Committee members included representatives from the Lakehaven Utility District, Federal Way Fire Department,the city's Public Works Department, and Department of Community Development Service's Planning and Building Divisions. This letter follows up the preapplication meeting for your proposal. Department and agency requirements are summarized below or are enclosed with this letter. The staff contact is listed with each summary. 1. Land Use Division—Contact Minnie Dhaliwal, (253) 661-4082 a. The existing site includes a series of lots substandard in lot area. If the existing lots are simply rearranged to create new lots so that no lot is less than minimum required by zoning, and such alteration does not diminish in size open space or other protected environment, the proposal will be reviewed as a Boundary Line Adjustment. Under this process, you will be required to provide evidence that the existing substandard lots are still considered legal lots of record. This can be done by submitting a title report for the lots. A boundary line adjustment is an administrative review process with a filing fee of $829. Environmental review through the State Environmental Policy Act(SEPA) is not required for boundary line adjustments. However, if there are any environmentally sensitive areas on or near the site, Federal Way City Code (FWCC) Article XIV (enclosed) regulates development and establishes setbacks from regulated slopes, Calvin King Preapplication Meeting August 7, 1998 Page 2 wetlands, and streams. Any future development within environmentally sensitive areas will require environmental rswbA master land use application and a boundary line adjustment handout are enclosed. b. The zoning for the subject site is Residential Single Family,RS-15.0. Minimum lot size for all lots is 15,000 square feet. Per FWCC Section 22-953, subject to all other requirements of the zoning code, an applicant may build one detached dwelling unit on a lot or parcel regardless of the size of the lot or parcel, if: 1) There is or has been a residence on the subject property; or 2) The lot lines defining the lot or parcel were recorded in the county assessor's office prior to February 28, 1990, and the lot or parcel has not simultaneously been owned by the owner of a contiguous lot or parcel subsequent to that date. Since the proposed lots have had contiguous ownership since February 28, 1990, any new single family lot created will need to meet minimum lot size required by zoning (i.e. 15,000 square feet). c. FWCC Section 22-1286 regulates development activities on or within 25 feet of geologically hazardous areas. Some areas of the subject site contain steep slopes in excess of 40 percent, and hence, are considered geologically hazardous areas. A geotechnical report, soils report, and a topographical survey by a licensed survey delineating any 40 percent slope and 25 foot setback from top and bottom of that slope needs to be submitted as part of the boundary line adjustment application. Please refer to the enclosed environmentally sensitive areas chapter of the FWCC for details. Drawings submitted for boundary line adjustment review must show location and extend of significant natural features on or within 100 feet of the site. Such features shall include, but are not limited to, streams, wetlands, significant trees, and slopes of 40 percent or greater within 25 feet of the affected lots. If any building site is located within a regulated slope area,the geotechnical report must document that future home construction will not result in unstable slope conditions. d. Future residences must conform to the following structural setback requirements of FWCC Section 22-631, Detached dwelling units (enclosed): front yard, 20 feet; side yard, five feet; and rear yard, five feet. Lot coverage is limited to 60 percent and includes all impervious surfaces such as driveways, walkways, patios, and roof overhangs. If an on site sewage disposal system is utilized, Seattle-King County Department of Public Health approval must be obtained prior to city approval. Please contact them at 296-4666. Also refer to the Lakehaven Utility District memo (enclosed). f. Lots established through boundary line adjustment must reflect legal access to a public right-of-way. Improvements to public rights-of-way will be required at the time of building permit application. Refer to the Public Works memorandum for additional information. g. At the time of building permit submittal to construct residences, any trees and vegetation on the site meeting the definition of significant must be retained in accordance with t Article XVII. Significant trees shall be flagged and protection techniques for retained significant trees shall be identified during construction in accordance with FWCC Section 22-1568. Significant trees are defined as 12 inches in diameter, or 37 inches in circumference (measured 4%2 feet above the ground); in good health; and not detrimental to the community. Significant trees do not include red alder, cottonwood,poplar, or big leaf maples. 