Greg Otto PO Box 12003 vi\-• Portland, OR 97212 RE: Proposed Steel Lake Residence PRE95-0014 Mr. Otto: This letter summarizes our pre-application meeting held March 30, 1995, at which time members of the Development Review Committee discussed general requirements that apply to your proposal. Those requirements are summarized below or are enclosed with this letter. Also enclosed for your reference is the meeting attendance sheet. In summary, you propose to construct a new two-story single family residence 8.5 feet from the Steel Lake shoreline to avoid an existing 10 foot wide sewer easement and line traversing the easterly portion of the lot at 30521 28th Avenue South. LAND USE (Bill Kingman, 661-4110) Steel Lake is classified as an environmentally sensitive area (wetland) pursuant to Federal Way City Code (FWCC) Section 18-141, regulated lake pursuant to FWCC Section 22-1, and shoreline pursuant to Washington Administrative Code (WAC) 173-20-360 (State Shoreline Management Act). For reference, the regulated lake setback requirement is 25 feet from the ordinary high water mark(OHWM), a point where the beach and vegetation meet. The shoreline setback requirement is 20 feet from the OHWM. You propose a 8.5 foot setback from a "shoreline". 1. Please provide a letter from Lakehaven Utility District regarding their lack of support of a sewer easement encroachment variance in order to a provide a building area that does not require shoreline setback variance. a' fr Mr. R. Greg Otto April 4, 1995 Page 2 2. Lacking solutions in #1 above, a Process II shoreline substantial development setback variance from 20 to 8.5 feet is necessary, pursuant to FWCC Section 18-166. Minimum variance amount will be determined using "common line setback" methodology discussed in the enclosed Shoreline Management Program Handbook, 1994 Edition, page H-247, or equivalent,. _as amended by Federal Way. Enclosed is a Master Land Use Application, Shoreline Variance Application, Process II decisional criteria, and flow chart for your review:Shoreline variance filing fee is $2,250, payable at time of filing. 3. Regulated lake setback is 25 feet from the OHWM. Minimum setback intrusion will be determined using the enclosed "average neighbor's setback" methodology discussed in FWCC Section 22-1334(4). This issue will be examined concurrent with review of the Process II shoreline variance application. No separate application or filing fee is necessary. 4. A.State Environmental Policy Act (SEPA) review is necessary because the proposal is located within an environmentally sensitive area (regulated lake setback). Development standards will be based on FWCC Section 22-1331, regulated lake. Enclosed is a SEPA checklist and handout describing how to obtain mailing labels. Please provide two sets of stamped envelopes addressed to all property owners and occupants within 300 feet of the site with the Process II shoreline variance application for public notices. SEPA filing fee is $472, payable at time of filing. 5. Impervious surface ratio is limited to 60 percent of the lot above ordinary high water mark (OHWM). Lot area below OHWM may not be included in the calculation. 6. Proposed north property line setback calculate five feet but measure four feet on the submitted drawing. For reference, five feet is required pursuant to FWCC Section 22-631. 7. Building height is limited to 30 feet above average building elevation. The proposed 28 feet is acceptable. 8. Two parking stalls are required. Driveway width is limited to 10 ft. PUBLIC WORKS DEPARTMENT (Julie Venn, 661-4125) 1. Water and sewer availability letters are required with the Process II shoreline variance application. 2. The proposed building will increase the impervious area by more than 500 square feet, therefore, building runoff must be tightlined to outlet to Steel Lake. Roof drain outlets shall have rip rap protection. Mr. R. Greg Otto April 4, 1995 Page 3 3. Full width right-of-way improvements along 28th Avenue South are required pursuant to FWCC Section 22-1473. The required improvements are not warranted at this time and may be deferred. A No-Protest LID Agreement must be signed and recorded with the building permit application. 4. The proposed building site is in an environmentally sensitive area. All measures necessary to protect Steel Lake during and after construction must be taken. A temporary erosion control plan is required with the building permit application. 5. All storm water runoff from paved areas subject to vehicular use shall be treated by separate storm drainage facilities. An oil/water separator and bioswale to treat this runoff must be designed to King County Surface Water Design manual standards and included with the Process II shoreline variance application. 