This letter summarizes comments given to you at the meeting by the members of the DRC.The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department,and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way City Code(FWCC)and relevant information handouts are enclosed with this letter.Please be advised, this letter does not represent all applicable codes. In preparing your formal application,please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION The project applicant proposes to subdivide an existing 2.67-acre residential lot into five residential lots. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review.These issues can change due to modifications and revisions in the plans.These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided.The major issues section is onlyy provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Mt AfAtelleidis Page 2 May 15,2008 • Planning Division 1. Critical areas on the subject property include Major Stream, Category I wetland,and Wellhead Capture Zone 1. 2. Proposed short subdivision is not exempt from State Environmental Policy Act(SEPA)review and is subject to threshold determination. • Public Works Development Services Division 1. Documentation showing ingress/egress rights over adjacent properties must be provided prior to plat approval if access is proposed over neighboring properties as part of the short plat. 2. Level 1 flow control and resource stream level water quality is required for this site. • Public Works Traffic Division 1. A Concurrency permit is required in order to assess project impacts and determine traffic and safety mitigation measures. 2. Street frontage improvements and right-of-way dedication are required along ls`Avenue South and South 353rd Street. 3. The current proposal needs to meet access management standards. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference.Each section should be read thoroughly. If you have questions,please contact the representative listed for that section. PLANNING DIVISION(Matthew Herrera,253-835-2638,matt.herrera@cityoffederalway.com) 1. Comprehensive Plan and Zoning Designation—The City's Comprehensive Plan designation for 35215 1st Avenue South is Single-Family Residential—High-Density. The property is currently zoned RS 9.6.The minimum lot area for residential lots in RS 9.6 zones is 9,600 square feet. Vehicular access easements,private tracts,flag poles,or access panhandles shall not be credited in the calculation of minimum lot area. 2. Procedural Information—Short subdivision review is administrative.Preliminary approval is granted by the City's Director of Community Development. A notice of application with an associated two-week comment period is required prior to preliminary approval.A two-week appeal period follows the Director of Community Development's short subdivision decision. 3. Yard Requirements—Setbacks are: Front—20 ft.; Rear—5 ft.; Side—5ft. (side yard setbacks for corner lots are 10 ft. for the portion of the lot not adjacent to the primary vehicular access). 4. Miscellaneous Residential Regulations— a) Maximum height of structures-30 ft.above average building elevation. b) Maximum lot coverage—60 percent. c) Required parking spaces—two per dwelling unit. 5. Critical Areas— a) Major stream No. J-1 traverses through the northeast portion of the subject property. Major streams require a 100-foot setback. The short subdivision application must include a stream delineation performed by a qualified professional. Stream setback areas shall be shown on the short plat map. 08-101775 Doc.ID.45165 Ms.Kondelis Page 3 May 15,2008 b) The City's critical areas inventory shows the existence of a Category I wetland on the subject property. Category I wetlands require a 200-foot setback. The short subdivision application must include a wetland delineation and evaluation.The wetland report shall include the information as detailed in FWCC § 22-1356. Wetland setback areas shall be shown on the short plat map. c) The subject property is located in a Wellhead Protection Area(Capture Zone 1).Development in Wellhead Protection Areas requires the applicant to complete and submit a Hazardous Materials Inventory Statement with the short subdivision application. 6. Buffer Averaging—Assuming the City's wetland consultant concurs with the applicant's assertion that the on-site wetland is a Category II wetland requiring a 100-foot buffer,the applicant proposes wetland buffer averaging to accommodate a storm drainage facility. In order to qualify for buffer averaging FWCC § 22-1359(b)states: "[Mutters may be averaged only when the wetland or the buffer which is proposed to be reduced contains habitat types which have been so permanently impacted that reduced buffers do not pose a detriment to the existing or expected habitat functions." If the applicant can provide information this criterion is met,then the applicant must demonstrate via Process III land use application all of the following: a. Reduced buffers will not affect the water quality entering a wetland or stream; b. Reduced buffers will not adversely affect the existing quality of wildlife habitat within the wetland or the buffer; c. Reduced buffers will not result in unstable earth conditions nor create erosion hazards;and d. Reduced buffers will not be detrimental to any other public or private properties,including the loss of open space. 