We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and Federal Way Fire Department. Some sections of the Federal Way City Code(FWCC)and relevant information handouts are enclosed with this letter.Please be advised,this letter does not represent all applicable codes. In preparing your formal application,please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION Proposal to subdivide one 1.54-acre parcel into five individual building lots,retaining an existing residental structure and garage on one of the lots. A detention pond is proposed at the north end of the site. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review.These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. c Mr.Sumpter January 27,2005 Page 2 • Public Works Development Services Division The project will be required to meet Level 3 flow control standards and Resource Stream Protection Area water quality standards. In addition, a latecomer's agreement may apply for stormwater improvements in the Mirror Lake basin, and/or the applicant will be required to construct improvements to lower the outlet to Fishers Bog. • Public Works Traffic Division All internal streets shall be constructed to roadway cross section"W." Staff strongly recommends communicating with neighboring property owners to accomplish acceptable traffic circulation that meets City codes and policies. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions,please contact the representative listed for that section. PLANNING DIVISION (Deb Barker,253-835-2642, deb.barker@cityoffederalway.com) 1. Zoning, Use and Review Process—The site is zoned RS-7.2 (Single-Family Residential,one unit/ 7200 square feet). Proposed lot sizes must meet or exceed the minimum lot size of the zone. The submitted plan depicts lots that are less than the minimum lot size,and would not be permitted unless approved as a cluster subdivision. See section 13 below for cluster provisions. A subdivision requires review of and recommendation on the preliminary plat application by the City of Federal Way Hearing Examiner. The Hearing Examiner makes a written recommendation based on criteria listed under FWCC Section 20-126. Once the Hearing Examiner's review is complete, his recommendation is presented to the City Council Land Use/Transportation Committee (LUTC) at a public meeting. The LUTC makes a recommendation on the application to the City Council, who then makes the final determination on the preliminary plat,based on the criteria listed under FWCC Section 20-127. A preliminary plat checklist and master land use application are enclosed along with applicable code sections from the subdivision code.' The preliminary plat application fee is$6,801.50, plus$68.50 per acre.The$389 preapplication fee paid in 2004 can be deducted from the preliminary plat application fee. The application must be prepared in accordance with the submittal requirements listed in the subdivision code and the enclosed information bulletin. Separate fees are required for Public Works engineering review and inspection. 2. State Environmental Policy Act(SEPA)—A proposed subdivision of five or more lots is subject to SEPA review. As such, an environmental checklist must be submitted and reviewed prior to the City issuing an environmental threshold determination. Public notice of the environmental determination is also issued,which includes a 14-day comment and 14-day appeal period. A SEPA checklist is enclosed. The SEPA checklist application fee is$832.50. 1 Pursuant to FWCC Section 22.31(1)(k),preliminary plat applications are exempt from RCW 36.70B.060 through 36.70B.090, and 36.70B.110 through 36.70B.130.The City elects to provide a letter of complete application and public notice of application and decision notwithstanding this decision. 04-105273 Doc.I .30031 Mr.Sumpter January 27,2005 Page 3 3. Open Space Requirements—Pursuant to FWCC Section 20-155(b), a subdivision must provide open space in the amount of 15 percent of the gross land area of the subdivision site. On-site open space must include a minimum of 10 percent usable area,and must comply with the open space types and quantities specifically described in FWCC Section 22-155(a)through (c). If approved,a fee-in-lieu payment may be made to satisfy open space requirements at the discretion of the City's PARCS Director after consideration of the City's overall park plan,quality, location, and service area of the open space that would otherwise be provided within the project. The fee-in-lieu of open space shall be calculated on 15 percent of the most recent assessed value of the property at the time of final plat. Usable open space design or fee options,along with provisions for access, improvements, ownership,and maintenance,will be reviewed in conjunction with review of the preliminary plat. No information about open space has been identified with the preapplication conference request. 