2. LAND USE ISSUES Stormwater 1. Per FWCC Sec. 21-86, since this development will create more than 5000 sq. ft. of new impervious area, surface water runoff control and water quality treatment will be required per the current King County Surface Water Design Manual (KCSWDM), the City's amendments and through the SEPA process, the Hylebos Creek and Lower Puget Sound Basin Plan. 2. The City has identified downstream conveyance, erosion, flooding and habitat problems associated with stormwater runoff from these sub-basins. At the time of engineering plans submittal, a written narrative on the relevance to the site of all the core and special requirements in KCSWDM and a level 1 downstream analysis of the drainage system will be required as well. The applicant may provide an independent study and mitigation proposal or, as an option, the applicant may provide mitigation as recommended in the Executive Proposed Basin Plan, Hylebos Creek and Lower Puget Sound. The site is located in an area recommended for enhanced stormwater infiltration and implementation of basinwide recommendation BW-2. Soils logs will be required to verify infiltration suitability. In the event that infiltration cannot be achieved and runoff must be discharged off-site, the Basin Plan calls for the use of 7-day storm events (for till soils) and 24-hr storm events (for outwash soils) with storage volume increased by a 30% safety factor in sizing on-site detention facilities. If the downstream analysis shows impacts due to the proposed development, additional stormwater controls will be needed. Any on-site facilities should be placed in a separate tract to be dedicated to the City for future maintenance. Geotechnical 1. Pursuant to FWCC section 22-1286 Geologically Hazardous Areas Development, due to the existing topography and proposed grading of the project area, a geotechnical report shall be prepared by a qualified professional engineer licensed in the State of Washington which describes how the proposed development will impact the following on the property and nearby properties: 1. Slope stability, landslide hazard, sloughing; 2. Seismic hazard; 3. Groundwater; 4. Seeps, springs and other surface waters; 5. Existing vegetation; 6. Storm water infiltration; 7. Recommended foundation design; 8. Locations for roadway improvements 9. Structural fill placement; 10. Import fill material; 11. Differential settlement; 12. Monitoring and testing Traffic/R-O-W Improvements 1. See attached memorandum from Hazem El-Assar, dated 8/6/98, for traffic and street improvement requirements. 2. Per section 22-1477 of the FWCC, the applicant may make a written request to the Public Works Director for a modification, deferment or waiver from the requirements specified in number one above. A handout on these procedures is attached. NPDES Permit 1. The applicant will need to apply for and obtain a National Pollutant Discharge Elimination System (NPDES) permit from the Washington State Department of Ecology if site grading will disturb 5 acres or more. Questions related to this matter should be directed to Mr. Glenn Piertz, Environmental Engineer with the state at 360-407-6436. BUILDING PERMIT ISSUES 1. Technical Information Report(Mt) will need to be prepared for the project and submitted with the construction permit application. The TIR will require the signature/seal of a Professional Engineer licensed in the State of Washington. 2. Prior to issuance of any building permit, the onsite and offsite improvement work must be secured by a financial guarantee (bond). The guarantee may be in one of three forms, a cash deposit, assignment of funds in a financial institution, or a bond from a surety. The bond is for 120% of the estimated construction cost. The applicants engineer prepares the estimate using bond quantity worksheets available form the Public Works Department. The bond must be completed and on file with the City when the building permit is issued. At the completion of construction and after the city receives payment of inspection fees, receives as-built mylars, and all the inspector's punch list items are completed, the bond will be reduced to 30% of the original value and be retained for a two year maintenance period. Any defects that show up during the maintenance period will require correction and subsequent inspection fees shall be paid before the maintenance portion of the bond will be released. 3. The applicant shall reimburse the City for the cost of all required regulatory, warning and street name signs that are installed prior to acceptance by the City of all other require improvements. 4. Copies of Public Works' standard checklists are available upon request to assist the applicant's engineer in preparing the plans and the TIR. 5. When topographic survey information is shown on submitted plans, as may be required, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S." on all sheets where elevations are called out. 6. All drawings shall be drafted/plotted on 24" x 36" mylar sheets with permanent black ink. Site plans shall be drawn at a scale of 1"=20' or larger. Drawings submitted for plan review shall be printed on 24" x 36" paper. 7. The site plan submitted should show the location of any existing and proposed utilities in the areas affected by construction. No traffic impact analysis is required. Right-of-Way Improvements Per FWCC Sec. 22-1474, full right-of-way improvements are required on 1st Avenue SW between SW 372nd Street and SW 371st Street. This includes 28'pavement, vertical curb, gutter, 4' planter strip with trees, 5' sidewalk, and street lights. These improvements can be accommodated within a 52' right-of-way. On SW 371st Street, SW 372nd Street, and 2nd Avenue SW, half width improvements are required along the project frontage, including a 20' pavement, vertical curb, gutter, 4'planter strip with trees, 5' sidewalk, and street lights. These improvements can be accommodated within a 26' half right-of-way. If alleys are proposed to provide access to any lots, they shall be improved