7. Wetland Mitigation—The City's Traffic Division has indicated road improvements to l S`Avenue South will be required. Road improvements made in a regulated wetland will require Process IV `Hearing Examiner's Decision'.Approval for improvements within a regulated wetland shall be based on all of the following criteria: a) It will not adversely affect water quality. b) It will not adversely affect the existing quality of the wetland's or buffer's wildlife habitat. c) It will not adversely affect drainage or stormwater retention capabilities. d) It will not lead to unstable earth conditions nor create erosion hazards. e) It will not be materially detrimental to any other property in the area of the subject property nor to the city as a whole, including the loss of open space. f) It will result in no net loss of wetland area,function or value. g) The project is in the best interest of the public health, safety or welfare. h) The applicant has demonstrated sufficient scientific expertise and supervisory capability to carry out the project. i) The applicant is committed to monitoring the project and to making corrections if the project fails to meet projected goals. As part of the Process N application,the applicant shall submit a report,prepared by a qualified professional approved by the city that includes the following information: 1) Mitigation plan—A mitigation plan shall include the following elements: a. Monitoring program for a minimum of five years. f. Contingency plan. g. Subject to the applicant's election of timing alternatives,a performance and maintenance bond in an amount of 120 percent of the costs of implementing the mitigation plan or the contingency plan,whichever is greater. 2) Mitigation—Mitigation of wetland impacts shall be restricted to restoration, creation or enhancement,within the same basin,of in-kind wetland type which results in no net loss of wetland area,function or value.Where feasible,mitigation measures shall be designed to improve the functions and values of the impacted wetland. 3) Minimum Acreage Mitigation Ratio—The following are ratios for providing restoration, creation or enhancement of impacted wetland areas.The first number of the ratio specifies the acreage of wetland requiring restoration,creation or replacement and the second specifies the acreage of wetlands impacted. Wetland Category Creation and Enhancement Restoration Category I (all types) 6:1 12:1 Category II: Forested 3:1 6:1 Scrub/Shrub 2:1 4:1 Emergent 2:1 4:1 Category III: Forested 2:1 4:1 Scrub/Shrub 1.5:1 3:1 Emergent 1.25:1 2.5:1 The director may permit or require the replacement ratios to be increased or decreased based on the following criteria: a. Probable success of the proposed mitigation. b. Projected losses in function or value. c. Findings of special studies coordinated with agencies with expertise which demonstrate that no net loss of wetland function or value is attained under an alternative ratio. d. In no case shall the minimum acreage replacement ratio be less than 1.25:1. 4) Timing—All required wetland mitigation improvements, including monitoring, shall be completed and accepted by the director of community development prior to beginning activities that will disturb regulated wetlands, or the applicant shall provide a performance and maintenance bond.In either event,the applicant may not take any action that disturbs a regulated wetland or its buffer until the director has reviewed and approved the mitigation plan. All wetland-or buffer-disturbing activities, and all mitigation, shall be timed to reduce impacts to existing plants and animals. 08-101775 Doc.ID.45165 Ms.Kondelis Page 5 May 15,2008 5) Inspections—The applicant shall pay for services of a qualified professional selected and retained by the city to review the wetland mitigation report and other relevant information, conduct periodic inspections,issue a written report to the director of community development stating that the project complies with requirements of the mitigation plan,and to conduct and report to the director on the status of the monitoring program. 8. Culverts—If it is determined that the on-site stream will require culvert expansion,procedural requirements are as follows: a) The city will review and decide upon applications using Process III `Project Approval'. b) The city will allow a stream to be put in a culvert only if: i. No significant habitat area will be destroyed; and ii. It is necessary for some reasonable use of the subject property. Convenience to the applicant in order to facilitate general site design will not be considered.The applicant must demonstrate,by submitting alternative site plans showing the stream in an open condition,that no other reasonable site design exists. c) The culvert must be designed and installed to allow passage of fish inhabiting or using the stream. The culvert must be large enough to accommodate a 100-year storm. d) The applicant shall,at all times,keep all culverts on the subject property free of debris and sediment so as to allow free passage of water and,if applicable, fish.The city shall require a bond under FWCC 22-146 et seq.to ensure maintenance of the culvert. 9. State Environmental Policy Act(SEPA)—Typically short subdivisions are exempt from SEPA environmental review.This exemption does not apply if critical areas are located on the subject property. Due to the critical areas identified above, the short subdivision is subject to environmental review pursuant to SEPA.The SEPA threshold determination and the associated appeal period must be completed prior to preliminary short plat approval.A completed environmental checklist must be submitted with the short subdivision application. 10. Open Space—All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site. Short subdivisions can satisfy this requirement with a fee in lieu payment calculated on 15 percent of the most recent assessed value of the property. This payment must be made to the City's Parks Department prior to recording the short plat with the King County Division of Records and Elections. 