Certified Arborist,regarding the removal of two red alder trees;one being an 18 inch diameter tree at 4.5 feet above ground and the other a 15 inch diameter tree at 4.5 feet above ground. FINDINGS The subject trees are located within a critical area,within a few feet of Lake Lorene,a regulated lake under the Federal Way Revised Code(FWRC).The alder trees overhang the shoreline. The arborist recommends removal of both trees as they are in decline.Removal as discussed in the arborist report meets the partial exemption regulations in FWRC 19.145.120(7).A report by a certified arborist has been prepared and submitted to the city. The arborist proposes to use hand tools to remove both of the trees. The proposed tree removal is permitted in a regulated lake buffer under FWRC 19.145.370(1).The remaining trees on site satisfy the seven required tree units for the property;therefore,no replanting is required. DECISION Mr. Bryce Landrud has determined that both of the alder trees at the above address should be removed.Pursuant to FWRC 19.145.120(7),the tree removal outlined in the August 1,2016,arborist report is hereby approved. The first (eastern)has a diameter of 18 inches at 4.5 feet above ground. It has numerous dead and dying limbs, and is canted at a significant angle of about 15 degrees over the lake. It is in the middle stage of decline and can be expected to shed more and more material into the lake until it dies. The second one has a diameter of 15 inches, also at 4.5 feet above ground. This tree already has a severe decay column throughout the stem, and about 60%of the canopy has already died. This tree should be considered to be in a state of imminent risk of failure. Both of these trees must be considered to be in a state of decline and are both unsightly and present a risk to any recreational users of the lake. If either of them falls into the lake, it will likely be stuck there with no means to remove it. Though these trees are technically in a critical area buffer, there is essentially no buffer area. The lawn(as do most on the lake) extends right to the edge of the lake, where a 12" shoreline drops to the water. This shoreline likely changes by a few inches throughout the season, but not significantly. Any material from the removal of these trees, if left 'in the buffer' would essentially appear to be a pile of logs and brush at the view end of a manicured landscape. It is my opinion that the removal of these trees need include the hauling and removal of the debris from your yard. Respectfully submitted, Bryce Landrud I.S.A. The following activities are partial exemptions to the provisions of this chapter and require written approval from the director: (1)Essential public facilities, public utilities and other public improvements. The director may permit the placement of an essential public facility, public utility or other public improvements in a critical area if no practical alternative with less impact on 1 the critical area(s)exists. The specific location and extent of the intrusion into the critical area must constitute the minimum necessary encroachment to meet the requirements of the public facility or utility and not pose an unreasonable threat to the health, safety, or welfare on or off the subject property.The intrusion shall attempt to protect and mitigate impacts to the critical area function and values. The"public utility and other public improvements"shall not include improvements whose primary purpose is to benefit a private development, including without limitation interior roads or privately owned detention facilities installed within or during the construction of a residential subdivision, binding site plan, or other commercial development. The director may require supporting documentation to demonstrate compliance with partial exemptions. (2)Site reconnaissance necessary for preparing land use or building permit applications.Any disturbance of the critical area shall be the minimum necessary to conduct the site reconnaissance and the area shall be restored to its previous condition immediately. (3)Normal maintenance and continuation of existing landscaping and gardens that were legally established prior to city incorporation. This partial exemption shall be documented by photographs, statements, and/or other evidence provided by the applicant. (4) Demolition of structures.The applicant shall submit a temporary erosion and sedimentation control plan and apply for applicable demolition permit(s). (5)Restoration and enhancement that does not alter the location, dimensions, or size of the critical area or buffer and does not reduce the existing quality or functions of the critical area or buffer.The applicant shall submit a restoration and/or enhancement plan prepared by a qualified professional or as determined by the director. (6) Removal of invasive and noxious vegetation with mechanized equipment and/or with the use of herbicides.
