We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project, as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department,and representatives from Lakehaven Utility District and Federal Way Fire Department. Some sections of the Federal Way City Code(FWCC)and relevant information handouts are enclosed with this letter. Please be advised,this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. For specific technical questions about your project, please contact the appropriate DRC representative as listed below. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION Request to subdivide a vacant 5.5 acre parcel into eight residential lots of approximately 5,000 square feet in size,with a stormwater tract and cul-de-sac roadway.A wetland buffer reduction from 200'to 100' would be required. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided.The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Mr.Han Kim April 29,2004 Page 2 • Planning Division 1. The site contains or is adjacent to the following regulated environmentally sensitive areas: a category 1 wetland with a 200 foot buffer, a major stream with a 100 foot buffer, a regulated lake with a 25 foot buffer and is within the Urban Environment under the Shoreline Management Act 2. Wetland buffer reduction can only be approved by the Federal Way Hearing Examiner if provisions of FWCC Section 22-1359(f)are met. • Public Works Development Services Division 1. If the outfall of the stormwater detention facility flows into any wetlands from the wetland buffer,a level flow spreader shall be constructed for the outflow along the wetland buffer. 2. A full width overlay of South 304th shall be required if the pavement is open cut for water and/or sewer or other utility extensions. • Public Works Traffic Division 1. The applicant shall construct half-street improvements along South 304`h Street to meet current City street standards. 2. Access intersection must be located no closer than 150 feet to any other street intersection or driveway. 3. Submit an intersection sight distance analysis at the plat access intersection with South 304th Street. • Building Division Structures may not be built over the sewer line. • Lakehaven Utility District The existing sewer main and easement significantly encumber proposed lots four and five. It will be difficult to relocate this sewer main due to the minimal pipe slope and impacts on environmentally sensitive areas. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions please contact the representative listed for that section. PLANNING DIVISION(Deb Barker,253-661-4103,deb.barker@cityoffederalway.com) 1. Zoning, Use and Review Process—The site is zoned RS-5.0(Single Family Residential,one unit/ 5,000 square feet.). Proposed lot sizes must meet or exceed the minimum lot size of the zone. The site plan depicts 5,000 square foot lots in conformance with this requirement. 04-100513-PC Doc.I . 26084 Mr. Han Kim April 29,2004 Page 3 A subdivision of five or more lots requires review of and recommendation on the preliminary plat application by the City of Federal Way Hearing Examiner at a public hearing. The Hearing Examiner makes a written recommendation based on criteria listed under FWCC Section 20-126. Once the Hearing Examiner's review is complete,his recommendation is presented to the City Council Land Use/Transportation Committee(LUTC)at a public meeting. The LUTC makes a recommendation on the application to the City Council,who then makes the final determination on the preliminary plat, based on the criteria listed under FWCC Section 20-127. A preliminary plat checklist and master land use application are enclosed, along with applicable code sections from the subdivision code.' The 2004 preliminary plat application fee is $6,708 plus$67.50 per acre. The $389 preapplication review fee will be credited toward your plat application fee.The application must be prepared in accordance with the submittal requirements listed in the subdivision code and the enclosed information bulletin. Separate fees are required for Public Works engineering review and inspection. 2. State Environmental Policy Act(SEPA)—The proposed subdivision is subject to SEPA review'. As such, an environmental checklist must be submitted and reviewed prior to the City issuing an environmental threshold determination. Public notice of the environmental determination is also issued, which includes a 14-day comment and 14-day appeal period.A SEPA checklist and mailing label handout is enclosed. The 2004 SEPA checklist application fee is$817.00. 3. Environmentally Sensitive Areas—The subject site contains a category I wetland with a 200-foot buffer and erosion hazard soils. The site is adjacent to a major stream with a 100-foot buffer, a regulated lake with a 25-foot buffer, and is regulated by the Shoreline Management Act as the site is within 200 feet of the lake Ordinary High Water Mark(OHWM). The following provisions of FWCC Chapter 22, Article XIV—"Environmentally Sensitive Areas"and FWCC Chapter 18, Article III—"Shoreline Management"apply to this proposed development. a) Regulated Wetland The site contains a wetland;which, according to the 2000 Federal Way Wetland Inventory, is considered to be a category 1 wetland that requires 200-foot setbacks pursuant to FWCC Section 22-1357. The site plan for the proposed subdivision depicts lot, storm drainage pond,and right-of-way intrusions into