Dear Mr. Luber:
This letter is in response to your inquiry regarding a proposed addition to an existing single family home located at
the above address.
The subject property is located within the designated marine shoreline area—rural environment.The zoning that
applies to the subject property is RS 7.2.Your specific inquiry(March 8,2011,e-mail),is in regard to a proposal to
add height to an existing portion of a single family home to convert the existing attic space to a living space.The
portion of the structure where the proposed attic conversion is proposed currently extends into the required shoreline
stringline setback area.
According to Federal Way Revised Code(FWRC) 19.30.090,Nonconforming Development, for single-family
residences,existing nonconformities may remain and continue so long as the existing nonconformities are not being
increased or expanded in any way.The proposal to increase the roof height increases the volume of the portion of
the house that is currently nonconforming(within the required setback)and increases the nonconformity. Therefore,
the proposed addition to the roof area in question is not permissible.
In your letter,you inquired about the shoreline variance process.FWRC 15.05.110(enclosed)specifies the shoreline
variance process.The purpose of the variance process is to grant relief to specific bulk, dimensional, or performance
standards set forth in the shoreline master program that impose an unnecessary hardship on the applicant. A
shoreline variance request is reviewed under the provisions of Process IV,Hearing Examiner Decision,and is
subject to appropriate fees and review and approval by the Washington State Department of Ecology(DOE)and
associated fees.The shoreline variance request must also meet a series of conditions,including the preclusion or
significant interference with a reasonable use of the property.
You may be interested to know that the city has prepared an update to the Shoreline Master Prouram(SMP)that will
result in an update of the shoreline regulations(FWRC Title 15).The proposed revisions are currently being reviewed
by the Washington State DOE. The proposed update includes changes to the application of the stringline setback that
would eliminate the provision where the stringline setback can require structures be set back further than the standard
minimum shoreline setback for marine shoreline properties. If the DOE approves this change, then it will be
implemented by the city. So, at some point in the future, the current nonconforming situation may cease to exist.

15.05 Shoreline Management
15.05.110 Shoreline variance.
(1)The purpose of a shoreline variance is to grant relief to specific bulk, dimensional or
performance standards set forth in the shoreline master program, and where there is an
extraordinary or unique circumstance relating to the property such that the strict implementation
of the shoreline master program would impose unnecessary hardship on the applicant or thwart
the policies of the Shoreline Management Act.
(2)When a variance is requested, the substantial development permit and the variance shall be
reviewed under the provisions of process IV,Chapter 19.70 FWRC, and the hearing examiner
shall be the final approval authority.
(3)A variance from the standards of the master program may be granted only when the
applicant can demonstrate that all the following conditions will apply:
(a)That the strict requirements of the bulk, dimensional or performance standards set
forth in the master program precludes or significantly interferes with a reasonable use of the
property not otherwise prohibited by the master program;
(b)That the hardship described above is specifically related to the property, and is the
result of unique conditions such as irregular lot shape, size, or natural features, and the
application of the master program, and not for example, from deed restriction or the applicant's
own actions;
(c)That the design of the project will be compatible with other permitted activities in the
area and will not cause adverse effects to adjacent properties or the shoreline environment;
(d)That the variance authorized does not constitute a grant of special privilege not
enjoyed by other properties, and will be the minimum necessary to afford relief;
(e)That the public interest will suffer no substantial detrimental effect;
(f)That the public rights of navigation and use of the shorelines will not be adversely
affected by the granting of the variance when the proposal is for development located waterward
of the ordinary high water mark, or within marshes,bogs or swamps; and
(g)That consideration has been given to the cumulative effect of like actions in an area
where similar circumstances exist, and whether this cumulative effect would be consistent with
shoreline policies or would have substantial adverse effects on the shoreline.
(4) Shoreline variances may not be used to permit a use that is specifically prohibited in an
environment, or to vary uses permitted within an environmental designation.

Hello Isaac,
I spoke to Becky in your department last week, and she suggested I email you (I understand that you may be on vacation
when I send this), and cc Deb.
This is in regards to the property located at: 2820 SW 300TH PL in Federal Way(Tax Lot No. 416660-0140). It's a single
family residence located on the shoreline. We're working on behalf of the owners, Pat Montgomery and Judy
Featherstone.
Please see the attached PDF that contains a site sketch, an existing photograph, and an image of the house with the new
proposed roof line.
The project proposal is mostly interior remodeling, new windows and doors (in some cases, in new locations), as well as
to raise a portion of the roof to convert attic space to livable space (approx. 200 SF).We are NOT expanding the
"footprint" of the building.
A portion of the house on the North (water-side) appears to be within the"string" setback based on the adjacent house
corners to the east and west. The proposed area of roof we'd like to raise is within the"string"setback. We weren't sure
how to interpret the code as it applies to raising a portion of an existing roof, but not expanding the footprint.
We're looking for a formal confirmation that our proposal conforms with the shoreline setback codes, and that we can
proceed with a building permit application and this won't be an issue in getting it approved. If that's not possible, we
understand we can apply for a variance. However, we'd like to get some sense of whether a variance application for a
condition such as this is likely to be approved or whether it's a long shot(or just about no shot), and how long that
variance process generally takes.
