Existing Zoning: RS-7.2 Comprehensive Plan Designation: Suburban Residential Pursuant to WAC 197-11-340(2), the City of Federal Way is required to send the environmental determination that results from this environmental review, along with the checklist, to the Department of Ecology and other agencies with jurisdiction. Therefore, the City will not act on the proposal for fifteen days after issuance of the environmental threshold determination. A. Background: 1, 2. The formal short plat application was taken out in the name of William Wilson and is called Wilson's Short Plat. 3. Wilson's address is 5601 225th SW, Mount Lake Terrace, WA 98043 5. The agency requesting the checklist is City of Federal Way Community Development Services. 7. Future activity may include the construction of a residence on the new lot created with the short plat process. 10. Future development of the proposed lots will be subject to all applicable codes, policies and development regulations. 11. Lot 1, Block 4 of Steel Lake Terrace is proposed to be subdivided into two 7280 square foot lots. The site zoning is RS-7.2, with the minimum lot size 7200 square feet. B: Environmental Elements: 1. Earth: a: The site is generally described as flat and rolling. A one story house is currently situated on the eastern portion of the site facing 28th Avenue South. The proposed short plat will provide two single family residential lots, one which is appropriate for future development. A building permit will be required, as well as right of way permits for required street improvements. b. Concur with checklist: Approximately eight percent. c: The soils on this site are mapped as Alderwood Gravelly sandy loams (AgB) by the USDA Soils Conservation Service 1973 Soil Survey. Runoff with this type of soil is classified as slow and erosion hazard is slight. d: Concur with checklist. e: Concur with checklist: Grade and fill activities during future construction will be designed and constructed in accordance with the City's regulations for erosion and sedimentation control. f: The site is located in the Central Lower Puget Sound Sub Basin. King County sensitive area maps and site inspection do not reveal the site to be a problem area relative to landslides, seismic hazards, erosion, wetlands, or 100-year floodplains. g: Impervious surface allowances for the single family residence will be subject to lot coverage provisions of the Federal way City Code (FWCC) h: A Temporary Erosion and Sedimentation Control (TESC) plan is required to be approved and implemented in conjunction with filling and grading activities, in accordance with the City's engineering standards, using the appropriate methods under the King County Surface Water Design Manual (KCSWDM). 2. Air: a: Short term impacts to air quality will occur during construction and paving operations. Longer term impacts due to vehicle emissions will vary in level according to the amount of traffic generated in the future by the proposal. Construction activity, especially site preparation work, will contribute to a short term increase in local suspended particulate levels. Construction activity also contributes to carbon monoxide levels through the operation of construction machinery, the use of trucks to deliver equipment and materials, and worker access to the site by automobile. These activities also involve emissions of hydrocarbons and oxides of nitrogen, potentially elevating the level of photochemical oxidants, such as ozone, in the ambient air. Natural gas mains up to 2 inches in diameter are installed in the right-of-way of South 311th Street and 28th Avenue South. It is not known whether wood stoves or fireplaces are proposed. b: Concur with checklist. c: Compliance with local, state and federal air quality standards will provide sufficient mitigation of the potential onsite impacts of construction activities or heating methods. In addition, retention of significant trees and vegetation will provide filtering of suspended particulates. 3. Water: a. Surface: The site is located approximately 1000 feet southwest of wetland number Hylebos 2, (known as Steel Lake), a class 1(C) wetland per King County wetland inventory. b. Ground: Structures that increase the impervious surface area by 500 feet or more must provide runoff control by tight-lining to an approved storm drainage system. The City of Federal Way requires the use of on-site infiltration systems for runoff control where the appropriate soil conditions exist. Sewer service is available to the newly created lot via side sewer connection to the existing mainline in South 311th Street. c. Water Runoff: The checklist indicates that "sheetflow from 28th Avenue South will be absorbed into the ground in the right of way ditch". As with all paved developed areas, the project site will contribute pollutants to ground and surface waters through runoff from required right-of-way improvements, buildings, driveways, patios and other impervious surfaces. Future improvements and associated traffic will discharge oils, grease, antifreeze and metals into the ground and surface waters. The City Short Plat process requires implementation of adopted road standards. The proposed short plat fronts two roads that do not meet current road improvement standards. FWCC section 22-1473 requires full width right-of-way improvements along South 311th