Committee members at that meeting included representatives from the City's Public Works Department, Department of Community Development Services' Planning and Building Divisions, Federal Way Fire Department, and Lakehaven Utility District. This letter summarizes the preapplication conference for your proposal. Department and agency requirements are enclosed with this letter. PLANNING DIVISION —Jane Gamble, 253-661-4120 A) Required Review Process Land Use Approval:The zoning of the subject site is Community Business, (BC). This zoning district permits church uses under Federal Way City Code(FWCC) Section 22-755 (enclosed). The required review process for the project is Process II, Site P/an Review. A development requirements checklist and master land use application are enclosed along with applicable code sections. A building permit can be issued after Process II approval is granted. State Environmental Policy Act(SEPA): Pursuant to Washington Administrative Code(WAC) 197-11-800(3), a project that involves the remodeling of an existing facility in conjunction with a change of use can be subject to SEPA review. In this instance, the Public Works Traffic Division has determined that the change from office to church use will not create a significant impact on traffic patterns in the area. No other significant impacts have been identified as a result of the proposed change of use, and as such, it has been determined that this project will be exempt from SEPA review. Mr. Shawn Q Penn Page 2 June 27, 2001 B) Fees;The fee for Process II review is $1,473.00. The $321.00 deposit paid at the time of preapplication is subtracted from this total. Additional fees are associated with other City and district regulations and permits. C) Nonconformance:Pursuant to FWCC Section 22-334(1) (enclosed), if an applicant proposes a change of use on only a portion of a property occupied by multiple tenants or uses, the applicant shall meet those provisions determined by the director to be reasonable related and applicable to the change of use. These provisions shall apply only to that geographic portion of the site related to the use or tenant space on which the change is proposed. The proposed project is considered a change of use, in that the site was last used as an Auto Service Rhodda Paint store. Furthermore, pursuant to code requirements, if the use conducted on the subject property has ceased for more than one year, the applicant shall repair and/or restore the improvements on the site (e.g., drainage, landscaping, curbing, parking, parking lot landscaping, etc.). The Rhodda Paint store was closed on June 13, 2000. As such, this proposal requires that the site be brought into conformance with current development standards in that geographic portion of the site related and applicable to the change of use, and that the existing improvements be repaired and restored. These development standards include, but are not limited to, required perimeter landscaping, parking lot standards including parking lot landscaping, and community design guidelines. In order to determine whether or not public improvements must be installed, please submit a valuation of the proposed work for remodeling the existing structure, along with an assessment of the value of the structure. Pursuant to FWCC Section 22-1473, the applicant must provide right-of-way improvements when proposed improvements in any 12-month period exceed 25 percent of the assessed or appraised value of all structures on the subject property. Please submit a valuation of the proposed work and an assessment of all structures on the property, in order that the City may determine whether or not this requirement is triggered by the proposed development. According to King County Assessor records, the combined value of both buildings on the site totals $425,000. If the value of the proposed work is less than $106,250, the project will be exempt from Public Works right-of-way requirements. The applicant may obtain an MAI appraisal of the structures if they chose to establish a higher value. D) Setbacks:The minimum setback requirement in a BC zone for a church use is 20 feet from the front property line, and 0 feet from the side and rear property lines. The FWCC defines the front property line as being adjacent to a right-of-way that is more than 21 feet in width. When the subject property is adjacent to more than one right-of-way that is more than 21 feet in width, the applicant shall designate which of the adjacent property lines is the front property line and the remainder of such adjacent property lines will be considered as either a rear property line or side property line. In this instance, the subject property abuts both Pacific Highway South and South 310th Street; each of these streets is more than 21 feet in width. In that the structure under consideration is located only seven feet Doc.I.D.14896 Mr. Shawn Q Penn Page 3 June 27, 2001 from South 310th Street, the front property line will be considered that property line adjacent to Pacific Highway South; to consider the South 310th property line as the front property line would render the existing structure nonconforming due to its location within what would otherwise be considered the required front yards. Please be aware that the required yard setbacks are also subject to perimeter landscape requirements. Please see Landscaping below. E) Lot