Request for Electrical Services - Work Order No. 9603910
Dear Ms. Schroder:
Puget Power is presently in the process of planning power service to the Woodmark Project on S 312th
and 24th Avenue So. To most efficiently serve the project, it would be necessary to extend with
underground service from an existing pole on the West side of Steel Lake Park to S. 3 12th. The pole at
the south margin of S. 312th would be removed and an underground extension plug installed for possible
future service to the park. No above ground installations are planned. Enclosed please find sketches
indicating this proposed installation.
Pursuant to an easement secured on the Park property in November of 1991,. under King County
Recording Number 9203180689, Puget was granted the right to construct such additional facilities upon
prior written approval by the City of Federal Way. A copy of this document is also enclosed.
If the City is in agreement, please acknowledge your approval by signing below in the space provided. A
copy of this letter has been provided for your records.

EASEMENT
FOR UTILITY PURPOSES

For and in consideration of One Dollar ($1. 00) and other
valuable consideration, the receipt of which is hereby
acknowledged, the CITY OF FEDERAL WAY, a municipal corporation of
the State of Washington ("Grantor" herein), grants, conveys and
warrants to PUGET SOUND POWER & LIGHT COMPANY, a washington
corporation ("Grantee" herein), for the purposes hereinafter set
forth a perpetual easement under, across and over the following
described real property (the "Property" herein) King County,
Washington:

Northeast quarter, EXCEPT the South 30 feet; AND EXCEPT roads, in
section 9, Township 21 North, Range 4 East, W. M., in King County,
Washington.

Except as may be otherwise set forth herein Grantee's rights shall
be exercised upon that portion of the Property (the "Right-of-Way"
herein) described as follows:
The west five feet of the South 650 feet.

1. Pureose. Grantee shall have the right to construct,
operate, maintain, repair and replace an electric transmission
and/or distribution system upon and under the Right-of-way together
with all necessary or convenient appurtenances therefor, which may
include but are not limited to the following:
a. Overhead facilities. Poles and/or towers with crossarms,
braces, guys and anchors, electric transmission and distribution
lines; communication and signal lines; transformers.
b. Underground facilities. underground conduits, cables,
vaults, manholes, switches and transformers; semi-buried or ground
mounted facilities such as pads, transformers and switches.
Upon prior written approval by Grantor, following the initiaf)
construction of its facilities, Grantee may from time to time
enlarge the existing facility or construct such additional
facilities as it may require.
2. Access. Grantee shall have the right of access to the
Right-of-Way over and across the Property to enable Grantee to
exercise its rights hereunder, provided, that Grantee shall to the
extent reasonably practicable, restore the property to the
condition it was immediately prior to such access.
3. Obstructions: LandscaDinq. Grantee may from time to time
remove trees, bushes, or other obstructions within the Right-of-way
and may level and grade the Right-of-Way to the extent reasonably
necessary to carry out the purposes set forth in paragraph 1
hereof, provided, that following any such work, Grantee shall, to
the e,xtent reasonably practicable, restore the Right-of-Way to th~.j ,

1nstallat10n of G;rantee' s underground facilities, Grantor may
undertake any ord1nary improvements to the landscaping of the
Right-of-Way, provided that no trees or other plants shall be
placed thereon which would be unreasonably expensive or impractical
for Grantee to remove and restore.
4. Grantor' s Use of Riqht-of-Way. Grantor reserves the right
to use the Right-of-Way for any purpose not inconsistent with the
rights herein granted, provided: that Grantor shall not construct
or maintain any building or other structure on the Right-of-way
which would interfere with the exercise of the rights herein
granted; that no digging, tunneling or other form of construction
activity shall be done on the Property which would disturb the
compaction or unearth Grantee's facilities on the Right-of-Way, or
endanger the lateral support to said facilities; and that no
blasting shall be done within 15 feet of the Right-of-way.
5. Indemnity. The Grantee agrees to indemnify and hold the
Grantor, its elected official, officers, employees and agents
harmless from any and all claims, demands, losses, actions and
liabilities (including costs and all attorney fees) to or by any
and all persons or entities, including without limitation, the
respective agents, licensees, representatives, arising from,
resulting from, or connected with this easement to the extent cause
by the negligent acts, errors or omissions of the Grantee, its
partners, shareholders, agents, employees, or by Grantee's
violation of this easement.
The Grantor agrees to indemnify and hold the Grantee, its
officers, directors, shareholders, partners, employees, and agents
harmless from any and all claims, demands, losses, actions and
liabilities (including costs and attorney fees) to or by any and
all persons or entities, including without limitation, their
respective agents, licensees, or representatives, arising from,
resulting from or connected with this easement to the extent caused
by the negligent acts, errors, or omissions of the Grantor, its
employees or agents.
The provisions of this paragraph shall survive the expiration
or termination of this easement with respect to any event occurring
prior to such reversion or termination.
6. Abandonment. The rights herein granted shall continue
until such time as Grantee ceases to use the Right-of-way for a
period of five (5) successive years, in which event this easement
shall terminate and all rights hereunder shall revert to Grantor.
7. Successors and Assiqns. The rights and obligations of the
parties shall inure to the benefit of and be binding upon their
respective successors and assigns.
