This letter summarizes the pre- application conference, at which time committee members discussed development standards applicable to the project. The various comments from other agencies are included with this letter. BACKGROUND: The proposal is to develop the site into a gasoline station and convenience store. A drive-thru lane is also shown on the site plan however, no explanation of the drive-thru usage was provided. The site is currently developed with a bank building which you propose to demolish. The zoning for the site is BN(Neighborhood Business). LAND USE DIVISION(Jim Harris,661-4019) 1. Review Process—A service station in the BN zoning district is permitted under Federal Way City Code(FWCC) section 22-723 subject to Process B1(Project Approval). Process III review is an administrative review with public notice and a written decision. 2. State Environmental Policy Act(SEPA)—Compliance with the State Environmental Policy Act is required.An environmental checklist must be submitted and reviewed prior to the city issuing an environmental threshold determination. SEPA review must conclude before the Process III approval may be granted. 3. Public Notice—All property owners and residents within 300 feet of the site are notified of the application and SEPA decision.Public notification includes posting the site, publication in the Federal Way News, and mailing to residents and owners of property within 300 feet of the site. The applicant is required to provide two sets of stamped, addressed envelopes(with City of Federal Way return address) and a list of all property owners, residents, and tenants of properties within 300 feet of the subject proposal. ' in• hen , r t. Mr. P.J.McGuire j> July 24, 1997 Page 2 4. Parking—Parking for the convenience store use requires one parking space per 300 square '. feet of gross floor area. If the proposed use of the building includes a fast food restaurant, one parking space per 80 square feet of gross floor area is required. The service station use 0 requires parking on a case-by-case basis. The total number of parking stalls is determined by adding the parking for each of the 11 proposed uses. The 11 proposed spaces meet the minimum number of stalls required for the proposed 2,500 square foot convenience store, without a separate fast food use. Modifications to decrease the required parking standards may be granted by the Director of Community Development Services based on the criteria contained in FWCC section 22-1398. Full size parking stall dimensions are 81/2 by 18 feet. Compact stalls are S'by 15 feet.No more than 25 percent of the proposed parking may be compact size. 5. Bulk regulations—The minimum setbacks for a service station and convenience store are as follows: 40 foot front setback, 10 foot side, and 15 foot rear.Pursuant to note 7 of FWCC section 22-723,the convenience store must be at least 20 feet from the east property line adjacent to the residential zone(the site plan depicts an 18 foot building setback which does not meet the 20 foot minimum). The minimum setback for the gas pump canopy and/or fueling island is 25 feet from any property line(the site plan shows a 13 foot setback from the canopy to the east property line which does not meet the 25 foot minimum). Note 1 in FWCC Section 22-723 states parking shall be located a minimum of ten feet from any property line for a service station use. 7f If the project requires dedication of land to accommodate right-of-way improvements, building setbacks shall be measured from the new right-of-way line. Building height is limited to 30 feet above average building elevation if within 100 feet of the adjacent residential zone. Structures beyond 100 feet of the residential zone may be up to 35 feet above average building elevation.Rooftop mechanical equipment must be screened from the street and adjacent properties. 6. Required Landscaping—A preliminary landscape plan, prepared by a licensed landscape architect in accordance with FWCC Article XVII,Landscaping, is required as part of the Process III submittal. The landscape plan must contain the following elements: a. Buffer Requirements—FWCC section 22-1566(e)requires type III landscaping five feet in width along the north, west, and south property lines of the subject site. Type III landscaping provides a partial visual separation of uses,to soften the appearance of Mr.P.J.McGuire July 24, 1997 Page 3 parking areas and building elevations. Type HE landscaping includes a mixture of six foot tall evergreen trees and 1.5 inch caliper deciduous trees interspersed with 24 inch tall shrubs and groundcover. Pursuant to FWCC section 22-1566, 15 feet of type I landscaping is required along the east property line adjacent to the residential zoning district. Type I landscaping consists of evergreen trees, large shrubs and groundcover that will