PROJECT DESCRIPTION Development and construction of used car sales lot with capacity of 100 used vehicles plus parking for customers,employees, and service vehicles. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review.These issues can change due to modifications and revisions in the plans.These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Project could potentially trigger Land Use Process IV Hearing Examiner Decision regarding intrusion into a stream buffer. • Public Works Development Services Division There is a potential onsite closed depression on the west end. If so, a certain amount of hydrological recharge will be required.This will be determined with the preliminary TIR at the land use phase of the project. • Public Works Traffic Division 1. If a complete application is submitted after January 1, 2007, a Concurrency Application is required. The City Council has not yet adopted the fees for this permit.The Concurrency Permit process will determine if any additional analysis, improvements,or traffic mitigation fees apply to the project. 2. As this application proposes a specialized land use, the applicant's traffic engineer needs to submit a trip generation study to determine the number of trips generated by the proposed development during the weekday PM peak hour. At a minimum,the trip generation study shall include three (3) studies for similar land use and will be reviewed and approved by the Traffic Division. Based upon the number of PM peak hour trips, additional steps may be required. Please see detailed comments. 3. The City of Federal Way Code requires street frontage improvements and right-of-way dedication along 13th Place South.Please see detailed comments. Setbacks: 20 feet front, 0 feet side, 0 feet rear File#06-104962-00-PC Doc ID 38425 1 Mr. Monahan Page 3 November 17,2006 Parking Required: Under FWCC Section 22-1113(e),an outdoor use, activity or storage area will be used in calculating the gross floor area of a use or development if this area will be used for outdoor use, activity, or storage for at least two months out of every year. o Therefore: • Based on parking requirements set forth by FWCC Section 22-754 [I parking stall per 300 square feet], 183 parking stalls would need to be installed (customer/employee use). Figure based off of 162' x 338' area(54,756square feet). - o However: • The City is amenable to accepting a parking study for parking stall amount requirements. Landscaping: • Per FWCC Section 22-1566(0(1), five-foot-wide Type III Iandscaping shall be provided along Pacific Hwy South and along perimeter lot lines. • Per FWCC Section 22-1567,parking areas adjacent to public right-of-way shall incorporate berms at least three feet in height within perimeter landscape areas; or alternatively, add substantial shrub plantings to the required perimeter landscape type, and/or provide architectural features of appropriate height with trees, shrubs and groundcover, in a number sufficient to act as efficient substitute for the three-foot berm,to reduce the visual impact of parking areas and screen automobiles, and subject to approval by the Director of Community Development. • Parking lot landscaping requirements are exempt (FWCC Section 22-1 113(d)(4))in the car sales area so long as the requirements of FWCC Section 22-1567 are met. • Depending on the outcome of the parking study and the amount of parking required by the study: o 20 square feet per parking stall (when up to 49 parking stalls are provided)of Type IV parking lot landscaping is required in the customer/employee parking lot area. o 22 square feet per parking stall (when 50 or more parking stalls are provided) of Type IV parking lot landscaping is required in the customer/employee parking lot area. o Landscape islands shall be a minimum size of 64 square feet and a maximum of 305 square feet, and a minimum width of 6 feet. • Parking islands must cap all rows of parking. • Deciduous trees are preferred for landscape islands within interior vehicle use areas. • A minimum six-foot high solid screening fence or other appropriate screening approved by the Director of Community Development is required around the outside edges of the area devoted to the outdoor use, activity or storage (FWCC Section 22-1 1 13(c)(2)). For this site plan's purposes.the "back half"of the subject site (behind the sales building)will require this screening due to the nature of work being performed (auto repair/service/car storage). Community Design Guidelines: • No elevation drawings were provided with this submittal.All community design guidelines set forth in FWCC Article XIX "Community Design Guidelines" are applicable to this project. • Pedestrian pathways from right-of-way and bus stops to primary entrances, from parking lots to primary entrances, and pedestrian areas, shall be accessible and should be clearly delineated. File#06-104962-00-PC Doc ID tg425 Mr. Monahan Page 4 November 17,2006 • Pedestrian pathways and pedestrian areas should be delineated by separate paved routes using a variation in paved texture and color, and protected from abutting vehicle circulation areas with landscaping.Approved methods of delineation include: stone, brick or granite pavers; exposed aggregate; or stamped and colored concrete. • Pedestrian walkways, a minimum of six-foot-wide, shall be provided between the interior of the project and the public sidewalk. • Bicycle racks to be provided • Outdoor furniture, fixtures, and streetscape elements such as lighting, freestanding signs, trellis, arbors,raised planters,benches and other forms of seating,trash receptacles,bus stops, phone booths, fencing, etc., should be incorporated into the site design. • Building design guidelines set forth by FWCC Section 22-1635 must be implemented into building design. Environmental Factors: A 50-foot stream setback encroaches into the subject site. o Intruding into stream setback will require a Use Process IV Hearing Examiner land use decision. o Applicant must prove: 1. It will not adversely affect water quality; 2. It will not adversely affect the existing quality of wildlife habitat within the stream or setback area; 3. It will not adversely affect drainage or stormwater retention capabilities; 4. It will not lead to unstable earth conditions nor create erosion hazards; 5. It will not be materially detrimental to any other property in the area of the subject property nor to the City as a whole, including the loss of significant open space; and 6. - It is necessary for reasonable development of the subject property. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Sean R. Wells,P.E.,253-835-2731, sean.wells@cityoffederalway.com) Land Use Issues—Stormwater I. Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual(KCSWDM)and the City of Federal Way Addendum to the 1998 KCSWDM.This project meets the requirements for a Full Drainage Review. At the time of land use site plan submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has I"= 100', five-foot contour planimetric maps that may be used for basin analysis. 2. The project lies within a Level 1 flow control area,thus the applicant must design the flow control facility to meet this performance criteria.The project also lies within a Resource Stream Protection Water Quality Area. Water Quality Treatment shall be designed to meet the treatment criteria of the Resource Stream Protection Menu. Fle,(b-104962-00-PC Doc ID 38425 Mr. Monahan Page 5 November 17.2006 3. In lieu of providing onsite detention, the applicant may elect to convey stormwater to Kitts Corner regional facility. The pro-rata share contribution amount is$5,022 per acre,which is applied to the entire site irrespective of proposed impervious area.The downstream conveyance system must have capacity for the additional_stormwater. Any necessary upgrades to the downstream conveyance system will be the responsibility of the applicant. Water quality treatment must be provided onsite prior to discharge. 4. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. 5. Detention and water quality facilities for private commercial developments outside the City Center Core must be above ground (i.e. open pond.). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 6. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 7. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES)permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at http://www.ecy.wa.gov/programs/sea/pac/index.html, or by calling 360-407-6437. 8. If work is to be done below the ordinary high water mark, a Hydraulic Project Approval (HPA) permit may be required. Information regarding this permit can be obtained from the Washington Department of Fish and Wildlife, at http://www.wa.gov/wdfw/hab/hpapage/htm or by calling the office of Regulator Assistance at 360-407-7037. 9. There is a potential onsite closed depression on the west end. If so, a certain amount of hydrological recharge will be required. This will be determined with the preliminary TIR at the land use phase of the project. Right-of-Way Improvements I. See the Traffic Division comments from Sanjeev Tandle for traffic related items. 2. Based on available records and the submitted materials, it appears that this proposal meets the 25 percent threshold criteria for requiring street frontage improvements as identified in the Federal Way City Code(FWCC) Section 22-1473. The applicant/owner may submit an MAI appraisal for the subject property, or King County Assessor's records may be used. Development Services Division will evaluate this data to determine if the project actually meets the City's 25 percent threshold for requiring street frontage improvements. 3. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 4. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. File 806-104962-00-PC Doc ID 38425 Mr. Monahan Page 6 November 17.2006 Building (or EN)Permit Issues 1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees are S730.00 for the first 12 hours of review, and $61 per hour for additional review time.A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. The Federal Way Development Standards Manual(including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 3. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. 4. Bonding is required for all improvements associated with the project.The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 5. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats,remain the responsibility of the individual property owners. 6. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29"or"DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. 7. Drawings submitted for plan review shall be printed on 24"x 36" or 22" x 34"paper. All final approved drawings shall be drafted/plotted on 24"x 36"or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1"= 20', or larger. Architectural scales are not permitted on engineering plans. 8. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 1998 KCSWDM,must be shown on the engineering plans. 9. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. The following sections include steps for the applicant to submit a complete application before and after January 1, 2007. Complete application submittal before January 1, 2007 I. The applicant's traffic engineer needs to submit a trip generation study to determine the number of trips generated by the proposed development. At a minimum, the trip generation study shall include three(3) studies for similar land use to be reviewed and approved by the Traffic Division.The methodology for determining the trip generation shall be based upon the guidelines established in the most recent edition of the Institute of Transportation Engineers(ITE) Trip Generation. 2. If the trip generation is determined to be 10 or more PM peak hour trips and/or greater than 100 trips during any other peak hour,a complete Transportation Impact Analysis (TIA)is required.The report shall include a sight distance analysis as well as access and circulation for vehicle deliveries.The access and circulation analysis will need to include turning templates for the truck deliveries of vehicles on site.The TIA will also determine any prorata share traffic mitigation required. 3. If the trip generation is determined to be less than 10 PM peak hour trips and less than 100 trips during any other peak hour, a modified TIA is required to support the trip generation as well as a sight distance analysis and access and circulation for vehicle deliveries.The access and circulation analysis will need to include turning templates for the truck deliveries of vehicles. Complete application after January I, 2007 1. The applicant's traffic engineer needs to submit a trip generation study to determine the number of trips generated by the proposed development.The trip generation is required to be submitted with a Concurrency Application.The fee required on the Concurrency Application will be determined by the number of trips as determined by the trip generation study. At a minimum,the trip generation study shall include three(3) studies for similar land use to be reviewed and approved by the Traffic Division.The methodology for determining the trip generation shall be based upon the guidelines established in the most recent edition of the Institute of Transportation Engineers(ITE) Trip Generation. 