CONDITIONS:
1.Window signs are all signs located inside and affixed to a window and intended to be viewed from the exterior of a
structure. Window signs are used to advertise products,goods or services for sale on-site,business identification,hours
of operation,address,and emergency information. The area of window signs shall not exceed 25%of the window area.
2.No sign shall project above the roofline of the exposed building face to which it is attached.(FWCC,22-1601(B)(2))
3.A.separate electrical permit is required for any sign requiring electrical work. The electrical work must be approved
by one of the city electrical inspectors.
4.FINAL SIGN INSPECTION IS REQUIRED IN ORDER TO RECEIVE SIGN REGISTRATION NUMBER.

5.This sign permit approval is granted pursuant to Federal Way City Code Section 22-1597 through 22-1604 only,and
does not constitute a grant of approval to engage in a casino,mini-casino,or house-banked cardroom. Approval of
such uses must be obtained from the Washington State Gambling Commission,and the City of Federal Way reserves all
rights with respect to any review or decision of the Gambling Commission.

Thanks for the information. My understanding is that the State Gambling Commission will hold their
review of the Casino application until the Liquor License hearing is over, and an outcome of the hearing
is available.

Just as an FYI - Cafe Arizona has applied for a sign permit that says"Casino". We do not regulate text
on signage, so we have to approve the permit. Mary Kate just wanted me to let you know that they will
be advertising themselves as a casino, although our understanding is that they will be operating only as a
cardroom.

Hi Brian and Mary Kate:
The sign code does not contain any provisions by which the city may regulate the content of the sign.
So, I agree that we need to issue the sign permit. They may have other exposure, under the Consumer
Protection Act or otherwise, if they are engaging in false or misleading advertising.
However, we should include the following disclaimer on the permit, or in a signed letter or statement
signed by Mary Kate or Stephen and issued along with the permit:
"This sign permit approval is granted pursuant to FWCC 22-1597-22 1604 only, and does not constitute
a grant of approval to engage in a casino, mini-casino, or house-banked cardroom. Approval of such
uses must be obtained from the Washington State Gambling Commission, and the City of Federal Way
reserves all rights with respect to any review or decision of the Gambling Commission."
That should protect our rights to participate and object to any Gambling Commission approval. Let me
know if you need anything more.

Thanks for the cc on this Brian. I have been in touch with Bob Sterbank since Pat is out today.
We are delaying this morning until Bob verifies our position however, we are fairly certain that we cannot
legally withold issuance of the permit. The applicants have complied with all of the requirements of the
code. Under the law we are obliged to issue the permit or deal with potential litigation. In addition, we
would be treating this applicant differently than any other applicant in the city. Based on the issues in the
current action with this business, I do not think it would be wise to provide any opportunity to prove their
point regarding how they have been treated by the city. •
I will have staff notify you when the permit is issued.
