Dear Mr. &Mrs.Neubauer:
Thank you for your comments regarding the proposed 308th Street Storm Drainage Improvement project. In
summary,you have requested to have the new grass swale constructed with equal portions of the swale on both
sides of the existing property line between 2006 and 2010 South 308th Street.Currently,the majority of the
existing grass swale is located on your property at 2010 South 308th Street.
The preliminary design plan shows the new(revised)swale being located on the abutting Stokes property(2006)
where the Public Works Department has obtained a ten-foot wide easement. However,the Public Works
Department has not finalized the design of the project. Fei Tang,with the Public Works Department Surface
Water Management(SWM)Division,will continue to be in contact with you to determine a mutually amenable
final design location for the swale.
The city's Department of Community Development Services is responsible for issuing the State Environmental
Policy Act(SEPA)decision for the project, as well as processing the Shoreline Substantial Development Permit.
At this time, in order to issue the final SEPA decision,the final precise location of the swale does not necessarily
need to be determined. Therefore, enclosed is a copy of the city's final environmental determination of
nonsignificance(DNS).
Please be advised that upon completion of the SEPA appeal period,the Department of Community Development
Services will then be issuing a shoreline substantial development permit in the form of a Process III decision.The
final location of the swale will need to be determined by the Public Works Department, prior to issuance of the
shoreline permit. The city will also be providing you a copy of the Shoreline Permit(Process III)decision.

SUMMARY OF PROPOSED ACTION
The City of Federal Way's Department of Public Works proposes to construct approximately 300 linear
feet of storm drainage improvements. The project is designed to route stormwater run-off from South
308th Street to Steel Lake via a controlled conveyance system. The project includes constructing

program. The goal is to manage stormwater runoff that emanates from properties and streets within the
city, and eventually enters nearby streams. The department's on-going surface water management
program includes specific projects such as this proposed action, as well as public education and source
control programs,regular street and storm system maintenance, and investigation of local surface water
complaints. The proposed project is a component of the implementation of the citywide surface water
control program.

ANALYSIS OF ENVIRONMENTAL CHECKLIST
Following are staff responses to the elements of the enclosed environmental checklist indicating whether
or not city staff concurs with the applicant's response to the checklist item, or staff clarification or
amendment of the response.
A. BACKGROUND
1-7. Concur with the checklist.
8-10. Concur with the checklist. Determination of Nonsignificance(DNS)for phase 1 issued July
19, 2001.
11. Concur with the checklist. The existing surface flow of stormwater run-off in this area
results in potential flooding of the existing single-family residence located at 2006 South
308t Street. The proposed project would correct the drainage-flooding problem.

B. ENVIRONMENTAL ELEMENTS
1. Earth

a-b. Concur with the checklist. Average grade of the proposed route is approximately 10
percent.
c. Concur with the checklist. The underlying Alderwood gravelly sandy loam soil series
is moderately well drained. Runoff is slow and the erosion hazard is slight.
d. Concur with the checklist. The City of Federal Way Environmentally Sensitive Areas
Map does not reveal this site to be in a problem area relative to landslide, seismic
hazard,erosion, steep slope hazards, or 100-year floodplain.
e. Concur with the checklist.Approximately 150 cubic yards of soil will be excavated
and backfilled for the project. As a result, limited erosion potential exists.
f-h. Concur with the checklist. Soil disturbing activities could result in erosion and
transport of sediment. Sand, silt, and soil damage aquatic habitat and are considered
pollutants.
To mitigate potential erosion impacts,the applicant will implement a Temporary
Erosion and Sedimentation Control(TESC)Plan utilizing Best Management Practices
(BMPs)before any soil disturbing activities. Implementation and monitoring of the
TESC Plan will prevent and/or minimize erosion impacts during the construction
phase of the project. Upon completion of construction,the areas of soil disturbance
will be re-vegetated.
Since the project will not result in any net increase in impervious surface,post-
construction erosion impacts are not anticipated.
2. Air
a. Concur with the checklist. Short-term air quality impacts will result during site
preparation and construction. Construction activity contributes to carbon monoxide
and particulate matter levels through the operation of construction machinery, delivery
equipment and materials,and worker access to the site by automobile. These activities
include emissions of hydrocarbons and oxides of nitrogen,potentially elevating the
level of photochemical oxidants, such as ozone, in the ambient air. Long-term impacts
will not be increased by completion of this proposal.
b-c. Concur with the checklist. The applicant could reduce air impacts by watering exposed
soil,covering all transport trucks, cleaning roads,managing construction traffic,and
requiring emission control devices on construction equipment. Compliance with local,
state, and federal air quality standards provides sufficient mitigation of potential short-
term air quality impacts.
3. Water
a. Surface
1) Concur with the checklist. Steel Lake is located at the terminus of the proposed
project.

