This letter summarizes comments given to you at the meeting by the members of the DRC.The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department,and representatives from Lakehaven Utility District and Federal Way Fire Department. Some sections of the Federal Way City Code(FWCC)and relevant information handouts are enclosed with this letter. Please be advised,this letter does not represent all applicable codes.In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION The proposal is establish a new single-family house on a Steel Lake lot. MAJOR ISSUES • Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Mr.J.Armando Leyva Page 2 August 21,2003 • Planning Division The proposed improvements can only be approved if a shoreline variance is approved. The shoreline variance application must be accompanied by a survey that accurately identifies the Ordinary High Water Mark(OHWM).Depending on the extent of the application, SEPA may be required. • Public Works Development Services Division Street frontage improvements are required along 28th Avenue South, including nine feet of right-of- way dedication,curb, gutter, sidewalk,planter strip,and street lighting.If the developer wishes to reduce and/or eliminate these requirements,a right-of-way modification request must be submitted. • Lakehaven Utility District The existing sewer main and associated easement significantly encumbers this property. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference.Each section should be read thoroughly. If you have questions please contact the representative listed for that section. PLANNING DIVISION(Deb Barker,253-661-4103,deb.barkerAcityoffederalway.com) Background—A preapplication conference for a single-family residence proposed on Steel Lake was held on March 30, 1995.The applicant at the time proposed an 8.5-foot setback from a shoreline.A formal environmental application checklist was submitted on October 5, 1995, and a Determination of Nonsignificance(DNS)was issued on November 16, 1995,for a house set back 6.5 feet from the OHWM of Steel Lake. The City granted site plan approval for the proposal on December 28, 1995.The Federal Way Hearing Examiner conducted a public hearing for a shoreline variance to allow a new single-family house five feet from the OHWM on February 13, 1996. His decision to grant a variance to a house within a shoreline setback was issued on February 27, 1996.The Shoreline Variance received final approval by the Washington State Department of Ecology on March 22, 1996. Although a single-family building permit was issued for this site,the shoreline variance expired before the house was constructed and work on the building permit was halted.In addition, information submitted for the shoreline variance in 1996 may not have accurately represented the OHWM for determining the building structural setbacks as required under the Shoreline Management Act or conditions have since changed. Zoning and Setbacks—The zoning of the subject site is Residential Single Family(RS 7.2).The RS zoning district permits residential single-family uses under FWCC Section 22-631 (enclosed). The subject site is located on Steel Lake,which is classified as an urban shoreline environmental designation and regulated under FWCC Section 18-164. Pursuant to FWCC Section 18-165(d)(3),residential development in the urban shoreline designation requires that residential buildings be set back behind the string line setback or 30 feet,whichever is greater.Development water ward of the OHWM is prohibited. Steel Lake is also a regulated lake pursuant to FWCC Section 22-1,and structures, improvements, and land surface modifications within 25 feet of the lake are regulated under FWCC Section 22-1334. Armando Leyva Page 3 August 21, 2003 Shoreline—For lots where properties adjacent to both sides of the lot are developed with single-family residences located less than 50 feet from the OHWM,the proposed residence may be located the same distance from the OHWM as the adjacent structures or 30 feet,whichever is greater.Any setback less than 30 feet requires that a shoreline variance to the setback be obtained.A variance to the setback requirement may be sought pursuant to FWCC Section 18-171. The shoreline variance process requires that the Federal Way Hearing Examiner conduct a public hearing and issue a decision on the application. The Washington State Department of Ecology must also review the shoreline variance request and has the final decision authority for such an application. In order to apply for a shoreline variance, information identified on the Development Requirements checklist must be submitted, along with a nonrefundable application fee of$3,614.50. Properties located within 300 feet of the subject site are notified of the shoreline variance application and of the public hearing. Stamped, addressed mailing envelopes that meet the requirements of the public notice handout must be submitted with the application. As noted in the City's April 12,2002 letter, based on an inspection of the site by City staff on April 5, 2002, it appears that the information submitted for the 1996 shoreline variance may not have accurately represented the OHWM for determining the building structural