Coverage:Pursuant to FWCC Section 22-755, no maximum lot coverage is established. Instead, the buildable area will be determined by other site development requirements. F) Parking:Pursuant to FWCC Section 22-755, a Transportation Management Plan (TMP) must be submitted as part of an application for a church use. The TMP shall address the following: traffic control, parking demand and management, and traffic movement to the adjacent street system. The number of required parking spaces will be based on the outcome of this analysis. Please submit a written narrative of all of your intended uses for the site (i.e., daycare, classrooms, group meetings, church services, etc.). This narrative should detail the days and times of these activities, and an estimation of the number of participants in each,activity. Shared Parking: Recognizing that the required TMP may determine that there is inadequate parking available on the site, please be advised that pursuant to FWCC Section 22-1421, the applicant shall provide the required number of parking spaces either on the subject property or on a lot adjoining the subject property. If the parking is located on a lot other than the lot containing the use which generates the parking space requirements, the owner of the lot containing the parking must sign a covenant, or other instrument, in a form acceptable to the City attorney, requiring that the lot be devoted in whole or in part to required parking for the use on another lot. The applicant must record this statement with the county to run with all affected property. Alternately, FWCC Section 22-1422 (enclosed), allows two or more businesses or uses to share parking areas. The number of parking spaces that must be provided in such shared areas must be at least 90 percent of the parking spaces required for all such businesses or uses that are open or generating parking demands at the same time. The owner of each lot must sign an agreement in a form acceptable to the City Attorney, stating that the owner's property is committed to providing parking for the other property. This statement must be recorded with the King County auditor, at the applicant's expense, and shall run with the properties. The shared parking facilities and buildings which they serve shall be connected with pedestrian facilities improved according to the standards set forth in FWCC Section 22- 1634(d)(2), and no building or use involved shall be more than 500 feet from the most remote parking facility. If you propose to use parking located off site, please submit a site plan indicating the distances between the proposed church and the shared parking area, as well as the required pedestrian connections between these areas Doc.I.D.14896 Mr. Shawn Q Penn Page 4 June 27, 2001 G) Landscaping: Perimeter Landscape Requirements:The building that will house the proposed church use is located directly atop the northerly and easterly property lines. Pursuant to FWCC Section 22-1566(f), five feet of Type III landscaping is required along all perimeter lot lines. However, pursuant to FWCC Section 22-334, the applicant shall meet those provisions reasonably related and applicable to the change of use. It is determined that in the areas where the existing structure intrudes into required landscape buffering, the perimeter landscaping can be waived. However, the parking lot landscaping requirements are applicable. There are currently ten parking stalls provided adjacent to the proposed site. Under the FWCC, 20 square feet of interior parking lot landscaping is required for every parking stall when up to 49 parking stalls is provided. As such, a 180 square foot parking lot landscape island of Type III landscaping must be installed in the northern most parking stall, reducing the number of parking stalls to nine. This landscaped island will serve to act as both a perimeter and parking lot vegetative buffer. Please refer to the redlined landscape plans for details. The applicant has proposed that additional parking will be provided across the street in a parking lot that is owned by the same party owning the structure in which the church use is proposed. This additional parking area appears to be in a state of disuse and is substandard in terms of current development regulations. The parking area must be cleared of all debris, re-striped, and the perimeter landscape beds must be replanted with Type III landscaping. The landscape beds must also be weeded and mulched. Please submit a landscape plan, prepared by a licensed Washington State landscape architect, that provides for the necessary landscape improvements. H) Height/Facade Length:The maximum building height allowed is 35 feet above average building elevation. The existing structure appears to meet this requirement. I) Community Design Guidelines:The project is also subject to FWCC Article XIX, Community Design Guidelines Pursuant to FWCC Section 22-1634(d) (enclosed), pedestrian connections should be provided between properties to establish pedestrian links to adjacent buildings, parking, and public right-of-ways. There is currently no pedestrian pathway from South 310th Street to the proposed church entrance. A pedestrian path will also need to be provided between any shared parking areas and the primary building. Be aware that pursuant to FWCC Section 22-1634 (enclosed), approved methods of delineation include: stone, brick, or granite