provide a 100 percent screen within three years of planting, or a combination of 75 percent evergreen and 25 percent deciduous trees, large shrubs and groundcover, and backed by a 100 percent sight obscuring fence. The site plan submitted incorrectly shows a five foot landscape strip along the east property line where 15 feet is required. b. Parking Lot Landscaping—Type N landscaping must be provided in the interior of the parking lot in accordance with FWCC section 22-1567. Twenty-two square feet of interior lot landscaping must be provided for each parking stall for parking lots with 50 or more stalls.Parking lot landscaping shall generally be provided at the end of all parking rows, and dispersed throughout the parking area in a manner to reduce visual impact of the parking lot. c. Plant Species—The landscape plan shall state how it conforms to the drought tolerant plant species requirements of FWCC section 22-1564(f). d. Screening—Trash enclosures shall be screened from abutting properties and rights-of- way by a 100 percent sight-obscuring fence or wall and appropriate landscape screen. e. Significant Trees—A significant tree inventory must be provided with the land use application per FWCC section 22-1568(c)(2). Significant trees are generally defined as 12 inches in diameter, or 37 inches in circumference measured 41/2 feet above the ground and in good health. Significant trees do not include red alder, cottonwood, poplar, or big leaf maple. If the development on the site requires removal of more than 75 percent of the significant trees on the property, then they shall be replaced in an amount equal to 25 percent of the significant trees which existed on the site before development. Replacement tree standards are found in FWCC section 22-1568(c)(5). Significant trees in the perimeter landscape areas must be retained. f. Modification—Opportunities to modify landscape requirements are available pursuant to section 22-1570. 7. Design Guidelines—Article XIX of the Federal Way City Code applies to this project. The following list briefly identifies major elements of the design guidelines. Please review the enclosed design guidelines for all applicable design elements. 11 I II I . Mr. P.J. McGuire July 24, 1997 Page 4 a. Building facade modulation and/or screening shall incorporate at least two of the four options outlined in section 22-1635(b) of the design guidelines. b. Pedestrian connections from the sidewalk to the building provided be and, +�+� delineated by separate paved routes pursuant to section 22-1634(d). c. The drive-thru stacking lane shall be physically separated from the parking lot by type II landscaping or architectural screening pursuant to section 1634(g)(2). A drive-thru bypass lane is recommended. The drive-thru speaker shall not be audible off site. d. Additional design guideline elements include screening of lighting to adjacent properties. ;; e. Provide a bicycle rack per section 1634(d). 8. Fees—Process III review fee is$1,333. SEPA environmental review as part of a project is $472. Additional fees may include Public Works plan review fee, demolition permit fee, and building permit fees.Building permits must be obtained before any demolition, interior, or exterior work commences. 9. Signs—A sign permit must be obtained under separate permit.Pursuant to FWCC section , , 22-1601(A)(2),BN zoned properties qualify for one freestanding medium profile sign,which includes either a monument or pedestal sign. The maximum sign area is 40 square feet k maximum per face for a single tenant identification. The maximum height of a monument of f; pedestal sign is 12 feet. Wall signs are permitted, and are limited to seven percent of the exposed building face to which it is attached, provided no individual sign shall exceed 240 square feet. FWCC section 22-1601(B) allows three wall signs for a building when the largest exposed building face is between 1,000-2,999 square feet. Pursuant to notes in the zoning use chart section 22-723 for the BN zone, the hours of operation of these proposed uses may be limited to reduce impacts on nearby residential areas. b. LAND USE ISSUES 1. The use of the property is proposed to change. As such, in accordance with section 22-326 of the FWCC, all non-conforming site issues must be brought into compliance with current standards. This compliance includes storm drainage facilities. If the increase of impervious surface area is 5000 square feet or more, a storm drainage analysis will be required per criteria in the 1992 King County Surface Water Design Manual (KCSWDM). Water quality must be brought into compliance with current standards per Federal Way City Code sections 22-330 and 22-1196. The water quality facility will be designed per the KCSWDM. A Level I downstream analysis shall also be provided. The city has available 1"=100', 5 foot contour, planimetric maps that must be used for basin analysis. Contact Kevin Peterson, Engineering Technician at 661-4126 for further details. 