11. Landscaping and Significant Trees—A landscape plan prepared by a licensed landscape architect is required for all subdivisions. The plan shall identify existing wooded areas, significant trees', meadows,rock outcroppings, and other landscape features.The plan shall also show all proposed buffers,open spaces, street trees,and other ornamental landscaping. Significant tree replacement requirements2,if applicable,will be implemented at the single-family building permit stage. Significant trees are defined as:(1)Twelve inches in diameter or 37 inches in circumference measured four and one-half feet above ground;and(2)In good health;and(3)Not detrimental to the community(e.g.is not diseased,dying,or likely of falling into public right-of-way,etc.)or obscuring safe site distance requirements.Significant trees shall not include red alder, cottonwood,poplar or big leaf maple. 2 If the approved development will require the removal of more than 75 percent of the significant trees on the subject property, significant trees shall be replaced in amount to 25 percent of the significant trees which existed on the subject property prior to development.For specific information regarding significant tree retention and replacements standards please refer to FWCC 22- 1568. 08-10177s Doc.I.D.45165 Ms.Kondelis Page 6 May 15,2008 12. Landscape Tract—Land divisions should provide a 10-foot-wide Type III landscape strip along arterial streets(1st Avenue South).Type III landscaping shall be provided in the separate tract.Type III landscaping is defined as a mixture of evergreen and deciduous trees interspersed with larger shrubs and groundcover.For specific information regarding planting requirements please see the enclosed Landscaping Article from the City's zoning code. 13. Retention of Vegetation—All natural vegetation including,but not limited to significant trees, shall be retained on the site to be subdivided except vegetation that will be removed for improvements (e.g. streets and utilities). 14. Land Use Applications—If it is determined the development project will require approval via Process III `Project Approval' and Process IV `Hearing Examiner's Decision',the Process III review may be consolidated into the Process IV review if the Director determines it will result in more efficient decision making. 15. Administrative Fees—Current short subdivision review and environmental review fees are$2,278.50 and$903.50,respectively. Process III `Project Approval' fees are $2,280.00 and Process IV `Hearing Examiner's Decision' fees are$3,757.50.Be advised,these fees are for review of preliminary short plat approval and SEPA determination only and do not include fees with regard to concurrency, engineering plan review, open space,etc. 16. Approval Duration—Short plat preliminary approval expires one year from the date of approval.No less than 30 days prior to the lapse of approval,the applicant may request a one-time extension limited to one year. 17. Recording—The City will record the short plat with the King County Division of Records and Elections subsequent to Public Works Department approval of submitted as-built plans. Prior to recording the short plat,all surveying and monumentation must be complete. In addition,all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (William Appleton,253-835-2730, William.appleton@cityoffederalway.com) Land Use Issues—Stormwater 1. Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual(KCSWDM)and the City of Federal Way Addendum to the 1998 KCSWDM.This project meets the requirements for a Full Drainage Review. At the time of land use site plan preliminary short plat submittal,a preliminary Technical Information Report(TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required.A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1"= 100', five-foot contour planimetric maps that may be used for basin analysis. 2. The project lies within a Level 1 flow control area,thus the applicant must design the flow control facility to meet this performance criteria.The project also lies within a Resource Stream Protection Water Quality Area.Water Quality Treatment shall be designed to meet the treatment criteria of the Resource Stream Protection Menu. 08-101775 Doc.ID.45165 Ms.Kondelis Page 7 May 15,2008 3. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. 4. Detention and water quality facilities for short plats must be above ground(i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 5. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 6. If more than one acre will be disturbed during construction,a National Pollutant Discharge Elimination System(NPDES)permit may be required.Information regarding this permit can be obtained from the Washington State Department of Ecology at http://www.ecy.wa.gov/programs/sea/pac/index.html,or by calling 360-407-6437. 7. If work is to be done below the ordinary high water mark, a Hydraulic Project Approval(HPA) permit may be required. Information regarding this permit can be obtained from the Washington Department of Fish and Wildlife,at http://www.wa.gov/wdfw/hab/hpapage/htm or by calling the office of Regulator Assistance at 360-407-7037. Right-of-Way Improvements 1. See the Traffic Division comments from Soma Chattopadhyay,Traffic Engineer, for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements,the dedication shall be conveyed to the City through a statutory warranty deed.The dedicated area must have clear title prior to recording. 3. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 4. FWCC Section 16-47 requires that overhead utility lines be relocated underground if over 500 feet, or three spans are affected by a project. 5. FWCC Section 22-1543 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection. Lots and intersections within new subdivisions or short plats must be designed to meet this standard. Building(or EN)Permit Issues 1. Engineered plans are required for clearing,grading,road construction,and utility work. Plans must be reviewed and approved by the City.Engineering review fees are$780.00 for the first 12 hours of review, and$65 per hour for additional review time.A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. In addition to engineering approval,short plats and subdivisions are required to obtain a separate permit for grading.Details and fees may be obtained from the Federal Way Building Department. 08-101775 Doc.I .45165 Ms.Kondelis Page 8 May 15,2008 3. The Federal Way Development Standards Manual(including standard detail drawings, standard notes,and engineering checklists)is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 4. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. 5. Bonding is required for all drainage and public improvements associated with the project.The bond amount shall be 120 percent of the estimated costs of the improvements.An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called.Upon completion of the installation of the improvements, and final approval of the Public Works Inspector,the bond will be reduced to 30 percent of the original amount and held for a two- year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities(including the detention and water quality facilities)and street systems during the two-year maintenance period. During that time,the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements.Upon satisfactory completion of the two-year maintenance period,the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City.Maintenance for private roads and drainage facilities, including short plats,remain the responsibility of the individual property owners. 7. When topographic survey information is shown on the plans,the vertical datum block shall include the phrase"DATUM:N.G.V.D.-29"or"DATUM:K.C.A.S.,"on all sheets where vertical elevations are called out. 8. Drawings submitted for plan review shall be printed on 24"x 36"or 22"x 34"paper.All final approved drawings shall be drafted/plotted on 24"x 36"or 22"x 34"mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1"=20', or larger. Architectural scales are not permitted on engineering plans. 9. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures,per Appendix D, 1998 KCSWDM,must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION(Soma Chattopadhyay,253-835-2745, soma.chattopadhyay@cityoffederalway.com) Transportation Impact Analysis Based on the Institute of Transportation Engineers Trip Generation 7th Edition,land use code 210 (Single- Family Detached Housing),the project is expected to generate approximately seven new weekday evening peak hour trips.Therefore, a Concurrency analysis is required for this proposal and the concurrency application fee is$327.The applicant would be expected to contribute pro-rata shares towards TIP projects impacted by 1 or more peak hour trips.Mitigation improvements necessary beyond those identified in the TIP to meet the City's adopted level-of-service standard are required to be provided by the applicant to meet concurrency requirements of the Growth Management Act. 08-101775 Doc.I.D.45165 Ms.Kondelis Page 9 May 15,2008 Street Frontage Improvements 1. Per FWCC Section 22-1474,the applicant/owner would be expected to construct street improvements consistent with the planned roadway cross-sections as shown in Map III-6 of the FWCP and Capital Improvement Program(CIP) shown as Table III-19.Based on the materials submitted,staff conducted a limited analysis to determine the required street improvements in meeting the FWCC.Based on the analysis and FWCC,the applicant would be expected to construct improvements on the following streets to the City's planned roadway cross-sections: • ls`Avenue South is planned as a Type"I" street,consisting of a 58-foot street with curb and gutter, six-foot planter strips with street trees, 8-foot sidewalks,and street lights in a 92-foot right-of-way(ROW).Assuming a symmetrical cross section, 16-foot ROW dedication and half street improvements are required and should be measured from the centerline. • South 353rd Street is planned as a Type"W"street,consisting of a 28-foot street with curb and gutter,4-foot planter strips,5-foot sidewalks and streetlights in a 52-foot right-of-way(ROW). A 22-foot ROW dedication and full street improvements are required. However,staff will support the limited modification of the street improvements consisting of 24 feet of pavement, 4-foot planter strip, 5-foot sidewalk,and 3-foot utility strip on the north side of the ROW.A 6- foot ROW dedication will be required. 2. Per FWCC Section 22-1477,the applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements. Information about right-of-way modification requests is available through the assigned planner. Such requests have a set review fee. 3. Staff supports having the owner set aside the South 353rd Street of the subject property as a Tract "X"for future ROW dedication. Access and Traffic Circulation 4. Access management standards are based on roadway safety and capacity requirements.FWCC Section 22-1543 provides access standards for streets based on planned roadway cross-sections. Please note that access classifications are per Drawing 3-1A in the Public Works Development Standards. 