4. Significant Trees, Vegetation, and Grading—All existing significant trees and natural vegetation must be retained on the site to be subdivided,except that which will be removed for improvements or grading as shown on approved engineering plans. Clearing and grading of individual future lots is not permitted during construction of the plat infrastructure,except in locations to be determined by the City that present extreme topography or other unusual conditions. A preliminary clearing and grading plan shall be submitted as part of the preliminary plat application(FWCC Section 20-179). It is the applicant's responsibility to demonstrate that the grading limits are the minimum necessary to accommodate infrastructure improvements. Also,note that trees defined as significant by the FWCC shall be identified and retained or replaced at the rate of at least 25 percent of the significant trees on the site. Removal of significant trees that are located within areas to be developed for rights-of-way or other plat utilities are exempt from the 25 percent retention calculation. The application must include an inventory of significant trees presently on the site,and plat design shall accommodate existing significant trees to the maximum extent possible. A landscape plan prepared by a licensed landscape architect,and consistent with FWCC Section 20- 186,must be submitted with the preliminary plat application.The plan shall identify the following: significant trees to be removed and retained; street trees along the internal plat streets; and landscaping around all sides of the proposed detention pond(FWCC Section 20-178). 5. Lot Design—Street and access easement improvements must meet the requirements contained within FWCC Sections 20-176 to 20-187. Included within these requirements are provisions for landscaping,utilities,and storm drainage.The minimum lot frontage is established at 22 feet for a one-way driveway unless shared access easement is provided? Structural setbacks are 20 feet front yard,and five feet side and rear yard. Corner lots shall only have one front yard setback requirement, with the other yards established as side or rear. As depicted,the existing garage is less than five feet from a proposed side property line.This nonconforming condition must be corrected prior to plat approval with the garage removed or the property line a minimum of five feet from the garage. 2 This provides for a 12-foot wide driveway with five-foot wide side yard setbacks. 04-105273 Doc.ID.30031 Mr.Sumpter January 27,2005 Page 4 6. Drainage—Drainage facilities, including any above ground conveyance ditches, must be established in formal tracts and shall not be part of an easement associated with a parcel. Any formal storm drainage tracts shall be screened from adjoining lots and the right-of-way,with vegetation to be maintained by the homeowners' association. 7. Public Notice—With the application,provide three sets of stamped, addressed envelopes for property owners within 300 feet of the subject site. Include the City of Federal Way return address on all envelopes.3 For our records, provide lists of the owners within 300 feet of the subject site and provide a corresponding parcel map showing the 300-foot radius from the subject site. Refer to the enclosed handout on mailing labels. 8. School Mitigation Fees—Payment of a school impact mitigation fee is required for each single- family residence at the time of issuance of individual residential building permits.The current single-family residential mitigation fee is $3,269.00.The school mitigation fee is reviewed annually by the Federal Way School District and City Council. 9. School Access Analysis—A copy of the application packet has been forwarded to the Federal Way School District for review of school pedestrian access and circulation. A school access analysis prepared by the applicant shall be submitted in conjunction with the preliminary plat application. Please contact Geri Walker,Federal Way School District at 253-945-2071, for access analysis parameters. 10. Final Plat—The City currently requires a$2,512.50 application fee for final plat.The final plat fee in effect at time of final plat application is required to process the final plat. Substantial completion of the plat infrastructure must occur prior to submittal and processing of the final plat. The City allows bonding of only minor improvements identified in FWCC Section 20-135 in order to process the final plat. FWCC Section 20-136 requires City Council review of the final plat. 11. Short Plat—As discussed at the preapplication conference meeting,an alternative proposal for the subject site could be a short plat.This would create no more than four lots, including the existing house. The short plat process is administrative, and environmental review would not be required. Please be advised that items 4, 5, 6, 8, and 9 listed above still apply to a short plat application. Open space is not required for short plats. Land subdivided under a short plat could not be further subdivided for five years per RCW 58.17.060. Short plat fees are$2,109.00. 12. Cluster Subdivision—Cluster subdivisions standards are provided in FWCC Section 20-153. The minimum lot area for a cluster subdivision is two acres,per FWCC Section 20-154(b)(a)(1), greater than the 1.54 acres on the subject site. In addition,cluster subdivisions are required to have all open space on site; with 10 percent of the open space as usable open space. As this site is devoid of critical or sensitive areas and is less than the minimum lot size,the site is not eligible for cluster subdivision. 3 City of Federal Way,Department of Community Development Services,PO Box 9718,Federal Way,WA 98063-9718 04-105273 Doc.ID.30031 Mr.Sumpter January 27,2005 Page 5 PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower,253-835-2732; ann.dower@cityoffederalway.com) Land Use Issues—Stormwater 1. Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual(KCSWDM),and the City of Federal Way Addendum to the 1998 KCSWDM. This project meets the requirements for a Full Drainage Review. At the time of land use site plan submittal,a preliminary Technical Information Report(TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1"= 100', five-foot contour planimetric maps that may be used for basin analysis. 