The project is designed to route stormwater run-off from South 308th Street to Steel Lake via a controlled conveyance system. The project includes constructing approximately 170 linear feet of 12-inch underground storm drain pipe and associated structures, and improving approximately 130 linear feet of grass swale between the storm drain pipe outfall and Steel Lake. The project is designed to eliminate potential flooding of an existing single-family residence and improve stormwater quality.A portion of the project lies within 200 feet of Steel Lake and therefore,the proposal requires review under the Washington State Shoreline Management Act. Under Process III land use review,the Director of Community Development Services renders a written decision after considering all of the information and comments submitted on the matter, and based upon the decisional criteria in Federal Way City Code(FWCC) Section 22-395 and the applicable criteria for the underlying application. FINDINGS 1. The subject property is zoned RS 7.2, and the Comprehensive Plan Designation is Single-Family High Density. 2. The project site runs within a 15-foot wide storm drainage easement adjacent to a side property line of a residential property at 2006 South 308th Street,between two existing single-family residences. The site is located on the south side of Steel Lake and is located landward of the ordinary high water mark of Steel Lake, between an existing bulkhead at the lake's edge and South 308th Street. The subject property and neighboring property are both developed with single-family residences. Construction of the drainage improvements will not affect either of the existing neighboring residences. 3. The subject drainage project is proposed to improve an existing storm drainage conveyance corridor/ditch that is currently located in the approximate location of the proposed improvements. 4. On March 10, 2001, and March 17, 2001,the Community Development Services Department published Notice of Land Use and Shoreline Substantial Development Permit Application and Notice of Anticipated Determination of Nonsignificance in the Federal Way Mirror. In addition, in conformance with applicable code standards, public notice boards were posted at the site, city hall, and public libraries, and a public notice of application was mailed to agencies with jurisdiction and owners of property within 300 feet of the site on March 9, 2001. The notice of application 28-day comment period expired on April 9, 2001. 5. One written comment letter was received by the city, from the Neubauer's, a neighboring property owner. The Neubauer's comments were generally regarding the location of the proposed improvements in relation to their side yard property line, abutting the proposed project. The city responded to the Neubauer's in an April 24, 2001 letter. 6. The State Environmental Policy Act(SEPA) Determination of Nonsignificance was finalized on April 24, 2001, and no appeals of the SEPA decision were filed. 7. The proposal is within 200-feet of Steel Lake, a shoreline of the state as defined by the Revised Code of Washington (RCW)90.58.030, and is regulated by the Washington State Shoreline Management Act and City of Federal Way Shoreline Master Program. 8. The site is located in Federal Way's"Urban" shoreline designation. 9. Stormwater conveyance facilities are processed according to the use regulations for utilities in the city's Shoreline Master Program. 10. The proposed project is consistent with the following policies from the Federal Way Shoreline Master Program (Comprehensive Plan): Shoreline Use Activities Section—Utilities LUP119—In developed shorelines not served by utilities, utility construction should be encouraged to locate where it can be shown that water quality will be maintained or improved. LUP 123—New utility facilities should be located so as neither to require extensive shoreline protection nor restrict water flow, circulation or navigation. LUP 125—New utility routes should be designed to minimize detrimental visual impact from the water and adjacent uplands. Shoreline Environments Section—Urban Environment L UP84—Emphasis should be given to development within already developed areas. LUP 88—Redevelopment and renewal of substandard areas should be encouraged in order to accommodate future users and make maximum use of the shoreline resource. 11. The project has been reviewed and is consistent with the shoreline development regulations contained in FWCC Section 18-165(g), utilities. 12. Pursuant to FWCC Section 18-170, applications for Shoreline Substantial Development Permits are reviewed under the provisions of Process III review. 13. The proposal is within 25-feet of Steel Lake, a Regulated Lake under FWCC Section 22-1,and is subject to the Regulated Lake provisions of the FWCC. Pursuant to FWCC Section 22-1335(3),the Director of Community Development Services may permit the placement of a utility in the setback area of a regulated lake if she determines that the line or improvement must traverse the setback area because no feasible alternative location exists based on an analysis of technology and system efficiency. The specific location and extent of the intrusion into the setback area must constitute the minimum necessary encroachment to meet the requirements of the utility. The linear drainage facility is proposed to upgrade an existing drainage course, and is in approximately the same location of the existing drainage course that presently traverses the regulated lake setback area. The proposed storm drainage improvements will not create any additional intrusions into the regulated lake setback area than what currently exists,and it is not feasible to reroute or relocate a natural drainage conveyance path. The proposed 15-foot wide intrusion into the regulated lake setback area is the minimum width necessary to construct, operate, and maintain a public drainage corridor. 