the depicted 200-foot wetland buffer. This intrusion must be reviewed through Process IV, pursuant to FWCC Section 22-1359(f).The Federal Way Hearing Examiner may approve a request to locate an improvement or conduct a land surface modification in a wetland buffer only if all specific criteria are met and a wetland buffer enhancement plan to protect wetland buffer functions and values is approved. Use Process IV requires that the Hearing Examiner conduct a Public Hearing to review the project and determine that specific criteria have been met by the application in conjunction with preliminary plat review. ' Pursuant to FWCC Section 22.31(1)(k),preliminary plat applications are exempt from RCW 36.70B.060 through 36.70B.090, and 36.708.110 through 36.708.130.The City elects to provide a letter of complete application and public notice of application and decision notwithstanding this decision. 2 If a short plat were proposed,it would require environmental review as well due to the existence of environmentally sensitive areas on or within 200 feet of the subject site. 04-100513-PC Doc.1.D. 26084 Mr.Han Kim April 29,2004 Page 4 A wetland delineation that meets the requirements of FWCC Section 22-1356 must be submitted with the formal subdivision application. A buffer enhancement plan that utilizes appropriate native vegetation and clearly substantiates that an enhanced buffer will improve and provide additional protection of wetland functions and values per FWCC Section 22-1359(e) must also be submitted. City wetland consultant review of the wetland intrusion,enhancement plan,and subsequent monitoring of the approved project at the expense of the applicant shall be required in conformance with the FWCC. b) Major Stream The site is east of Redondo Creek,which is daylighted in the vicinity of the proposed plat. This stream,which flows into Puget Sound, meets the definition of a major stream in FWCC Section 22-1,and contains a 100-foot buffer. A stream survey prepared in conformance with FWCC Section 22-1306 must be prepared to identify the OHWM of the stream, and the 100-foot buffer from the OHWM. Please be advised that since the City does not have a stream biologist on staff,the City may retain a stream consultant to review the findings at the expense of the applicant as provided in FWCC Section 22-1243. Intrusions into the 100-foot stream buffer as provided for in FWCC Section 22-1312 et al,would be reviewed by the Federal Way Hearing Examiner in conjunction with the preliminary plat process. c) Regulated Lake The site fronts onto Steel Lake,which is defined as Hylebos#2 of the King County Wetland Inventory Notebooks Volume 3 South. All areas landward 25 feet in every direction from the OHWM of a regulated lake is defined as a setback area of the lake. The OHWM of the regulated lake must be identified on the formal application, and the 25-foot buffer from the ordinary high water mark depicted. All activity within the lake buffer is regulated under FWCC Section 22-1334,while activity proposed waterward of the OHWM is regulated under FWCC Section 22-1333. These would be reviewed under applicable review processes and disclosed in the environmental checklist. d) Shoreline The subject site contains a shoreline of the state under the Shoreline Management Act per FWCC Chapter 18,and which is further classified as an Urban Environmental Designation as defined in FWCC Section 18-164. The purpose of the Urban Environment is to ensure optimum utilization of shorelines of the state within urbanized areas,by permitting intensive use and by managing development so it enhances and maintains the shorelines of the state for a multiplicity of urban uses. Specific requirements found in FWCC Section 18-165(c)and(d)of the Urban Shoreline Designation include, but are not limited to: water dependent recreation uses and public utilities are the only development activities permitted waterward of the OHWM; development shall maintain the first 50 feet of property abutting a natural environment as required open space; and 50 foot setbacks shall be maintained unless modified. 04-100513-PC Doc.I . 26084 Mr. Han Kim April 29,2004 Page 5 The subdivision requires that an application for a shoreline substantial development permit be obtained as provided for in FWCC Section 18-170. The application is reviewed under Process III procedures and requires environmental review. Following a Process III decision by the Director of Community Development Services,the Washington State Department of Ecology reviews the shoreline permit application.No work can be done until the ecology review is concluded. Shoreline fees are $2,079.50 plus additional fees based on the value of the improvement. Refer to the enclosed fee sheet. e) Geologically Hazardous Areas According to the City's environmentally sensitive areas map,the site contains erosion hazard soils,which are defined as geologically hazardous areas in FWCC Section 22-1, "Definitions." The City regulates these areas and a corresponding 25 foot buffer pursuant to FWCC Section 22-1286. Soils reports, in conformance with FWCC Section 22-1286(c), must be provided with the formal applications. The report must contain specific recommendations for foundations and roadway systems for the plat. 4. Open Space Requirements—Pursuant to FWCC Section 20-155(b), a subdivision must provide open space in the amount of 15 percent of the gross land area of the