this letter to waive ARCO's right to appeal the City's December 12, 2000, approval of the above-referenced
application as regulated by Section 22-356 of the Federal Way City Code. We understand that with this waiver,
the appeal period is reduced from 17 days to 3 days and final approval will be granted on December 15, 2000.

Dear Mr. Ferko:
The City has completed a Process I review of the proposal submitted November 22,2000, regarding site
improvements at the above referenced site. Specifically,you are proposing to add a one and one-half foot tall
parapet to the top of the AM-PM Convenience Store, in addition to the replacement of the existing store fascia.
These improvements are intended to facilitate conformance with the Federal Way City Code(FWCC) sign code.
Zoning for the subject site is Community Business(BC). Vehicle service stations are permitted in the BC zone
pursuant to FWCC Section 22-754.
The subject site station does not meet the following FWCC Section 22-754 code requirements: the convenience
store does not meet the required 15 foot side yard setback and the gas pump canopy does not meet the 25 foot
setback required under FWCC Section 22-754, note#3.However,as the proposed parapet addition and fascia
work does not exceed 50 percent of the assessed or appraised value of the existing improvements, conformance
with the code standards is not required with the Process I application pursuant to FWCC Section 22-334(6).
The parapet addition and fascia work does not create new impervious area or change the use; does not reduce
required landscaping, buffering,open space,or public areas,does not change parking, pedestrian connections,
utilities, or easements; does not impact sensitive area or significant trees; and does not constitute a substantial
change to the approved architectural design.
Therefore, based on the City's review,the parapet addition and fascia work is administratively APPROVED. This
decision shall not waive compliance with future City of Federal Way codes,policies,and standards relating to this
project site. The effective date of the decision is December 12, 2000.Pursuant to FWCC Section 22-356, any
person who received notice of the administrative decision may appeal the decision to the Federal Way Hearing
Examiner by December 29,2000. •
An hourly Process 1 application fee of$92.00 is now clue(two hours at$46.00 per hour).This must be paid before
the building permit file number 00-]05809-CO will be issued. if you have any questions about this letter, please
