
however, the wind load has not been modified. The amendment has occurred because of the
method used in calculation the wind resistance, not the actual threshold.
Committee member Noble-Gulliford also addressed waterfront homes with potentially long
driveways. Would these homes be required to have fire sprinkler systems? Ms. Gillis noted
that there are provisions in the code that accommodate homes that do have Fire Department
vehicle access. The code allows requirements to be determined on a case by case basis,
depending on the availability of fire hydrants, Fire Department vehicle access, etc. Ms. Gillis
also explained how this section of the code applies to high rise buildings up to five stories. Ms.
Gillis also stated that the current codes adopted by the City are not being amended from what
has been in place since 2009.
Public Comment was received by Gordon Goodsell, Asst. Fire Marshall, King County Fire &
Rescue. Asst. Fire Marshall Goodsell works at City Hall in conjunction with the City's
Community and Economic Department and specifically, the Building Division. Mr. Goodsell
explained a bit further about requirements on building and commercial construction, single-
family to multi -family. Mr. Goodsell shared the national consensus in the building code, how
the state adopted the code and made it an appendix so that local jurisdictions have the ability to
enact the requirements on a case by case basis. Mr, Goodsell supports looking at the sprinkler
code for single-family residences and put the topic back into the code where it originally was.
Chair Celski asked if there is any lifesaving potential by using fire sprinkler systems. Asst. Fire
Marshall Goodsell said yes, in his experience, there is absolutely lifesaving potential with fire
sprinklers. Mr. Goodsell also shared a bit about how the sprinkler heads work and react to heat.
Chair Celski inquired about other juri$lictions that mandate fire sprinkler systems for
residential buildings. Mr. Goodsell named approximately ten jurisdictions within Washington

that require fire sprinkler systems and stated that approximately ten more municipalities are
looking into it as well. Chair Celski asked what the increased cost to build a 2,000 s.f. home
with sprinklers. Mr. Goodsell replied that the increase in price is approximately $1.61/s.f.
Committee Member Burbidge asked if there was a cost saving for homeowners on their
homeowner's insurance if the home has functioning fire sprinklers. Mr. Goodsell stated that in
his research, he has found there to be between a 0-10% reduction in homeowner's insurance,
with an average savings of approximately 7%. To, clarify, the savings is on the total policy
cost.
Committee member Noble-Gulliford asked if the fire sprinkler data applies to both
manufactured homes and estate built homes.
Chair Celski asked for clarification on the State's deadline for Federal Way to adopt the
required code amendments. City Building Official Gillis confirmed that Federal Way needs to
have the adopted code amendments in place to be enforced by July 1, 2013. Ms. Gillis also
commented on Asst. Fire Marshall Goodsell's comments, stating that she agrees that fire
sprinkler systems are beneficial, but that they are not the only lifesaving provisions. Smoke
alarms have proven to be very successful at saving lives. Requirements for smoke detectors
have been upgraded in recent years as well as requirements for CO detectors. Both of these
provisions add no additional cost to construction of a building. The provisions being discussed
regarding fire sprinklers, if enacted, would affect approximately 100 homes a year. These are
the new homes constructed and will not provide any additional safety requirements for the
thousands of existing homes that currently occupy the city.
Committee member Noble-Gulliford asked Ms. Gillis if her position was the same regardless it
the residence is a single-family home or a multi -family residence. Ms. Gillis explained that
apartment complexes already have provisions for fire sprinklers. She holds the same position
for cottage housing, duplexes and manufactured homes as she does for single family housing.
Chair Celski suggested that staff study fire sprinklers more at a later date.

4. OTHER
The Committee received a late public comment from Jennifer Wojciechowski (1091 S 317`s St, Federal Way),
requesting information regarding the sale of the property formally known as the Federal Way School District bus
barn and what the future plans, zoning, permits, etc. that are being pursued for this location and how it may affect
the neighboring community. Director Roe offered to get the information Ms. Wojciechowski has requested and
will follow up with her in the near future.
Committee Member Burbidge also asked staff to follow up with her and the other Council members regarding
student pedestrian safety along SW Dash Point Road as it come up to 215` Ave SW across from Lakota Middle
School. Director Roe is aware of the topic and will follow up with Council as he gets additional information.

