Background
Plaintiff was riding her bicycle on the sidewalk when she
was run over by a vehicle that failed to obey a stop sign as it
was leaving a commercial driveway. Plaintiff suffered severe
injuries.
The driver of the vehicle had the minimum insurance
mandated by state law.
Plaintiff alleged that the City is jointly and severally liable
based on the design of the roadway. Even though driver is
likely entirely or largely at fault, joint and several liability
greatly expands City's potential exposure.
The parties attended mediation.
The parties agreed upon a settlement, the City's
share of which is $425,000 pending council
approval.
$250,000 of this total will be paid by the City (with
credit for to -date expenditures including legal
fees).
The City's insurance carrier will pay the balance of
$175,000.
The City admits no liability in this matter as part of
this settlement.
Mayor's Recommendation
Approve the settlement in the matter of Feliz-Bordonada v
Keiser, et al.