15. The proposal as designed meets the decisional criteria of FWCC Section 22-395(b), and embodies design principles that protect the public health, safety,and welfare by upgrading a public storm drainage facility and improving stormwater quality. CONCLUSIONS The Shoreline Substantial Development Permit, and Process III application has been reviewed for compliance with the Washington State Shoreline Management Act, Shoreline Master Program,Federal Way Comprehensive Plan, pertinent shoreline and zoning regulations, and other applicable city regulations. The proposal meets the decisional criteria of the applicable regulations and Process III review as discussed in the above findings. Based on the findings and conclusions of this review, approval of the project is warranted. This decision shall not waive compliance with future City of Federal Way codes, policies,or standards relating to this decision. The project consists of replacing/enhancing a short section of storm water drainage system. There are two phases for this project: phase I was proposed last year to install 120 linear feet of storm drain pipe and associated structures. However, only about 20 feet of pipe and two catchbasins were installed. Phase II, including the balance of phase I, consists of replacing approximately 170 linear feet of existing overland drainage system with storm drain pipes and associated structures, and improving approximately 130 linear feet of grass swale between the pipe outfall and Steel Lake. Two goals will be achieved by this project: potential flooding to a nearby home will be eliminated by routing stormwater runoff from public street to Steel Lake in a controlled fashion; and water quality treatment will be provided/enhanced by catching sediments in newly provided catchbasin sumps and filtering in the enhanced bioswale before it is discharged to Steel Lake. 12. Location of the proposal. Give sufficient information for a person to understand the precise location of your proposed project,including a street address,if any,and section, township, and range, if known. If a proposal would occur over a range of area,provide the range or boundaries of the site(s). Provide a legal description,site plan,vicinity map,and topographic map,if reasonably available. The project is located at 2006 South 308`h Street in the city of Federal Way. It is in the northwest quarter of Section 9, Township 21 N, Range 4 E. Figure 1 shows the vicinity and location of the project area. B. ENVIRONMENTAL ELEMENTS: 3 1. EARTH: a. General description of the site (underline one: flat, rolling, hilly, steep slopes, mountainous, other The topography of the project site slopes to the north. The difference between the highest and lowest points along the project alignment is 31 feet over a distance of approximately 300 feet,and the average grade is approximately 10 percent. b. What is the steepest slope on the site(approximate percent slope)? Over the entire project alignment, the average slope is approximately 10 percent with a 3.5 feet of drop at approximately 35 feet to the south end of the project. The drop is protected by a rock/concrete retaining wall. c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, and muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. According to the King County Soil Survey, the primary soil series in the general project area is Alderwood gravelly sandy loam, 0 to 6 percent slopes(AgB),that is defined as: Alderwood gravelly sandy loam, 0 to 6 percent slopes (AgB). This series is made up of moderately well drained soils that have a weakly to strongly consolidated substratum at a depth of 24 to 40 inches. The surface layer and subsoil are very dark brown, dark- brown, and grayish-brown gravelly sandy loam about 27 inches thick. The substratum is grayish-brown, weakly consolidated to strongly consolidated glacial till that extends to a depth of 60 inches and more. Runoff is slow and the erosion hazard is slight. d. Are there surface indications or history of unstable soils in the immediate vicinity? If so,describe. There are no indications of unstable conditions along the project route e. Describe the purpose, type, and approximate quantities of any filling or grading proposed. Indicate source of fill. Approximately 150 cubic yards of soil will be excavated and backfilled for the construction of the storm drainage improvements(pipelines). f. Could erosion occur as a result of clearing, construction, or use? If so, generally describe. The proposed excavation and backfill activities have the potential to cause limited erosion during construction. Timing and phasing of construction, the amount of fill removed, the effectiveness of erosion-control measures, and weather conditions would influence the extent of this erosion potential. 4 g. About what percent of the site will be covered with impervious surfaces after project construction (for example, asphalt or buildings)? This project will not result in any net increase in impervious surfaces on the project site. h. Proposed measures to reduce or control erosion, or other impacts to the earth Construction is to be performed during dry periods (e.g., during summer months) followed by immediate restoration and enhancement of vegetation, if applicable. An erosion and sedimentation control plan will be developed as part of the final design to minimize impacts of erosion during construction. Measures would include vegetative controls, structural controls such as fabric filter fences, gravel berms, and other Best Management Practices (BMPs). Monitoring and maintenance of such control measures would be conducted throughout project construction to ensure proper performance. 