6. The 100-year flood plain elevation must be determined. The finished floor elevation must be at least one-foot above the 100-year elevation. 7. The driveway width shall be 10 feet wide per FWCC Section 22-1542. 8. All electrical utilities shall be placed underground. LAKEHAVEN UTILITY DISTRICT (Mary Cossette, 941-2288) Comments enclosed. Federal Way, WA 98003 RE: Request For Pre-Application Meeting PROPOSAL: I am requesting a pre-application meeting to discuss a proposal for a single family dwelling on Tax Lot 92 on Steele Lake, in Section 9, TWP 21 North, Range 4 East WM in King County, Washington (see attach- ment #1) . Construction of the dwelling will require a variance for shoreline setback. HISTORY OF THE PROPERTY: Archival Records indicate that Tax Lot 92 was segmented October 4, 1941. It has remained the same since that time. HARDSHIP: The sewer line runs diagonally through the lot at a point 17 feet into the lot on the south property line, and at a point 24 feet into the lot on the north property line (see attachment #2) . The size of the lot and the configuration of the sewer easement create a hardship that can be alleviated by a variance from the shoreline setback. The proposed dwelling would set approximately 8 feet from the surveyed shoreline. It would also set approximately 5 feet east of a line drawn between the mid-points of the structures on the adjoining lots to the north and to the south of the proposed dwelling (see attachment #3) . CITY OF FEDERAL WAY MEMORANDUM February 23 , 1995 TO: File 1� FROM: Bill Kingman, Associate Planner d SUBJECT: Steel Lake Residence PRE95-0014 I've examined the proposal to construct a new two story residence at 30521 28th Avenue South abutting Steel Lake. Below are issues that must be resolved with subsequent Process II shoreline variance application and SEPA review. For reference the proposal is to construct a new single family residence 8.5 feet from Steel Lake shoreline due to a existing 10 foot wide sewer easement and line traversing the easterly portion of the lot. Issues Steel Lake is classified as a environmentally sensitive area (wetland) pursuant to Federal Way City Code (FWCC) Section 18-141, regulated lake pursuant to FWCC Section 22-1 and shoreline pursuant to Washington Administrative Code (WAC) 173-20-360 (Shoreline Management Act) . For reference the regulated lake setback requirement is 25 feet from the ordinary high water mark (OHWM) , a point where vegetation stops and the beach starts. Shoreline setback requirement is 20 ft. from the OHWM. Proposed is 8. 5 ft. setback from the edge of the "shoreline" . The lot is zoned RS 7.2 . Front yard setback requirement is 20 ft. from the property line, 25 ft. is proposed. Side yard setback requirement is 5 ft. , four ft. is proposed on north line and 5 ft. on the south line. Impervious surface ratio is limited to 60 percent of the lot above the OHWM. Two parking stalls are required. Building height is limited to 30 ft. above average building elevation, 28 ft. is proposed. Driveway width is limited to 20 ft. 1. The property owner should discuss either filing a sewer easement encroachment variance or request to relocate the sewer line with Lakehaven Utility District in order to a provide building area that does not require setback variances. How did other homes in area obtain permits to construct over the sewer line? ! • 2 . Lacking solutions in #1 above, a Process II shoreline substantial development setback variance from 20 to 8. 5 ft must be obtained, pursuant to FWCC Section 18-166. Minimum variance amount will be determined using "common line setback" methodology discussed in the Shoreline Management Program Handbook, 1994 Edition, page H-274, or equivalent as amended by Federal Way. 3 . A Process I regulated lake setback variance is required and will be decided with Process II shoreline variance. Minimum variance amount will be determined using "average neighbor's setback" methodology discussed in FWCC Section 22-1334 (4) . 4 . SEPA is necessary because the lot is located within a environmentally sensitive area (regulated lake setback) . Development standards will be based on FWCC Section 22- 1233 (6) , regulated lake. 5. Impervious surface ratio is limited to 60 percent of the lot above the ordinary high water mark (OHWM) . Lot area below the OHWM may not be included in the calculation. 6. North property line setback calculates to five feet but measures four feet on the drawing. Five feet is required pursuant to FWCC Section 22-631. PRE9514.M2 2
