This letter summarizes comments given to you at the meeting by the members of the DRC.The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way City Code(FWCC)and relevant information handouts are enclosed with this letter.Please be advised,this letter does not represent all applicable codes. In preparing your formal application,please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION Preapplication to subdivide vacant lot into a five-lot sub-division OR a four-lot short-plat.Access is via a second parcel owned by applicant. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review.These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided.The major issues section is only provided as a means to highlight critical requirements or issues.Please be sure to read the entire department comments made in the next section of this letter. Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual and Federal Way Addendum. 2. Street frontage improvements and right-of-way required. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly.If you have questions,please contact the representative listed for that section. PLANNING DIVISION (Deb Barker,253-835-2642, deb.barker@cityoffederalway.com) 1. Zoning, Use and Review Process—The site is zoned RS-9.6(Single-Family Residential,one unit/ 9,600 square feet).Proposed lot sizes must meet or exceed the minimum lot size of the zone.The submitted plan depicts lots that meet the minimum lot size. A subdivision of five of more lots requires full subdivision review,including review of and recommendation on the preliminary plat application by the City of Federal Way Hearing Examiner. The Hearing Examiner makes a written recommendation based on criteria listed under FWCC Section 20-126. Once the Hearing Examiner's review is complete,his recommendation is presented to the City Council Land Use/Transportation Committee(LUTC)at a public meeting.The LUTC makes a recommendation on the application to the City Council,who then makes the final determination on the preliminary plat,based on the criteria listed under FWCC Section 20-127.A preliminary plat checklist and master land use application are enclosed along with applicable code sections from the subdivision code.' The preliminary plat application fee is$6,851.00,plus$70.50 per acre.The application must be prepared in accordance with the submittal requirements listed in the subdivision code and the enclosed information bulletin. Separate fees are required for Public Works engineering review and inspection. 2. State Environmental Policy Act (SEPA)—A proposed subdivision of five or more lots is subject to SEPA review. As such, an environmental checklist must be submitted and reviewed prior to the City issuing an environmental threshold determination.Public notice of the environmental determination is also issued,which includes a 14-day comment and 14-day appeal period. A SEPA checklist is enclosed.The SEPA checklist application fee is$843.50. 3. Open Space Requirements—Pursuant to FWCC Section 20-155(b),a subdivision must provide open space in the amount of 15 percent of the gross land area of the subdivision site. On-site open space must include a minimum of 10 percent usable area,and must comply with the open space types and quantities specifically described in FWCC Section 22-155(a)through(c).If approved,a fee-in-lieu payment may be made to satisfy open space requirements at the discretion of the City's PARC S Director after consideration of the City's overall park plan,quality, location,and service area of the open space that would otherwise be provided within the project.The fee-in-lieu of open space shall be calculated on 15 percent of the most recent assessed value of the property at the time of final plat. 1 Pursuant to FWCC Section 22.31(1)(k),preliminary plat applications are exempt from RCW 36.70B.060 through 36.70B.090,and 36.70B.110 through 36.70B.130.The City elects to provide a letter of complete application and public notice of application and decision notwithstanding this decision. 06-102203 Doc ID 36218 4 Mr.Veeder Page 3 June 7,2006 Usable open space design or fee options,along with provisions for access,improvements, ownership, and maintenance,will be reviewed in conjunction with review of the preliminary plat. No information about open space has been identified with the preapplication conference request. 