2. Driveways may not be located closer than 150 feet to any street intersection or to any other driveway, whether on or off the subject property. (FWCC 22-1543). Refer to the Traffic Division memo regarding existing driveway locations and circulation. 3. Section 22-1473 of the FWCC requires full width right-of-way improvements along 21st Ave SW, a principal arterial. The improvements include both sides of the road and any necessary transitions. Per section 22-1524, principal arterial classification for 5 lanes, the minimum right-of-way width is 100 feet, minimum paving width is 60 feet with vertical curbs, bicycle lane, street lighting, 8 foot sidewalks with a minimum 6 foot utility/landscaping strip planted with street trees at 30 foot on center are required. Additional right-of-way may be necessary to install street improvements. Per section 22-1477 of the FWCC, the applicant may make a written request to the Public Works Director for a modification, deferment or waiver from the above requirements. A handout on these procedures is attached. 4. The site plan submitted should show the location of any existing and proposed utilities in the areas affected by construction. 5. Roof runoff shall be tightlined into the existing on-site stormwater system. 6. A separate memo from the Traffic Division is attached. Depending on their comments certain items within this memo may or may not apply. Contact the engineering plans reviewer with any questions. BUILDING PERMIT ISSUES 1. Final site improvement plans will need to be prepared for the project and submitted with the building permit application. The plans shall be drawn on 24" x 36" size sheets at a scale of 1" = 20', based on KCAS or NGVD-29 vertical datum and signed/sealed by a professional engineer licensed in the State of Washington. 2. Provide as-built storm drainage and street improvement plans on mylar per the city's as-built standard. 3. Prior to issuance of the building permit, payment of engineering review costs, Public Works inspection fee deposit, and posting of a performance bond is required. A supplemental administrative fee deposit shall also be provided in accordance with the table in FWCC section 22-151. A two-year maintenance bond in the amount of 30- percent of the bond amount will be required after acceptance of on-site and off-site improvements and as-built plans. 4. The applicant shall reimburse the City for the cost of all required regulatory, warning and street name signs that are installed prior to acceptance by the City of all other required improvements. 5. Copies of Public Works' standard checklists are available upon request to assist the applicant's engineer and other professionals in preparing plans for review. Credit was given for the trip generation of the previous use (Bank) . • The need for a left-turn lane on 1st Avenue S. at the proposed driveway location will need to be analyzed. The turn lane will provide a safe storage area for the left-turning vehicles. • The access off of S. 348th Street shall remain right-in/right- out only. • To ensure safe and efficient traffic operation, the turning movements of the tanker trucks servicing the site should be analyzed to determine the appropriate driveway width and radius. Auto-Turn computer software can be used for the analysis. The construction type for the store building will be classified as Type 5N, while the fueling canopy will be classified as Type 2N. 3. Building setbacks for the proposed structures are acceptable as shown in the proposal, except for the east side of the fueling canopy. The canopy edge is within 13 feet of the east property line which is not acceptable. Adjustment to the canopy location is required to resolve this situation. 4. All portions of the store and fueling facilities are required to be accessible in compliance to State regulations per WAC 51-30-1100. 5. The proposed food service facilities shall be submitted to the King County Health Department for review and approval prior to applying for a building permit. 6. Comply with State regulations per WAC 51-11 and 51-13 for energy conservation and fresh indoor air requirements for the store. 7. The proposed complex is feasible as presented in regard to the City's building code regulations. 