Dear Mr.Palm:
The City's Planning Division has completed an administrative land use review of the proposed food cart
located at the existing Home Depot retail store at 1715 South 352"Street.The proposed food cart will be
an accessory use to the Home Depot store.The Comprehensive Plan and zoning designation for the
subject property is Commercial Enterprise(CE). The existing retail use is permitted per Federal Way City
Code(FWCC) § 22-866. The Process I application was submitted and determined to be complete on May
12,2008.The City's Department of Community Development Services hereby approves the Process I
application.
FINDINGS
1. As shown in the Process I submittal packet,the proposed improvements include the placement of
an 8'x12' food cart in a portion of the Home Depot's designated loading area.As proposed,the
placement of the food cart does not block drive or fire lanes.
2. The proposed improvements do not reduce required parking, landscaping,buffering,open space,
or public areas; do not change the location of utilities or easements;and create no impacts to
sensitive areas or significant trees.
3. The City's Building Division has indicated an electrical permit and sign permit will be required.
4. The South King Fire and Rescue District has indicated a fire extinguishing unit is required for the
food cart.A fire prevention permit is also required.
Based on the City's review,the Process I land use application for the installation of the food cart is
approved.
APPEALS
The effective date of this decision is June 21,2008,or three days from the date of this letter.Pursuant to
FWCC § 22-368, any person who received notice of this administrative decision may appeal the decision
to the Federal Way Hearing Examiner by July 5,2008.Any appeal must be in the form of a letter
delivered to the Department of Community Development Services with the established fee. The appeal
letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in
the Director's decision, including the identification of specific findings and conclusions made by the

Director disputed by the person filing the appeal.No work on the proposal can commence until the end of
the appeal period. However, in that you are the only party of record,you may waive your right to appeal
this decision. If you wish to waive your right to appeal,you must do so in writing to the attention of
Associate Planner Matthew Herrera.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes,policies,and
standards relating to this development. This Process I approval does not constitute approval of a building

Dear Ms. Van Dyke:
The City of Federal Way's Department of Community Development Services is in receipt of the Process I
`Director's Approval' Master Land Use Application with regards to the above-referenced Johnnie's Dog
House development project. Site improvements included in the May 12, 2008, application consist of a 96
square-foot pre-fabricated mobile food cart to be an accessory use to the existing Home Depot retail
establishment. The subject site's Comprehensive Plan and zoning designation is Commercial Enterprise
(CE).
TECHNICAL COMMENTS/REQUEST FOR ADDITIONAL INFORMATION
The City's Development Review Committee (DRC)has reviewed the application materials and provided
comments below. If you have questions about an individual comment, please contact the appropriate
department representative noted below.

• Please indicate the specific type of hood vent that will be used for the food cart.Type I hoods cannot
vent beneath the Home Depot canopy. A Type I hood would require 10 feet of separation from the
building.
• Please show details of how the structure will be tied-down.
The following comments regarding additional permits are for informational purposes only and are not
required for Process I approval. These permits can be submitted anytime, but will need to be approved
prior to installation of the food cart.
1. Building Permit A separate building permit will be required. The permit application must show
how the structure will be tied down.
2. Electrical Permit —A separate electrical permit may be required.
3. Sign Permit—A separate sign permit will be required. Please find the enclosed signage section of the
FWCC. If you have questions regarding the City's sign requirements, please contact a Development
Specialist at 253-835-2607.

any service connections.
CLOSING
The applicant responses to identified technical comments for the Process I application are necessary
before `Director's Approval' can be granted. When resubmitting materials required for the Process I
application, please use the enclosed green resubmittal form. Pursuant to FWCC § 22-34, if an applicant
fails to provide additional information to the City within 180 days of being notified that such information
is requested, the application shall be deemed null and void and the City shall have no duty to process,
review, or issue any decisions with respect to such an application.

Looking at the submitted material I notice the words fries on the building and a exhaust hood on the roof. This
exhaust hood can not vent under the over hang of the building, it will have to extend up through the building
and vent on the roof
also please contact Chris Ingham at South King Fire for requirements for a sprinkler system.

As you know, we are currently working with Johnnie's Dog House to place a mobile food unit at
the Home Depot Store#4703 in Federal Way, WA.
The trailer that we would like to place at this location is 8' x 12' in size and has all of the
following items, just to list a few ... screened windows, all NSF equipment, ALL stainless steel
counters, shatter proof bulbs, 6" base cove, easy to clean walls, sinks large enough to wash,
rinse, and sanitize the largest utensil, along with the items that you would request for meeting
your local codes.
We have included the following items for your review:
• A completed Master Land Use application form
• Six copies of the site plan
• A photo of the proposed trailer to be placed at the Home Depot
• $75.50 submittal fee
• This letter will act as the narrative description of the project