subdivision site. On-site open space must include a minimum of 10 percent usable area, and must comply with the open space types and quantities specifically described in FWCC Section 22-155(a)through(c). A fee-in-lieu payment may be made to satisfy open space requirements at the discretion of the City's Parks Director after consideration of the City's overall park plan,quality, location,and service area of the open space that would otherwise be provided within the project. The fee-in-lieu of open space shall be calculated on 15 percent of the most recent assessed value of the property at the time of final plat. Usable open space design or fee options, along with provisions for access, improvements, ownership,and maintenance,will be reviewed in conjunction with review of the preliminary plat. Trails that are located in wetland buffers, if approved under FWCC Section 22-1359(d), and if approved by the Parks Director, may be used to provide usable open space as required under the FWCC. 5. Significant Trees, Vegetation, and Grading—All existing significant trees and natural vegetation must be retained on the site to be subdivided,except that which will be removed for improvements or grading as shown on approved engineering plans. Clearing and grading of individual future lots is not permitted during construction of the plat infrastructure, except in locations to be determined by the City that presents extreme topography or other unusual conditions. A preliminary clearing and grading plan shall be submitted as part of the preliminary plat application(FWCC Section 20-179). It is the applicant's responsibility to demonstrate that the grading limits are the minimum necessary to accommodate infrastructure improvements. Also, note that trees defined as significant by the FWCC shall be identified and retained or replaced at the rate of at least 25 percent of the significant trees on the site. Removal of significant trees that are located within areas to be developed for rights-of-way or other plat utilities are exempt from the 25 percent retention calculation. The application must include an inventory of significant trees presently on the site,and the plat design shall accommodate existing significant trees to the maximum extent possible. 04-100513-PC Doc.1.D, 26084 Mr.Han Kim April 29,2004 Page 6 A landscape plan prepared by a licensed landscape architect,and consistent with FWCC Section 20- 186, must be submitted with the preliminary plat application.The plan shall identify the following: significant trees to be removed and retained; street trees along the internal plat streets; and landscaping around all sides of the proposed detention pond(FWCC Section 20-178). 6. Lot Design—Street and access easement improvements must meet the requirements contained within FWCC Sections 20-176 to 20-187. Included within these requirements are provisions for landscaping, utilities, and storm drainage.The minimum lot frontage is established at 30 feet unless shared access easement provided.3 Structural setbacks are 20 feet front yard, and five feet side and rear yard. Corner lots shall only have one front yard setback requirement, with the other yards established as side or rear. 7. Drainage—Drainage facilities, including above ground conveyance ditches, must be established in formal tracts and shall not be part of an easement associated with a parcel. Any formal storm drainage tracts shall be screened from adjoining lots and rights-of-way with vegetation to be maintained by the homeowner's association. 8. Public Notice—With the application,provide three sets of stamped addressed envelopes for property owners within 300 feet of the subject site.Also provide one set of stamped addressed envelopes for occupants of non-owner occupied units within 300 feet of the site. Include the City of Federal Way return address on all envelopes.4 For our records, provide lists of the owners and occupants within 300 feet of the subject site and provide a corresponding parcel map showing the 300-foot radius from the subject site. 9. School Mitigation Fees—Payment of a school impact mitigation fee is required for each single- • family residence at the time of issuance of individual residential building permits. The current single-family residential mitigation fee is $3,269.00 per dwelling unit. The school mitigation fee is reviewed annually by the Federal Way School District and City Council. 10. Walking Areas—A copy of the application packet has been forwarded to the Federal Way School District for review of school pedestrian access and circulation. A memo from the school district will be forwarded to you upon receipt.A school access analysis is required in conjunction with the preliminary plat application. 11. Final Plat—The City currently requires a$2,475.00 application fee for final plat.The final plat fee, in effect at the time of the final plat application, is required to process the final plat. Substantial completion of the plat infrastructure must occur prior to submittal and processing of the final plat. The City allows bonding of only minor improvements identified in FWCC Section 20-135 in order to process the final plat. FWCC Section 20-136 requires City Council review of the final plat. 3 This provides for a 20-foot wide driveway with five-foot wide side yard setbacks. 4 City of Federal Way,Department of Community Development Services,PO Box 9718,Federal Way,WA 98063-9718 04-100513-PC Doc.I . 