RES 22-831 - Amending 2022 Fee ScheduleRESOLUTION NO. 22-831 A RESOLUTION of the City of Federal Way, Washington, amending the fee schedule for 2022 established by Resolution No. 21-817 and amended by Resolution No. 22-820, to modify school impact fees. WHEREAS, the City of Federal Way ("City") is authorized by Chapter 82.02 RCW to condition new growth and development within the City upon the payment of a proportionate share of the cost of new school facilities to serve such new growth and development through the assessment of impact fees; and WHEREAS, the City is further authorized by Chapter 82.02 RCW to impose impact fees on behalf of and for the benefit of the Federal Way School District ("District"); and WHEREAS, Chapter 19.95 of the Federal Way Revised Code ("FWRC") provides that the City shall collect school impact fees, based on the fee schedule adopted by City Council, from all residential development activity in the City; and WHEREAS, FWRC 19.95.030 provides that the impact fee shall be based on a capital facilities plan developed by the District and adopted by reference by the City as part of the capital facilities element of the City's comprehensive plan; and WHEREAS, the District's Capital Facilities Plan, as the same exists or my hereafter by amended, has been adopted as part of the capital facilities element of the City's comprehensive plan; and WHEREAS, under FWRC 19.95.100, the District is required to annually submit to the City, by no later than May I" of each year, the annual update of the District's capital facilities plan, containing an updated fee calculation and a proposed revised fee schedule; and WHEREAS, FWRC 19.95.110 provides that the City Council shall review the materials Resolution No. 22-831 Page 1 of 17 received from the District on an annual basis and may make adjustments to the fee schedule on the basis of such review; and WHEREAS, the City and the District entered into an Interlocal Agreement on December 22, 1995 (AG 96-174), that further identifies the District and City's role in the collection and distribution of impacts fees on behalf of the District; and WHEREAS, the District adopted its annual update to the District's capital facilities plan in May, 2022, and provided the updated capital facilities plan ("Updated Plan") to the City on July 21, 2022; and WHEREAS, the Updated Plan provides that due to declining enrollment, the updated school impact fee recommendation is zero for all types of residential development; and WHEREAS, the City Council finds it necessary to revise the City's school impact fees in accordance with the District's adopted Updated Plan. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, RESOLVES AS FOLLOWS: Section 1. Fee Schedule. The City hereby adopts and incorporates the amendments to the 2022 Fee Schedule attached as Exhibit A. Section 2. Severability. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this resolution. Section 3. Corrections. The City Clerk and the codifiers of this resolution are authorized to make necessary corrections to this resolution including, but not limited to, the correction of Resolution No. 22-831 Page 2 of 17 scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any references thereto. Section 4. Ratification. Any act consistent with the authority and prior to the effective date of this resolution is hereby ratified and affirmed. Section 5. Effective Date. Fee is based on estimated hourly staff costs. C. REFUNDS OF LAND USE FEES. The Filing Fees as set forth in the Fee Schedule for the City are established to defray the cost of posting and processing and the proceedings in connection with a land use application. The Director of Community Development may authorize the refunding of not more than 80 % of the total application fees paid provided the applicant presents a written request to withdraw or cancel the application. The refund amount shall be determined at the Director's discretion and be based on the amount of staff resources utilized at the time of the request. D. MULTIPLE FEES When multiple land use fees are required for the same project, the highest fee shall be charged at full cost and each additional fee shall be charged at 25 % of listed cost. Exceptions: 1) If a land use permit is required in conjunction with a subdivision application (preliminary plat, short subdivision or binding site plan), full fees for both types of permit shall be charged. 2) SEPA fees shall be charged at the full rate shown. SECTION EIGHT. MISCELLANEOUS. (MAYOR) Miscellaneous Review, Inspection or other Activity (Land Use, Public Works & Building Permit Services): Any public works, land use or building permit -related review, inspection or other activity not covered by the fee schedule, if performed by a City employee, is based on actual hourly cost, plus benefits of 35 % , plus overhead of 25 % , plus a $15/hr computer usage fee. (IT) In order to accommodate the high cost and need to continually replace telecommunications, data, network, hardware, and software systems caused by a continuous and rapidly changing technology environment, the technology fees shall be applied to the following transactions: A. Business license fees. A fee of one dollar ($1) per business license transaction unless the business is exempt from payment of the business license fee B. Parks and recreation fees. A fee of one dollar ($1) per transaction for each registration for any parks and recreation program. For the purposes of this subsection, 'transaction" shall mean the process of collecting and receipting fees and charges in the form of cash, check, or credit card payment for programs, services, or miscellaneous resale items offered by the parks and recreation department. The fee shall not apply to the following: 1. The fee shall not apply to registrations or transactions with a total cost less than ten dollars ($10); 2. The fee shall not apply to drop -in transactions (such as, for example and without limitation (1) time payment for use of the weight room at Community Center). C. For all other applications, permits, inspections, registrations, transactions, and approvals established under the Federal Way Revised City Code, the fee shall be established by council resolution.
