If the Parties are unable to settle any diVute, difference or claim arising from this Agimment, the exclusive means of resolving that dispute, difference, or claim, shall be by filing suit under the venue, rules and jurisdiction of the King County Supenior Court, King County, Washington, unless the parties agree in writing to an alternative process. If the King County Superior Court does not have jurisdiction ever such, a it, then suit may be filed in any other appropriate court in in Couniy, Washington. Each party consents to the personal jurisdiction of the state and fedwal courts in King County, Wastungton and waives any objection that such courts are an inconvenient forum. If either PaTty brings any clairn or lawsuit arising from this Agreement, each Party shall pay all its legal costs and attorney's fees and expenses incurred in defending or bringing such claim or lawsuit, including all appeals., in addition to any other recovery or award provided by law; provided, however, nothing in this paragraph shall be construed to limit the Parties' rights to indemnification under Section 5 of this Agreement.