pavers; exposed aggregate; or stamped and colored concrete. Paint striping on asphalt as a method of delineation is not allowed. Please refer to the redlined site plan for suggestions for a pedestrian connection between the proposed entrance and South 310th Street. Additionally, primary entrances to buildings should be clearly visible or recognizable from the right-of-way. As proposed, the primary entrance to the part of the building that would be used for the church is in no way differentiated from the side of the building. It will be necessary to install an awning or other architectural element that will highlight the proposed entrance. This structural appurtenance must be harmonious with the rest of the Doc.I.D.14896 Mr. Shawn Q Penn Page 5 June 27, 2001 building. Please submit architectural drawings of the proposed awning, and include a materials or color board. Façade Modulation;The requirements of building design are laid out in FWCC Section 22- 1635. One requirement of this code section is that all building facades that are both longer than 60 feet and visible from a right-of-way shall incorporate at least two design guideline options. The structure on the proposed project site has facade lengths of greater than 60 feet; however, there is sufficient modulation to satisfy code requirements. J) Garbage and Recycling Receptacles: Pursuant to FWCC Section 22-949 (enclosed), storage areas for garbage and recycling receptacles must be provided on site. The minimum of 65 square feet of storage space must be provided for recycling. Please submit a site plan indicating the location of the garbage and recycling enclosures. Refer to the enclosed FWCC Section 22-949 for information on locating and screening outdoor garbage and recycling receptacles. K) Sign Requirements:Please be advised that pursuant to FWCC Section 22-1599, no sign shall be erected, moved, enlarged, altered, or relocated by any person without a permit issued by the City. A sign permit may be obtained for Crosspointe Community Church after land use approval has been issued for the site. For your information, a multi-tenant building in the Community Business zone is permitted a medium profile freestanding sign. L) Other Considerations:It will be necessary to identify exactly what part of the building will be used for the proposed church. If you intend to use the entire building at any time, then land use approval, the Transportation Management Plan, the requirements of the Federal Way Fire Department and Building Division will apply to the entire building. Development regulations cannot be applied in part based on temporary use of a portion of the site. Your application should include a written narrative that clarifies your intention to use either part of the structure or the entire structure, for this will determine the direction of the City's review. Please be advised that you are required to obtain a business registration from the City of Federal Way in order to operate as a church. The necessary information can be obtained at City Hall. All structures over 4,000 square feet require a professional stamp. 3) Two exits are required from what is now designated as the Worship Room. Additional doors from the A-3 space shall be considered as an exit doors per UBC 1003.3.1.1 as amended. All exit doors shall not be fitted with a lock or latch unless it is panic hardware (UBC 1007.2.5). 4) Based on 4,494 Square feet, which does not include all the area adjacent to the common area and the additional space now designated as "M", UBC Chapter 29 requires a minimum of 1 male water closet and 2 female water closets. One water closet for females is insufficient. 5) Per UBC 3405, "no change shall be made to the use of the building that would place the building in a different group of occupancies, unless such building is made to comply with the requirements of this code for such division or group of occupancy". Based on this code requirement, a change of use from M to A-3 will require that all requirements for an A-3 be met. They are being given full use of the building until a tenant is found for the other half. The Church would like to move into the space as it is without any changes. The building was designed and built under the 1985 UBC and the then current energy code. The original design occupancy was B-2. The previous building tenant was a paint store, which under the current code is an M occupancy. I have looked at the plans for the building and have analyzed the building from the standpoint of converting either all of the building or half of the building to an A-3 occupancy. To qualify as an A-3 occupancy the assembly space would have to be restricted to a maximum seating of 299, the Church is looking at the Worship Room having an occupant load of 227. There are only 51 parking stall connected with this facility, which under the current zoning code requires 1 stall per 5 seats. At an occupant load of 227 the Church needs 45 stalls.. The Church currently has 51 members.. Attached is a code spreadsheet analysis of the building showing that it meets code for the A-3 occupancy. I have also attached a tenant improvement floor plan that shows room size for the proposed Church. The existing building has one or more rooftop forced air units. I am waiting for a report on the amount of cfm provided. The Church will need a total of 4,155 cfm for their portion of the facility.
