After evaluating the existing conditions along the referenced streets, review of Federal Way City Code(FWCC)provisions(Sections 22-1477, 22- 1496, 22-1544), and direction provided by the City Council, the Public Works Department hereby approves the following roadway modifications: Since the existing driveway configurations of neighboring properties along 13t Place S will not allow driveway access for this site to meet the required 150' spacing, the applicant may install a driveway at approximately half-way between the north and south property lines. This configuration will allow for the best possible distance between accesses and is within the Public Works Director's authority to modify under FWCC 22- 1544(1), which allows reduction of the spacing standards by up to 20%. The existing driveway onto 13h Place S shall be closed. The conditions of this right-of-way modification will be applicable for a period of one year from the date of this letter. If a building permit is not issued within the one-year time limit, this waiver will be void, and a new request for modification must be submitted. After evaluating the existing and proposed conditions, review of Federal Way City Code (FWCC) provisions (Sections 22-1474, 22-1477, 22-1496), and direction provided by the City Council, the Public Works Department hereby approves the request to waive street improvements, based upon the following code section 22-1477 (1): The improvements as required would not be harmonious with existing street improvements, would not function safely or would not be advantageous to the neighborhood or City as a whole. The Comprehensive Plan designates 13th Place South as a Type "R" street, consisting of a 40-foot street with curb and gutter, four-foot planter strips with street trees, six-foot sidewalks, and street lights in a 66- foot right-of-way. Existing improvements along 13th Place South consist of a 48' street with eight-foot sidewalk abutting the curb, all within a 64' right-of-way. Full improvements as required would not be harmonious or function safely with the existing improvements. As stated in the City's preapplication conference letter, dated July 20, 2007,the applicant will be required to dedicate one foot of right-of-way,and install streetlights and street trees behind the sidewalk.
