Your request included a wetland evaluation performed by Alder NW dated June 4, 2008.The Alder NW evaluation produced findings that the on-site wetland located at 35215 1s`Avenue South should be classified as Category II,not Category I as classified in the City's critical areas inventory. As part of the wetland determination,the City has retained ESA Adolfson to conduct a peer review of the Alder NW report. FINDINGS • Review of the Alder NW evaluation and subsequent site visit conducted by Adolfson biologists Sara Noland and Lara Thoreson concludes the on-site wetland is a Category I wetland and is classified correctly in the City's critical areas inventory. As referenced in the enclosed technical memo,these findings include: o The on-site wetland is hydrologically connected via major stream to the West Hylebos Wetland Park which provides significant habitat, exceptional local significance, and a unique educational site thereby satisfying Federal Way City Code 22-1357(a)(1)(b)criteria for Category I wetlands. o Opportunity for water to flow between the on-site and off-site wetlands via culvert under 1st Avenue South,thereby meeting the criterion that the wetlands on either side should not be considered separate. CLOSING As the Adolfson findings confirm the City's Category I designation, applicable comments provided by the City's Development Review Committee meeting with the applicant May 8, 2008, shall apply. The property is a 2.7-acre site located at 35215 First Avenue South in Federal Way, Washington. ESA Adolfson also reviewed the City's 2005 stream classification and critical areas map,as well as information from the City's 1998 Wetland Inventory relevant to the Gumarin parcel. The purpose of this review was to evaluate the submitted report per the requirements of Federal Way City Code(FWCC)Chapter 22 pertaining to wetlands and streams. Document Review The Alder NW report describes the site as containing an existing single-family residence,garage,and sheds with surrounding lawn,landscaping,and mixed forest. The site is described as sloping down toward the east and northwest. Alder NW identified a stream(described as a branch of Hylebos Creek)crossing through a triangular shaped wetland in the northeast corner of the site. The wetland was delineated by Alder NW in January 2008. The report states that Alder NW revisited the wetland in May 2008 to review drainage patterns in the wetland. Alder NW states that the on-site stream enters the north side of the property via a culvert underneath an access driveway to apartments located northwest of the site. The stream runs through the on-site wetland and exits the site via a second culvert under First Avenue South. The report describes that Hylebos Creek upstream and downstream of the site has been mapped as a"major creek"by the City of Federal Way. The City's 2005 stream classification map shows the on-site stream as a"major creek." The Alder NW report concludes that the on-site wetland should be considered a Category II wetland because it is larger than 2,500 square feet and contiguous with a water body that supports fish. The report states that the on- site wetland should be considered separate from off-site wetland areas to the north and east for purposes of assigning wetland classifications and buffer requirements. They conclude that both the stream and the wetland require a buffer width of 100 feet under City code. The City of Federal Way Wetland Inventory(1998)and critical areas map(2005)indicate that the wetland on the Gumarin parcel is part of a large wetland system located along West Hylebos Creek. The central portion of this wetland is located within West Hylebos Wetlands Park,east of First Avenue South. The map shows the northwestern edge of this wetland extending onto the Gumarin parcel. While the Alder NW report describes the Matthew Herrera\Gumarin Wetland Review September 26,2008 Page 2 of 4 on-site wetland as Category II,the City of Federal Way Wetland Inventory identified this wetland system as a Category I wetland. This classification appears to have been based on the presence of three or more wetland classes,one of which is open water(FWCC 22-1357). Site Visit ESA Adolfson biologists Sara Noland and Lara Thoreson visited the site on August 28,2008. Site conditions were generally consistent with the Alder NW report description. Wetland boundary flags were still present on- site,and we agreed with the wetland boundary delineation. The on-site wetland contains a single vegetation community type(forested). Surface water three to six inches deep was flowing to the southeast within the on-site stream channel(Photo 1). No ponding was present at the upstream culvert(under the access road to the off-site apartments). This portion of the stream channel had a noticeable slope downward to the southeast. Within the central portion of the on-site wetland,portions of the stream channel were incised. A pool approximately three feet wide containing surface water approximately seven inches deep was present where the stream entered the culvert under First Avenue South(Photo 2). A similar pool was present at the off-site end of this culvert,east of First Avenue South. Both ends of this culvert were underwater and the culvert appeared to be relatively level. Very little flow was evident in the ponded areas. Review Comments We concur with the Alder NW report that the on-site stream is a"major creek,"which requires a standard buffer width of 100 feet(FWCC 22-1306). The stream buffer falls within the buffer for the surrounding wetland. We disagree with the conclusion of the Alder NW report regarding the classification of the on-site wetland. Based on the submitted wetland report and our site observations,we recommend that the on-site wetland should be considered part of the larger Category I wetland system identified in the City's wetland inventory. The on-site wetland would therefore require a 