RECITALS
A. R &G PROPERTY HOLDINGS, LLC, a Washington limited liability company ( "Grantor ") is the owner of
certain real property (the "Property ") located in Federal Way, Washington, and legally described as follows:
SEE ATTACHED EXHIBIT "B" — LEGAL DESCRIPTION
B. The City of Federal Way, a Washington municipal corporation ( "Grantee "), desires to construct
improvements to Pacific Highway South, and requires entry onto a portion of the Property in which to locate the
improvements.
C. The undersigned Grantor having an interest in that certain real property located at 35060 Pacific Hwy South,
Federal Way, Washington and depicted on Exhibit "A" attached hereto and incorporated by this reference, does
hereby grant to Grantee, and to its agents, the right of entry onto the Property for the purpose of construction of
the driveways, slope restoration, drainage, utilities, irrigation, and /or property restoration.
Said right of entry shall commence at such time as the City of Federal Way issues NOTICE TO PROCEED to
the prime contractor for construction of the Pacific Highway South HOV Lanes Phase V Improvements Project
and shall terminate at the completion of the project, but no later than December 31, 2017.
