In order to alter the approved occupancy of a building,the city must first determine that the proposed use of the proposed occupancy is permitted. In this particular case,the subject site is zoned Community Business(BC). Church uses are permitted within BC zoning districts pursuant to Federal Way City Code (FWCC)Section 22-755 (enclosed), subject to use Process II,Site Plan Review.As this site has never been as a church,a formal land use process is required.' In order to review the proposed church use, a preapplication conference must be requested per FWCC Article XX,"Preapplication Conference"(enclosed).At the preapplication conference,you will meet with representatives from the Planning Division,Building Division, Public Works Traffic and Engineering Divisions,Federal Way Fire Department,and Lakehaven Utility District. They will review the proposed change of use and determine which code requirements apply to the project. The filing fee for a preapplication conference is$321.00.2 A master land use application and preapplication handout are enclosed. After we received your preapplication request,we will be able to schedule the preapplication meeting. Generally,the preapplication process takes about 30 days,between the time your request is submitted and the preapplication summary letter is sent. The current permit is M — Mercantile; we request adding an A3 — Assembly permit; the building is zoned BC. It is our desire as a worshiping faith community to use the building located at 1626 S. 310 for a center of spiritual formation and expression, which would also include our church office. The square footage of the site is 6,000 sq. ft. We are, upon approval, entering a month-to-month Lease Agreement efficacious for IA the building only, approximately 3,000 sq ft. Our understanding is that this agreement is contingent, in small part, upon our quality as tenants but also in large measure to the landlords ability to lease the entirety of this building or purchase of the same said facility. Once a tenant emerges or a buyer is secured our Lease Agreement will either be renegotiated or terminated, whichever is best for all parties involved. We have contracted the services of J. Patrick Mitchell & Associates from Kirkland to analyze the building in terms of proposed use and subsequent codes. It is our impression that this building meets the necessary code requirements. We have also been advised as to the person to square foot ratio and the potential requirement of dividing the building in order to keep our attendance numbers in conformity with the number of parking spaces available. 'A these understandings, then (responsible portion of leased facility, tentative nature of agreement and code requirements), we seek to limit our attendance numerically and our space physically with the aid of temporary partitions. It is also in accord with our philosophy and vision to limit our seating. Our service is designed to operate optimally with 90-100 persons. Our vision involves the personal interaction of attendees in which individuals are encouraged to engage the presentation and participate in their own spiritual formation. Hence, the environment needs to reflect and encourage this, so we use couches and tables instead of uniform rows and pews. By their very nature, living room type furniture occupies space and limits seating. Pertaining to other potential requirements, such as drinking fountain and ventilation, I offer these comments. Regarding the water fountain, we are seeking to add a utility sink with cup dispenser. Contributing to the informal nature of our service, we serve coffee and espresso drinks and to ensure cleanliness of the equipment and availability of water to our attendees a sink available for all would be more effective. Regarding the ventilation and c.f.m. requirements, we secured the services of NorPac Heating and Air Conditioning Inc. of Auburn to inspect the roof-top facilities. The building located at 1626 S. 310 in Federal Way has two (2) five (5) ton units, each capable of 2400 cfm and BTUH of 90,000 (input) and 70,000 (output). They are being given full use of the building until a tenant is found for the other half. The Church would like to move into the space as it is without any changes. The building was designed and built under the 1985 UBC and the then current energy code. The original design occupancy was B-2. The previous building tenant was a paint store, which under the current code is an M occupancy. I have looked at the plans for the building and have analyzed the building from the standpoint of converting either all of the building or half of the building to an A-3 occupancy. To qualify as an A-3 occupancy the assembly space would have to be restricted to a maximum seating of 299. There are only 51 parking stall connected with this facility, which under the current zoning code requires 1 stall per 5 seats, this further restricts the assembly space seating to 255 maximum. The Church currently has 51 members.. Attached is a code spreadsheet analysis of the building showing that it meets code for the A-3 occupancy. I have also attached the most likely room layout and sizes for when the other half is leased out.. The existing building has one or more rooftop forced air units. I am waiting for a report on the amount of cfm provided. The Church will need a total of 4,155 cfm for their portion of the facility. In addition they handed me a stack of papers and explained to me, in as much detail as possible, the anticipated requirements for securing such a change. They were very helpful indeed. We (Crosspointe Church) have since attempted to fulfill those requirements as best as possible and sent a letter addressed to you as the only contact name provided.