2. The project lies within a Level 3 flow control area,thus the applicant must design the flow control facility to meet this performance criteria. In addition to Level 3 flow control,the project may be required to contribute to or construct a project to lower the outlet to Fishers Bog. This project is intended to further reduce flooding problems in the Mirror Lake Basin and will be constructed by private development. A latecomer's agreement is anticipated for this project and would include a contribution from this property. 3. The project lies within a Resource Stream Protection Water Quality Area. Water Quality Treatment shall be designed to meet the treatment criteria of the Resource Stream Protection or Basic Water Quality Menu. 4. Soil logs will need to be provided to verify infiltration suitability. 5. For subdivisions within the City of Federal Way,the detention and water quality treatment facility is required to be an open pond within a separate storm drainage tract,dedicated to the City for future maintenance. The water quality treatment system shall also be within a tract to be dedicated to the City. Both detention and water quality facilities may be within the same tract. If the project is changed to a short plat,the storm drainage tract would not be dedicated to the City and would be maintained by the homeowners. 6. Show on the preliminary plans,with dimensions,the proposed location of the detention and water quality facilities. Right-of-Way Improvements 1. See the Traffic Division comments from Raid Tirhi,Traffic Engineer,for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements,the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 04-105273 Doc.1.D.30031 Mr. Sumpter January 27,2005 Page 6 Building(or EN)Permit Issues 1. The Federal Way Development Standards Manual(including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 2. A final TIR shall be prepared for the project and submitted with the permit application. The final TIR will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 3. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. 4. The applicant shall reimburse the City for the cost of all required regulatory,warning,and street name signs that are installed, prior to acceptance by the City of all other required improvements. 5. Bonding is required for all improvements associated with the project.The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount for a two-year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities(including the detention and water quality facilities)and street systems for the two-year maintenance period. During that time,the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. 7. When topographic survey information is shown on the plans,the vertical datum block shall include the phrase"DATUM:N.G.V.D.-29"or"DATUM: K.C.A.S.,"on all sheets where vertical elevations are called out. 8. All drawings shall be drafted/plotted on 24" x 36" or 22"x 34"mylar sheet with permanent black ink. Drawings submitted for plan review shall be printed on 24"x 36"or 22"x 34" paper. Site plans shall be drawn at a scale of 1"=20',or larger.No architectural scales are permitted on engineering plans. 9. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 1998 KCSWDM,must be shown on the building set plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION(Raid Tirhi,PE,253-835-2744, raid.tirhi@cityoffederalway.com) 1. Based on the Institute of Transportation Engineers Trip Generation 7th Edition,the project is expected to generate less than 10 peak hour trips. Therefore, a Traffic Impact Analysis(TIA) is not required. 04-105273 Doc.ID.30031 Mr.Sumpter January 27,2005 Page 7 2. Per FWCC Section 22-1474,the applicant/owner would be expected to construct half-street improvements consistent with the planned roadway cross-sections as shown in Map III-6 of the FWCP and Capital Improvement Program(CIP) shown as Table 111-19. Based on the materials submitted, staff conducted a limited analysis to determine the required frontage improvements in meeting the FWCC. Assuming future symmetrical street widening,the applicant would only be required to dedicate eight feet of right-of-way(ROW)to bring the following street up to current standards: a) South 312'h Street is a Type"G" street,consisting of a 66-foot street with curb, gutter, six-foot planter strip with trees, eight-foot sidewalk, and streetlights in a 100-foot right-of-way. 3. ROW dedication shall be conveyed to the City through a Statutory Warranty Deed and must have clear title prior to recording. 4. All internal streets shall be Type"W"streets,consisting of a 28-foot street with curb, gutter,four- foot planter with street trees, five-foot sidewalk, and street lights in a 52-foot right-of-way. 5. FWCC Section 20-151 and Federal Way Policy TP21,require block perimeters no longer than 1,320 feet for non-motorized, and 2,640 feet for streets. Therefore, a north-south street connection would be required extending 3rd Place South/4`h Avenue South towards South 312`h Street.This connection shall be constructed to roadway cross section"W"with a minimum of 20-foot pavement width. Furthermore, a full east-west street connection with roadway cross section"W"between neighboring properties to the east and the west is also required. 