8. Other issues will surely come up as the design progresses. Buildings recommends another preliminary review at the 90% mile stone of design development. The island shall be sized and graded to prevent the runoff of spilled liquids and the runon of stormwater from the surrounding area. • The fueling island shall be covered to prevent the direct entry of precipitation onto the island. Precipitation runoff from the roof/canopy of the island shall not be discharged to the sanitary sewer. • Liquids spilled, dripped, or blown onto the fueling island shall be collected in either trench drains or catchbasins. Such drains or catchbasins shall be connected to an approved oil/water separator which discharges to the sanitary sewer. • A drain valve shall be installed on the discharge side of the separator. This valve is to remain CLOSED at all times, except for washing down the fueling island or to discharge accumulated stormwater. • In the case of a fuel spill, the spilled fuel shall be pumped from the drains, catchbasins, or separator, and treated and disposed of off site in accordance with Department of Ecology regulations. • An Accidental Spill Prevention Plan (ASPP) shall be developed by the business owner. The ASPP shall include, but not be limited to, a copy of the Discharge Agreement required, a site map indicating the drain valve location, emergency phone numbers, spill response procedures, and the location of spill cleanup materials. The business may use the District model for an ASPP to develop their own (see attached). • The business shall have a designated responsible person available either on site or on call at all times. All other employees of the business shall be properly trained and familiar with the ASPP and spill cleanup procedures and shall review the ASPP and such procedures at least annually. • Any proposal for variance from these standards requires approval from the Director of Wastewater Operations prior to construction and/or commencement of discharge. A Certificate of Water Availability shall be provided indicating the fire flow available at the site. This project will require fire hydrant(s). Existing fire hydrants on public streets are available for this project. Existing fire hydrants on adjacent properties shall not be considered unless fire apparatus access roads extend between properties and easements are established to prevent obstructions of such roads. When any portion of the facility or building protected is in excess of 150 feet from a water supply on a public street, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains capable of supplying the required fire flow shall be provided. Fire hydrants: 1) Shall be located not more than 300 feet on center. All measurements shall be made as vehicular travel distance. 2) Shall not be located closer than 50 feet to any building. 3) Shall not be obstructed by any structure or vegetation, nor shall the visibility of the fire hydrant be impaired for a distance of 50 feet in the direction of vehicular approach to the fire hydrant. [K.C.F.D. #39 Administrative Policy Guideline No. 1004] Fire hydrant locations are subject to the approval of the Fire Marshal or his/her designee. When exposed to vehicular damage, fire hydrants shall be suitable protected. Fire hydrants shall be in service PRIOR to and during the time of construction. FIRE APPARATUS ACCESS ROADS Fire apparatus access roads shall be provided when any portion of the facility or any portion of an exterior wall of the first story of the building is located more than 150 feet from fire apparatus access as measured by an approved route around the exterior of the building or facility. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system,these provisions may be modified by the chief. Plans for fire apparatus access roads shall be submitted to the fire department for review and approval prior to construction. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25 ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de- sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 12 percent. [K.C.F.D. #39 Administrative Policy Guideline No. 1006] Designated fire lanes may be required for emergency access. This may be done during the plans check or after the facility is in operation. When required, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction by parking and other obstructions. Fire apparatus access road gates shall comply with K.C.F.D. #39 Administrative Policy Guideline No. 1003 (copy attached). Fire apparatus access roads shall be installed and made serviceable PRIOR to and during the time of construction. FIRE-EXTINGUISHING SYSTEMS Plans and specifications for automatic fire-extinguishing systems for the protection of commercial-type cooking equipment shall be submitted to the fire department for review and approval prior to installation. FIRE DEPARTMENT ACCESS TO BUILDINGS Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Numbers shall contrast with their background. Numbers shall be a minimum of six (6") inches in height. When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for life-saving or firefighting purposes,the chief is authorized to require a key box to be installed in an accessible location. The key box shall be of a type approved by the chief and shall contain keys to gain necessary access.