26084 Mr.Han Kim April 29,2004 Page 7 PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kim Scattarella,P.E.,253-661-4132, kim.scattarella@cityoffederalway.com) Land Use Issues—Stormwater 1. Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual(KCSWDM), and the City of Federal Way Addendum to the 1998 KCSWDM. This project meets the requirements for a Full Drainage Review. The project lies within a Level 1 flow control area,thus the applicant must design the flow control facility to meet this performance criteria. The project also lies within a basic water quality area. Water quality treatment shall be designed to meet the treatment criteria of the Basic Water Quality Menu.A larger area and more suitable location of the proposed stormwater tract than was shown on the original site plan is suggested. 2. At the time of land use site plan submittal,a preliminary Technical Information Report(TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1"= 100', five-foot contour planimetric maps, or 1"=200' drainage basin maps that may be used for basin analysis. 3. Soil logs will need to be provided to verify infiltration suitability. 4. For subdivisions within the City of Federal Way,the detention and water quality treatment facility is required to be an open pond within a separate storm drainage tract,dedicated to the City for future maintenance.The water quality treatment system shall also be within a tract to be dedicated to the City. Both detention and water quality facilities may be within the same tract.For private commercial developments,the flow control and water quality facilities may be placed underground. 5. Show on the preliminary plans,with dimensions,the proposed location of the detention and water quality facilities. Right-of-Way Improvements 1. See the Traffic Division comments from Raid Tirhi, P.E., Senior Traffic Engineer,for traffic related items. 2. If dedication of an additional right-of-way is required to install street frontage improvements,the dedication shall be conveyed to the City through a Statutory Warranty Deed. The dedicated area must have clear title prior to recording. 3 All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 4. Frontage improvement requirements apply to the parcel's entire street frontage,not just the portion of the site that is being developed. 04-100513-PC Doc.I . 26084 Mr.Han Kim April 29,2004 Page 8 5. FWCC Section 16-47 requires that overhead utility lines be relocated underground if over 500 feet, or three spans are affected by a public works project. This condition will be applied to South 304th Street. 6. A full width overlay of South 3041h Street shall be required if the pavement is open cut for water and/or sewer extensions. Building(or EN)Permit Issues 1. The"Federal Way Development Standards Manual"(including standard detail drawings, standard notes,and engineering checklists) is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 2. A final TIR shall be prepared for the project and submitted with the permit application. The final TIR will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 3. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. 4. The applicant shall reimburse the City for the cost of all required regulatory,warning, and street name signs that are installed, prior to acceptance by the City of all other required improvements. 5. Bonding is required for all improvements associated with the project.The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount for a two-year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities(including the detention and water quality facilities),and street systems for the two-year maintenance period. During that time,the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. 7. When topographic survey information is shown on the plans,as may be required,the vertical datum block shall include the phrase"DATUM:N.G.V.D.-29"or"DATUM: K.C.A.S.,"on all sheets where vertical elevations are called out. 8. All drawings shall be drafted/plotted on 24"x 36"or 22"x 34"Mylar sheet with permanent black ink. Drawings submitted for plan review shall be printed on 24"x 36" or 22"x 34" paper. Site plans shall be drawn at a scale of 1"=20',or larger.No architectural scales are permitted on engineering plans. 9. Provide cut and fill quantities on the cleaning and grading plan. Erosion control measures,per Appendix D, 1998 KCSWDM,must be shown on the building set plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. 04-100513-PC Doc.ID. 26084 • Mr. Han Kim April 29,2004 Page 9 PUBLIC WORKS TRAFFIC DIVISION (Raid Tirhi,253-661-4142, raid.tirhi@cityoffederalway.com) 1. Per FWCC Section 22-1474,the applicant/owner would be expected to construct half-street improvements consistent with the planned roadway cross-sections as shown in Map III-7 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19. At a minimum,the applicant would be expected to construct half-street improvements on the following street: • South 304th Street is a Type"M" street, consisting of a 36-foot street with curb, gutter, six-foot planter strip with trees, eight-foot sidewalk, and street lights in a 70-foot right-of-way. 2. The applicant may make a written request to the Director of Public Works to modify, defer, or waive the required improvements. 3. Tapers and transitions beyond the project frontage may be required,as deemed necessary for safety purposes. Taper rate shall be based on WSDOT Design Manual; WS^2/60 or AASHTO as directed by the Public Works Director. 