4. Significant Trees, Vegetation, and Grading—All existing significant trees and natural vegetation must be retained on the site to be subdivided,except that which will be removed for improvements or grading as shown on approved engineering plans. Clearing and grading of individual future lots is not permitted during construction of the plat infrastructure,except in locations to be determined by the City that present extreme topography or other unusual conditions. A preliminary clearing and grading plan shall be submitted as part of the preliminary plat application(FWCC Section 20-179). It is the applicant's responsibility to demonstrate that the grading limits are the minimum necessary to accommodate infrastructure improvements. Also,note that trees defined as significant by the FWCC shall be identified and retained or replaced at the rate of at least 25 percent of the significant trees on the site.Removal of significant trees that are located within areas to be developed for rights-of-way or other plat utilities are exempt from the 25 percent retention calculation.The application must include an inventory of significant trees presently on the site, and plat design shall accommodate existing significant trees to the maximum extent possible. A landscape plan prepared by a licensed landscape architect, and consistent with FWCC Section 20- 186, must be submitted with the preliminary plat application. The plan shall identify the following: significant trees to be removed and retained; street trees along the internal plat streets; and landscaping around all sides of the proposed detention pond(FWCC Section 20-178). 5. Lot Design—Street and access easement improvements must meet the requirements contained within FWCC Sections 20-176 to 20-187. Included within these requirements are provisions for landscaping,utilities, and storm drainage.The minimum lot frontage is established at 22 feet unless shared access easement is provided.2 Structural setbacks are 20 feet front yard, and five feet side and rear yard. 6. Drainage—Drainage facilities,including any above ground conveyance ditches,must be established in formal tracts and shall not be part of an easement associated with a parcel.Any formal storm drainage tracts shall be screened from adjoining lots and the right-of-way, with vegetation to be maintained by the homeowners' association. 7. Public Notice—With the application,provide three sets of stamped, addressed envelopes for property owners within 300 feet of the subject site. Include the City of Federal Way return address on all envelopes.3 For our records,provide lists of the owners within 300 feet of the subject site and provide a corresponding parcel map showing the 300-foot radius from the subject site. Refer to the enclosed handout on mailing labels. 8. School Mitigation Fees—Payment of a school impact mitigation fee is required for each single- family residence at the time of issuance of individual residential building permits.The current single-family residential mitigation fee is$3,393.00.The school mitigation fee is reviewed annually by the Federal Way School District and City Council. 2 This provides for a I2-foot-wide driveway with five-foot-wide side yard setbacks. School Access Analysis—A school access analysis prepared by the applicant shall be submitted in conjunction with the preliminary plat application.Please contact Geri Walker,Federal Way School District at 253-945-2071, for access analysis parameters. 10. Final Plat—The final plat fee in effect at time of final plat application is required to process the final plat. Substantial completion of the plat infrastructure must occur prior to submittal and processing of the final plat.The City allows bonding of only minor improvements identified in FWCC Section 20- 135 in order to process the final plat.FWCC Section 20-136 requires City Council review of the final plat. 11. Short Plat—As discussed at the preapplication conference meeting, the alternative proposal for the subject site with four or fewer lots would be considered a short plat.The short plat process is administrative, and environmental review would not be required.Pursuant to FWCC Chapter 20, Article II, Division 5,"Short Subdivision Plats,"short plat applications are administratively processed through the Department of Community Development Services under FWCC Section 20- 83,et al.The administrative review process requires that the Director of Community Development issue a decision on the short subdivision request.Public notice of the complete short plat proposal is required per FWCC Section 20-90,and a 14-day public comment period is provided. However,no public hearing will be required.The applicant is responsible to install all required infrastructure before the short plat will be recorded at King County. Pursuant to FWCC Section 20-152,all lots should be of ample dimensions to provide a regular- shaped building area that meets required setbacks; all lots should be designed to provide access for emergency apparatus; and all lots should abut a public street right-of-way. Please be advised that items 4, 5, 6, 8, and 9 listed above apply to a short plat application. Short plat fees are $2,131.50. 12. Boundary Line Adjustment—There are two underlying lots at the subject site.A boundary line adjustment(BLA),which is a minor alteration in the location of lot boundaries on existing lots, could be proposed under FWCC Section 20-41(a)through(d).The BLA process is administrative; no public notice is required.Each lot established under a BLA shall meet design standards of FWCC Section 20-152, and shall abut a public street right-of-way.BLA fees are$1,249.50. Please be advised that additional requirements may apply to residential structures constructed on lots established under the BLA process.Refer to Public Works comments below. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Sean R.Wells,P.E.,253-835-2731, sean.wells@cityoffederalway.com) Land Use Issues—Stormwater 1. Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual(KCSWDM)and the City of Federal Way Addendum to the 1998 KCSWDM.This project meets the requirements for a Full Drainage Review.At the time of land use site plan preliminary plat or preliminary short plat submittal, a preliminary Technical Information Report(T1R),addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1"= 100', five-foot contour planimetric maps that may be used for basin analysis. 06-102203 Doc ID 36218 r Mr.Veeder Page 5 June 7,2006 2. The project lies within a Level 1 flow control area,thus the applicant must design the flow control facility to meet this performance criteria.The project also lies within a Resource Stream Protection Water Quality Area.Water Quality Treatment shall be designed to meet the treatment criteria of the Resource Stream Protection Menu. 3. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. 4. Detention and water quality treatment facilities for subdivisions are required to be above ground(i.e. an open pond), within a separate storm drainage tract, and dedicated to the City for future maintenance.Detention and water quality facilities may be within the same tract.Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 5. Detention and water quality facilities for short plats must be above ground(i.e. open pond.). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 6. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 7. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System(NPDES)permit may be required.Information regarding this permit can be obtained form the Washington State Depai talent of Ecology at http://www.ecy.wa.gov/programs/sea/pac/index.html,or by calling 360-407-6437. 8. If work is to be done below the ordinary high water mark, a Hydraulic Project Approval (HPA) permit may be required.Information regarding this permit can be obtained from the Washington Department of Fish and Wildlife,at http://www.wa.gov/wdfw/hab/hpapage/htm or by calling the office of Regulator Assistance at 360-407-7037. Right-of-Way Improvements 1. See the Traffic Division comments from Maryanne Zukowski, Senior Traffic Engineer, for traffic related items. 2. Based on available records and the submitted materials,it appears that this proposal meets the 25 percent threshold criteria for requiring street frontage improvements as identified in the Federal Way City Code(FWCC) Section 22-1473.The applicant/owner may submit an MAI appraisal for the subject property, or King County Assessor's records may be used.Development Services Division will evaluate this data to determine if the project actually meets the City's 25 percent threshold for requiring street frontage improvements. 3. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed.The dedicated area must have clear title prior to recording. 4. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 06-102203 Doc 1D 36218 b Mr.Veeder Page 6 June 7,2006 5. FWCC Section 16-47 requires that overhead utility lines be relocated underground if over 500 feet, or three spans are affected by a project.This condition will be applied to 5 Avenue. SW. 6. FWCC Section 22-1543 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection. Lots and intersections within new subdivisions or short plats must be designed to meet this standard. EN Approval Issues 1. Engineered plans are required for clearing, grading,road construction,and utility work.Plans must be reviewed and approved by the City. Engineering review fees are$730.00 for the first 12 hours of review, and$61 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit for grading. Details and fees may be obtained from the Federal Way Building Department. 3. The Federal Way Development Standards Manual(including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 4. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. 5. Bonding is required for all improvements associated with the project.The bond amount shall be 120 percent of the estimated costs of the improvements.An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called.Upon completion of the installation of the improvements, and final approval of the Public Works Inspector,the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities(including the detention and water quality facilities)and street systems during the two-year maintenance period. During that time,the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements.Upon satisfactory completion of the two-year maintenance period,the remainder of the bond will be released.Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City.Maintenance for private roads and drainage facilities,including short plats,remain the responsibility of the individual property owners. 7. When topographic survey information is shown on the plans,the vertical datum block shall include the phrase"DATUM:N.G.V.D.-29"or"DATUM: K.C.A.S.,"on all sheets where vertical elevations are called out. 8. Drawings submitted for plan review shall be printed on 24"x 36" or 22"x 34" paper. All final approved drawings shall be drafted/plotted on 24"x 36" or 22"x 34"mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1"=20', or larger. Architectural scales are not permitted on engineering plans. 