Simpson: The City of Federal Way has completed the technical review of your shoreline permit application to construct a new 3, 030 square foot concession/toilet/life guard building, 10, 470 square foot paved shoreline promenade with beach stairs and illumination and related field improvements within the existing Steel Lake City Park abutting Steel Lake in Federal Way, Washington. The proposal is located on a 23 . 9 acre parcel at 2410 South 312th Street, adjacent Steel Lake, in Section 9, Township 21, Range 4 East, W.M. , King County, Parcel number 092104-9026. Pursuant to the State Shoreline Management Act (Act) and King County Shoreline Master Program (Program) , your Shoreline Substantial Development Permit application is hereby approved subject to the conditions noted below. Conditions of Approval : 1 . A building permit shall be obtained from the city prior to commencement of any activity related to this approval . 2 . Building permit shall include a temporary erosion control plan showing location of silt fencing or equivalent to protect integrity of Steel Lake. 3 . Building permit drawings shall be amended to show location of existing sanitary sewer and storm drainage lines as shown on drawing C-1 . 4 . Construction debris shall be disposed as required by the city. Construction debris shall not be placed on the beach. 5 . Building fire alarm, approved by King County Fire District #39, shall be installed in the concession building. 6 . All promenade illuminating shall be designed to prevent offsite glare. 7 . Promenade east landing shall be relocated to be at least 25 feet from Steel Lake ordinary high water mark. 8 . Utility permits shall be obtained from Lakehaven Utility District prior to commencement of any activity related to this approval . 9. Site plan must be signed/sealed by a state licensed Land Surveyor if topographic information is incorporated into the site plan. 10 . Provide document confirming stormwater runoff from existing onsite parking lots and roadways meet applicable water quality standards . Storm water treatment system retrofit for the entire site will be necessary if water quality standards are not met . Specifically, water runoff treatment facilities pursuant to Federal Way City Code (FWCC) Section 22-330 (a) (6) will be required. 11 . All drainage facility drawings shall be signed/sealed by a state licensed Engineer. 12 . CONSTRUCTION PURSUANT TO THIS PERMIT WILL NOT BEGIN OR IS NOT AUTHORIZED UNTIL THIRTY DAYS FROM THE DATE OF FILING AS DEFINED IN RCW 90 . 58 . 140 (6) AND WAC 173-14-090, OR UNTIL ALL REVIEW PROCEEDINGS INITIATED WITHIN THIRTY DAYS FROM THE DATE OF SUCH FILING HAVE TERMINATED; EXCEPT AS PROVIDED IN RCW 90 . 58 . 140 (5) (a) (b) (c) . The proposal is located adjacent to Steel Lake and is consistent with the Shoreline Management Act policies and King County Shoreline Master Program guidelines . The site is classified as a shoreline of the state by the Act and is located within a "Urban" shoreline designation, as identified in the County' s Program. Unless modified or appealed, this approval is valid for a period of one year from the date of the decision. If no further action is taken within one year of the decision, the decision will expire. A single one year extension may be granted only if a written request is submitted to the City Department of Community Development Services, 33530 First Way South, Federal Way, Washington, at least thirty (30) days prior to the expiration of the decision. This decision may be appealed by any person who received a copy of this decision. The appeal must be in the form of a letter delivered to the Department of Community Development Services, 33530 First Way South, Federal Way, Washington, and be accompanied by the established fee, within fourteen (14) calendar days after issuance of the decision. The appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusions of the Director of Community Development Services disputed by the person filing the appeal . A request for reconsideration of this decision may also be filed by any person who received a copy of the decision, within fourteen (14) calendar days after the issuance of the decision. This decision shall not waive compliance with future City of Federal Way codes, policies and standards relating to this development. This decision is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the permittee from compliance with any other federal, state, or local statutes, ordinances, or regulations applicable to this proposal, but not inconsistent with the Shoreline Management Act (Chapter 90 . 58 .RCW) . This decision may be rescinded pursuant to RCW 90 . 68 . 140 (7) in the event the permittee fails to comply with the terms or conditions contained in this decision. The proposal is located within 200 feet of Steel Lake. The related State Environmental Policy Act decision (determination of non-significance) was issued 3/3/95. FINDINGS 1 . The subject site is approximately 23 . 9 acres in size. 2 . Proposal is within 200 feet of Steel Lake, a shoreline of the state as defined by Washington Administrative Code (WAC) 173- 20-360 (3) and is regulated by the Washington State Shoreline Management Act and King County Shoreline Master Program. The King County Shoreline Master Program has been adopted as Federal Way' s Shoreline Master Program. 3 . Site is located in Federal Way' s "Urban" shoreline designation (adopted King County Shoreline Master Program) . Recreation uses are permitted in the Urban designation subject to a shoreline substantial development permit. 4 . Site is located in Federal Way' s "Open Space" Comprehensive Plan designation. 5 . Site is located in Federal Way' s residential (RS-7 .2) zone . Proposed demolition requires a shoreline and Process I approval. For reference, public parks are permitted in the RS- 7 .2 zone pursuant to Process III approval . 6. Current uses of the site and surrounding area include the following: Site: city park North: residential South: public school East: residential West: residential 7 . A environmentally sensitive area (open water wetland) has been identified within 100 feet of the proposal as defined by Federal Way City Code (FWCC) Section 18-141 . 8 . A State Environmental Policy Act determination of non- significance was issued 3/3/95. The commend period expired 3/18/95 and the appeal period expired 4/2/95. No comments or appeals were filed. 9. Proposed project includes a Preliminary Layout Plan North received March 3, 1995. 10 . Proposed construction is consistent with the Washington State Shoreline Management Act policies (Washington Administrative Code 173-14) and applicable King County Code (KCC) requirements (KCC Title 25) for shoreline development. Existing city park is classified as a "water enjoyment" use pursuant to RCW 90 . 58 . 020 and subsequent Washington State Department of Ecology interpretations clarifying water dependent, water related and water enjoyment uses . Existing public park is classified as a "recreation" use pursuant to KCC Title 25 . 16 . 200 . Recreation is defined by KCC Title 25. 08 . 390 as private or public development operated and devoted to facilities and equipment for recreational purposes, including but not limited to swimming pools, tennis courts, playgrounds, picnic areas, campgrounds, resorts and other similar uses whether the use of such area is limited to those paying a fee or free to the public. Recreation is allowed in the Urban shoreline designation pursuant to KCC Title 25. 16.200 . 11 . Existing public park is classified as a "public park" use by FWCC Section 22-646. Public parks are defined as natural or landscaped area, provided by a unit of government, to meet the active or passive recreational needs of people pursuant to FWCC Section 22-1 . 12 . Proposed development, application and attachments will comply with Federal Way Comprehensive Plan, pertinent zoning regulations and all other applicable City regulations as conditioned by Process I approval . 13 . Proposed development will embody good design principles that will not conflict with adjacent uses in the immediate area as conditioned by Process I approval . 14 . Proposed development will be consistent with Site Plan Review decisional criteria, FWCC Section 22-364 and Process I decisional criteria, FWCC Section 22-394 (b) as conditioned by Process I approval .