2. AIR: a. What types of emissions to the air would result from the proposal(i.e., dust, automobile, odors, and industrial wood smoke) during construction and when the project is completed? If any, generally describe and give approximate quantities if know. A variety of construction activities associated with the project, if not properly mitigated, would temporarily generate particulate with a diameter less than 10 microns (PM10) and small amounts of carbon monoxide(CO). Emissions of PM10 and CO from construction activities would be temporary in duration and small in quantity compared with existing background levels from other sources such as automobiles. Excavation activities by heavy equipment will generate dust from the site. Vehicles leaving the site may deposit mud on public streets, which could then become a source of dust after it dries. b. Are there any off-site sources of emissions or odors that may affect your proposal? If so, generally describe. No off-site sources of emissions or odor would affect the proposal. c. Proposed measures to reduce or control emissions or other impacts to air, if any: Particulate emissions in the form of fugitive dust during construction activities are regulated by the Puget Sound Air Pollution Control Agency (PSAPCA). PSAPCA regulations require best available control technology to control all emissions of fugitive 5 t dust. These requirements further stipulate that fugitive dust from construction activities shall not be injurious to human health, plants and animals, or property, and shall not unreasonably interfere with the enjoyment of life and property. In addition, the operation of a vehicle that deposits particulate matter on a paved, public highway is prohibited. Incorporating mitigation measures into construction specifications for the project would reduce construction impacts to local air quality. Mitigation measures to control PM 10, deposition of particulate matter, and emissions of CO during construction could include the following: • Spraying exposed soil with water would reduce emissions of PM10 and deposition of particulate matter. • Covering all trucks transporting materials would eliminate particulate blowing off trucks during transportation. Wetting materials in trucks or providing adequate freeboard (space from the top of the material to the top of the truck ) would reduce PMIO and deposition of particulate during transportation. • Removing particulate matter deposited on paved, public roads would reduce mud on area roadways. • Routing and scheduling construction trucks to reduce traffic delays during peak travel times would reduce secondary air quality impacts caused by reduction of traffic speeds while waiting for construction trucks. • Requiring appropriate emission control devices on all construction equipment powered by gasoline or diesel fuel would reduce CO emissions in vehicular exhaust. Using relatively new, well-maintained equipment would reduce CO emissions. 3. WATER: a. Surface: 1) Is there any surface water body on or in the immediate vicinity of the site (including year round and seasonal streams,saltwater,lakes, ponds, wetlands): If yes, describe type and provide names. If appropriate, state what stream or river it flows into. Steel Lake is the discharge point for the project and is located to the north of the project. Steel Lake drains to Puget Sound through Redondo Creek. 2) Will the project require any work over, in, or adjacent to (within 200 feet) the described waters? If yes,please describe and attach available plans. The pipe outfall of the project will be approximately 130 feet to Steel Lake. The bioswale improvement will be between the pipe 6 outfall and the bank of Steel Lake. See Figure 2 for detail. Application for Shoreline Management Substantial Development Permit is in the process. 3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and indicate the area of the site that would be affected. Indicate the source of fill material. There will be no filling and dredging in or from surface water or wetland. Excavation activities in and along the pipeline route will not affect local water bodies. 4) Will the•proposal require surface water withdrawals or diversions? Give general description, purpose,and approximate quantities if known. No surface water withdrawals or diversions will be required as part of this project. 5) Does the proposal lie within a 100-year floodplain? If so, note location on the site plan. The proposed project does not lie within a 100-year floodplain. Localized flooding occurs along the project route, hence the storm drainage improvement is being proposed. However, the flooding is not the result of surface water levels of a floodplain. 6) Does the proposal involve any discharges of waste materials to surface waters? If so,describe the type of waste and anticipated volume of discharge. No discharges of waste materials into surface waters are anticipated as a result of the construction of this project. b. Ground: 1) Will ground water be withdrawn, or will water be discharged to ground water? Give general description, purpose, and approximate quantities if known. There will be no ground water withdrawn nor water discharged to ground water. 2) Describe waste material that will be discharged into the ground from septic tanks or other sources, if any (for example: domestic sewage; industrial, containing any toxic chemicals; agricultural; etc.). Describe the general size of the system, the number of such systems, the number of houses to be served (if applicable),or the number of animals or humans the system(s) is(are)expected to serve. 