The existing stormwater run-off in this area discharges to Steel Lake. The
proposed stormwater conveyance system would continue to discharge to Steel
Lake. The proposed project will not alter the existing flow rate or water quality
of the stormwater run-off.
2) Concur with the checklist.
3) No fill or dredge material will be placed in or removed from Steel Lake because
of the proposed project.
4) The proposed project does not involve surface water withdrawals or diversions.
5-6) Concur with the checklist. FEMA maps indicate that the project site is not
located within a 100-or 500-year flood plain.
b. Ground
1-2) Concur with the checklist.
c. Water Runoff(including stormwater)
1) Concur with the checklist. Runoff in excess of the absorption capacity of the
sub-basin is collected by the proposed system. The existing stormwater run-off
discharges via surface flow to Steel Lake, north of the proposed project. The
proposed stormwater conveyance system would continue to discharge to Steel
Lake.
The existing flow of stormwater run-off in this area results in potential flooding
of the existing single family located at 2006 South 308th Street. The proposed
project would correct the drainage-flooding problem.
2) Concur with the checklist. The proposed project will not alter the existing flow
rate or water quality of the stormwater run-off.
d. Concur with the checklist. To mitigate potential surface and stormwater impacts,the
applicant will implement a TESC Plan utilizing BMPs before any soil disturbing
activities. Implementation and monitoring of the TESC Plan will prevent and/or
minimize erosion impacts during the construction phase of the project. Upon
completion of construction,the areas of soil disturbance will be re-vegetated.

4. Plants
a-d. Concur with the checklist. Significant tree replacement may be required pursuant to
Federal Way City Code(FWCC)Chapter 22.
5. Animals
a-d. Concur with the checklist. The site is located within the Pacific Flyway, a significant
route for migratory waterfowl. Steel Lake, located 200 feet north of the terminus of the
proposed project, is utilized as habitat for bald eagles.However,there are no known
perch or nesting sites near the project site. The proposal involves improvements to the
existing stormwater conveyance system; as such, it is not anticipated to impact the
utilization of Steel Lake by bald eagles for habitat. Therefore, no significant adverse
wildlife impacts are anticipated, and no mitigation measures are necessary.
6. Energy and Natural Resources
a-c. Concur with the checklist. The applicant has proposed to reduce energy impacts by
limiting construction equipment idling, encouraging carpooling by construction
workers, locating staging areas in close proximity to the site, and phasing construction
and controlling traffic to limit idling vehicles.No significant adverse energy and
natural resource impacts are anticipated; therefore, no additional mitigation measures
are necessary.
7. Environmental Health
a. Environmental Health Hazards
1-2) Concur with the checklist. The risk of environmental health hazards is always
present during construction projects. The use of standard construction practices
and traffic control measures would greatly reduce the risk of an accident. Fire
and police personnel have reviewed the site plan for adequacy of emergency
access and layout.All applicable state laws concerning workplace safety should
be followed on the proposed project site during construction.
b. Noise
1) The project site is located adjacent to South 308th Street and therefore
experiences noises associated with the operation of vehicles.
2-3) Concur with the checklist.Noise levels will increase on a short-term basis during
construction activity.No increase in noise levels will be generated because of
the completed project. Control measures include use of muffled equipment,
acoustic shielding, and required conformance with local noise ordinances
regulating hours of construction and noise levels.

