Dear Mr. Bryant:
On April 14. 2006. the City of Federal Way's Department of Community Development Services received your
Process II land use application for a revision to the existing parking lot at the above-referenced retail complex.
The parking lot reconfiguration is proposed in order to provide a direct vehicular connection to the adjacent
property developed with a bank.
The site is zoned City Center Core (CC-C). Retail uses are permitted pursuant to Federal War City Code
(FWCC) Section 22-792. According to code regulations,upon receipt of an application the City has 28 days to
determine whether all information and documentation required for a complete application pursuant to FWCC
Section 22-33 has been submitted.
NOTICE OF COMPLETE APPLICATION
Please consider this letter as a Letter of Complete Application. Pursuant to FWCC, the application is deemed
complete as of May 4, 2006, based on a review of your submittal relative to those requirements as set out in
the Development Requirements checklist. A 120-day time line for reviewing the Process 11 application has
started as of this date. The City has 120 days from the date that an application is deemed complete to take
action on the application. However, the 120-day time line can be stopped at any time that the City requests
additional information. You will be informed of the status of the 120-day time line when you are notified in
writing that additional information is needed as noted below.

The following items are based on an initial technical review of the application by City staff during
completeness review. With this request for additional information, the 120-day maximum review time frame
is suspended with seven of the 120 days used, and it will be restarted within 14 days of the date of your
complete response to this request.

Based on a site visit to the subject site, the existing parking stall and site layout does not reflect approved site
and landscape plans submitted with the Process II application_ Parking stalls adjacent to building A.
including accessible parking stalls, have been relocated: an interior parking lot landscape island has been
eliminated: accessible ramps intrude into required yards and may extend over a property line: and the
garbage dumpster for Building B is relocated to the west side of the drive aisle adjacent to storm drainage

facilities. It is unclear how or when the site was modified, as the City has no record of any requests for
modifications to the approved site plan. In addition, the existing site and parking lot layout creates several
nonconforming conditions, including inadequate interior parking lot landscaping and property line
encroachment.
At this time, the applicant must revise the proposed parking lot reconfiguration to reflect the approved site
layout. Refer to the enclosed redlined plan.
Landscaping
1. Perimeter landscaping, consisting of trees, shrubs and ground cover, is required around all sides of the
subject site pursuant to FWCC Section 22-1566(g). Existing vegetation will be removed with the
proposed driveway access. Landscaping, including trees and shrubs, is proposed to he replaced in the
perimeter areas. The landscape plan prepared by Jane Garrison, Landscape Architect, must be revised to
address the following:
a. Revise the plant list into trees, shrubs, and groundcover groupings.
b. List plant quantities.
c. Ground cover can be four-inch pots in lieu of one gallon sizes. The ground cover is required in all
planting areas.
d. Revise the plant list to state that shrubs in perimeter planting areas shall be a minimum of 24
inches in height at the time of planting.
2. Any landscape island created or modified with this proposal shall meet current FWCC requirements for
interior parking lot landscaping. Please label new or modified parking stalls on the site plan.
3. Trees are missing from the western perimeter of the bank site adjacent to the South 316'1i Plaza site.
With the proposed driveway access, the landscaping on this property line must be brought into
conformance with FWCC. Revise the landscape plan to add trees to the bank perimeter.
4_ Relocation of the garbage dumpster requires that a landscape island be provided at the west side of the
enclosure.
Garbage and Recycling Enclosure
1. The proposed parking lot reconfiguration eliminates head-in access to the existing garbage enclosure. In
addition, it does not appear that this garbage enclosure was constructed in the location approved under
the site plan approval. As depicted,pickup service by Waste Management is severely impacted, and
may result in roll-out service only. The enclosure shall be relocated to align with the proposed drive
aisle as depicted on the redlined plan.
2. A complaint is on file with the City for the dumpster adjacent to Building B. The complaint under file
06-101977-CR,states that this project built after City incorporation,requires screening of the garbage
and recycling enclosure. As noted above, the garbage and recycling enclosure was illegally moved from
an approved location to a non-approved location, and not screened as required under the FWCC. Please
be advised that construction approval for this parking lot reconfiguration project cannot be issued until
the complaint is resolved. Please contact Betty Cruz, Code Compliance Officer, at 253-835-2632, to
address the complaint.