Street, a minimum paving width of 28 feet, vertical curbs and five foot sidewalks with a minimum four foot wide utility/landscaping strip. Full width right-of-way improvements along 28th Avenue South are also required with a minimum 60 foot wide right-of-way, minimum paving width of 40 feet, vertical curbs, street lighting, and five foot sidewalks with four foot utility/landscaping strips planted with street trees. If fully developed, these right-of-way improvements may create up to 4000 square feet of impervious area. It is assumed that future house and driveway improvements on lot B could create up to 3000 square feet of impervious area. The whole project has the potential to create more than 5000 square feet of impervious surfaces. If the short plat is approved without modification, the applicant shall be required to provide storm water drainage improvements applicable under the 1992 King County Surface Water Design Manual (KCSWDM), including surface water detention, biofiltration, and oil/water separation to mitigate identified impacts. Some pollutants could be separated out of the storm water runoff, to a certain extent, by installing oil/water separators in on-site catch basins, and/or by the use of grass-lined swales for pretreatment and conveyance. The project must be designed to comply with all applicable Core and Special Requirements outlined in the KCSWDM. The site is located in the Central Lower Puget Sound Sub-Basin, as identified in the Executive Proposed Hylebos Creek and Lower Puget Sound Basin Plan. This Basin Plan, while a draft, is the best tool available to identify surface, ground and water-runoff impacts. The City of Federal Way uses the Basin Plan to guide development and identify impacts. The Basin Plan recommends storm drainage enhancements to adequately mitigate the effects of development on water quality, flooding, and downstream erosion in the Central Lower Puget Sound Sub-Basin. Specifically, basin wide recommendation BW-2 calls for the use of the 2-year and 10-year 7-day rainfall events for sizing the required detention facilities, as opposed to the standard 2- year and 10-year 24-hour events. In addition, the BW-2 plans uses a modified time of concentration that utilizes interflow. The standard thirty percent factor of safety is not required. Short plat improvements may create impacts that require mitigation under guidelines used by the City. If the project generates more than 5000 square feet of impervious surfaces, the applicant will be required to provide the applicable storm water drainage improvements, including requirements of the King County Surface Water Design Manual and the recommendations in the Basin Plan. 4. Plants: Vegetation on-site consists of several large fir trees, grass and domestic shrubs. The rear of this site backs up to a wooded portion of Steel Lake Park. Trees that meet the City code definition of "significant" must be identified and retained in accordance with code requirements. 5. Animals: The site is adjacent to Steel Lake Park, a 52 acre multi-use park facility, that includes Steel Lake. Portions of Steel Lake serve as a part of a bird migration route. The lake is approximately 1000 feet from the short plat site. Based on information provided in the environmental checklist and site inspection by city staff, no threatened or endangered species are know to inhabit this site. 6. Energy and Natural Resources: Concur with checklist. Energy provisions for the development will conform to applicable local, state and federal regulations. 7. Environmental Health: a: The site is located outside of Ldn 65 Noise Contour of the Sea-Tac Airport Future Noise Exposure map for 1996. b: Noise levels created by the project will increase in a short term basis during construction activity. These will be controlled by required conformance with local noise ordinances that regulate hours of construction. A minor increase in noise levels due to traffic generated by the development is expected on a long term basis. 8. Land and Shoreline Use: a. A single family residence currently exists on the site. Single family residences are on the west, north and east of the site. South of the site is Steel Lake Park. b. Concur with checklist. c. The existing house is approximately 1000 square feet. A small wooden shed is west of the house. d. The shed sits within the required side yard setback of the proposed lot A. It is the applicants intent to relocate or demolish the shed to conform to code requirements. Removal or relocation of the shed will be required prior to the time that the short plat is recorded. e. Concur with checklist. (RS-7.2) The proposed lots will conform to zoning regulations. f. The comprehensive plan designation of the site is Suburban Residential. Proposed residences will comply with zoning regulations. g. Concur with checklist. h. Environmentally sensitive areas are not present on this site. i. Aesthetics: Construction of a single family home on the site will be subject to applicable zoning regulations. Bulk and height of the structure will be subject to regulation for lot coverage and maximum height. It is anticipated that the future development of the lot will be compatible with the middle income character of the neighborhood. 