2. Per FWCC Section 22-1474,the applicant/owner would be expected to construct street improvements consistent with the planned roadway cross-sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19. Based on the materials submitted that shows access to 13"'Place South, staff conducted a limited analysis to determine the required street improvements in meeting the FWCC. Based on the analysis and FWCC, the applicant would be expected to construct improvements on the following street to the City's planned roadway cross-sections: • 13"'Place South is planned as a Type "R"street, consisting of a 40-foot street with two 8-foot parking lanes, two 6-foot sidewalks. two 4-foot planter strips, and two 12-foot lanes in a 66- foot right-of-way(ROW). The applicant's engineer needs to verify that a 30-foot ROW has been dedicated. If that is the case and assuming a symmetrical cross section, three-foot additional ROW dedication and half street improvements are required and should be measured from the street centerline. 2. Per FWCC Section 22-1477, the applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements. Information about right-of-way modification requests is available through the assigned planner. Such requests have a set review fee. PUBLIC WORKS-SOLID WASTE AND RECYCLING DIVISION (Rob Van Orsow, 253-835-2770, robv@cityofederalway.com) Solid Waste& Recycling Design Considerations Solid waste and recycling design considerations include: • Adequate space allocation for interior and exterior collection containers.The following exterior trash enclosure parameters will accommodate most solid waste and recycling needs: Clear interior dimensions measuring 10' deep by 18' across. with a single two-door swinging gate spanning across the front of the enclosure.When the gate is opened,no structure or hardware is allowed above grade across the enclosure opening. Gate pins/holes are preferred in positions for closed gates and holding gates open for service access. • User access to interior waste and recycling storage areas/containers, and to exterior containers screened by enclosure(s). • Unobstructed, safe enclosure ingress and egress for service vehicles, directly in line with enclosure openings. • Landscaping, setbacks and screening requirements [based on FWCC Section 22-1564 (d)& (e)]. • Note that larger-scale commercial or multi-family developments may see long-term savings from the use of on-site solid waste compaction equipment. This equipment may require larger enclosures, defined overhead clearance, and consideration of power utility access and drainage management. Energy code compliance worksheets are required to be completed and included with your permit application. A wet stamp and signature is required on all sheets of plans and on the cover page of any calculations submitted. Federal Way reviews plans on a first in first out basis; however,there are some small projects with inconsequential review requirements that may be reviewed out of order. Review Timing The first comment letter can be expected within four to six weeks of submittal date. Re-check of plans will occur in one to three weeks after re-submittal. Revised or resubmitted plans shall be provided in the same format, size, and amount as the originally submitted plans. Revised/resubmitted drawings shall indicate by means of clouding or written response, what changes have been made from the original drawings. Plans for all involved departments will be forwarded from Community Development Services. Federal Way has an expedited review process. Information is available at our front counter. Other Permits & Inspections Separate permits may be required for electrical, mechanical,plumbing, fire suppression systems, and signs. Applicants may apply for separate permits at any time prior to commencement of construction. When required. special inspections shall be performed by WABO approved agencies or by agencies approved by the building official prior to permit issuance. Construction must be approved by all reviewing departments prior to final building division inspection. All concerned departments(Planning,Public Works, Electrical, Fire)must sign off before the Building Department can final the structure for occupancy. Building final must be approved prior to the issuance of a Certificate of Occupancy. The City of Federal Way does not issue temporary Certificate of Occupancies. All construction projects may be required to have a pre-construction conference. Plans for fire apparatus access roads shall be submitted to the fire department for review and approval prior to construction. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 30-ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 20-foot inside turning radius and not less than a 40-foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or Fire Department approved alternative at the dead end. The proposed site plan features one access directly off Pacific Highway South. The project also features a maintenance, wash and repair shop located in the rear. The project could include a secondary access . off a future extension of 13th Place South. The Federal Way School District owns the property involved in the extension of 13th Place South, however, we are interested in working with the District to construct a portion of our frontage for this project. There is a stream located on the adjacent property to the south. According to Land Services Northwest, our wetland biologist, the stream is listed on the King County web site as a Type III stream. Currently, a 50-foot-setback has been applied to our site plan in accordance with Federal Way City Code. We would like to discuss the history of the drainage in this area, options for tightlining the stream to the storm system at 13th Place South, and our options for reducing or averaging the stream setback. On our site plan we have noted the location of an existing King County drainage easement bisecting our property and a culvert which outlets to the stream. We are in the preliminary stages of site planning and feasibility and have not yet engaged the services of an architect. Therefore, we do not have preliminary elevations or floor plans at this time.