8. Land and Shoreline Use
a- 1. Concur with the checklist. The development near the proposal consists of single-
family residential dwellings. The project site is located within the RS-7.2 Single-
Family zoning district. The Comprehensive Plan designation of the project site is
Single Family—High Density.
The proposed project will be located within the South 308th Street public right-of-way
and within a stormwater drainage easement across the property located at 2006 South
308th Street,to be acquired by the city. The applicant shall be required to obtain
construction and maintenance easements as appropriate before the initiation of
construction activities.
The site has not been identified as being located within any designated
environmentally sensitive areas. Steel Lake is located within 200 feet of the project.
Therefore,a Shoreline Substantial Development Permit is required.
The proposal does not involve construction or demolition of structures. The proposal
will neither displace workers or residences;rather is intended to provide controlled
conveyance of stormwater run-off consistent with the citywide surface water control
program.
9. Housing
a-c. Concur with the checklist.No significant adverse housing impacts are anticipated;
therefore,no mitigation measures are necessary.
10. Aesthetics
a-c. Concur with the checklist. The applicant has proposed mitigate plant impacts by
replanting or replacing all vegetation removed because of construction activities.The
proposal involves improvements to the existing stormwater conveyance system and
adverse aesthetics impacts are not anticipated.
11. Light and Glare
a-c. Concur with the checklist. The proposal will not produce light or glare;therefore no
mitigative measures are proposed.
12. Recreation
a-c. Concur with the checklist. The proposed stormwater conveyance system improvements
are not anticipated to generate adverse recreation impacts. Therefore,no mitigation
measures are necessary.
13. Historic and Cultural Preservation
a-c. Concur with the checklist.No significant adverse historic and cultural preservation
impacts are anticipated;therefore,no mitigation measures are necessary.

14. Transportation
a-g. Concur with the checklist. The applicant has proposed to reduce transportation impacts
by repaving excavated portions of public right-of-way and replacing sidewalks and
private driveways. Implementation of a Traffic Control Plan may be required.No
additional mitigative measures are necessary.
15. Public Services
a-b. Concur with the checklist. The proposed project is a component of the implementation
of the citywide surface water control program. It is not anticipated that any special
emergency services will be required;therefore, no mitigation measures are necessary.
16. Utilities
a-b. Concur with the checklist. Water and sewer service are not necessary for the proposed
stormwater conveyance system improvements. However,there are existing water and
sewer facilities near the proposed project. Any required relocation of water or sewer
lines should be coordinated with Lakehaven Utility District as early in the process as
possible.No additional mitigative measures are necessary.
CONCLUSION
Based on staff analysis of the application,the completed SEPA checklist,and applicable city and county
regulations and policies,the proposal can be found to not have a probable significant adverse impact on
the environment.
The city reserves the right to review any further revisions or alterations to the site or the proposal in
order to determine the environmental significance or nonsignificance of the project at that point in time.

This office and other city staff have reviewed the environmental checklist you submitted. We
have determined that the checklist will not have a probable significant adverse impact on the
environment. As a result, an Environmental Impact Statement(EIS) is not required to comply
with the State Environmental Policy Act(SEPA). A copy of the determination is enclosed.
A 14-day comment period was previously provided under the Optional DNS period allowed by
the SEPA Rules (WAC 197-11-355). A notice inviting comments was published in the Federal
Way Mirror on March 10 and 17, 2001. The city received one comment letter from the
Neubauer's, of which we provided you a copy. A final DNS is being issued as of today's date,
with no further comment period. All final determinations may be appealed within 14 days.No
licenses, permits, or approvals will be issued until completion of the appeal period.
Our decision not to require an EIS does not mean that the license,permit, or approval you are
seeking from the city has been granted. Approval or denial of the proposal will be made by the
appropriate administrative or legislative body vested with that authority. The environmental
record is considered by the decision maker(s) and conditions may be imposed to reduce
identified environmental impacts, as long as the conditions are based on adopted and designated
city policy.