200-foot buffer(FWCC 22-1357). We do not believe that the available information supports giving the on-site portion of this wetland system a lower rating(Category II)or smaller buffer(100 feet)than the rest of the wetland system. The rationale for this conclusion is based on the following: First,one of the City's criteria for defining a wetland as Category I is that it contains"plant associations of infrequent occurrence,irreplaceable ecological functions,or exceptional local significance including but not limited to estuarine systems,peat bogs and fens,mature forested wetlands,groundwater exchange areas, significant habitat,or unique educational sites"(FWCC 22-1357(a)). The on-site wetland is hydrologically connected via a major creek to the West Hylebos Creek wetlands. These wetlands and this stream system provide significant habitat and have exceptional local significance for the City. Second,Alder NW refers to the Department of Ecology's Western Washington Wetland Rating System Manual for guidance on addressing wetlands bisected by human-made features such as roads. While the City does not use this rating system in assigning wetland classifications,we agree that it is appropriate guidance in this situation. Page 19 of the Manual(attached)specifically addresses when a wetland that is divided by a road should or should not be divided into separate"units"(i.e.,separate wetlands). Based on our site observations,there appears to be a level surface water connection between the wetland areas on either side of First Avenue South. Both sides of the culvert on either side of First Avenue South were underwater during our site visit in August 2008. The Alder NW report states that there is a difference of only 1.2 inches 2 A Matthew Herrera\Gumarin Wetland Review September 26,2008 Page 3 of 4 elevation between the ends of the culvert based on survey data. There was very little flow evident in the ponded areas on either side of the culvert. This situation provides the opportunity for water to flow between the on-site and off-site portions of the wetland. This meets Ecology's criteria for when wetlands on either side of a roadway should not be considered separate. In addition,the Alder NW report argues that,while the culvert under First Avenue South is nearly level based on survey data,there is an elevation difference of a foot or more between the"body of the wetlands"on either side of the roadway. However,this statement is not supported by surveyed elevation data within the wetlands. Recommendations Based on the above review,ESA Adolfson recommends that the wetland on the Gumarin property should be considered part of the larger Category I wetland system mapped by the City. The on-site wetland would therefore require a 200-foot buffer width. Limitations Within the limitations of schedule,budget,and scope-of-work,we warrant that this study was conducted in accordance with generally accepted environmental science practices,including the technical guidelines and criteria in effect at the time this study was performed. In this situation the open water is considered a part of one wetland that encompasses both the rooted submerged plants offshore and the shore-side plants. The absence of plants in the area of open water may only be temporary,or the submerged plants are present but not visible because they do not grow to the surface. The vegetation may also be absent due to wave action,physical removal, or herbicide applications. Wetlands Bisected by Human-Made Features When a wetland is divided by a human-made feature,such as a road embankment,the wetland should not be divided into different units if there is a level surface-water connection between the two parts of the wetland. Water should be able to flow equally well between the two areas. For example,if there is a wetland on either side or a road with a culvert connecting the two,and both sides of the culvert are partially or completely underwater for most of the year,the wetland should be rated as one. Make the down gradient wetland a separate unit,however,if the bottom of the culvert is above the high water marks in the receiving wetland,or the high-water marks on either side differ by more than 6 inches in elevation. Cases When a Wetland Should Not be Divided Differences in land uses within a wetland should not be used to define units,unless they coincide with the circumstances described above. The purpose of this work was to identify the limits of the wetland area on the property. The scope of work included a site visit on January 30, 2008, at which time we completed our site evaluation and flagged the limits of the wetland area on the property. We made a second visit to the site on May 25,to review drainage patterns within and through the wetland. PROCEDURES For the purpose of this study, we used the wetland definition adopted by the Environmental Protection Agency(EPA)and the Army Corps of Engineers (COE) for administering Section 404 of the Clean Water Act. According to this definition, wetlands are: Those areas that are inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps,marshes,bogs,and similar areas. (33 CFR 323) In accordance with this definition, a given area is designated as jurisdictional wetland if the hydrology results in inundated or saturated soils during the growing season, hydric soils are present, and the dominant vegetation is hydrophytic. Delineation procedures are based on diagnostic environmental indicators of wetland vegetation, wetland soils, and wetland hydrology. By definition, an area is designated as wetland when there are positive indicators for all three parameters. A listing of plant species has been developed for use in the methodology for delineating wetland areas. This listing assigns plant species to one of five indicator status categories ranging from Obligate wetland species, which almost always occur in wetlands, to Upland species, which rarely occur in