Foundation design within the setback is required due to existing unsuitable fill materials that has been accumulating prior to the applicant's proposal. Per an addendum to the geotechnical report prepared by Gary A. Flowers,PLLC, "...foundation loads for the residence will penetrate throughout the unsuitable fill soils and into the underlying dense to very dense, glacial till soils."This method will be used to eliminate landslide or seismic hazards from impacting the residence as a result of the nearby steep slope. 2. The rest of the property is predominantly lawn grasses(see photo#4&5). The proposed building which will intrude into the 50-foot stream setback meets the criteria set in Section 22-1312 (c)(1-6)of the FWMC based on the following: a) water quality will not be adversely affected because there will be no activity within the stream. The project will use best management practices(BMPs) including a temporary erosion and sediment control plan(TESC) specific to the site during construction phase to protect water quality; b) the project will not adversely affect the existing quality of wildlife habitat within the stream or setback because there will be no intrusion into the stream and the riparian vegetation west of the subject property and the location is clearly not a wildlife habitat being a mowed lawn grass area. c) the project will not adversely affect drainage or storm water retention capabilities because grading and clearing will be limited to the building area and vegetation removal will be limited to the extent possible.