11. Light and Glare: Levels of light normally associated with single family residences and corresponding traffic is anticipated. No significant impact on light and glare is anticipated as a result of the single family residence. 12. Recreation: a. Designated and informal recreational opportunities in the immediate vicinity include Steel Lake Park, Steel Lake Fire Station Recreation Center, Steel Lake Annex, and a running track at Continuation High School. b. Concur with checklist. c. The City of Federal Way Subdivision ordinance requires that all subdivisions provide open space in the amount of 15 percent of the gross land area of the subdivision site; or if the site is five acres or less in size, an optional fee in lieu of providing the open space is available via City Code Article II mitigation of Development Impacts. The applicant will be required to comply with the provisions of the selected code option. 13. Historic and Cultural Presentation: Concur with checklist. 14. Transportation: a. The site is located on the south west corner of 28th Avenue South and South 311th Street. 28th Avenue South is classified as a Residential Collector. South 311th Street is designated Neighborhood Access. b. The nearest METRO transit stop is located on South 312th approximately one block south of the site. c. Concur with checklist. d. Right of way dedication at the corner of South 311th and 28th Avenue South is required with the subdivision approval. Right of way improvements in accordance with FWCC ssection 22-1525 would be required at the time lot B is improved. 15. Public Services: As with all new development, the site will increase the demand for public services. Normal use of the site is not expected to significantly effect existing service levels of the City's Police and Fire Departments. 16. Utilities: Federal Way Water and Sewer indicate that water and sewer service is available to lot B from mains located in South 311th Street. Connection would be through side service installation. C. Conclusion: The proposal can be found to not have a probable significant adverse impact on the environment if appropriate conditions are properly implemented pursuant to a Mitigated DNS. Conditions of the MDNS are based upon impacts identified within the environmental checklist, attachments, and the above "FINAL STAFF EVALUATION FOR ENVIRONMENTAL CHECKLIST", and are supported by Plans and regulations formally adopted by the City for the exercise of substantive authority under SEPA. Proponent: William Wilson Location: 31105 - 28th Avenue South, Federal Way, WA Lead Agency: City of Federal Way The Responsible Official of the City of Federal Way hereby makes the following Findings of Fact based upon impacts identified in the environmental checklist and the "Final Staff Evaluation for Environmental Checklist; Application No: SEP-94-0003" and Conclusions of Law based upon the Federal Way Comprehensive Plan and other municipal policies, plans, rules, and regulations designated as a basis for exercise of substantive authority under the Washington State Environmental Policy Act Rules pursuant to R.C.W. 43.21C.060. Findings of Fact: 1. The "Final Staff Evaluation for Environmental Checklist Application No: SEP-94-0003 is hereby incorporated by reference as though set forth in full. 2. The proposed action is to sub-divide lot 1, block 4 of the plat of Steel Lake Terrace into two 7,280 sq. ft single family residential lots. 3. There is an existing residence on the eastern portion of proposed lot A. 4. An existing shed will be relocated or demolished to conform to City code requirements. 5. The City short plat process requires implementation of adopted road standards. The proposed short plat fronts two public roads that do not meet current road improvement standards. With associated improvements, the project has the potential of creating more than 5000 square feet of impervious surface. 6. The site is located in the Central Puget Sound Sub-Basin Planning area which recommends storm drainage enhancements to adequately mitigate effects of development on water quality, flooding, and downstream erosion. Conclusions of Law: 1. Allow residential development only when supported concurrently by adequate services including roads, utilities, transit, parks, recreation, schools, fire and police (policy H-4, FWCP). 2. Establish regulatory measures to prevent flooding (policy NE-17, FWCP). 4. Assure for all people of Washington safe, healthful, productive, aesthetically and culturally pleasing surrounding (policy 10.230.20(2) Federal Way Environmental Policy Ordinance). The lead agency for this proposal has determined that the proposed action does not have probable significant adverse impact on the environment, and an Environmental Impact Statement (EIS) is not required under R.C.W. 43.21C.032(2)(c), only if the following conditions are met. This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. Condition: 1. Runoff: As with all paved, developed areas, the sites will contribute some pollutants to ground and surface waters as these will be washed off by storm drainage across the site. Pollutants which accumulate on paved surfaces include heavy metals, petrochemicals and other substances. Some of these pollutants could be separated out of the storm water runoff n tors in the on-site catch basins or lined biofiltrationt, by installing oil/water swales to transport runoff off site or into on-site detention/retention grass- , P ponds/tanks.
