Dear Mr. Decker:
On November 25, 2003,the City of Federal Way's Department of Community Development Services
received your request for information related to a proposed expansion of an existing single-family home
located on the eastern shore of Steel Lake.
You describe a proposal to expand by approximately 10 feet the existing footprint of the residence,
specifically along the eastern façade,towards 28th Avenue South and away from Steele Lake.You have
indicated that you believe there is approximately 30 feet between the eastern edge of your home and the
public right-of-way.
There are three major issues related to your proposal. Please be advised that in the absence of an
engineered survey showing the exact location of the Ordinary High Water Mark(OHWM),the existing
sewer line,all existing structures,and surveyed property corners, staff can only provide generalized
comments at this time.Nonetheless,the following information should provide useful direction concerning
your proposal.
ISSUE#1
Sewer Line Intrusion—According to the Lakehaven Utility District maps of the existing sewer line
in this area, it appears that a sewer line runs directly beneath your home.I have enclosed a map of
the sewer line that Lakehaven has provided. Please be aware that this mapping is general in nature;
it is possible that the sewer line transects your property in another area of the lot. If you chose to
formally pursue this project,you would be responsible for providing an accurate survey of the
property, specifically identifying the location of this sewer line, in order for the City of Federal
Way Building Division to issue a determination as to whether a building permit could be issued for
the project. For your information,the City will not issue a building permit for new construction
over a sewer or water utility line.
If the required survey indicates that the sewer line does in fact run under the existing structure, a
determination from the Building Division would be required as to whether this nonconformance
would be permitted to be compounded by adding to the structure. In addition,and most

significantly,you will need to contact Lakehaven Utility District in order to receive direction
regarding their policies and procedures in such instances. Lakehaven's involvement in this proposal
will be a significant component of the project's development. The phone number for the Lakehaven

ISSUE#2
Nonconforming Development Standards—Steele Lake is a regulated lake with 25-foot setback
requirements pursuant to Federal Way City Code(FWCC)Section 22-1332. It appears that the
structure in question may be located within this 25-foot setback. Pursuant to FWCC Section 22-
334(3)(c), for single-family residences,existing nonconformities may remain and continue so long
as the existing nonconformities are not being increased or expanded in any way. While the
proposed addition would potentially not be increasing the nonconformities related to regulated lake
setbacks(in that the proposed expansion on the east of structure would likely be outside of the
regulated lake setback), an expansion over a sewer line or an expansion that renders the sewer line
more inaccessible would likely be considered to be increasing the existing nonconformance and
would not be allowed.
If the property were found to be conforming as to the 25-foot regulated lake setback,the above
referenced issues related to Building Division regulations and Lakehaven Utility District
requirements would still apply.
Please be aware that a survey of the property must indicate the exact location of the existing
structure in relation to both the OHWM(definition enclosed)of Steel Lake and the property line
abutting 281h Avenue South. It is unclear at this time that there is adequate room to expand the
existing structure to the east, bearing in mind that there is a 20-foot front yard setback requirement
from 28th Avenue South.
ISSUE#3
Shoreline Management Act—Please be advised that as well as being a regulated lake under the
FWCC, Steel Lake is also subject to jurisdiction under the Shoreline Management Act. These two
separate regulations are not mutually inclusive, and any proposal within these areas of jurisdiction
shall be subject to review and regulation under FWCC Chapter 18,Article III, "Shoreline
Management,"and FWCC Chapter 22,Article XIV, "Environmentally Sensitive Areas" (see
above).
If the structure in question is on a lot where properties adjacent to both sides of the lot are
developed in single-family residences located less than 50 feet from the OHWM, and the structure
in question is locate the same distance from the OHWM as the adjacent residences or 30 feet from
the OHWM,then pursuant to FWCC Section 18-165, it would be considered to be conforming as to
the requirements of the City-adopted Shoreline Management Act, and the proposed expansion
would not require a shoreline variance. If the structure in question is nonconforming as to the
shoreline setbacks pursuant to FWCC Section 18-165,then according to FWCC Section 18-175, a
building permit to modify the nonconforming development may be approved only if the
modification will make the development less nonconforming, or the modifications will not make
the use or development more nonconforming.

If the development were found to be nonconforming as to the setback requirements under the
Shoreline Management Act, it might is likely that it would meet the criteria for exemption under
FWCC Section 18-175, in that development away from Steel Lake,outside of the setback area,
could not be construed as increasing the nonconformance as to setback.
Please be aware the issues related to sewer line nonconformance(i.e., if the structure is currently
on, or proposed to intrude into sewer setbacks),are not reflected in a determination as to
compliance with Shoreline Management Act setbacks.
In the absence of more detailed information related to the exact location of the sewer line,the property
lines,and the OHWM on this property,this is the extent of the City's capacity to comment on your
proposal. We will be happy to review additional information as it becomes available.

Dear Greg:
I talked to Jim Harris on November 20 regarding a proposed expansion to my house at
the address above. He recommended that I write a letter to you to get a written response
prior to spending money on architectural work. Here is the scenario.
My house is located 60 feet from the centerline of 28th Avenue on the east end of Steel
Lake. The property line is 30 feet from the centerline of the road and the east wall (front)
of my house is located another 30 feet from there. The front setback in RS7.2 requires 20
feet. Therefore, there is approximately 10 more feet from the required setback to the
current location of the front wall of my house in which I could expand my house.
My house is an existing non-conforming structure in that it is located less than 30' from
the edge of the lake on the west (back)wall. It is my desire to expand my house up to the
setback from the front(east)property line (approximately 10')the length of the house.
This expansion would take place on the opposite side from the lake and thus would not
increase the non-conformance in relation to the setback from Steel Lake.