06-102203 Doc ID 36218 Mr.Veeder Page 7 June 7,2006 9. Provide cut and fill quantities on the clearing and grading plan.Erosion control measures,per Appendix D, 1998 KCSWDM,must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION,Maryanne Zukowski,PE,253-835-2742, maryanne.zukowski@cityoffederalway.com) 1. Based on the Institute of Transportation Engineers Trip Generation 6th Edition Land Use Code 210 (Single-Family),the project is expected to not generate 10 weekday PM peak hour trips or 100 daily trips.A traffic impact analysis(TIA)prepared by a traffic engineer is not required to assess project impacts and determine mitigation measures. 2. The project does need to address following analysis: n Sight Distance per AASHTO for vertical and horizontal alignment of proposed new roadway. ❑ Neighborhood Impacts ❑ Safety 3. Per FWCC Section 22-1474,the applicant/owner would be expected to construct half-street improvements consistent with the planned roadway cross-sections as shown in Map I1I-6 of the FWCP and Capital Improvement Program(CIP)shown as Table I1I-19.Based on the materials submitted, staff conducted a limited analysis to determine the required frontage improvements in meeting Federal Way City Code(FWCC).Based on the analysis and FWCC,the applicant would be expected to construct half-street improvements on the following streets: a) 51'Avenue SW is a Type T street,consisting of a 28-foot street with eight-foot ditches, five- foot sidewalks,three-foot utility strip in 60-foot right-of-way.The improvements shall be from street centerline to include a minimum 20 feet of paved surface for the '/2 street improvements. Assuming a symmetrical cross section,additional 30 feet of right-of-way(ROW)would need to be dedicated to the City. 4. Tapers and transitions beyond the project frontage may be required as deemed necessary for safety purposes,taper rate shall be based on WSDOT Design Manual; WS^2/60 or AASHTO as directed by the Public Works Director. 5. ROW dedication shall be conveyed to the City through a Statutory Warranty Deed and must have clear title prior to recording. 6. The applicant may make a written request to the Director of Public Works to modify, defer,or waive the requirements improvements.The applicant may request the reduction of the utility strip into an easement in lieu of right-of-way. The applicant may also request for review the elimination of five feet of sidewalks from the improvements. 7. A temporary 3/4 cul-de-sac will be required at 600 feet from SW 3161h Place. All cul-de-sac terminus shall be 106-foot diameter with 26-foot center island (optional as approved by the Public Works Director). 06-102203 Doc ID 36218 Mr.Veeder Page 8 June 7,2006 8. Per FWCC Section 20-151,no streets,or combination of streets, shall function as a cul-de-sac longer than 600 feet. 9. FWCC Sec.20-151 and Federal Way Comprehensive Plan Policy TP21,require block perimeters no longer than 1320' for non-motorize, and 2640 feet for streets. 10. Driveway serving a single-family dwelling unit abutting two streets should be at least 25 feet from the beginning of the street radius. 11. Please provide photo documentation within the report of the sight distance analysis.The photo must show the location of the sight distance standard in the picture as well as the location of the viewer. If a photo cannot be provided,plan sheets with plan and profile within the report can also provide the site distance documentation. If this method is used,place the distance requirements as met on those documents and provide this information within the appendix of the report. LAKEHAVEN UTILITY DISTRICT(Brian Asbury,253-946-5407,basbury@lakehaven.org) Water This property is located within the water service area boundary of the City of Tacoma. Sewer(Subdivision or Short Subdivision) To date,the owner/applicant has not submitted either a Preapplication,Pre-Design,or Developer Extension Agreement application to Lakehaven.A preliminary review of the subject application indicates that a Developer Extension Agreement will be required to construct new sanitary sewer facilities necessary for the proposed development. Lakehaven emphasizes that owners/applicants should apply separately to Lakehaven for either the Pre-Design or Developer Extension Agreement process early in the pre-design/planning phase to avoid delays in the overall development process. Further detail and/or design guidance and requirements regarding water and sanitary sewer facilities will be provided only after the owner/applicant has submitted the appropriate application to Lakehaven. Sewer(One SFR Connection) In lieu of the requirement for a developer extension agreement, a sewer connection for a proposed single- family residence maybe allowed under Lakehaven's "Temporary Service Policy". Such connection would be subject to owner's acquisition of the necessary private sewer easement on adjacent property and payment of earlycomer charges assessed with the side sewer permit. General All comments herein are valid for one(1)year and are based on the proposal(s)submitted and Lakehaven's current regulations and policies. Any change to either the development proposal(s)or Lakehaven's regulations and policies may affect the above comments accordingly. SOUTH KING FIRE AND RESCUE(Greg Brozek,253-946-7241,greg.brozek@southkingfire.org) Water Supplies for Fire Protection A Certificate of Water Availability shall be provided indicating the fire flow available at the site. Fire hydrants shall be spaced 700 ft.or less apart.Every building lot shall have a fire hydrant within 350 ft. All measurements shall be made as vehicular travel distance. 