SUBJECT: Renewal of the Steel Lake Management District No. 1
BACKGROUND:
After 10 -years of successful lake management, 2013 will bring to a close the existing Steel Lake,
Lake Management District (LMD) (2004-2013). The LMD provided an organizational structure
and funding mechanism that allowed for proactive lake management focusing on the protection
and enhancement of water quality, recreational use and aesthetic value of Steel Lake. Citizens
involved in the formation and operations of this LMD submitted a signed petition to the City of
Federal Way City Council to renew the Lake Management District No. 1, beginning in 2014
through 2023.
At the January 15, 2013 City Council meeting, both a public hearing date concerning the
reformation of the SLMD was set for February 19, 2013 and a resolution of intent to reform the
SLDM was adopted. Following the public hearing, Council adopted a resolution calling for the
reformation of the Steel Lake Management District No. 1, calling for a vote by the affected
public. Voting is completed and the results are in favor of the reformation of the Steel Lake
LMD.
The next step in the process of reforming the Steel Lake LMD is the adoption of an Ordinance
reforming the Steel Lake LMD, which is attached. Following adoption of the Ordinance, an
assessment roll will be created, published and sent to the affected parties.
A public hearing, the date of which has been set by the attached Ordinance as August 6, 2013
will be held, after which resolutions establishing the assessment role and Steel Lake Advisory
Committee will be brought before City Council for consideration. The adoption of an Ordinance
establishing the time of payment, interest and penalties will then be brought before Council for
consideration. The final step in the reformation process is the selection and appointment of the
Steel Lake Management Advisory Committee.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, RENEWING LAKE
MANAGEMENT DISTRICT NUMBER 1 FOR STEEL
LAKE AND SETTING A PUBLIC HEARING ON THE
ASSESSMENT ROLL FOR THE DISTRICT.
WHEREAS, on January 7, 2013, the City of Federal Way received a petition for the
renewal of Lake Management District Number 1 for Steel Lake pursuant to RCWs 35.21.403 and
36.61; and
WHEREAS, Lake Management District Number 1 for Steel Lake is created for the
purpose of generating revenue to provide ongoing aquatic vegetation management, water quality
monitoring, community education, and other related projects; and
WHEREAS, on February 19, 2013, the City of Federal Way City Council passed
Resolution Number 13-631, declaring its intent to renew Lake Management District Number 1
for Steel Lake, calling for a vote by the affected property owners on the renewal of the proposed
district; and
WHEREAS, the City of Federal Way City Council conducted a public hearing on
February 19, 2013, for the purpose of accepting testimony in support of and in opposition to the
renewal of Steel Lake Management District Number 1. At the public hearing, testimony was
provided by Steel Lake Advisory Committee members; and
WHEREAS, under RCW 36.61.090, a simple majority of the votes cast shall determine
whether the proposed lake management district shall be approved or rejected; and

WHEREAS, the ballots were tabulated on March 20, 2013, and the proposal to renew
Lake Management District Number 1 for Steel Lake has been approved by at least a simple
majority of the votes cast; and
WHEREAS, the ballots cast are available for public inspection at City of Federal Way,
33325 8th Avenue South, Federal Way, Washington;
WHEREAS, the City of Federal Way desires to renew Lake Management District
Number 1 for Steel Lake and proceed with special assessments and performing lake
improvement activities;
WHEREAS, the City of Federal Way has established the 2014-2023 Steel Lake
Management District Management Plan (SLMDP) forming the basis for the annual Lake
Management District work plan and Lake Management District management goals; and
WHEREAS, the hearing notice requirements of RCW 36.61 will provide an opportunity
to evaluate the assessment role for each property within the district.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY
DOES ORDAIN AS FOLLOWS:
Section 1. Renewal of District. Lake Management District Number 1 for Steel Lake is
hereby renewed. The boundaries of Lake Management District Number 1 for Steel Lake are
represented in Exhibit A, incorporated by this reference. The duration of the district shall be for
ten (10) years, from January 1, 2014 through December 31, 2023. Special assessments totaling
$15,232 will be collected annually to finance the District activities, with the total amount to be
collected during the life of the District estimated at being $152,320, which includes an automatic
inflation increase based upon the Seattle Consumer Price Index not to exceed five percent in any
given year. The special assessments will be imposed based on equal charges for similar parcels.