Please address the following comments and revise the drainage plan as appropriate:
1. Provide at least two cross-sections of the drainage corridor (one at the swale
location and one at the piped location).
SWALE AND PIPED LOCATION CROSS-SECTIONS ARE NOW INCLUDED IN THE PLANS,
ATTACHED.
2. Explain the discharge from the 12" HDPE pipe to the Type I catch basin to the at-
grade swale. Does the CB fill up with water then spill over into the swale?
A FLOW CONTROL/ENERGY DISSIPATOR IS PLANNED TO BE LOCATED AT THE TOP OF
THE SWALE. IT WILL CONSIST OF A MOSTLY BURIED CONCRETE BOX STRUCTURE WITH
A THREE-FOOT WIDE WEIR THAT WILL DELIVER LOW-VELOCITY FLOW TO THE TOP OF
THE SWALE. THE EXISTING SWALE WILL BE RE-ALIGNED AND REHABILITATED TO A
SHALLOW DEPRESSION AT MINIMUM THREE FEET WIDE AND AT MOST 8" DEEP WITH
THREE-HORIZONTAL:ONE-VERTICAL SIDE SLOPES. SEE CROSS-SECTION FOR DETAILS,
ATTACHED.
3. Explain how the runoff flows/discharges over the existing bulkhead at the edge of
lake.
THE EXISTING SWALE TRANSITIONS TO FLAT EVEN GROUND AS IT NEARS THE LAKE
BULKHEAD. FLOW SPREADS AND SLOWS BEFORE IT NEARS THE BULKHEAD. IT APPEARS
THAT THE FLOW NEVER REACHES THE BULKHEAD, BUT PONDS UP IN A DPERESSION
APPROXIMATELY 60-FEET FROM THE LAKE AND INFILTRATES INTO THE GROUND. ONLY
DURING A LARGE EVENT WOULD RUNOFF ACTUALLY FLOW OVER GROUND INTO THE
LAKE.
THE NEW SWALE WILL tit REGRADED UP UNTIL THE BEGINNING OF THE DEPRESSION
TO ALLOW FLOWS TO DISCHARGE INTO THE DEPRESSION AND INFILTRATE INTO THE
GROUND.
THE PHYSICAL CONDITION OF THE SITE SUGGESTS THAT THE SOILS IN THE AREA ARE
RELATIVELY PERMIABLE AND MOST, IF NOT ALL, OF THE RUNOFF THAT MAKES IT INTO
THE SWALE INFILTRATES INTO THE GROUND BEFORE REACHING THE LAKE. THERE IS
NO SIGN OF STANDING WATER, NO SEDIMENT DEPOSITS AND NONE OF THE GRASS IS
FLATTENED IN THE DEPRESSION. OUR GOAL IS TO HAVE THE SAME PERFORMANCE
CHARACTERISTICS WITH THE REGRADED SWALE.
Two copies of the revised full size plan sheets and one copy reduced to 11" X 17" are
attached.

4. Identify tax parcel numbers, addresses and property owner names on both parcels
shown on the drainage plan.
5. Sign and stamp the revised drainage plan sheet.
These revisions/clarifications must be made prior to the Department of Community
Development issuing a written decision on the Process III and Shoreline Substantial
Development permit.
Provide two copies of the revised full size plan sheets and one copy reduced to 11"X 17".

Dear Director of Community Dev. Services:
Please accept this memo as our written comments on the application of the proposal to the"Project Name",
"South 30 Street Storm Drainage Improvements"at"Location""2006 South 308`s Street,Federal Way,
WA 98003",submitted prior to the due date of April 9,2001.
We are the homeowners of the house on the adjacent side to your proposed project. Our concern with your
project,that we would appreciate your consideration on,is with the proposed improvement of the
approximate 130 linear feet of grass swale between the storm drainpipe outfall and Steel Lake. The
existing"natural grass Swale"is currently located solely on the side of the property line of 2010 S 308°St.
This has happened naturally over time with the flow of the rainfall drainage. We would like to ask for the
new and improved constructed grass swale to be placed"ON"the property line with equal portions on both
sides of the property line to be shared by both homeowners. Our reason for this request is that we pay the
property taxes up to the property line and the grass Swale artificially defines an assumed property line. In
addition,all of the drainage from 308°Street ultimately ends up in our front yard,and while we don't mind
sharing the burden of filtration,we would ask that it be distributed equally down the property line. We
would like the grass swale to be wide enough and with a gradual enough radius to allow both homeowners
the ability to mow the grass with their riding lawn mowers.
Additionally,at this time,we would like to make our written request for a copy of the final decision

RE: Request Waiver of Preapplication Conference—City of Federal Way 2006 South 308th Project Phase If
Dear Mrs.McClung:
Per City Code Section 22-1653 (2),I am writing this letter to request a waiver from the requirement to
undergo a preapplication conference based on the following reasons:
1. The nature of the proposed project is very simple. It consists of constructing approximately 170 feet of
storm water drainage pipe system to eliminate the potential flooding to a nearby house. The entire
project is contained within one single-family parcel in the easement. The potential conflicts with utilities
are unlikely. The impact to public is very limited.
2. The project needs to be constructed during the summer dry season to significantly reduce construction
cost associated with erosion control and to minimize the impact to Steel Lake that is located immediately
downstream of the project. Due to the fact that Shoreline Permit is required for the project and it
normally takes more than six months to obtain the permit,the three to four weeks of time needed to set
up the preapplication conference is very likely to make the construction in this year impossible.
3. This is the phase II of the entire project. Phase I was proposed and partially constructed last year.
Similar land use review has been conducted last year. Phase II is the simple extension from phase I.
Therefore,further preapplication review will unlikely provide any benefit.