06-102203 Doc ID 36218 Mr.Veeder Page 9 June 7,2006 Fire hydrants shall be in service PRIOR to and during construction. Fire Apparatus Access Roadway Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 ft. from fire apparatus vehicle access.Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25-ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 20-foot inside turning radius and not less than a 40-foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or Fire Department approved alternative at the dead end.All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 15 percent. 6) Serving a single residential property which have a dead end in excess of 150 feet in length shall be provided with a turn around approved by the chief. (KCFD#39 Administrative Policy Guideline No. 1006) EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions maybe modified by the chief. Fire apparatus access road gates shall comply with KCFD#39 Administrative Policy Guideline No. 1001. Automatic Fire Sprinkler Systems An automatic fire sprinkler system shall be installed in Group R,Division 3 occupancies: 1) When the occupancy exceeds 2,500 square feet(including attached garages)without adequate fire flow. 2) Without approved fire depai tinent access. 3) When the occupancy exceeds 10,000 square feet. 4) When the building is classified as an over-water structure. Comments: The minimum fire flow for one-and two-family dwellings shall be 1,000 gallons per minute. If the slope of a building lot does not allow the building(s)on the site to comply with the"life safety/rescue access"requirement,the building(s)shall be provided with an approved automatic fire sprinkler system. Life safety/rescue access shall mean an unobstructed access to all floor levels and each roof level of a building on not less than 20 percent of the building perimeter by utilizing a 35-foot ladder.An alternate 06-102203 Doc ID 36218 Mr.Veeder Page 10 June 7,2006 method would be at least one stairway enclosure with exit doorways from each floor level and with a door opening onto each roof level which conforms to the requirements of the International Building Code. Based on the Institute of Transportation Engineers Trip Generation 6th Edition Land Use Code 210 (Single Family),the project is expected to not generate 10 weekday PM peak hour trips or 100 daily trips. A traffic impact analysis(TIA)prepared by a traffic engineer is not required to assess project impacts and determine mitigation measures. Per FWCC Section 22-1474,the applicant/owner would be expected to construct half-street improvements consistent with the planned roadway cross-sections as shown in Map III-6 of the FWCP and Capital Improvement Program(CIP)shown as Table III-19. Based on the materials submitted, staff conducted a limited analysis to determine the required frontage improvements in meeting Federal Way City Code (FWCC). Based on the analysis and FWCC,the applicant would be expected to construct half-street improvements on the following streets: a) 51s`Ave SW is a Type T street, consisting of a 36' street with 8 foot ditches, 5- sidewalks, 3 foot utility strip 60' right-of-way. The improvements shall be from street centerline to include a minimum 20 feet of paved surface for the V2 street improvements. Assuming a symmetrical cross section, additional 30' of right- of-way(ROW)would need to be dedicated to the city. 5. Tapers and transitions beyond the project frontage may be required as deemed necessary for safety purposes,taper rate shall be based on WSDOT Design Manual; WS^2/60 or AASHTO as directed by the Public Works Director. 6. ROW dedication shall be conveyed to the City through a Statutory Warrant Deed and must have clear title prior to recording. 7. The applicant may make a written request to the Director of Public Works to modify, defer, or waive the requirements improvements. The applicant may request the reduction of the utility strip into an easement in lieu of right of way. Driveway serving a single family dwelling unit abutting two streets should be at least 25' from the beginning of the street radius. 12. Please provide photo documentation within the report of the sight distance analysis. The photo must show the location of the sight distance standard in the picture as well as the location of the viewer. If a photo cannot be provided,plan sheets with plan and profile within the report can also provide the site distance documentation.