setback as required under the Shoreline Management Act, or that conditions changed since that application.The April 5, 2002, inspection by City staff identified that several of the markers that identify the"line of vegetation"depicted on the site plan are actually within the lake, and appear to be water ward of the shoreline OHWM. Therefore, a survey that accurately represents the shoreline OHWM as defined in RCW 90.58.030 (enclosed)must be submitted with the formal shoreline variance application. The survey must be prepared by an independent shoreline consultant to determine the OHWM, which City staff will field verify,and must be stamped by a land surveyor licensed in the State of Washington. Alternatively,the City can hire an independent shoreline consultant to determine the OHWM at the expense of the applicant. In any case, the previous documents and surveys will not be suitable for review purposes for a new application. Regulated Lake—Steel Lake is a regulated lake with 25-foot setbacks required under FWCC Section 22- 1332. A variance to the regulated lake setback may be sought under FWCC Section 22-1334(4), but no structure other than moorage structures can be located water ward of the OHWM. The City is unable to determine if the proposed house meets the setback intrusions identified in FWCC Section 22-1334(4). Additional site plan information must be provided, including the proposed shoreline setback distance and the full footprint of residences on both abutting properties. If the proposed residence does not comply with the setback identified in FWCC Section 22-1334,then a Process IV Hearing Examiner variance to the 25-foot regulated lake setback is required. (If applicable,the regulated lake setback variance would be processed simultaneously with the shoreline variance hearing.) State Environmental Policy Act(SEPA)—The proposed development is subject to SEPA review because the project is located within an environmentally sensitive area(regulated lake setback). In an April 2, 2002 letter, Senior Planner Jim Harris stated that the 1995 SEPA documents are likely adequate for SEPA compliance,but that further staff evaluation may necessitate additional SEPA review. Specifically,the original environmental checklist identified the setback as 6.5 feet from the OHWM,and the constructed foundation,currently within the OHWM based on site observations, exceeds the parameters of the DNS. Armando Leyva Page 4 August 21,2003 If the proposed shoreline setback is less than the setback approved under the 1995 Environmental Decision,the SEPA decision may be amended. Please be advised that building permits may not be issued until all comment and appeal provisions of the various processed are concluded and the Department of Ecology has approved any variance requests. Application Fees—The project requires the following land use application fees: Shoreline Variance $3,614.50 Public Notice 250.00 Less Preapplication -382.50 Total: $3,482.00 SEPA(if required) $805.50 PW DEVELOPMENT SERVICES DIVISION (Ann Dower,253-661-4125,ann.dower(acityoffederalway.com) 1. Street frontage improvements are required along 28th Avenue South, including nine feet of right-of- way dedication,curb,gutter,eight-foot wide sidewalk, six-foot wide planter strip, street trees,and street lighting. If the developer wishes to reduce and/or eliminate these requirements, a right-of-way modification request must be submitted.A handout on this process is enclosed. 2. The 1998 King County Surface Water Design Manual, Appendix C provides information on erosion control and flow control for small sites. These items must be shown on the site plan. Roof runoff may be direct to the lake through perforated tightline connections. 3. A right-of-way permit will be required for any work within the public right-of-way. Bonding is required. NOTE: A Washington State registered architects stamp is required for additions/alterations(new or existing)of 4,000 gross floor area or greater unless specifically listed as an"exempt" structure per the Revised Code of Washington(RCW). Submit N/A copies with King County Health Department approval stamp for all projects that include food service facilities, septic systems, or other elements within the project that require health department approval. Armando Leyva Page 6 August 21, 2003 A wet stamp and signature is required on all sheets of plans and on the cover page of any calculations submitted. Federal Way reviews plans on a first in first out basis; however,there are some small projects with inconsequential review requirements that may be reviewed out of order. D. Review Timing The first comment letter can be expected within three to five weeks of submittal date. Re-check of plans will occur in one to three weeks after resubmittal. Revised or resubmitted plans shall be provided in the same format, size, and amount as the originally submitted plans. Revised/resubmitted drawings shall indicate by means of clouding or written response that changes have been made from the original drawings. Plans for all involved departments will be forwarded from Community Development Services. Federal Way has an expedited review process. Information is available at our front counter. E. Other