6. As noted in the preapplication meeting,a recently reviewed preapplication conference for the property to the east required extension of 4`h Avenue South to the north. Given the fact that the two properties submitted simultaneous preapplication conference requests,the City is mandated to condition from both applicants' three-quarter street improvements for this required north-south connection. Staff strongly recommends that property owners communicate and agree on building the street connection as a whole with each property owner providing"half'street improvement. 7. Per FWCC Section 22-1543,driveways must be located no closer than 150 feet to any street intersection or to any other driveway,whether on or off the subject property. 8. Please note that the City is in the process of developing a Traffic Impact Fee(TIF)system,which is expected to be complete by the summer of 2005. BUILDING DIVISION (Scott Sproul,253-835-2633,scott.sproul@cityoffederalway.com) No comments at this time. LAKEHAVEN UTILITY DISTRICT(Brian Asbury,253-946-5407,basbury@lakehaven.org) Water Issues A developer extension agreement will be required to extend mainline water facilities to serve the site, extending from existing facilities in South 31261 Street to a dead-end main in 3rd Avenue South.The District 04-105273 Doc.I D.30031 Mr.Sumpter January 27,2005 Page 8 encourages the owner to apply separately to the District for the developer extension agreement process early in the pre-design/planning phase to avoid delays in the overall development process. Sewer Issues If sewer service is desired or required by King County Environmental Health,a developer extension agreement will be required to extend mainline sewer facilities to serve the site.The District encourages the owner to apply separately to the District for the developer extension agreement process early in the pre- design/planning phase to avoid delays in the overall development process. General Comments 1. The District encourages the developer to coordinate project planning and work with similar work proposed for property adjacent to the east,to reduce the overall amount of facilities necessary to serve both projects and to provide more central facilities locations. 2. The District's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU).Residential equivalency for Single-family use is calculated as 1.0 ERU per unit.The District's current Capital Facilities Charges are$3,212/ERU for water and$2,702/ERU for sewer. Credit is available for this property from connection charges previously assessed under water meter application 508C for 1.0 ERU per acre for water only. All comments herein are valid for one year and are based on the proposal(s)submitted and the District's current regulations and policies.Any change to either the development proposal(s)or the District's regulations and policies may affect the above comments accordingly. FEDERAL WAY FIRE DEPARTMENT(Greg Brozek,253-946-7241,greg.brozek®federalwayfire.org) Water Supplies for Fire Protection A Certificate of Water Availability shall be provided indicating the fire flow available at the site. Fire hydrants shall be spaced 700 feet or less apart. Every building lot shall have a fire hydrant within 350 feet. All measurements shall be made as vehicular travel distance. Fire hydrants shall be in service PRIOR to and during construction. - Fire Apparatus Access Roadway Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 feet from fire apparatus vehicle access.Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25-ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 20-foot inside turning radius and not less than a 40-foot outside turning radius. 04-105273 - Doc.1.D.30031 Mr. Sumpter January 27,2005 Page 9 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or Fire Department approved alternative at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 15 percent. 6) Serving a single residential property which have a dead end in excess of 150 feet in length shall be provided with a turn around approved by the chief. (KCFD#39 Administrative Policy Guideline No. 1006) EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Fire apparatus access road gates shall comply with KCFD#39 Administrative Policy Guideline No. 1001. Automatic Fire Sprinkler Systems An automatic fire sprinkler system shall be installed in Group R,Division 3 occupancies: 1) When the occupancy exceeds 2,500 square feet(including attached garages)without adequate fire flow. 2) Without approved fire department access. 3) When the occupancy exceeds 10,000 square feet. 4) When the building is classified as an over-water structure. Project Specific Comments: The minimum fire flow for one-and two-family dwellings shall be 1,000 gallons per minute. If the slope of a building lot does not allow the building(s)on the site to comply with the "life safety/rescue access"requirement,the building(s)shall be provided with an approved automatic fire sprinkler system.Life safety/rescue access shall mean an unobstructed access to all floor levels and each roof level of a building on not less than 20 percent of the building perimeter by utilizing a 35-foot ladder. An alternate method would be at least one stairway enclosure with exit doorways from each floor level and with a door opening onto each roof level,which conforms to the requirements of the International Building Code. THESE FIRE DEPARTMENT COMMENTS ARE VALID FOR 180 DAYS FROM REVIEW AND ONLY FOR THE PLANS REVIEWED. CLOSING This letter reflects the information provided at the preapplication meeting and is intended to assist you in preparing plans and materials for formal application.