4. The applicant/owner shall dedicate sufficient public right-of-way across entire street frontage (South 304th Street),to widen and improve the abutting public street to the adopted City street standards. Right-of-way dedication shall be conveyed to the City through a Statutory Warrant Deed and must have clear title prior to recording. 5. All internal streets shall be Type W streets, consisting of a 28-foot street with curb, gutter, four-foot planter with street trees, five-foot sidewalk, and streetlights in a 52-foot right-of-way. 6. Per FWCC Section 22-1543, access driveway must be located no closer than 150 feet to any other street intersection or driveway. To meet these requirements,the following mitigation options may be used to create safer driveway designs: • Relocate driveway to provide the maximum separation so that the closest edges are no closer than 150 feet from the nearest edge of adjacent intersection. • Align the proposed driveway to match with existing intersection across the street. 7. Please note that the City is in the process of developing a Traffic Impact Fee(TIF)system,which is expected to be complete by the winter of 2004. This project may be required to pay traffic impact fees at the time of building permit. 8. Submit an intersection sight distance analysis at the plat access intersection with South 30411 Street. Analysis shall be conducted by a civil engineer licensed in the state of Washington. The sight distance triangle shall be depicted on the channelization plans. 9. It appears that there is a 30-foot right-of-way or road easement across the subject property. The applicant needs to research this with King County records and vacate any City property across this property. 04-100513-PC Doc.1.D. 26084 Mr.Han Kim April 29,2004 Page 10 BUILDING DIVISION(Scott Sproul,253-661-41222,scott.sproul@City of Federal Way.com) Structures may not be built over the sewer line. LAKEHAVEN UTILITY DISTRICT(Mary E.Young,253-946-5400,myoung@lakehaven.org) Water Issues: A developer extension agreement will be required to extend mainline water facilities to serve the site. Owner should apply separately to the District for this process at the same time formal application is submitted to the City of Federal Way to avoid delays in construction. Please allow 3 to 4 months for plan review and approval. Sewer Issues: A developer extension agreement will be required to extend mainline sewer facilities to serve the site. Owner should apply separately to the District for this process at the same time formal application is submitted to the City of Federal Way to avoid delays in construction. Please allow three to four months for plan review and approval. The existing sewer main and easement significantly encumber proposed lots four and five. General Comments: The District's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU). One single-family residence is equal to one ERU. The District's current Capital Facilities Charges are $3,212/ERU for water and$2,702/ERU for sewer.Credit is available for this property, from connection charges previously assessed under Utility Local Improvement District No. 2, at the rate of 4.0 ERU per acre for sewer only. FEDERAL WAY FIRE DEPARTMENT(Greg Brozek 253-946-7241,Greg.Brozek@federalwayfire.org) Water Supplies For Fire Protection A Certificate of Water Availability shall be provided indicating the fire flow available at the site. Fire hydrants shall be spaced 700 feet or less apart. Every building lot shall have a fire hydrant within 350 feet.All measurements shall be made as vehicular travel distance. Fire hydrants shall be in service PRIOR to and during construction. Fire Apparatus Access Roadway Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 feet from fire apparatus vehicle access. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25-ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 04-100513-PC Doc.ID.26084 St Mr.Han Kim April 29,2004 Page 11 3) Shall be not less than a 20-foot inside turning radius and not less than a 40-foot outside turning radius. 4) A dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or Fire Department approved alternative at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 15 percent. 6) A single residential property,which has a dead end in excess of 150 feet in length, shall be provided with a turn around approved by the chief. (KCFD#39 Administrative Policy Guideline No. 1006) EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system,these provisions may be modified by the chief Fire apparatus access road gates shall comply with KCFD#39 Administrative Policy Guideline No. 1001. Automatic Fire Sprinkler Systems An automatic fire sprinkler system shall be installed in Group R,Division 3 occupancies: 1) When the occupancy exceeds 2,500 square feet(including attached garages)without adequate fire flow. 2) Without approved fire department access. 3) When the occupancy exceeds 10,000 square feet. 4) When the building is classified as an over-water structure. Comments: The minimum fire flow for one-and two-family dwellings shall be 1,000 gallons per minute.If the slope of a building lot does not allow the building(s)on the site to comply with the"life safety/rescue access"requirement,the building(s) shall be provided with an approved automatic fire sprinkler system.
