Dear Sir;
1. I feel that I'm being blackmailed into paving the dead end street (South 304th
& Military Road South) that the property taxes should have maintained over the
years since the city became a city. South 304th Street use to go across what now is
1-5 interstate highway and the city was incorporated in February 28,1990 and has
not maintained the dead end street since with the property taxes collected off of
the lots that the dead end borders.
2. Now that I'm trying to put a house on one of the lots (2910 S. 304th) and get a
permit to do so, I'm being blackmailed by the city permit department (Mr. Jim
Fleming & Mr. Ken Miller) to pave the dead-end street before I'm issued a
building permit. The past taxes should have maintain that dead end portion of the
road and after I put a house on it the city will probably be collecting taxes above
and beyond what a empty lot would produce to pay for maintenance and road
upkeep of that dead-end road .
3. Attached are two letters, one to Mrs Mishael &Nikki Griffith and one to Ms.
Lois F, Cantrell where The City of Federal Way states that any preexisting
condition that was established prior to the incorporation of the city would not have

of monies to preform this additional requirement to get our building permit, and
besides the property taxes should have maintained this road even though it's a
dead-end.
5. Is there any relief under the Grandfather Clause,thats shown in the two
attached letters, that I could look to you on this matter of getting my building

I have reviewed the information you provided the city in a letter dated July 15, 1998 with various
attachments_. Of those attachments submitted, I particularly focused on the June 9, 1973,King
County approved Cantrell site plan, two pages of legal text and the October 18, 1995 Cantrell
request for the city to install a culvert at 2019 South 330th Street.
In conclusion, this information does not provide any evidence that the current driveway at Ms_ •
Cantrell's residence did not previously exist. My May 29, 1998 decision regarding the preexisting
condition and location of Ms_ Cantrell's driveway was based on personal testimony from three
sources including Ms. Cantrell, Mr. John Fournier and Ms. Grace_ Each testified that a driveway
at Ms_ Cantrell's residence had.previously existpsli h's current location for many/years. As a
result,the city cannot require any further improvements to this existing arivew�ay
Based on this personal testimony, and in consideration of the information you provided,my

It was recently brought to the caty's attention that your driveway may not be constructed to city
standards. After inspection it is confirmed that this is the case_
Federal Way City Code (FWCC)has two requirements specifically related to your current •
driveway condition_First,FWCC section 22-1135, requires that driveways serving single family_
homes be no wider than 20 feet and no closer than fivefeet to any side property line.While the
driveway width does not aoceed 20 feet, the portion of the driveway at the garage entrance is
located closer than fvt to the side property line.

Dear Mr. Ames:
The Public Works Department has received your letter dated July 24, 1998 in which you request
modifications to required right of way improvements along South 304th and Military Road. In
considering your request, Public Works' staff have evaluated the existing conditions along South
304th and Military Road, reviewed Federal Way City Code (FWCC) Sections 22-1473-1477, and
considered past direction provided by the City Council. FWCC Section 22-1477 "Modification of
Improvements Along Property Frontage" allows the Public Works Director to modify, defer, or
waive required street improvements only after consideration of four specific reasons. The following
responds to each request.
1) September 15, 1998 Letter - Modify Pavement Width, Sidewalks, Street Trees, and
Landscaping/Utility Strip.
The reason most applicable to your request is FWCC 22-1477(1) which states:
"improvements as required would not be harmonious with existing street improvements,
would not function properly or safely or would not be advantageous to the neighborhood or
city as a whole".
Staff Response and Decision: The proposed development provides "infill" of a existing,
single family lot, with 156 feet of frontage on South 304th and 129 feet of frontage on
Military Road. The City currently has a project under contract to improve the intersection
of South 304th and Military Road to accommodate left turn lanes and curb returns at this
intersection. South 304th dead ends into I-5 at your eastern property line and in considered
unimproved from the intersection of 304th and Military Road to I-5. Installation of all
required improvements, such as streetlights, street trees, curbs and sidewalks, at this time
would not create improvements that are harmonious with the existing street system, and
would not serve the neighborhood in an advantageous manner.
The City hereby grants a waiver of the required improvements, with the exception of a minimum 20- --
foot-wide asphalt road constructed from the end of the to be constructed curb return along your
entire frontage on South 304th. The property owner must sign a No Protest Local Improvement
District Agreement (LID) covenant in the event that a future LID is formed to make street
improvements. A copy of the LID agreement will be prepared for the owner's signature and must
be notarized and returned to the city with a $9.00 check for recording fee made payable to King
County Records and Elections, prior to the issuance of a building permit.

1) All trees delinated on site plan dated 8/31/98 shall be
maintained. if any the trees are damaged or destroyed they must
be replace per FWCC section 22-1568 (5) .
2) No building shall encroach onto any building setback line or
easement shown or not shown.
3) Maximum building height is 30 feet above the average building
elevation as per Federal Way City Ordinance #90-51.
4) Maximum driveway width is 20 feet.
5) The Driveway shall be paved per section 22-1453 of the Federal
Way City Code. The driveway shall be paved from the existing
roadway pavement edge, or curb, to the garage or carport.
6) Building setbacks are: 20 feet front; 5 feet side; 5 feet rear.
7) Per Federal Way City Code section 22-1133 (4) , eaves, chimneys or
awnings, and similiar elements of a structure that customarily
extend beyond the exterior walls of a structure may extend up to
18 inches "MAXIMUM" into the required yard setback. Additionally,
the total horizontal dimenisons of the elements that extend into a
required yard, excluding eaves, may not exceed 25% of the length
of the facade of the structure from which the elements extend.
8) This decision shall not waive compliance with future City of
Federal Way codes, policies, or standards relating to the subject
proposal.
9) Service connections for electrical and communication facilities
shall be placed underground per section 16-48 of the Federal Way
City Code.
10) Required downspout footing drains, and run-off from impervious
surfaces shall be tightlined to an approved storm drain system as
required per the approved drawings/plans. Call for inspection of
system prior to backfilling trenches. Final building inspection
will not be conducted until storm system is approved.
11) Prior to any clearing or grading on a lot, the owner/builder
shall install temporary erosion/sedimentation control facilities
approved by the City. These facilities must insure that dirt or
sediment laden water does not enter the public drainage system,
adjacent lots or public streets. The owner/builder bears the
responsibility to maintain the facilities in proper working order,
replacing as necessary. The facilities may be removed only after
such time as construction is complete and landscaping is
installed. See attached for standards and site plan for location
of silt fencing.
12) See street plan for frontage improvements, a minimum of 20-feet
by 80-feet paved section with a 32-foot by 40-foot turnaround on
304th street required.