Single family residential (RS7.2) lakefront developed properties will be charged $95 per year.
Single family residential (RS7.2, RS5.0) lakefront vacant properties will be charged $33 per
year. The multi -residential lakefront property (RM 1800) will be charged $306 per year. The
Steel Lake Park parcel will be charged $2,279 per year. The Department of Fish and Wildlife
public boat launch parcel will be charged $3,895 per year. Unallocated funds left in the current
Steel Lake Management District Number 1 (estimated to be $15,000 at the end of 2013) will roll
over into the renewed Steel Lake Management District Number 1.
Section 2. Publication. Within ten (10) days of adoption of this Ordinance, the City of
Federal Way shall publish in a newspaper of general circulation in Lake Management District
Number 1 for Steel Lake a notice indicating that this Ordinance has been adopted.
Section 3. Creation of District Limitations on Appeals. Pursuant to RCW 36.61.110, no
lawsuit may be maintained challenging the jurisdiction of authority of the City of Federal Way's
legislative authority to proceed with lake improvement and maintenance activities and creating
the lake management district, or in any way challenging the validity of the actions or decisions or
any proceedings relating to the actions or decision unless the lawsuit is served and filed no later
than forty (40) days after publication of a notice that the ordinance has been adopted ordering the
lake improvement and maintenance activities and creating the lake management district. Written
notice of the appeal shall be filed with the City Council and clerk of the Superior Court in King
County.
Section 4. Special Assessment Roll to be Prepared. Upon passage of this Ordinance, the
City of Federal Way shall cause to be prepared a proposed special assessment roll in accordance
with RCW Chapter 36.61.

Section 5. Public Hearing. A public hearing will be held by the Federal Way City Council
on August 6, 2013 at 7:00 PM or shortly thereafter at the City of Federal Way City Hall, 33325
8th Avenue South, Federal Way, Washington. At the public hearing, the City of Federal Way
City Council will consider the objections to the special assessment roll of the district, shall act as
a board of equalization, and may correct, revise, raise, lower, change, or modify the special
assessment roll or any part thereof, or set the proposed special assessment roll aside and order a
new proposed special assessment role be prepared. The City of Federal Way City Council shall
confirm and approve a special assessment roll by adoption of a resolution. Notice of the
proposed special assessment, the procedure for filing written objections thereto, and notice of the
public hearing shall be mailed to the taxpayers of record of all property within the district by the
City of Federal Way pursuant to RCW 36.61.140.
Section 6. Severability. If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 7. Corrections. The City Clerk and the codifiers of this ordinance are authorized
to make necessary corrections to this ordinance including, but not limited to, the correction of
scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any
references thereto.
Section 8. Ratification. Any act consistent with the authority and prior to the effective
date of the ordinance is hereby ratified and affirmed.
Section 9. Effective Date. This ordinance shall be effective five days after passage and
publication, as provided by law.

BACKGROUND
Six (6) bids were received and opened on May 20, 2013, for the South 356`x' Street Regional Detention Facility
(RDF) Retrofit Project. See attached Bid Tabulation Summary. The lowest responsive, responsible bidder is

SUBJECT: 2013/2014 Surface Water Infrastructure Maintenance and Services — Rebid
BACKGROUND:
Four bids were received and opened on October 16, 2012 for the 2013 Surface Water Infrastructure Maintenance
and Services Contract. The lowest responsive, responsible bidder was Action Service Corporation with a total bid
of $199,990.00.
On January 10, 2013, the City of Federal Way and Action Services Corporation entered into an
agreement for surface water infrastructure maintenance and service (Request for Bid #13-101). Since
this time, Action Services Corporation has been non-responsive to requests for information on disposal
of vactor solids and liquids, has failed to file a timely affidavit of intent to pay prevailing wages (filed on
5/20/13), has utilized equipment within the City that is in poor working condition on multiple occasions,
and has provided personnel with questionable experience/qualifications.
The City is terminating the contract with cause and has provided Action Services Corporation with thirty
(30) days written notice. Staff is requesting to rebid this work in order to obtain a more responsive and
responsible contractor to provide this critical service.

SUBJECT: 2014— 2019 Transportation Improvement Plan (TIP)
BACKGROUND:
In accordance with the requirements of Chapters 35.77 and 47.26 of the Revised Code of Washington, the
City of Federal Way adopted its original TIP and ASIP on July 23, 1991. The City is also required to
adopt a revised TIP and ASID on an annual basis reflecting the City's current and future street and arterial
needs. These plans identify capital projects that the City intends to construct over the next six years. In
order to be eligible for grant funding, projects are required to be listed in the City's TIP.
The City is required to hold a minimum of one public hearing on the revised plan, which is proposed for
the June 18, 2013 Council meeting. Once the revised plans have been adopted by Resolution, a copy of
the respective plans must be filed with the Washington State Secretary of Transportation and the
Washington State Transportation Improvement Board.
Attached for your review and comment are the proposed 2014-2019 TIP and ASIP (Exhibit A), a location
map (Exhibit B), and a draft resolution for adoption (Exhibit Q. The six-year TIP and ASID respond to
the Growth Management Act concurrency requirements as well as other emerging needs. Projects are
selected based on criteria adopted in the City's Comprehensive Plan TP81, which reads, "Prioritize
transportation projects considering concurrency, safety, and support for non -SOV modes, environmental
impacts, and cost effectiveness." Each project was ranked using the scoring criteria established for
Transportation TIP/CIP Prioritization. Staff also reviewed and analyzed available grant -eligible programs
suitable for project programming.

