The applicant for the project is David Warwick of Western Telecom on behalf of T-Mobile. The proposed monopole site is located in the City of Federal Way's Potential Annexation Area(PAA). The City of Federal Way has a substantial interest in development within its PAA. While the City recognizes that the proposed development is not currently required to meet the conditions of the Federal Way City Code(FWCC), the following comments are intended to provide information to King County on potential future implications related to the proposed development and to address relevant environmental issues.Additionally,the Community Meeting Public Notice indicates that the public is invited to submit alternative locations within 1/4 mile of the proposed facility. In that the City of Federal Way is within ''A mile of the proposed site,the City would respectfully submit the following information relating to jurisdictional requirements for siting a monopole within our existing City limits. Enclosed is a copy of the City of Federal Way zoning map indicating the various zones within an approximate 1/4 mile radius of the subject site. The City of Federal Way properties that are located within the stated 1/4 mile search ring include lands that are zoned Commercial Business(BC)and Multi-Family Residential(RM). Pursuant to FWCC Section 22-681 (enclosed), new monopoles are not permitted in the RM zoning district. A Personal Wireless Service Facility(PWSF)may only be located on an existing structure in a residential zoning district. As such,the properties zoned RM within the 'A mile search ring are ineligible as alternative locations for the proposed monopole. Pursuant to FWCC Section 22-762(enclosed), a 100-foot monopole is permitted in the BC zone, subject to the development standards identified in FWCC Section 22-967(3)(enclosed).Among these standards is the regulation that placement of a monopole shall be denied if placement of the antennas on an existing structure can meet the applicant's technical and network location requirements.Any application for a freestanding PWSF within the City's limits would require extensive analysis of existing structures, including, but not limited to,Puget Sound Energy poles. Mr.Greg Borba Page 2 April 2,2003 Additionally, pursuant to FWCC Section 22-967(3)(e), freestanding PWSFs are required to be designed and placed on the site in a manner that takes maximum advantage of existing trees,mature vegetation, and structures so as to screen as much of the total PWSF from prevalent views. This requirement would necessitate extensive natural screening and/or stealth technology to camouflage a proposed monopole; assuming that the applicant was able to prove that no existing structure is eligible for the proposal. Pursuant to FWCC Section 22-966(d),the siting of any new monopole is considered to be a lowest priority location, and only permitted if the applicant demonstrates to the City's satisfaction that it is not technically possible to site in a higher prioritized location (i.e. an existing structure). While the City's proposed zoning for the site at the time of annexation is BC,the City is concerned that the proposed monopole development at 27201 Pacific Highway South may be nonconforming to the City of Federal Way's development regulations, given the City's stringent screening requirements for monopole development. The property owner should be aware that creation of a nonconforming development has potential implications for all future development on the site, assuming annexation of the area occurs and the applicant exceeds nonconforming thresholds. For your information, pursuant to FWCC Section 22-334 (enclosed),nonconformances such as those related to perimeter landscape requirements,PWSF screening, and site access would need to brought into compliance with Federal Way regulations at such time as any of the following occurs: 1)change of use on the site; 2) increase in gross floor area; 3)abandonment; 5) cessation of use; and/or, 6)alterations or work in excess of 50 percent of the value of the existing improvements. The proposed monopole development could potentially create a substantial nonconformance on the site and, under Federal Way regulations,the nonconformance would be required to be brought into compliance at such time as the thresholds identified in FWCC Section 22-334 are exceeded. This project requires a Commercial Building Permit!SEPA Checklist from King County. Part of the Commercial Building Permit/SEPA process includes a community meeting prior to filing an application with King County. The purpose of this meeting is to inform the surrounding neighborhood of the proposed facility and to take public input regarding the proposed location. T-Mobile will present information relative to the availability of alternative existing structures for location within 1/4 mile and we will discuss reasons why location on those structures is not feasible. You may submit alternative locations within'A mile in writing to David Warwick,5 or more days prior to the meeting. Your alternatives will be evaluated and discussed at the meeting. Alternative sites proposed by you or other citizens can also be presented in writing at the meeting and will be subsequently considered by the applicant. The proposed project consists of installation of six(6)wireless antennas below the top of a new 100'tall monopole with ground equipment to be located at the base of the pole surrounded by a 6'tall cedar fence painted to match the existing commercial structure adjacent to the site. An 8'wide landscape buffer will surround the compound to the South and West. The purpose of the proposed project is to provide coverage for the area of portions of Federal Way,Des Moines,Kent,and King County. A map is attached that shows the proposed location of the facility. A sketch of the proposed facility is also included.
