Pursuant to Federal Way City Code(FWCC) Section 22- 368,this decision may be appealed in the form of a letter delivered to the Department of Community Development Services(33530 First Way South,PO Box 9718, Federal Way, WA 98063-9718)by May 24, 2004, by any person who submitted comments or receives a copy of this decision.An appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusions of the Director of Community Development Services disputed by their person filing the appeal,and must include the appeal fee of$144.00. Any appeal of this Process II decision will be heard by the Federal Way Hearing Examiner. Please be advised that since you are the only party of record for this application,you may waive your right to appeal. The City must receive this waiver in writing. The applicant has submitted for Use Process II approval to enclose an existing 6,623 square foot outdoor garden center at the Wal-Mart located at 1900 South 314th Street. Enclosure of the garden area does not constitute gross floor area expansion in that the existing garden center area was calculated as part of the gross floor area for the original land use approval associated with the development of the Wal-Mart(File No: 97-100894). 2. Zoning for the subject site is City Center Frame(CC-F). This zoning district permits retail uses pursuant to Federal Way City Code(FWCC) Section 22-804. The project is subject to Process II, Site Plan Review, as it does not meet the land use process exemptions under FWCC Sections 22-32 and 22-32.2. 3. The project is exempt from State Environmental Policy Act review pursuant to Washington Administrative Code 197-11-800(1)(a)(iii). 4. On site parking consists of 577 stalls, including 478 on the primary site and 99 on an adjacent accessory lot across South 314th Street.The amount of parking is consistent with code requirements. Enclosure of the existing garden area does not constitute gross floor area expansion; as such,no additional parking is required in relation to the proposal. 5. Community Design Guidelines: Projects processed under site plan review are subject to the provisions of FWCC Chapter 22,Article XIX,"Community Design Guidelines."Pursuant to FWCC Section 22-1634(4),the addition of the garden center enclosure is architecturally consistent with the existing structure, providing overall design continuity by using similar elements throughout the project. The proposed garden area enclosure provides significant architectural features that reflect the design and materials of the existing store, such as support columns made of matching masonry block, similar roofline elements, EIFS medallion features,and accessory design elements such as color banding. Pursuant to FWCC Section 22-1635(b),all building façades that are both longer than 60 feet and visible from either a right-of-way or residential use or zone shall be subject to modulating and/or screening requirements.The south elevation, measuring 80'-0"feet in length is the only façade subject to the screening/modulation requirements of this code section.The west façade, measuring 136'-6"in length, is not visible from a public right-of-way or residential zone. The proposal provides an eight-foot foundation planting of Type II landscaping, consisting of European Hornbeams measuring a minimum of eight feet in height planted ten feet on center, to meet the modulation requirement pursuant to FWCC Section 22-1639(c)(3)for the south elevation. 6. Pursuant to FWCC Section 22-394(b),and the forgoing findings,the proposal is found to be consistent with the Federal Way Comprehensive Plan;all applicable provisions of the FWCC; and with the public health,safety,and welfare. 7. Final construction drawings will be reviewed for compliance with specific regulations and other applicable City requirements. A building permit is required for this project. These findings shall not waive compliance with future City of Federal Way codes, policies,and standards relating to this development. As a final note,please be aware that the proposed south and west elevations are subject to façade modulation/screening pursuant to Federal Way City Code(FWCC) Section 22-1635, in that these facades are both longer than 60 feet and are visible from a right-of-way. In the CC-C zoning district,building facades that are subject to FWCC Section 22-1635 must incorporate at least one articulation element: as such,the screening provided by the existing large trees is required in order for these façades to satisfy design guideline requirements. Given this requirement, be advised that if any of the large trees around the perimeter of the project area are temporarily dislocated during construction, it will be the applicant's responsibility to maintain the replanted trees in a manner so as to ensure their survival,and/or to replace as necessary any existing tree that cannot be replanted. The City will require that replacement trees be in kind,both as to species and caliper of existing trees.
