This office and other City staff have reviewed the environmental checklist you submitted. We have determined
that the proposal will not have a probable significant adverse impact on the environment.As a result,an
environmental impact statement(EIS)is not required to comply with the State Environmental Policy Act(SEPA).
A 14-day comment period is required by the SEPA rules(WAC 197-11-340).A notice inviting comments was
published in the Federal Way Mirror on August 22,2007.At the end of the comment period,the department will
determine if the DNS should be withdrawn,modified,or issued as proposed.All final determinations may be
appealed within 14 days following the comment deadline.No licenses,permits,or approvals will be issued until
completion of the appeal period.
Our decision not to require an EIS does not mean that the license,permit,or approval you are seeking from the
City has been granted.Approval or denial of the proposal will be made by the appropriate administrative or
legislative body vested with that authority.The environmental record is considered by the decision maker(s)and
conditions will be imposed to reduce identified environmental impacts,as long as the conditions are based on
adopted and designated City policy.
After a final decision has been made on your proposal(i.e.,after approval has been issued or City Council action
taken,as applicable),you may,but are not required to,publish a Notice of Action as set forth in RCW
43.21C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's
compliance with SEPA can be made.A copy of the Notice of Action form and copies of RCW 43.21C.080 and
WAC 197-11-680 providing instructions for giving this notice are available from the Department of Community
Development Services.
The City is not responsible for publishing the Notice of Action. However,the City is responsible for giving a
notice(to parties of record)stating the date for commencing a judicial appeal(including the SEPA portion of that
appeal)if your proposal is one for which the City's action on it has a specified time period within which any court
appeals must be made.

PURPOSE OF CHECKLIST
The State Environmental Policy Act(SEPA),Revised Code of Washington (RCW)Chapter 43.21C,requires
all governmental agencies to consider the environmental impacts of a proposal before making decisions.An
environmental impact statement(EIS)must be prepared for all proposals with probable significant adverse
impacts on the quality of the environment. The purpose of this checklist is to provide information to help you
and the agency identify impacts from your proposal(and to reduce or avoid impacts from the proposal,if it
can be done)and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about our proposal. Governmental

The applicant is proposing to develop a 13-unit subdivision of approximately 4 acres,as a cluster
development. The project includes an on-site park and storm water detention area,as well as utilization of the
storm water control facility adjacent to this property,as acceptable to the City of Federal Way. The project
will include the construction of public streets,sidewalks and other improvements,including improvement of
38th Street adjacent to the property.All work will be done in accordance with the City of Federal Way
requirements. The lots will range in size from 7,200 to 8,523 sf.

approximately 4 acres,as a single-family residential development.The project includes a storm water
detention area,as approved to the City of Federal Way.The project will include the construction of

The property is located easterly of 38th Avenue South and west of 41st Avenue South and a
continuation of 333rdth Street turning northerly and becoming 40th Avenue South. The property is located in
Section 15,Township 21 North,Range 4 East,Willamette Meridian,in King County,Washington consisting
of tax parcels 6143600500,6143600614 and 6143600617.
B. ENVIRONMENTAL ELEMENTS
1. EARTH
a. General description of the site(circle one): flat,rolling,hilly,steep slopes,mountainous,other.
The site has a gentle slope to the south,but would be considered relatively flat.
b. What is the steepest slope on the site(approximate percent slope)?
Less than 10%.
c. What general types of soils are found on the site(for example,clay,sand,gravel,peat,mulch)?If
you know the classification of agricultural soils,specify them and note any prime farmland.
Dense glacially consolidated silty sand.

facilities. There will be about 20,000 feet of cut and fill for the storm water management facility, streets and
pads,as well as cuts and fills not to exceed eight feet. There will be select back fill materials imported for
backfilling trenches,roadwork and concrete preparation. The site is intended to balance on-site.

A temporary erosion control plan will be developed and implemented.Appropriate measures such as silt
fencing and other measures in accordance with City of Federal Way requirements will be utilized,as
appropriate.
2. AIR
a. What types of emissions to the air would result from the proposal(i.e.,dust, automobile,odors,
industrial wood smoke)during construction and when the project is completed?If any,generally
describe and give approximate quantities if known.
The types of emissions that will be those generally associated with plat construction and single-
family neighborhoods. These would include construction equipment exhaust,dust,automobile
exhaust and smoke from gas fireplaces. There will be no unusual odors or industrial emissions.
b. Are there any off-site sources of emissions or odor that may affect your proposal?If so,generally
describe.
The off-site sources of emissions or odors would be the residential neighborhoods that surround the
site and SR 18.
c. Proposed measures to reduce or control emissions or other impacts to air,if any.
The Washington Clean Air Act requires the use of all known available and reasonable means of
controlling air pollution,including dust. Construction impacts will not be significant and can be
controlled by watering or using dust suppressants on areas of exposed soils,water truck wheels
before leaving the site and maintaining gravel construction entrances.
3. WATER