to 20' pavement, with a 5' sidewalk on one side, within a 36'tract width. Alleys may not provide access to more than four lots and they shall have a 90' diameter turn-around if more than 150' long. In addition, all streets providing access to the proposed project shall be paved to a minimum of 20'width. Per FWCC Sec. 22-1477, a request for modification, deferment, or waiver from the above improvements may be submitted to the Public Works Director. Vacation requests shall follow the procedures indicated by FWCC Chapter 13, Article IV. This would require a developer extension agreement. Owner should apply separately to the District for this process at the same time formal application is submitted to the City of Federal Way to avoid delays in construction. Please allow 2 to 3 months for plan review and approval. Sewer: Sewer service is not immediately accessible in the area. Fire hydrants shall be spaced 700 ft. or less apart. Every building lot shall have a fire hydrant within 350 ft. All measurements shall be made as vehicular travel distance. Fire hydrants shall be in service PRIOR to and during construction. FIRE APPARATUS ACCESS ROADWAY Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 ft. from fire apparatus vehicle access. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25 ton fire apparatus and shall be provided with a surface so as to provide all- weather driving capabilities. 3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 1 5) Gradient shall not exceed 15 percent. 6) Serving a single residential property which have a dead end in excess of 150 feet in length shall be provided with a turn around approved by the chief. [K.C.F.D.#39 Administrative Policy Guideline No. 1006] EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Fire apparatus access road gates shall comply with K.C.F.D. #39 Administrative Policy Guideline No. 1001 (copy attached). AUTOMATIC FIRE SPRINKLER SYSTEMS An automatic fire sprinkler system shall be installed in Group R, Division 3 occupancies: 1) When the occupancy exceeds 2,500 square feet (including attached garages) without adequate fire flow. 2) Without approved fire department access. 3) When the occupancy exceeds 10,000 square feet. 4) When the building is classified as an over-water structure. Comments: The minimum fire flow for one- and two-family dwellings shall be 1,000 gallons per minute. If the slope of a building lot does not allow the building(s) on the site to comply with the "life safety/rescue access" requirement, the building(s) shall be provided with an approved automatic fire sprinkler system. Life safety/rescue access shall mean an unobstructed access to all floor levels and each roof level of a building on not less than 20 percent of the building perimeter by utilizing a 35-foot ladder. An alternate method would be at least one stairway enclosure with exit doorways from each floor level and with a door opening onto each roof level which conforms to the requirements of the Uniform Building Code. These existing lots are all 100 ft. long by 25 ft. wide and are on very steep terrain. The current zoning in the area is SR15000. This zoning reflects the minimum lot size necessary to install a septic system. There are no sewers within the area. There are few roads in the area that can be driven, even fewer that meet the current City road standards. When the minimum lot size is overlaid onto the existing platted lots, Mr. King's property could yield 8 buildable lots, (six lots within Block 21 and 2 lots within Block 22). Please refer to the attached reduced assessor's map. Two of the lots within Block 21 can be accessed from 2nd Ave. SW, south of SW 371st St. (existing road paved to the NW corner of the Block). The remaining six lots are not accessible from any existing roads. The right-of-way is existing, but the roads have not been constructed. The terrain for any potential roads is very difficult due to slopes. Mr. King would like to access at least two of the proposed lots in Block 21 from south via 1st Ave. SW. This road is partially improved with gravel and is of substandard width to within 200 ft. of the lots. There are no drainage improvements within this road. Slopes will be fairly steep 15% to 20% in both road length and width directions. A substantial amount of grading will be required. I anticipate that a right-of-way permit will be required for any proposed access for these lots. It is our desire to come to an agreement with the City to build this lot access to a reasonable standard that is cost effective for the few lots. The more lots that can be accessed (maximum of 5) from the south route, the more we can afford to invest in the access road. If the City will allow only two lots with a minimal access road, similar to a driveway, then that may be the best alternative. We have had tests and designs prepared for the septic systems and they are feasible. Public water mains are existing in the frontage right-of-ways. Please meet with us to discuss the City's position and possible alternatives. SW @ SW 372nd ST. Mr. Cal King owns several lots within Block 21 and 22 of the East Tacoma Addition in the south edge of the City. This area of the City has steep slopes and few improved roads, despite the existence of all right-of-ways and a multitude of small existing platted lots. Mr. King would like to construct an access to two of the lots in the southeast corner of Block 21 . Approx. 