5. 1s`Avenue South is Access Class"3",which permits full access as close as 150 feet to any other street intersection driveway,whether on or off the subject property.Please show all neighboring driveways within 250 feet of the proposed driveway(s). 6. Per FWCC Section 22-1496,the applicant would be expected to construct on west side of the property a 12-foot(for one lot)or 16-foot(for two lots)minimum paved access on 15-foot(for one lot)or 20-foot(for two lot)minimum easement,which will connect to 30-foot easement and construct 20-foot minimum pavement with 5-foot sidewalk in 30-foot easement. 7. Internal street for three lots access from South 353rd Street should be 20-foot minimum pavement on 25-foot minimum easement. Other Comments 8. Please utilize roadway cross-section Z for a Cul-de-sac terminus dimensions(53-foot radius)or as approved by the Fire Department. 10. Please note that the maximum allowable grade for city streets/access driveways is 15 percent or as approved by the Fire Department. LAKEHAVEN UTILITY DISTRICT(Brian Asbury,253-946-5407,basbury@lakehaven.org) Water 1. A Certificate of Water Availability(application form enclosed)will presumably be required to be submitted with any land use and/or building permit applications.Allow 30 days to issue. 2. A Developer Extension Agreement will be required to construct new mainline water distribution facilities,including a new fire hydrant, for the proposed development.Additional detail and/or design requirements can be obtained from Lakehaven by completing&submitting a separate application to Lakehaven for either a Developer Pre-Design Meeting or a Developer Extension Agreement(application forms enclosed). Lakehaven encourages the owner to apply for either of these processes separately to Lakehaven, early in the pre-design/planning phase to avoid delays in overall project development. 3. A private,water easement will presumably be required across certain portions/tracts/lots of the proposed short plat,for the benefit of the portion(s)of the other short plat lot's building supply line across said property.This private easement shall cover off-site property along the route of the affected portion of the building supply line from the edge of public right-of-way or Lakehaven easement to the benefitted lots/properties. 4. A separate water service connection application(form enclosed) submitted to Lakehaven is required for each new service connection to the water distribution system, or any modification to an existing water service connection(e.g., larger service, abandonment of existing service(s), etc.), in accordance with standards defined in Lakehaven's current 'Fees and Charges Resolution'. 5. The associated Developer extension Agreement must achieve a point of either Substantial Completion or Acceptance, as determined by Lakehaven prior to activating any new domestic/commercial or irrigation water service connection(s). Sewer 1. A Certificate of Sewer Availability(application form enclosed)may be required to be submitted with any land use and/or building permit applications.Allow 30 days to issue. 2. A Developer Extension Agreement will be required to construct new sanitary sewer facilities necessary for the proposed development, including'extend-to-far-edge'requirements.Additional detail and/or design requirements can be obtained from Lakehaven by completing&submitting a separate application to Lakehaven for either a Developer Pre-Design Meeting or a Developer Extension Agreement(application copies enclosed).Lakehaven encourages the owner to apply for either of these processes separately to Lakehaven, early in the pre-design/planning phase to avoid delays in overall project development. 3. A private,sewer easement will presumably be required across certain portions/tracts/lots of the proposed short plat, for the benefit of the portion(s)of the other short plat lot's sewer service line across said property.This private easement shall cover off-site property along the route of the affected portion of the sewer service line from the edge of public right-of-way or Lakehaven easement to the benefitted lots/properties. 4. The King County parcel#is 302104-9025. The site is approximately 2.67 acres and believed to have an RS9.6 zoning designation. The site currently has a single family residence being rented. The site is also encumbered by a wetland in the NE corner. We have had some preliminary assessments preformed by AlderNW. The site also has some sloping so construction of roads and housing must be evaluated. As we understand the site history,the site was previously owned by a family of which two family members still own houses west of the site and utilize a previously recorded road easement along the southern border of the site. We intend to utilize the road easement and upgrade it to City private road standards and possibly approach the family members to the west to participate with the improvements. We would ask for City input regarding road issues. With regards to the wetland on site,we understand that there is a stream running through the site at the NE corner. The site sheet flows stromwater towards 1st Ave and into the wetland. In order to accommodate stormwater facilities on the site we will be proposing to mitigate a portion of the wetland buffer,to relocate and enhance if agreeable to the City's professional staff. We would request any guidance you can give with regard to this matter. Other than the two items listed above,roads/access and wetlands,we would request any guidance from City staff that would be pertinent to the development/subdivision of this lot as observed by staff.