There is a chance that waste materials could enter via surface water runoffs from paved streets. The
oil/water separators and biofiltration systems will provide quality filtration of storm water prior to

Surface water run-off will be collected and controlled through an approved conveyance system and
controlled by storm water management facility.Water collected by rain gutters will be dispersed by splash

There will be and increase in the level of noise for this project it is anticipated that construction
and building activities will commence at 7 am and be completed by 7 pm,or as allowable by
the City of Federal Way codes provisions. Upon completion of the construction there will be
noise typical with a 12 unit residential neighborhood.

Construction hours will be limited to those approved by the City of Federal Way.Equipment
will have mufflers and be properly maintained.

Two residential single-family homes are on-site and there is a large residential subdivision to the
east and south. A recreation area lies to the west,this property has an interest in that recreation area
and a well is to the north along with more homes.

14. TRANSPORTATION

The project has frontage along 38th Avenue South,which will be widened directly adjacent to the
property. Right of way will be dedicated to the City for this purpose as part of the plating process.
This project will also provide better conductivity as S. 332rd PL will be connected to 38th Avenue
South and then connected to the existing S 333rd Place.
b. Is the site currently served by public transit?If not,what is the approximate distance to the nearest
transit stop?
Less than one mile.
c. How many parking spaces would the completed project have?How many would the project
eliminate?
No existing parking will be eliminated. Each house will have at least a two car garage with additional
parking in the driveway.
d. Will the proposal require any new roads or streets,or improvements to existing roads or streets,not
including driveways?If so,generally describe(indicate whether public or private).
A residential street will pass through the subdivision to provide access to the new lots.All new
residential streets will be constructed per City requirements. There will be the pavement section
along with 5 foot wide side walks along with curbs and gutters and planter strips per City Standards.
It is proposed that 332 terminate at 38th Avenue South and will only be a half street. There will be
widening of 38th Avenue South only along the property frontage area.
e. Will the project use(or occur in the immediate vicinity of)water,rail,or air transportation?If so,
generally describe.
No extraordinary uses are anticipated.
f. How many vehicular trips per day would be generated by the completed project?If known,indicate
when peak volumes would occur.
It is expected that the 11 new homes will generate approximately 11 more peak hour trips and 110
average daily trips.
g. Proposed measures to reduce or control transportation impacts,if any.
The improvement or 38th Avenue South will help to improve the system. The connection of 38th
Avenue South to 333rd will improve conductivity.All these costs will be borne by the developer.
15. PUBLIC SERVICES
a. Would the project result in an increased need for public services(for example: fire protection,police
protection,health care,schools,other)?If so,generally describe.
This project would require additional police,fire and emergency service personnel,but no special
services are required. The increased demand is within the capacity of the City of Federal Way.

This project is designed to comply with all applicable codes for fire and public safety and health.
This will mitigate the impact of the above services.

other information on file with the City, it is likely that the City of Federal Way will determine that the
project will not have a probable significant adverse impact on the environment. It is likely that an
environmental impact statement(EIS)will not be required under RCW 43.21C.030(2)(c).The City
anticipates that a Determination of Nonsignificance (DNS)will be issued for the proposed project.The
optional DNS process of WAC 197-11-355 is being used.The proposal may include mitigation measures

under applicable codes,and the project review process may incorporate or require mitigation measures
regardless of whether an EIS is prepared. A copy of the subsequent threshold determination for the
specific proposal may be obtained upon request. (In addition,the lead agency may choose to maintain a

Integrated Comment Period: Consistent with the provisions of WAC 197-11-355, a single integrated
comment period will be utilized to obtain comments on the Notice of Application and Optional
Environmental Determination. This may be the only opportunity to comment on the environmental
impacts of the proposal.
Any person may submit written comments on the environmental impacts of the proposal to the Director
of Community Development Services by 5:00 p.m. on February 12, 2007.Any interested party may
appeal the environmental threshold determination. Details of appeal procedures for the requested
environmental decision will be included with the written decision.
Issuance of Final Environmental Determination: If timely comments do not identify probable significant
adverse impacts that were not considered by the Optional Environmental Determination,the DNS will be
issued without a second comment period. A copy of the DNS may be obtained upon request.
Consistency with Applicable City Plans and Regulations: The project will be reviewed for consistency
with all applicable codes and regulations, including the FWCC environmental and zoning codes; surface
and stormwater management codes;King County Road Standards; and King County Surface Water
Design Manual.
