The proposed 27 foot mobile trailer is to be attended by a Goodwill Industries employee between the hours of 8:30 a.m. and 5:00 p.m. to accept donations and maintain the mobile facility. Formal plans for the proposed donation station were submitted on April 10, 2009. The zoning for the site is Comrriercial Enterprise(CE). The Process I application is hereby conditionally approved. FINDINGS Due to the frequently mobile nature of the proposed accessory use to the Walmart Super Center, it has been determined that the proposed donation station does not meet the definition of "Outdoor storage containers"as defined by Federal Way Revised Code(FWRC) 19.05.150, "0 definitions,"and is therefore not governable under FWRC 19.125.180"Regulation of outdoor storage containers for permanent accessory storage."The accessory outdoor use was reviewed as an administrative Land Use Process I as prescribed by FWRC 19.125.170, "Commercial and industrial uses,"as it does not meet the exemptions of FWRC 19.125.170(4). It has been determined by the Director of Community Development Services that screening' is not necessary if all materials and donated goods are contained within the mobile trailer. Furthermore, the mobile donation station must be situated in a visually unobtrusive location of the proposed site and must be located outside of any drive aisle. As shown on the site plan submitted on April 10, 2009,the mobile donation station has been proposed to be placed in the southwest corner of the lot. The location fronts an interior roadway and does not front a right-of-way. Due to the location, it has been deemed that the donation station is not visually intrusive and does not alter the character of the previously approved developed site. The donation station must be manned during hours of operation. 3. The donation station, donated goods, and any/all material related to the donation station must be clear from all drive-aisles. This decision shall not waive compliance with future City of Federal Way codes,policies, and standards relating to this site. The effective date of this decision is April 27,2009 (three days from the date of this letter). Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by May 11,2009. Please be aware that no work on the proposal can commence until the end of the appeal period. However,in that you are the only party of record,you may waive your right to appeal this decision. The City must receive this waiver in writing. Waiver of the right to appeal does not affect the effective date of this decision. Therefore, if you choose to waive your right to appeal, you could begin work on the proposal as soon as the waiver is received by the city. The total hourly Process I application fee is $79.50(one hour at$79.50 per hour). The$79.50 deposit paid at the time of application covers this fee. The station is a 27' trailer, with professionally prepared graphics, (see attached flyer) and a set of stairs. The station has an attendant on site 7 days per week from 8:30 am until approximately 5:00 pm. Part of the attendants duties are to keep the site neat and orderly as well as greet donors and accept their donations. No sales occur on site...this is purely a collection site. Goodwill has been very successful utilizing Attended Donations Stations as it allows donors to easily and conveniently make their donations...most on a repeat basis. They prefer making smaller donations...on their schedule...at our sites, making it very easy to donate. Most of our donors make frequent donations and feel more active in supporting their community. Our attendants are trained, customer service oriented and are happy to accept donations. They take pride in their site and it shows! Also the attendant's presence on site enhances the security aspect for the store and its customers.
