Dear Mr. Rhodes:
I am in receipt of your November 6,2003, letter in which you indicated your interest in trimming 25
maples trees on your property. While your letter and accompanying map indicate that the trees are located
on a steep slope,you acknowledge that trees stabilize the hillside and that you want to ensure that this
stabilization will continue.
The subject site is located in lot 6 of the plat of Marine Hills Division 17.The plat map depicts a,"Native
growth protection easement between the top of bank line and the rear property line."
According to City records,following the clearing and topping of trees located on the slope adjacent to
your home,the Federal Way Code Compliance Officer indicated in a July 14, 1999 letter,that based on a
July 31, 1997 interpretation,there was a procedure for obtaining approval for,"...temporary
encroachment into a sensitive area for view enhancement and vegetation control."While no further
enforcement action was taken,the letter advised that future work would require City approval prior to any
activity. A copy of his letter is enclosed.
The Federal Way City Code(FWCC)regulates both vegetation removal and trimming of trees,as well as
any activity that is proposed on or within 25 feet of geologically hazard areas. One type of a geologically
hazardous area is a steep slope hazard area,which is defined as those areas with a vertical relief of 40
percent or more and with a vertical rise of 10 feet or more for every 25 feet of horizontal distance. A
proposal to top trees located within geologically hazardous areas requires review under Use Process I,
based on the July 31, 1997, interpretation.
In order to apply for a Use Process I application to top maple trees in a steep slope hazard area,the
following must be submitted:
• A completed Master Land Use Application
• Hourly review fee deposit of$57.501
• Four copies of a written Vegetation Control Plan that is prepared by a Certified Arborist that
contains or addresses items A-F of the Interpretation for Temporary Encroachment in
Environmentally Sensitive Area Setback for Vegetation Control and Enhancement.
• Four copies of a written response to the Decisional Criteria 1-6 of the Interpretation for
Temporary Encroachment in Environmentally Sensitive Area Setback for Vegetation Control
and Enhancement.A Certified Arborist must prepare the response as well.
Please note that fees quoted in this letter are valid to December 31,2003,and will increase in 2004 based on direction provided
by the Federal Way City Council.

Please note that in order to be approved under Process I, a vegetation management proposal should result
in minimal impact on the function and quality of the environmentally sensitive setback area when
established guidelines are followed.The Process I application will be checked at intake to determine if the
application can be considered complete. Staff should be able to review the complete application and issue
a decision in approximately 38 days.
Under FWCC Section 22-1286,the installation or maintenance of landscaping normally associated with
residential use may not occur on or within 25 feet of a geologically hazardous area, unless no reasonable
alternative exists, and then only if the work will not will not lead to or create any increased slide, seismic,
or erosion hazard. Should the City determine that the vegetation control plan impacts the steep slope
areas,a soils report prepared by a qualified professional engineer licensed in the State of Washington
must be submitted. The report must describe how the proposed work will impact each of the following
and provide recommendations based on the findings as per FWCC Section 22-1286:
• Slope stability, landslide hazard and sloughing
• Seismic hazards
• Groundwater
• Seeps, springs, and other surface waters listed in the subject property
• Existing vegetation
Additionally, work that adversely impacts the steep slope areas may not be exempt from environmental
review under the State Environmental Policy Act(SEPA)pursuant to FWCC Section 18-143. If SEPA is
required, a completed environmental checklist, mailing envelopes,and a$1,486.00 filing fee must be
submitted. A preapplication conference is required for projects that require SEPA unless exempted
pursuant to FWCC Section 22-1653(2).

Dear Mr. Fewins,
I am thinking about re-topping and trimming 25 Maple trees on my property
located at 850 So.Marine Hills Way. The trees are on a steep slope to the west of my
home and maybe in a sensitive area. I am well aware of the fact that the tress stabilize