7 t The proposed project will not require the discharge of waste material to groundwater from septic tanks or other systems. c. Water Runoff(Including Storm Water): 1) Describe the source of runoff(including storm water) and method of collection and disposal,if any(include quantities,if known). Where will this water flow? Will this water flow into other waters? If so,describe. Runoff in excess of the soil/surface absorption capacity originates within the sub-basin. This water flows towards the north and discharges into Steel Lake. Typical contaminants found in this water will be filtered through the bio-swale prior to discharge to the lake. 2) Could waste materials enter ground or surface waters? If so, generally describe. The quality of storm drainage from the local sub-basin is typical of a residential area in that the major runoff components emanate from streets,driveways, and rooftops. d. Proposed measures to reduce or control surface, ground, and runoff water impacts, if any: During the construction of the facilities proposed for this project, diversion of runoff water will be provided where appropriate. The erosion control plan developed for this project will address runoff control as well. Federal Way's Department of Public Works is involved in implementing a citywide surface water control program. The goal is to generally manage storm water runoff which emanates from properties and streets within the City and which eventually enters nearby streams. The Department's on-going surface water management program includes specific projects such as this proposed action, as well as public education, regular street sweeping and storm system cleaning, and investigation of local surface water complaints. Source controls are promoted as part of this program, as well. 4. PLANTS: a. List other proposed measures to reduce or control energy impacts, if any: Proposed measures to control energy impacts during construction would include the following: Limiting idling of construction and employee vehicles; encouraging carpooling or vanpooling of construction workers to and from the work site; locating construction staging areas as close as possible to the site; and phasing construction and designing efficient detours to limit idling traffic. 7. ENVIRONMENTAL HEALTH: a. Are there any environmental health hazards, including exposure to toxic chemicals, risk of fire and explosion, spill, or hazardous waste that could occur as a result of this proposal? If so, describe. The proposed project may be constructed near sanitary sewer, potable water and natural gas pipelines (see-attached drawings). A survey of utilities will be prepared and areas where in-ground utilities cross the proposed stormwater pipeline improvements measures shall be taken to ensure careful construction management practices will be followed to minimize construction-related accidents or injuries. There is not anticipated to be any potential for exposure to toxic or hazardous materials, explosion risks, or other environmental health hazards associated with the construction or operation of the project. 1) Describe special emergency services that might be required: Construction-related accidents or injuries may require response by local fire, police, aid units, or ambulances. 2) Proposed measures to reduce or control environmental health hazards,if any: 10 None are necessary. b. Noise: 1) What types of noise exist in the area which may affect your project (for example: traffic,equipment,and operation,other)? There are no noise sources in the project area that would affect the proposed project. 2) What types and levels of noise would be created by or associated with the project on a short-term or a long-term basis (for example: traffic, construction, and operation, other)? Indicate what hour's noise would come from the site. Construction activities would generate short-term noise during the construction period of the project. Project construction would involve removing.of paved surfaces and repaving, excavation, pipeline placement activities, and replanting activities. The most prevalent noise source at construction sites would be engine-powered equipment during daylight operating hours. Local noise regulations set permissible levels for operation of construction equipment. The regulations do not apply, however, to construction equipment during daytime hours, when project activities would occur. Because trucks would be present during most phases, noise from construction trucks usually would affect more people. Maximum noise levels from construction equipment could range from about 70 to 100 dBA at 50 feet and from 50 to 90 dBA at 200 feet. During construction, noise levels could temporarily increase at sensitive receptors along some sections of the pipeline route. The final project would generate no noise impacts. 3) Proposed measures to reduce or control noise impact,if any: To reduce construction noise at nearby receptors, the following construction measures have been identified: • Equipping engines of construction equipment with adequate mufflers, intake silencers, and engine enclosures to reduce their noise emissions by 5 to 10 dBA • Shielding noisy equipment with acoustic barriers to reduce noise levels • Specifying the quietest equipment available to reduce noise emissions by 5 to 10 dBA • Turning off construction equipment during prolonged periods of nonuse to eliminate noise from construction equipment during those periods • Requiring contractors to maintain all equipment and train operators to reduce noise levels and increase efficiency of operation • 11 • Limiting construction activities to between 7 AM and 8 PM Monday through Saturday to eliminate construction noises during the more sensitive nighttime hours and to comply with local noise regulations. No construction is permitted on Sundays without the Community Development Director's approval. • Locating stationary equipment away from receiving properties to decrease noise from that equipment relative to the increased distance 8.