200 ft. of 1st Ave. SW would need to be extended to the north within the existing right-of-way. This existing road north of SW 374th does not meet current City standards. ( We are requesting that the City allows the two lots to be accessed by a new 20 ft. wide gravel surfaced road with a "hammerhead" turnaround.) This is the only economically feasible alternative to making these lots buildable. I have prepared a design for a road that would meet the City standards and would access 5 of the lots owned by Mr. King. However, as you could see by the design that is enclosed, this would be a very expensive road improvement project and would not be viable for only 5 residential lots. We need to come up with an alternative that is more cost effective. We would be willing to reduce the number of lots that would have access if the construction standards are relaxed. I understand that this may be possible if only two lots are considered. This would be more of a single joint-use driveway than a public road. Normally, the City would require curb, gutter, sidewalk, drainage and asphalt pavement. There would be a minimum street width that would require a tremendous amount of cross-grading. This type of work would be required along approx. 300 ft. of the right-of-way and possibly extending for a distance along the existing road. The potential value of the lots would be far less than the cost to construct a road of this type. I feel that the City needs to consider any development in this part of the City on a case by case basis. If the regular City standards are applied in this area, it will never be developed. From: Bob Sterbank To: TRENTW Date: Aug 5, 1998 (Wed) 5:12pm Subject: Ballinger Act Trent, the Ballinger Act was apparently the colloquial name for the 1889 Act which stated that, if a platted county road which "remains unopened for public use for the space of five years after authority is granted for opening the road" is vacated by operation of law. The statute was effectively repealed in 1909, and so affects only those county roads which were platted before 1904 (since if the road was platted in 1905, the statute was repealed before the five years was up). If SW 371st Street was platted after 1904, or if the road was located within a city, town, or village (instead of within the County) the Ballinger Act does not apply. And, I suppose there is some issue about what it means to say "authority is granted for opening the road." It could mean a simple dedication as part of a plat, or it could mean that the County formally ordered or authorized a private applicant to open the road, but it never happened. I don't know without further research. There are some cases on this, but I'll wait to hear from you as to whether this is actually a live issue before proceeding further on it. Assuming the Act applies, the question raised by Skip Tullock's memo is what use was being made by the City. You stated that you believe that there are storm drainage pipes in the right-of-way. This presents a threshold question of whether placement of storm pipes constitutes "opening a right of way for public use." Assuming that it does, the pipes would have to have been placed within five years of platting of the road. If the Act applies because the road was platted prior to 1904, and the pipes were placed after the five-year period, the road was already effectively vacated by the time the pipes were installed. So, I'd need more info about what's there and when it was put there to tell you if the street has been automatically vacated or not. Even if the street was not automatically vacated, the City could still vacate the street itself, and reestablish a street somewhere else, under RCW 35.79 (although reestablishing the street would require a property purchase or grant of an easement) . RCW 35.79. statess that a city can vacate a street but maintain an easement for utility purposes. I think that storm pipes would meet the "utility purposes" part of the requirement, and allow us to keep an easement for them. It would also allow us to vacate only a portion of the road, and maintain the rest of it. This could be key, since as I mentioned on the telephone, if part of the street was authomatically vacated the entire street is gone (unless there is an argument about a partial opening of the street) . I gave you an incomplete reference to the current vacation statute. It's RCW 35.79.030. 2. I think the portion of Skip's memo stating that existing public use defeats the street vacation was drawn from a point in the old Carolyn Lake memo you gave me. But Carolyn raised the point because public use can create a prescriptive right to the street, even if the street had previously been vacated by the passage of five years. Here, though, if the street was automatically vacated, and all there is in the former ROW is some pipes, we'd only have a prescriptive easement to maintain the pipes -- not a prescriptive street easement. After evaluating the existing conditions along SW 371°`St. and 2"d Ave. SW,review of Federal Way City Code (FWCC) provisions (Sections 22-1496, 22-1477, 22-1524), and the direction provided by the City Council, the Public Works Department hereby modifies the requirements for street improvements applicable to your permit application, as discussed below. FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works Director to grant a request to MODIFY, DEFER, or WAIVE the required street improvements only after consideration of four specific reasons. The reason most applicable here is contained in FWCC 22-1477 (1) Improvement as required would not be harmonious with existing street improvements" (2) ffinusual topographic or