1_ Eliminate stall #9 at the South 316°i Street entrance to provide a longer throat length.
2. The proposed access connection might create a safety problem with pedestrians and the bank drive-
through. Proper signage should be installed to direct motorists.
Building Department, Nlichael Lee, 253-835-2639
1. Accessible parking spaces shall be located on the shortest accessible route of travel from adjacent
parking to an accessible building entrance per 1106.6 of the International Building Code. Revise spaces
#16 and #24 to meet the preceding requirements.
2. The dimensions of the accessible space and the accessible aisle shall be noted on the plans to meet
502.2. 502.3, and 502.4 of ICC/ANSI Al 17.1-2003.
3. A sign, as required by 1 110 of the International Building Code, shall be located per 502.7 of ICC/ANSI
A117.1-2003. Note the location on the plan.
4. The ramps from the accessible parking space to the front entrance shall be noted on the plans to have a
slope of not less than 1:12 in compliance with 405 ICC/ANSI A 117.1-2003.
5. One of the three required accessible spaces shall be noted as and meet requirements for van accessible
spaces (502.2, 502.3. and 502.4 of 1CC/ANSI Al 17.1-2003).
SUMMARY
In summary, applicant responses to technical comments for the Process II application are necessary before
additional project review can proceed. With this request for additional information, the 120-day maximum
review time frame is suspended with seven of the 120 days used, and it will be restarted within 14 days of the
date of your complete response to this request. When resubmitting requested information,please provide four
copies of any reports, and seven copies of any plans, in addition to the green resubmittal form.
CANED LIATION
Pursuant to FWCC Section 22-34, if an applicant fails to provide additional information to the City within
180 days of being notified that such information is requested, the application shall he deemed null and void
and the City shall have no duty to process, review, or issue any decisions with respect to such an application.

I have reviewed the submitted plans and don't have any comments on this project. However, to improve
access and on-site circulation I recommend taking out parking stall #9 and install proper signs at the new
access connection. I think proper signs could help direct traffic coming out of the bank drive-thru and
pedestrian going to the bank as well.
If you have questions let me know by tomorrow cause I'm out this Thursday and Friday.

SECOND AMENDMENT TO EASEMENT AGREEMENT
THIS SECOND AMENDMENT TO EASEMENT AGREEMENT (this
"Amendment") is made this day of October, 2005 by and between
WOODSTONE CREDIT UNION, a Washington corporation ("Woodstone"), and
WESTERN PALISADE INC., a Washington corporation("Western Palisade").
RECITALS
A. Woodstone is the successor owner of real property Parcel No. 092104-
9317 located in King County, WA., which is legally described in Exhibit A attached
hereto (the "Woodstone Property"). Western Palisade is the successor owner of real
property Parcel No. 092104-9304 located in King County, WA., which is also legally
described in Exhibit A (the "Western Palisade Property"). Woodstone's predecessor
in title to the Woodstone Property and Western Palisade's predecessor in title to the
Western Palisade Property entered into a Shared Parking Easement Agreement,
dated February 23, 1994, and recorded in the real property records of King County,
WA., as Document No. 9406302086, as amended by a Shared Parking Agreement
Addendum, dated March 10, 1994, and recorded in the real property records of'King
County, WA., as Document No. 9811101913 (as amended, the "Agreement"). The
Agreement purported to establish a cut-through easement for passage between the
parties' respective properties for ingress and egress and the right to use the parties'
respective parking areas.
B. The parties have now agreed to make certain changes to the
Agreement as set forth in this Amendment.
AGREEMENT
NOW THEREFORE, for and in consideration of the payment by Woodstone
to Western Palisade of the sum of$31,978.50, the receipt and sufficiency of which is
hereby acknowledged, and the mutual promises herein contained, the parties agree
as follows:
1. Location of Driveway Easement. The Agreement does not
precisely specify the location of the cut-through easement. The Agreement is
hereby modified to provide that the cut-through easement will cross the parties'
common boundary line at the location identified in Exhibit A.
2. Driveway Construction Costs. Section 2 of the Agreement provides
that the parties will share the costs of constructing a new common access driveway
between the Woodstone Property and the Western Palisade Property over the cut-
through easement. Section 2 of the Agreement is hereby modified to provide that
Woodstone will bear all costs associated with constructing that portion of the

common access driveway which is located on the Woodstone Property, Western
Palisade will bear all costs associated with constructing that portion of the common
access driveway which is located on the Western Palisade Property, and the parties
will share the cost of obtaining any permits required for constructing the common
access driveway.
3. Driveway Maintenance Costs. Section 3 of the Agreement provides
that the parties will share the costs of maintaining the common access driveway.
Section 3 of the Agreement is hereby modified to provide that Woodstone will bear
all costs associated with maintaining that portion of the common access driveway
which is located on the Woodstone Property, Western Palisade will bear all costs
associated with maintaining that portion of the common access driveway which is
located on the Western Palisade Property, and the parties covenant and agree to
keep the common access driveway located on their respective properties in good
condition and repair.
4. Notices. A new Section 9 is added to the Agreement as follows:

required lists, sizes, and quantities shown.