Permits and Inspections Separate permits may be required for electrical,mechanical, plumbing, fire suppression systems,and signs. The applicant may apply for separate permits at any time prior to commencement of construction. When required, special inspections shall be performed by WABO approved agencies or by agencies approved by the Building Official prior to permit issuance. Construction must be approved by all reviewing departments prior to final building division inspection. All concerned divisions/departments(Planning,Public Works,electrical,fire)must sign off before the Building Division can final the structure for occupancy. Building final must be approved prior to the issuance of a Certificate of Occupancy. The City of Federal Way does not issue temporary Certificate of Occupancies. All construction projects may be required to have a pre-construction conference. If a pre-con meeting is required,all subs,the general or representative,the architect or representative,the engineer or representative, electrical contractor,and any other interested party, should attend this meeting. Meetings will occur at the Building Division and will be scheduled by the inspector of record for the project. F. Site Specific Requirements 1. Occupied roofs may have access to only one exit where such occupied areas are less than 500 square feet and are located no higher than immediately above the second story(UBC 1004.2.3.2 exp. 5). With the building permit application submit complete gravity load calculation and complete lateral analysis. When submitting engineering it shall be signed and stamp by a Washington State Registered Engineer. 3. Provide a soil report for the proposed single-family home. The soil report shall be submitted by a Washington State geotechnical engineer. When submitting engineering is shall be signed and stamp by such person(UBC 1804.3). 4. Please provide the elevation of water table per UBC Section 1804. NOTE: The information provided is based on limited plans and information.The comments provided are not intended to be a complete plan review and further comments are possible at time of building permit plan review. LAKEHAVEN UTILITY DISTRICT(Mary Young,253-946-5400,myoung(a,lakehaven.org) Water Issues 1. Water can be provided from 28th Avenue South.A meter application will be required. Sewer Issues 2. It appears that some sort of structure is proposed around or near the existing sewer manhole.In general, the existing sewer and/or associated easement may not be encroached upon by any structure or other impediment to maintenance of the sewer main.The sewer main in this area is very shallow and flat, which would preclude its relocation.The owner may wish to propose certain encroachments that might interfere only minimally with maintenance of the sewer line(i.e.,cantilevered building construction with sufficient height clearance over the sewer main).Any such encroachment is subject to review and approval by the District's Field Operations Supervisor. Should such approval be granted,the District will require execution of an encroachment agreement and payment of the required agreement deposit of $100.00.The encroachment agreement shall delineate the owner's responsibility for relocation and/or repair of any encroachments subject to damage from the District's maintenance of the sewer main. 3. A side sewer permit is required. General Comments The District's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units(ERU). One single-family residence is equal to one ERU.The District's current Capital Facilities Charges are $3,205/ERU for water and$2,721/ERU for sewer.Credit is available for this property from connection charges previously assessed under Utility Local Improvement District No.2 at the rate of 4.0 ERU per acre for sewer only. Fire hydrants shall be spaced 700 feet or less apart. Every building lot shall have a fire hydrant within 350 feet.All measurements shall be made as vehicular travel distance. Fire hydrants shall be in service PRIOR to and during construction. Automatic Fire Sprinkler Systems An automatic fire sprinkler system shall be installed in Group R,Division 3 occupancies: 1) When the occupancy exceeds 2,500 square feet(including attached garages)without adequate fire flow. 2) Without approved fire department access. 3) When the occupancy exceeds 10,000 square feet. 4) When the building is classified as an over-water structure. Comments The minimum fire flow for one-and two-family dwellings shall be 1,000 gallons per minute. If the slope of a building lot does not allow the building(s)on the site to comply with the"life safety/ rescue access"requirement,the building(s)shall be provided with an approved automatic fire sprinkler system.Life safety/rescue access shall mean an unobstructed access to all floor levels and each roof level of a building on not less than 20 percent of the building perimeter by utilizing a 35-foot ladder.An alternate method would be at least one stairway enclosure with exit doorways from each floor level and with a door opening onto each roof level which conforms to the requirements of the Uniform Building Code. NOTE: These fire department comments are valid for 180 days from review and only for the plans reviewed.