A RESOLUTION of the City Council of the City of Federal Way,
Washington, adopting an extended and revised Transportation
Improvement Program and Arterial Street Improvement Plan for 2014-
2019, and directing the same to be filed with the Washington State
Secretary of Transportation and the Transportation Improvement
Board. (Amends Resolution 91-67, 92-117, 93-155, 94-186, 95-210, 96-
236, 97-258, 98-273, 99-299, 00-316, 01-343, 02-365, 03-391, 04-433, 05-
451, 06-481, 07-503, 08-732, 09-550, 10-558, 11-609, and 12-622).
WHEREAS, pursuant to the requirements of RCW Chapters 35.77 and 47.26, the City
Council of the City of Federal Way adopted its original Transportation Improvement Program on
July 23, 1991 (Resolution No. 91-67); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on August 4, 1992 (Resolution No. 92-117); and

WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on August 7, 2009 (Resolution No. 09-550); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on July 6, 2010 (Resolution No. 10-558); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on June 21, 2011 (Resolution No. 11-609); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on July 3, 2012 (Resolution No. 12-622); and
WHEREAS, the City Council of the City of Federal Way has reviewed the work
accomplished under the existing Program and has reviewed work scheduled to be accomplished
according to the updated Program; and
WHEREAS, a public hearing was held on the revised Transportation Improvement Program
on June 18, 2013, in compliance with the requirements of State laws; and
WHEREAS, the City Council has determined current and future City street and arterial
needs, and based upon these findings has prepared a revised and extended Transportation
Improvement Program and an Arterial Street Improvement Plan for the ensuing six calendar years;
and
WHEREAS, pursuant to RCW 35.77 and 47.26, the City Council is required to annually
revise and adopt an extended Transportation Improvement Program and an Arterial Street
Improvement Plan; and
WHEREAS, the City's SEPA Responsible Official has adopted the DNS Federal Way File
12 -101810 -00 -SE issued for the City's 2014-2019 Transportation Improvement Plan (TIP) and
Resolution No. 12- Page 3 of 6

Arterial Street Improvement Plan (ASIP) which includes the extended and revised projects contained
in the TIP adopted herein; and
WHEREAS, adoption of the City's 2014-2019 Transportation Improvement Plan (TIP) and
Arterial Street Improvement Plan (ASIP) DNS reflects the fact that there will be no significant
adverse environmental impacts as a result of adoption or implementation of the extended and revised
Transportation Improvement Plan (TIP) and Arterial Street Improvement Plan (ASIP) adopted
herein;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Program Adopted. The extended and revised Transportation Improvement
Program and Arterial Street Improvement Plan for the City of Federal Way for the ensuing six (6)
calendar years (2014-2019 inclusive), a copy of which is attached hereto as Exhibit A and
incorporated herein by this reference, which sets forth the City's transportation project locations,
types of improvements and the estimated costs thereof, is hereby approved and adopted.
Section 2. Filingof f Program. Pursuant to Chapter 35.77 RCW, the City Clerk is hereby
authorized and directed to file a copy of this Resolution, together with Exhibit A, with the
Washington State Secretary of Transportation and a copy with the Washington State Transportation
Improvement Board.
Section 3. Severability. If any section, sentence, clause or phrase of this resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this resolution.

Section 4. Corrections. The City Clerk and the codifiers of this resolution are authorized to
make necessary corrections to this resolution including, but not limited to, the correction of
scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any

Section 5. Ratification. Any act consistent with the authority and prior to the effective date
of this resolution is hereby ratified and affirmed.
Section 6. Effective Date. This resolution shall be effective immediately upon passage by
the Federal Way City Council.

Background: The City Council approved the 2013 Planning Commission's work program on April 16, 2013.
Subsequently, the City has received applications for several large multi -family complexes. In addition, the City is
planning some new civic projects. It has been 17 years since the Design Guidelines were Inst adopted. Based on staff's
experience with development review of land use applications, we have concluded that the Community Design
Guidelines are often implemented as code rather than guidelines, given the existing code language. Consequently,
implementation often does not recognize the uniqueness of individual sites and, therefore, may not be flexible enough
to result in the desired outcome for larger or more complex buildings or developments.
Options Considered: 1) Concur with the Mayor's recommendation; 2) Do not concur with the Mayor's
recommendation.