physical conditions preclude the construction of the improvements as required" (3) ■roper vertical or horizontal alignments cannot be determined because the existing streets do not have correct alignment" (4) "The required improvement is part of a larger project that has been scheduled for construction in the city's capital improvement program" SW 3713'St is classified as a collector street corresponding to Federal Way roadway section"T'. This roadway section requires 28-foot wide paved street with 8-foot ditch section,five-foot sidewalk,and a three-foot utility strip all within a 60-foot right of way. 2°d Ave.SW is classified as a local access street corresponding to Federal Way roadway section"X". This roadway section requires 20-foot wide paved street with 8-foot ditch section,five-foot sidewalk, and a three-foot utility strip all within a 52-foot right of way. Application of the required street improvements would result in an improved roadway section that is not harmonious with existing street improvements along 2'Ave. SW,which consist of 28-foot paved roadway,culverts,rolled curbs,no sidewalks, terminating in a cul-de-sac at the intersection of SW 371"St. and 2"d Ave. SW. As a result, the required street improvements are modified, to include constructing SW 371"St. along your frontage to, 28-foot paved road, ditch section sized to convey the 25-year storm, 5-foot gravel walk, and a 3-foot utility strip. 2'Ave. SW must be constructed along your frontage to, 20-foot paved road, ditch section sized to convey the 25-year storm, 5-foot gravel walk, and a 3-foot utility strip. Right-of-way improvements must be designed by a professional engineer registered in the state of Washington, and include enough information to determine that the streets may be extended in the future. In addition to the above, the applicant is required to execute a no protest local improvement district (LID) covenant in the event that a future LID is formed to make street improvements. A copy of the LID agreement will be prepared for the owner's signature and must be notarized and returned to the city with a $9.00 check for recording fees, made payable to King County records and elections, prior to issuance of a building permit. The conditions of this right of way modification will be applicable for one year from the date of this letter. If a building permit is not issued within the one-year time limit, the right of way modification will be void, and a new request for modification must be submitted. After evaluating the existing conditions along Southwest 372nd Street and 1st Avenue Southwest, review of Federal Way City Code(FWCC)provisions (Sections 22-1473, 22-1474, & 22-1477), and the direction provided by City Council, the Public Works Department hereby modifies the requirements for street improvements applicable to your permit application, as discussed below: FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works Director to grant a request to MODIFY, DEFER, or WAIVE the required street improvements after consideration of four specific reasons. 1st Ave Southwest 1st Avenue Southwest currently consists of an undeveloped right-of-way. Th;,,,f)toty nned roadwaysection per the current Federal Way Comprehensive Plan (FWCP) is cross sectiowhich consists of 28-feet of pavement (two twelve-foot travel lanes with 2 foot paved shou ), 8-foot-wide drainage ditches, 5-foot-wide sidewalks and 3-foot-wide utility strips within a minimuV0"foot wide right-of-way. The Public Works Department hereby requires the construction of half street improvements to the above standards along the entire length of subject property in accordance with the following conditions: 1. The street improvements shall include a minimum of 20 feet of asphalt pavement, and an 8- foot wide drainage ditch, 5-foot wide concrete sidewalk and 3-foot wide utility strip on the project side of the roadway. A temporary turn-around cul-de-sac, with a minimum 40-foot radius, shall be constructed at the northerly terminus of these road improvements. 2. The existing gravel roadway from SW 374th St to subject site shall be improved to a minimum 20-foot wide gravel roadway in order to provide the minimum roadway section that allows for safe and adequate emergency vehicle access to the site. 3. The property owner shall execute a no protest Local Improvement District waiver agreement (L.I.D.) in the event that a future L.I.D. is formed to make improvements on 1st Avenue SW. Southwest 372nd Street Southwest 372nd Street currently consists of an undeveloped public right-of-way. The planned roadway section per the current FWCP is cross section V which consists of 24-feet of pavement (two twelve-foot travel lanes), 8-foot-wide drainage ditches, 5-foot-wide sidewalks and 3-foot-wide utility strips within a minimum 56-foot wide right-of-way. The Public Works Department hereby requires the construction of half street improvements to the above standards along the entire length of subject property in accordance with the following conditions: 1. The street improvements shall include a minimum of 20 feet of asphalt pavement, and an 8- foot wide drainage ditch, 5-foot wide concrete sidewalk and 3-foot wide utility strip on the project side of the roadway. 2, The property owner shall execute a no protest Local Improvement District waiver agreement (L.I.D.) in the event that afuture L.I.D. is formed to make improvements on SW 372nd Street. All right-of-way improvements shall be constructed in accordance with the current King County Road Standards and applicable FWCC.