wetlands. Diagnostic indicators of hydric soils are related to soil saturation, which leads to anaerobic conditions in the soil. Under these conditions, decomposition of organic material is inhibited and soil minerals are reduced, creating characteristic soil colors that can be quantified by comparison with Munsell Soil Color Charts. A chroma of one or less in unmottled soils or a chroma of two or less in mottled soils generally indicates a hydric soil. In addition, soils that are saturated during the growing season satisfy a criterion for hydric soils. We used a hand auger to collect soil samples from a depth of 8 to 16 inches. Wetland hydrology is defined as inundated or saturated soil conditions for at least 14 consecutive days during the growing season. If no water is present at the time of evaluation, other indicators may include topographic low points or channels, flood debris, complete absence of vegetation, or presence of hydric soils. SITE CONDITIONS/WETLAND The subject property is rectangular shaped parcel of approximately 2.7 acres. The location of the property is illustrated on the Vicinity Map (Figure 1). It is bounded on the east by 1st Avenue South, and on the north by a paved road providing access to an apartment complex off the northwest corner of the property. A gravel surfaced driveway along the SW 353rd Street right-of-way forms the south property line. The two properties to the west are currently occupied by existing single-family residences. There is an existing single-family residence on the subject property along with a garage and several smaller sheds. Except for the area immediately surrounding the home, which is occupied by lawn and landscaping, the property is largely undeveloped and is occupied by mixed forest. Topographically, the property generally slopes down from approximately elev. 246 along the west property line to ward the east and northwest. The low point on the property is on the northeast corner,where a branch of Hylebos Creek crosses the northeast corner, and enters a 48"diameter culvert under 15t Avenue South. We have identified the limits of a roughly triangular shaped wetland on the northeast corner of the property as shown on site maps prepared by CramerNW and on the attached Site Map (Figure 2). The northern and eastern limits of the wetland are generally defined by the road berms for 1'Avenue South and the roadway along the north property line. It appears that there had been some grading on the property in the past to create a larger flat area around the existing house. The southwest limits of the wetland are defined in part along the limits of the past grading. Vegetation within the wetland is dominated by red alder (Alnus rubra) trees. Understory shrub species include salmonberry (Rubus spectabilis), hardhack spirea (Spiraea douglasii), Himalayan blackberry (Rubus discolor) and red osier dogwood(Cornus stolonifera). A branch of Hylebos Creek flows through the site wetland. The creek enters the north property line through a 48" diameter culvert, and flows across the northeast corner where it enters a 48: diameter culvert under 1S` Avenue South. Upstream and downstream or the property, Hylebos Creek has been mapped as major creek under City of Federal Way stream criteria. There are forested wetland areas to the north and east of the subject property. The site wetland is separated from the off- site wetland to the north by the approximately 50ft wide road berm for the roadway accessing the apartment complex off Project No. 42508 Page No. 2 Ms. Ale Kondelis June 4,2008 the northwest corner of the property. It is separated form the wetland off the property to the east by the approximately 60ft berm for 1' Avenue South. The Washington State Wetland Rating System for Western Washington, Washington State Department of Ecology publication number 04-06-025 provides guidance for defining the extent of wetlands where there are a wetland is divided by a human-made feature, such as a road embankment. Wetlands divided by roadways are treated as separate wetlands where there is one way flow through culverts connecting the two sides of the embankment. If the wetland on either side of the embankment are to be considered as one unit, water should be able to flow equally well between the two areas on either side of the road embankment. There is a drop of almost two feet between the upstream and downstream elevations in the culvert entering the north side of the wetland. The site wetland should be considered as a separate unit from the wetland to the north. At the east end of the wetland there is less difference in the invert elevations for the upstream and downstream ends of the culvert in 1'Avenue South. At the time of observations in January and in late May,there was water movement from west to east through the culvert. Survey date shows that the difference in the culvert invert elevations across the road embankment is approximately 1.2 inch. High water marks on the west side of the road way are contained within the stream channel and there is no back up of water into the body of the wetland on either side of the stream channel. It is our interpretation that the site wetland should be designated a separate unit from the wetlands to the north and east. It is our interpretation of the City of Federal Way Wetland rating system, that the site wetland meets the criteria for designation as a City of Federal Way Category II Wetland. It satisfies the criteria for this category because it is greater than 2,500sq.ft in size and is contiguous with a water body which supports a fish population. In accordance with City of Federal Way regulations, a buffer of 100ft is assigned to Category II wetlands. The buffer for the branch of Hylebos Creek passing through the wetland is 100ft. As such the stream buffer does not extend beyond the 100ft wetland buffer. We trust the information presented is sufficient for your current needs.
